HomeMy WebLinkAbout20252400.tiffResolution Approve Data Use Agreement for Technical Services Program Integration of Real -Theta Air Quality Conditions from Three (3) Weld County Monitoring Station Locations and Authorize Chair to Sign Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with a Data Use Agreement for Technical Services Program Integration of Real -Time Air Quality Conditions from Three (3) Weld County Monitoring Station Locations, further identified as Missile Site, Orchard, and Hereford, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Health and Environment, and the Colorado Department of Public Health and Environment, Air Pollution Control Division, commencing upon full execution of signatures, with further terms and conditions being as stated in said agreement, and Whereas, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Data Use Agreement for Technical Services Program Integration of Real -Time Air Quality Conditions from Three (3) Weld County Monitoring Station Locations, further identified as Missile Site, Orchard, and Hereford, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Health and Environment, and the Colorado Department of Public Health and Environment, Air Pollution Control Division, be, and hereby is, approved. Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign said agreement. cc.. The Colorado Department of Public Health (CDPHE) has begun to host data for other local government entities. In order post data from Weld County, they are requesting a data use agreement. This use agreement is similar to ones used with other local entities and legal has reviewed the language contained within. Weld County retains all rights to ownership of the data. What options exist for the Board? Signing of this agreement allows for increased visibility and usage of Weld County air monitoring data. There will need to be some small configurations during implementation to mirror layout of state structure, but once completed, data should be transmitted regularly without need for staff involvement. Recommendation: I recommend approval to place this data use agreement on a future Board agenda for formal consideration. Ross .4P \`C 2025-2400 $ /25 I-1 Loon DATA USE AGREEMENT This Data Use Agreement ("Agreement") is between the Colorado Department of Public Health and Environment's Technical Services Program and Weld County at 1555 N 17th Ave, Greeley, Colorado, 80631. Weld County operates three air monitoring stations at Missile Site Park (40.428670, -104.860882), Orchard (40.334625,-104.159983), and Hereford (40.978113,-104.72613). The Technical Services Program, part of the Air Pollution Control Division within the Colorado Department of Public Health and Environment, will integrate Weld County's air monitoring data into its public -facing website. This integration will enhance public access to real-time air quality information for Weld County, promoting greater transparency and public awareness of local air quality conditions. Data Owner Obligations: «Under what authority the Program is able to share identifiable data.>> Weld County, as the "Data Owner", agrees to: A. Provide the following information to the Data User: Electronic transmission of air quality data in a format agreed upon by both parties, provided at regular intervals relative to the availability of data resolution and restrictions of the supplying data system. B. Ensure that data is transmitted electronically in a manner that is consistent with cybersecurity standards. C. Keep a secure copy of any data transmitted for at least ninety (90) days to address any data questions and/or privacy concerns. D. Notify the data user of substantive invalidation of air quality data as a result of quality control checks, audits, or calibrations. Note that this will not result in the removal of invalidated data from the User's system unless specifically requested. E. Data provided by the Data Owner is considered fully publicly available and will be published in near -real-time to existing public -facing data systems in use by the Data User. F. Data provided by the Data Owner will be presented similarly to regulatory data but will not be considered regulatorily significant as the data is not collected under the Data User's quality umbrella. Uses and Disclosures as Requested in this Agreement. The Data User shall immediately make public all data provided by the Data Owner. The Data User may not publish all data provided if requested by the Data Owner, or as restricted by relevance to existing Data User tools. B. Safeguards. The Data User agrees to provide clarification that the data collected is preliminary and subject to quality reviews, and is owned by the Data Owner. The Data User may, on request, provide the Data Owner contact information to inquiries about the data. C. Amendments. The Data User and the Data Owner shall negotiate in good faith to amend this Agreement to equitably and fairly reflect any changes that alter either or both parties' obligations under this Agreement. Any amendments to this Agreement must be made in writing and signed by both the Data Owner and the Data User. D. Data Ownership. The Data Owner is Weld County. The Data User does not obtain any right, title, or interest in any of the data furnished by Weld County. E. Publication/Release Requirements. Any release of information shall include the following statement: All data are collected in real-time and have not been corrected nor validated. Data is provided by the [data owner]. These data are non -regulatory and will not be used in policy decisions directly.
