,j'il2 /sr' RESOLUTION WHEREAS, the Weld County Fish & Wildlife Association, c/o Eldon Keyser, 1402 24th Avenue, Greeley, Colorado 80631, has requested permission to locate a trap and skeet shooting range, including a game preserve on the following described property, to-wit: A parcel of land more specifically described as being that part of the Northeast Quarter (NE ') lying north and west of the Owl Creek Ditch in Section Nineteen (19), Township Seven (7) North, Range Sixty-four (64) West of the 6th P. M. , Weld County, Colo- rado, and WHEREAS, the petitioner was present and represented by Eldon Keyser and Wayne White, Chairman of the Board of the Weld County Wildlife Association, and WHEREAS, there was opposition to the request of petitioner to locate said trap and skeet shooting range and game preserve on the above described premises, and WHEREAS, the said requested trap and skeet shooting range, in- cluding a game preserve, is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, the said trap and skeet shooting range, including a game preserve, may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of the Weld County Fish & Wild- life Association, c/o Eldon Keyser, 1402 24th Avenue, Greeley, Colo- rado 80631, to locate a trap and skeet shooting range, including a game preserve, on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect said trap and skeet shooting range, including a game preserve, and shall have up to one (1) year from date hereof to begin construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That when said trap and skeet shooting range is completed, same shall be limited in size as shown on revised plans as submitted. PL0759 730568 4. Subject to rifle ranges being set back at least six hundred (600) feet from the Owl Creek Easement. 6. Subject to submission of plans for keeping area free of litter. 7. Subject to submitting plans relative to off-street parking and shooting facilities. 10. SUBJECT : Personnel DISCUSSION : Mr . Adams stated that six months ago additional help had been requested to help with the field inspections and building inspections . Need someone almost full time to stay in the office and plan check and answer questions concerning construction of buildings . Mr . Adams submitted a list of the salaries presently being paid to employees of the Weld Co . Planning staff . He requested a reason for his salary not being raised at the end of the an- niversary date as he had been informed he would . Mr. Watson made a motion that if the present budget could afford $70. 00 more a month immediately , then ok . Retroactive to June 1 . Mr. Nix felt that Mr . Lorenson should be given the responsibility of carrying through with the employees of the County that are under his direction . Secondly , the only assurance to give Mr. Adams , the Board will follow through with his request and if _ at all possible to make the adjustment (retroactive to June 1 ) under the direction of Mr . Lorenson . Mr. Ohi stated that the salary survey would show that our highs were quite a bit under those of other counties . It was the general feeling that Mr . Adams should not have had to appear on his own behalf . Said field trip was made at 11 a .m. June 19 , 1973 . One additional petition submitted by applicant . Mr. Connell stated that the basic thing to look at in any ap- plication was the immediate welfare and safety of the area . Mr. Nix stated that the applicant should provide ample security. Mr. Watson stated that the Board was told verbally that the shooting range would be over 600 ' over the ridge . They will also do all the dirt work and build as many bluffs as necessary. Mr . Anderson read the reasons listed on the petitions : 1 ) Bring too much traffic into the area ; 2) Gun ranges would imperil the people and livestock in the area ; 3) The gun fire would make too much noise ; and 4) It would bring too many hunters into the area . The question of dropping the game preserve was brought up as possibly helping alleviate some of the objections of the neighbors . Mr. Anderson read staff comments ( see minutes June 4) . t ( • The answer to petition against SUP ( Item #5 on staff recommenda- tions ) was suggested to be stricken since the approval to the satisfaction of" cannot be done as there is no criteria for it. Mr. Elliott stated that after making the field trip , there were only four or five houses actually in the area . