Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcel (s): 080314400013 The project proposes to: Change of Zone (COZ) from the A (Agricultural) Zone District to the C-3 (Business Commercial) Zone District. ACCESS Development Review has reviewed the application materials related to access. No proposed access is shown on the applicant's draft COZ plat although the application questionnaire indicates that applicant is proposing to have one (1) access on County Road 47 south of Lone Tree Creek and one (1) access on County Road 47 north of Lone Tree Creek. Per Section 8-14-30.A., of the Weld County Code, a parcel shall be limited to one (1) safe access point for ingress and egress, except if allowed pursuant to Subsection E, of the foregoing section. Subsection E states that an additional access may be allowed if the applicant demonstrates the need for more than one access, the proposed access complies with the spacing criteria for that road classification, and no other safety concerns exist. Minimum access spacing for a local road is shown below in Table 8-2, of the Weld County Engineering and Construction Criteria manual. The number and location of accesses for the subject parcel will be determined during the subsequent Site Plan Review process. ROAD AND RIGHT-OF-WAY County Road 47 is designated on the Weld County Functional Classification Map (Code Ordinance 2017- 01) as a local road which requires 60 feet of right-of-way. County Road 47 is a paved road for 535 feet north of SH 392 and is a gravel road going north beyond that point. Pursuant to the definition of setback in the Weld County Code, Section 23-1-90, the required setback is measured from the right-of-way line. Be aware that the physical road may not be centered in the right-of-way. This road is maintained by Weld County. The Colorado Department of Transportation (CDOT) has jurisdiction over access to State Highway 392. Please contact Rose Valdes, CDOT Access Manager, at 970-939-2440, to verify the need for an access permit or any other requirements CDOT may have. DRAINAGE REQUIREMENTS No Drainage Narrative is required. TRAFFIC REQUIREMENTS No Traffic Narrative is required. CONDITIONS OF APPROVAL The plat shall be amended as follows: 1. Delineate and label the existing County Road 47 right-of-way and the physical location of the road. Reference the document used to create the right-of-way in the label. (Development Review) 2. Show and label any approved Colorado Department of Transportation (CDOT) access(es) on SH 392 and include in the label the CDOT access permit number(s) if applicable. (Development Review) 3. Show and label (including the reception number) any existing access and/or utility easement within the limits of the subject parcel. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. The historical flow patterns and runoff amounts will be maintained on the lots created with this lot line adjustment. PARCEL: 080314400013 DELINEATE ON THE PLAT: 1. Show the floodplain and floodway (if applicable) boundaries on the map. Label the floodplain boundaries with the FEMA Flood Zone and FEMA Map Panel Number or appropriate study. PLAT NOTES: 1. A Flood Hazard Development Permit is required for all construction or development occurring in the floodplain or floodway as delineated on Federal Emergency Management Agency (FEMA) FIRM Community Panel Map # 08123C -1535E dated January 20, 2016 and 1575F dated November 30, 2023 (Lone Tree Creek Floodplain). Any development shall comply with all applicable Weld County requirements, Colorado Water Conservation Board requirements as described in Rules and Regulations for Regulatory Floodplains in Colorado, and FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. The FEMA definition of development is any man-made change to improved or unimproved real estate, including by not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials. 2. FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any development activities, the owner should contact Weld County to determine if the floodplain boundaries have been modified.
