HomeMy WebLinkAbout20250941.tiffRecord of Proceedings Minutes Board of County Commissioners Weld County, Colorado Monday, April 7, 2025 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, April 7, 2025, at the hour of 9:00 a.m. e Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Chief Financial Officer, Cheryl Pattelli Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner Peppler seconded the motion and it carried unanimously. 1. Minutes from March 24, 2025 e Amendments to Agenda: There were no amendments to the Agenda. e Consent Agenda: Commissioner Ross moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. Presentations and Proclamations: 1. IE Recognition of Services, Department of Human Services — Sandra Hasch: Chair Buck read the certificate for the record. Jamie Ulrich, Director of the Department of Human Services, thanked the Board for the recognition and the opportunity to honor Sandra Hasch who has served in the Area Agency on Aging (AAA) division, which is now known as the Home and Community Support division, for the past 33 years. Tami Grant, Deputy Director of the UIZ2 2025-0941 BC0016 Page 2 Monday, April 7, 2025 www.weld.gov Department of Human Services, expressed it has been her pleasure to know Ms. Hasch professionally and personally, stated she is a Case Management expert, and highlighted her institutional knowledge with her 'steel trap' recollection of information. Ms. Grant shared Ms. Hasch has been a huge influence and support in the division throughout her career and will be sorely missed. Sandra Hasch shared her passion for serving the aging community, expressed her love for the team she has worked with, and indicated she has been fulfilled and grateful for the opportunity to serve Weld County. The Board expressed their appreciation for her dedication, passion and commitment in serving the citizens of Weld County, and wished her the best for her future retirement endeavors. (Clerk's Note: The group gathered for a photo opportunity.) 2. National Public Health Week — April 7-13, 2025: Commissioner James read the certificate for the record. Jason Chessher, Director of the Department of Public Health and Environment, thanked the Board for their support in the recognition of National Public Health Week. He highlighted a small fraction of the services provided to the citizens of Weld County, and humbly extended his heartfelt appreciation to staff for their passion to encourage the communities to be their healthiest. Each Commissioner, in turn, expressed their gratitude for the profound, daily efforts staff executes "under -the -radar" to promote public awareness and education. (Clerk's Note: The group gathered for a photo opportunity.) Warrants: 1. IR General Warrants: Commissioner Maxey moved to approve the General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. 2. El Commissioner Warrants — Lynette Peppier: Commissioner Ross moved to approve the Warrants, as printed. Commissioner James seconded the motion, and upon a roll call vote of four (4) to zero (0), the motion carried with Commissioner Peppler abstaining. New Business — General: 1. El Consider Contract ID #9255 Final Application for Nonattainment Area Air Pollution Enterprise (NAAPME) Community Clean Transportation Assistance Program (CCTAP) Grant Funding for County Road 59 and State Highway 52 Roundabout Project, and authorize Chair to sign and Department of Public Works to Submit Electronically: Evan Pinkham, Department of Public Works, explained Weld County, among various other agencies, request to submit the final application for a new funding opportunity for the Nonattainment Area Air Pollution Enterprise (NAAPME) Community Clean Transportation Assistance Program (CCTAP). He stated the Department of Public Works is pursuing grant funds for the County Road (CR) 59 and State Highway (SH) 52 Roundabout Project, in the 2025-0941 BC0016 Page 3 Monday, April 7, 2025 www.weld.gov amount of $1,794,634.00, in collaboration with the Colorado Department of Transportation (CDOT) to assist with construction costs. Mr. Pinkham stated, if the grant is awarded, along with additional grant funding provided through the Colorado Mitigation Air Quality (CMAQ) and the Upper Front Range Transportation Planning Region (UFRTPR), the roundabout project will be fully funded. Commissioner James moved to approve said application, and authorize the Chair to sign, and the Department of Public Works to submit electronically. The motion was seconded by Commissioner Ross and it carried unanimously. 