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Planning staff ' s recommendations deleting Number 5 and also having some sort of liability in- surance coverage . DISCUSSION : When Mr. Rosales came in for his building permit for the barn , he should have been told at that time he would have to have a Special Use Permit before he could continue with his plans . Rosales does not comply with a farm existing feeding operation because he only has 40 acres of land and he can ' t raise enough roughage on 40 acres of land to feed 100 head of dairy cows , therefore he does need a Special Use Permit . If a person raises more than 50% of the roughage fed his cattle on what land he owns , then he does not have to obtain a Special Use Permit . This removes liquid impurities from liquid gas , and then pumps the gas on to be used in the Denver area . This is a 40 acre site located in the sandhills , with no visible residences around . West Hill -N-Park is an addition to the existing Hill -N-Park Mobile Home Park . There is a proposed 100 ' right of way on 47th Avenue . Do have lagoons on the site . Have been notified they will have to be brought up to standards . There is an agreement between Evans and Arrowhead for 450 taps to service some ground in which Hill -N-Park -is lo- cated . The contract reads that Arrowhead can supply any of the 450 taps to Arrowhead Subdivision or to the SZ Section 26 in which Hill -N-Park is located . There is a letter from Mr . Karowsky stating that there are 190 taps left and West Hill -N- Park can utilize these taps . Will buy the water from Evans or Central Weld as it becomes available . For now the commitment from Central Weld to service West Hill -N-Park is adequate per Mr . Ohi . If the plat is approved they can go ahead and enter into a contract . Mr. Benson stated that they were in the pro- cess of updating the system (sewage ) . Connell stated that there is the right of condemnation so there was no need to change the right of way now . It is presently a hazardous corner. Carol ; Harold Herbst ; Mrs . Hines DISCUSSION : Attempting to buy this piece of land in order to replace present range which was sold . There is already a North Weld Water soft water tap present . Has 1200 gallon septic tank. Hunters will be able to sight-in big game guns . There is ade- quate backstop for protection . Three people live across the Owl Creek Ditch . Trap shoots held once a month . Will put up a temporary clubhouse immediately if this request is approved . Has visited with several people in the area and they seemed to be in favor of this . Mr . Anderson stated that there were copies of four (4 ) petitions in the file with approximately 66 names on them against this request. There are only four or five actual property owners within 500 feet of this property . Mr. Keyser submitted a copy of a petition with 15 people who are in favor of this and stated that he could obtain quite a few more if necessary . This will be a posted "No Hunting" area . Total acreage is 123 acres . Mr . Brown stated that they I { trained about 1 ,000 hunter safety students . This would be very beneficial for this type of in-the-field training . Mr. Winn stated that in 20 years at the first range , there was never any trouble with neighbors . Felt that the range cut down on vandelism . The Conservation Office will help plant more trees . Mr. Simpson felt there is a definite need for this . Hunters will sight-in their rifles either here or somewhere out in the country , which may not be a legal area . This would be a safer area then for them to just sight them any where . • IMr. Siglinger has house closest to this proposed request. Doesn ' t feel that this is a safe area . Submitted petition of persons within rifle range surrounding this property . Live- stock has been killed . Noise pollution problem. Felt that it was a needed use , but this particular area is too close to houses . I Mr . Nap stated that he has hunted big game for many years . How- ever , knows of an isolated area where pheasant hunting used to be good ; until it became well known and now it ' s flooded with hunters and is not a safe place to go any longer . Afraid this is what will happen here . Mrs . Carol milks 650 cows and felt that all the shooting could cause problems . Did not feel that Galeton was that anxious to have this permit go into effect. 903 / Mr . Herbst\-rzlt it would be a danger toJlivestock . Carrie Brown , helping Weld Co . Wildlife , wanted to know exactly how many homes were actually in the area . Mr . Siglinger stated there were about 12 or 13 within a mile radius . Mrs . Hines also felt it was an unsafe area . Mr. Keyser stated that they have been looking for an area for this range for over a year . Planning staff recommends approval because it agrees with land use policy , agrees with surrounding ' land use and zoning and Health Dept . recommends approval . Motion carried. • SUBJECT: Mobile Homes DISCUSSION : At present, mobile homes that do not meet Uniform Building Code are allowed only in mobile home courts ; or in PA" zoning for farm help ; in "Business" , " Industrial " or "Commercial " zoning for protection of property. There are several that once the owner has the mobile home on his property , they then put it on Ad Valorem tax and feel that they are being doubly taxed when they have to keep renewing the permit. Mr . Connell stated that when the owner puts this mobile home on a permanent founda- tion and adds it to the Ad Valorem , it ceases to be of a tem- porary nature . Mr . Connell will get an opinion from the Attorney General ' s Office . Will report findings to the Board at its second meeting in July ( the 17th) . SUBJECT : Production of Crude Oil Tape #489 DISCUSSION : Two miles east of Ione is an oil drilling