HomeMy WebLinkAbout730827.tiff fact& .446 6s6 --it --/7 e es-_ T arbr .d 8:i Y RESOLUTION WHEREAS, it has been determined by the Board of County Commissioners, Weld County, Colorado, that a proposed sale of a tract of land more particularlY described as follows, to-wit: The South Half (S1/2) of Section Eight (8) , Township Eight (8) North, Range Sixty-five (65) West of the Sixth P.M. , Weld County, Colorado, except the South- west Quarter of the Southwest Quarter of the South- east Quarter (SWaSWaSEa) thereof, by Emma C. & George S. Ball , grantors, to James S. Brinks, grantee, whereby grantors retain and reserve unto themselves the Southwest Quarter of the Southwest Quarter of the Southeast Quarter (SWaSWaSEa) of said Section Eight (8) for residential purposes, does not come within the purview of the definitions of the terms "Subdivision" and "subdivided land" as set forth in CRS 106-2-33, (3) (a) and (b) 1963, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, desires to exempt this particular division of land pursuant to its authority under CRS 106-2-33 (d) , 1963, as amended. NOW, THEREFORE, BE IT RESOLVED, that the proposed sale of the hereinabove described tract of land to James S. Brinks, grantee, be exempted from the definition of the terms "Subdivision" and "subdivided land" as provided for in the new Weld County Subdivision Regulations at Section 2-1, A. , (3) , adopted August 30, 1972. The above and foregoing resolution was, on motion duly made and seconded, adopted by the following vote on the 23rd day of May, A.D. , 1973. M. , containing 320 acres more or less . The Planning Department has reviewed this request and recom- mends that the request be approved for the following reasons : DOES DOES NOT X Require water Require sewer X X Create traffic problems X Fall in flood plain X Agree with Planning Commission Policy X Create housing X Agree with surrounding land use X Meet all known requirements Comments : The applicants wish to retain 10 acres which includes their • residence and other improvements and sell 470 acres , of which 320 acres are contiguous to the 10 acret homesite . The 470 acres will be sold to one person and will remain in agricultural use . In my opinion , there is little justification to require the applicants to submit an application for a Recorded Exemp- tion for the reasons listed above , and I recommend that their application for exception from subdivision be approved . My home and improvements are situated on the Southwest Quarter of the Southwest Quarter of the Southeast Quarter (SW 1/4 SW 1/4 SE 1/4) of Section 8 , Township 8 North , Range 65 blest of the 6th P.M. My parents moved on that place in 1908 and that has been the home of my parents and my home ever since. We presently have a septic tank and leach field which has worked satisfactorily for the past 25 years without any difficulty or trouble of any kind. We have two domestic wells on the property that have produced water for our domestic needs and our cattle operation ever since my family moved on the property. One well was a dug well which was dug very shortly after my family moved on this ::lace in 1908 ; the other is a drilled well which was drilled about 30 years ago. T,pproximately 10 acres are used .for our residence, farm buildings and cor- rals , and we would at this time propose to sell the rest of our irrigated land, in the amount of some 470 acres , and .reserve and retain the 10 acres , being our residence and improvements , and continue in the future to run a fey; cattle on 32.0 acres of pasture which we will still retain and own on the East Half of Section 13 , Township 8 North, Range 66 West of the 6th P.M. The 470 acres is being sold to one person and I presume will be used as an irrigated farm in the future as he is buying all of the water with the land. I am presently 75 years of age; my wife is 70 years of age, and we are both retired, or semi-retired, and it is our wish to continue to make our residence on our old home place, run a few cattle on our pasture land and have corrals and improve- ments tc keep them in when they are off the pasture land. They tell me that if I wish to retain less than 30 acres of my property, it is necessary that I have a special permit authorizing me to do this. Section 2-1 of the weld County Subdivision Regulations adopted in September of 1972, not for the purpose of erecting any further residential huildings or improvements but solely for the purpose of permit- ting !ate to make a sale of my irrigated far* land which Iy now am unable to take care of myself , and at the same time retain my home and live where I would like to live. We will have no pro- blems with requirements for water of any kind as we have two good domestic wells . No traffic problem will be created. Our septic tank and leach field has been operating satisfactorily for 25 years and I see no reason why it should not continue to operate satisfactorily in the future, our rroperty is not in a flood plain. A special exemption will not create any additional housing. It will not change any of the surrounding land use and it will not bother or interfere with any person. Inasmuch as the sale of our irrigated farm. is due to be closed at about the middle of May, it is requested that you take as prompt action as possible on this request. If you would like me to answer any questions or give you any fur- ther information, I will be very happy to cooperate with you in any way I can in order to inform you of all the facts concerning this matter to enable you to make an informed decision. I trust the wishes of a longtime resident of Weld County will be given some consideration in your decision, to permit me and my wife to continue_ to live on our family homestead after all these years.