2. a Consider Contract ID #9281 Memorandum of Agreement for Temporary Construction Easement for County Road 76 Improvement Project Between County Roads 29 and 31, and Authorize Chair to Sign — Allen and Janie Lasnier: Mike Bedell, Department of Public Works, stated the agreement is for a temporary construction easement (TCE) for drainage improvements and paving County Road (CR) 76, between CRs 29 and 31, for the amount of $500.00. Commissioner Maxey confirmed the streamlining efforts of providing staff memos, rather than pass arounds, and he further moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Ross and it carried unanimously. 3. a Consider Temporary Closure of County Road 90 Between County Roads 19 and 29: Amy Mutchie, Department of Public Works, stated the closure began on March 31, 2025, and will go through April 18, 2025, for emergency roadway repairs due to heavy truck hauling. She stated water will be used for dust control on the gravel portion of the detour route and local access will be maintained. Commissioner Ross moved to approve said temporary closure. The motion was seconded by Commissioner Peppier and it carried unanimously. 4. IE Consider Expression of Opposition to Colorado Senate Bill 2025-3: Steve Reams, Weld County Sheriff, stated the Colorado State Legislature recently passed Senate Bill (SB) 2025-3, that is one of the most restrictive gun laws in recent history. He expressed his concern with this being an unfunded mandate, which will do nothing to improve public safety, and creates additional barriers for law abiding citizens as further infringement of the 2nd Amendment. In response to Commissioner James, Sherriff Reams expressed his opinion that this is one (1) step away from a complete ban of firearms in the state and confirmed additional laws will not hinder criminals who are intent on committing crimes. Commissioner Maxey expressed his gratitude for the work of law enforcement personnel and extended appreciation for their advocating on behalf of Weld County citizens. He further commended Captain Matt Turner, Weld County Sheriff's Office, for his willingness to answer questions and offer his insight on concerns regarding laws and regulations of firearms. Commissioner Ross moved to approve said Resolution. The motion was seconded by Commissioner Maxey and it carried unanimously. 2025-0941 BC0016 Page 4 Monday, April 7, 2025 www.weld.gov New Business — Planning: 1. ElConsider Certification to Weld County Treasurer of County Compliance Violation Penalties as Special Assessment — Donald Harris and Christina Elam (Continued from 10/7/2024): Adria Schiel, Assistant County Attorney, stated this and the next two cases for consideration were continued from October 7, 2024. She explained the property has various violations with outstanding penalties, and upon inspection completed by Nicole Brick, Code Compliance Officer for the Department of Planning Services, it is confirmed the property is still in violation; however, there has been a recent Application for a Treasure's Deed, therefore, staff recommends another continuation of the matter to allow adequate time to complete the tax lien sale. Commissioner Ross moved to continue said certification to August 4, 2025, at 9:00 a.m. The motion was seconded by Commissioner Peppler and it carried unanimously. 2. a Consider Certification to Weld County Treasurer of County Compliance Violation Penalties as Special Assessment — Charles Simansky (Continued from 10/7/2024): Ms. Schiel reviewed the property location and violations presented and indicated the property has been sold to a new owner; therefore, she stated staff's recommendation is to dismiss the outstanding penalties as due process requires the County to start the process over with the new property owner. Commissioner James moved to dismiss said certification and deemed the penalties are no longer due or owing. The motion was seconded by Commissioner Maxey and it carried unanimously. 3. a Consider Certification to Weld County Treasurer of County Compliance Violation Penalties as Special Assessment — Enrique Jimenez- Gonzales (Continued from 10/7/2024): Ms. Schiel reviewed the property location and violations presented, and indicated the property is now in substantial compliance with the Weld County Code; therefore, she stated staff's recommendation is to dismiss the outstanding penalties. Commissioner Ross thanked the property owners for working with staff to get into compliance and further moved to dismiss said certification and deemed the penalties are no longer due or owing. The motion was seconded by Commissioner James and it carried unanimously. El Public Comment: There was no public comment offered. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