outfit . It has been stated that there could be anywhere from 100 to several hundred of these sites put into the County . Up to this point, we have issued building permits as temporary sites . However , they are actually indefinite . Each crude oil well has its own collection tank . It would necessitate the approval of the County Commissioners for each site . The Planning Commission should communicate to the County Commissioners that these are temporary structures and would require individual SUP ' s as the "Agricultural " zoning states . They would be required to obtain building permits . County Attorney suggested that a brief reso- lution be sent to the County Commissioners requesting this be handled differently . Possibly by permit only and would not be required to come before the Planning Commission each time . This does not release the oil company of any responsibility to the property owner . Organised about 40 years ago by a small group of sportsmen, this club has dedicated itself to the conservation of fish and wildlife, good sportsman- ship, recreation, and most recently to the teaching of gun safety and the right to bear arms for recreation and legal hunting. All dues, raffle and bingo income and any other income from donations or special programs sponsored by the club is used to make payments on the land, to improve and maintain our range and recreation area. This area, composed of about 123 acres df--- land, is located 7 miles east of Eaton and 3 miles north of Galeton, Colorado. When fully completed we plan to have 2 operating traps for trap shooters operating on the second and fourth Sundays of each month. We also have a picnic and play area, archery range, and when completed, hope- fully by the end of this summer, a 200 yard, rifle range, two 100 yard ranges , a - 75 yard, a 50 yard, and 25 yard range. Membership dues this year are 513 00 including a key to get into the facili- ties and anyone who is a U. S. Citizen without a criminal record, of sound mind and agrees to obey our rules may join the club. Dues are payable from October to October of each year. To join our club send 513.00 to P O. Box 300 along with your full name, complete address, phone number and your occupation. A key and mem- bership pocket card will be sent to you by return mail . Arm patches for your jacket with the club emblem on them are available for 51 25 each. Every club must have some rules to abide by, and our basic rules are as follows: Actions open, guns unloaded until on the firing line Obey the range officers. Do not break glass on the ranges. Do not set cans on the target frames. When shooting or picnicing is finished , clean up, help keep the range and picnic areas clean and in good repair All vehicles must stay on the roads. Positively no rifle or pistol shooting east of the old R.R embankment and shooting only during the daylight hours. Anyone under 18 must be accorTanied by an adult member. No shooting of wildlife on our range and keep the gate locked at all times. Anyone breaking any of these rules, doing vandalism to our property, or any misconduct that might endanger another person or jeopardize our club, can and will be dismissed from the club and after a proper hearing with the board of directors, if felt necessary, will be prosecuted by the law and made liable for all costs involved with such legal actions and all damages to club property. Our range is checked and watched most of the time for intruders and those persons who do not obey the rules. All shoots are under the supervision of at least one club director. Regular membership meetings are held the second Thursday of each month at the Greeley Community Building and are open to all , starting at 7 .30 p.m. At these meetings we have a short business meeting and then a program, raffle, and refreshments. Pro- grams consist of films and special speakers suitable for children and adults alike. There are no meetings during June, July and August. Directors and officers of the club meet the last Thursday of each month. The purpose of these meetings arc to plan all of our activities and maintain the business of the club. Though this cleared up a number of items which I had questions on, I have sent an additional letter (dated August 23, 1974) requesting further clarification. I talked to Mr. Keyser regarding the complaints which are outlined in my letter of July 31 . He indicated that the range should not have been in use during the hours specified; and that he would investigate the incident in hopes of preventing similar occurances in the future. In reference to the game preserve, Mr. Keyser indicated that development of facilities for such a preserve was not their intent. Rather, they were concerned with maintaining existing wildlife in the area in the existing natural setting. Finally, Mr. Keyser indicated that the range was used on a "members and guest basis, and was not open to the general public. Signs are being prepared regarding this qualification and are to be posted on the site. He did indicate that other clubs would be using the facilities when joint matches were scheduled. I certainly do object to ;field County Fish and Aildlife Association establishing a Trap Shooting and Game Preserve near my farm. T am leaving this weak on a business trip to Arkansas , but upon my return to Denver plan to drive to Greeley to voice my objection to person. For years I have kept a "No Shooting--No Trespassing" sign on my property trying to keep hunters and target shooters off the property to make it safe and usable as a cheat and grain growing farm. The safety of the people working on the land is important. Otherwise , I will be unaole to obtain a lessee for the property. A trap shooting area near would bring hunters and target shooters who would use the whole area--not just the designated Game Preserve. No one would want to work or live on property that close to a Trap Shooting and Game Preserve. I and members of my family have held this property for many years looking toward possible personal use of the property some day. _I plan to attend the August 13, 1973 meeting and voice my objections to the plan. APRIL 6, 1976 On August 29, 1973 the Board of County Commissioners approved by resolution a special use permit requested by the Weld County Fish & Wildlife Association to locate a trap and skeet shooting range, including a game preserve on the following described property: A parcel of land more specifically described as being part of the Northeast Quarter (NEa) lying north and west of the Owl Creek Ditch in Section Nineteen (19), Township Seven (7) , Range Sixty-four (64) West of the 6th P.M. , Weld County, Colorado. The Special Use permit was granted subject to the following conditions: 1 . That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect said trap and skeet shooting range, including a game preserve, and shall have up to one (1 ) year from date hereof to begin construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That when said trap and skeet shooting range is completed, same shall be limited in size as shown on revised plans as submitted. 4. Subject to meeting all requirements of the American Trap Association and the National Skeet Shooting Association. 5. Subject to rifle ranges being set back at least six hundred (600) feet from the Owl Creek Easement. 6. Subject to submission of plans for keeping area free of litter. 7. Subject to submitting plans pertaining to hours of operation and lighting arrangements, including method of supervision. 8. Subject to submitting plans for development of game preserve. 9. Subject to submitting plans relative to off-street parking and shooting facilities. 10. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. C.) O Following recent complaints by local residents and at the request of the Zoning Administrator the materials, plans, correspondence, etc. in the Weld County Fish & Wildlife Association's file were reviewed and field checks were made of the property checking to see if the above conditions had been complied with. The field inspection revealed that the Weld County Fish & Wildlife Association is basically following the development indicated on plans submitted to the Weld County Planning Commission. Located on the property are trap shooting area, picnic and play area, archery range, hunter safety training area, and an area for shooting ranges. There are at present, six areas set aside for shooting ranges located in the Southwest part of the property. Two of these areas do not have earth embankments on the north side and do not appear to be used as shooting ranges. Four are being used as shooting ranges. They vary in length from approximately 25 yards to 200 yards, each is surrounded on three sides by an earth embankment with heights of 7 to 12 feet. Direction of fire is from the south to the north. The Weld County Fish and Wildlife Association's plans indicate they would have five shooting ranges. The longest being 550 yards in length. This parti- cular range has not been constructed to date. A second field check indicated that all the ranges are under construction from time to time with the intention of improving the ranges. The Weld County Fish and Wildlife Association, Inc. have indicated in printed materials that "when completed, hopefully by the end of this summer (1976), a 200 yard rifle range, two 100 yard ranges, a 75 yard, a 50 yard, and a 25 yard range? will exist on the property. Determination is needed to see if the sixth range being constructed is an expansion or enlargement of the special use. If so, the Weld County Fish and Wildlife Association, Inc. would need to make a new application under the special use provisions of the County Zoning Resolution. There appears to be a question of compliance on the part of the Weld County Fish and Wildlife Association, Inc. in several areas, with conditions set forth in the County Commissioner's resolution, the first being, in a letter dated July 30, 1973, addressed to the Weld County Commissioners from Gary L. Gain, then President of Weld County Fish and Wildlife Association, he states, "the hours of operation will be only day- light hours.. .We plan no lighting for the range at this time." Since that time both written and verbal complaints have been received from people living in the area that shots have been heard coming from the range after dark. Secondly, no permits have been obtained from the Weld County Health Department for the two privies being used. 2 U O Thirdly, no building permits were obtained from the Weld County Building Inspection Department for the two pitted trap houses located on the property. Finally, the Weld County Planning Commission office has not received any plans pertaining to the development of the game preserve. It is the recommendation of the Weld County Planning Commission staff that the Weld County Fish and Wildlife Assocation, Inc. officers be invited to attend a regular scheduled Planning Commission meeting to answer any questions which members of the Planning Commission may have concerning matters discussed in this report and that the Weld County Fish and Wildlife Association, Inc. relate future plans or intents regarding the further development of the Weld County Fish and Wildlife Assocation's,Inc. property. Fish and Wildlife plans to do to comply with the recommendations set forth by the Planning Commission Staff. First, We have never had a problem with litter on the old range. Litter barrles will be available at all areas of the land. The people responsible for running the shoots also must check the ranges used to make sure all litter is picked up. Second, the hours of operation will be only daylight hours. Trap shoots will be on the first and third Sundays from 10:00 AM thru 4:30 PM. Our Trap Season runs from September to June. The rifle ranges are not used extensively until three weeks before the opening -of deer and elk seasons. We plan no lighting for the range at this time. We have plans to use a section of the range for hunter safety training. This will be done with small groups and under strict supervision of State certified Hunter Safety Instructors and/or Wild life Conservation Officers. Third, we feel that any person on the Board of Directors of the Association is qualified and authorized to supervise any of the shooting matches held on the range. Wayne ?^hite, past president, now chairman of the board of directors . He is an ex-marine and was an instructor's assistant on semi-automatic rifles uhile in training for the marines. Paul Dunlop, U. S. N. retired. He is past president and nou a dircctor of the club. He has helped and been an instructor on gun safety for new licenses and is an expert with the rifle and the pistol. Courtney Gra..-ford, an honorary director and advisor. He is presently em- ployed with the Colorado State Game and Fish Dept. He checks the range as often as possible for trespassers and he also teaches gun safety classes. Charlie Brown, an honorary director and is one of the main advisors and planners of the range for the complete layout and safety features of it. He is em- ployed with the State Game and Fish Department. He uas just recently trans- ferred to Craig, Colo. Lt. Col. Clifford A. Balcer, is with the Air National Guard stationed at the Greeley Airport. He was also one of the main planners for the ranges and the safety features Pc are building not. He is a board member and very active in the Club. He Hill be instructing the safety and handling of semi- automatic weapons and trill use the range two to four times each year for sight-ins. Albert Wynne, gun collector. He is a director and advisor] also a long time member of the club. He is a sportman and gun expert. He attends nearly all of the shoots and gives expert advise on safety. Ilonte Davenport, Trap Shoot Chairman. He has guided the club many years in the art of trap shooting with a perfect record of no accidents. He is also a director on the board. Sue Faulk is our most active lady member. She has served many years in one area or another with the club. She is an expert in gun handling and has been teaching as a licensed instructor in gun safety for several years. Don Sherman, licensed instructor on gun safety. He is a member of the local Jaycees and has been working with us in the planning of our rifle ranges. Jim Graham, black powder expert has a perfect safety record and oversees most o£ the black pouder shoots at the range. He is also a director of the club. Les Lieser, president of the club. He is an all around sportsman and very safety conscious. He has taught the classes for new licenses. He is also a member of the R. R. A. Eldon Keyser, treasurer o£ the club. We can't see how the ideas of gun ranges and wildlife preserve are compatible. If the number of people didn't drive away the birds, pheasants and deer, already in the area, the noise oz the firearms certainly would. r We were told that the recreation zoning would be an asset to our community.We don't agree;and our friends and nei- ghbors don't agree. The gun club would overpopulate the area with pheasants. This would draw more hunters into our area. The only "recreation" the community residents would derive from the project would be running off the hunters in an effort to save our land, animals and lives.
