Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Chief Financial Officer, Cheryl Pattelli Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner Peppler seconded the motion and it carried unanimously. 1. Minutes from March 17, 2025 Certification of Hearings: Commissioner James moved to approve the below listed Hearing Certificate. Commissioner Maxey seconded the motion, which carried unanimously. 1. Special Event Permit — The Wild Animal Sanctuary, A Colorado Non -Profit Corporation Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: Commissioner Ross moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. L\ 2025-0882 BC0016 Page 2 Monday, March 31, 2025 www weld gov Presentations and Proclamations: 1 ` Recognition of Services, Sheriff's Office — Darice Knowlton: Chair Buck read the certificate for the record Captain Matt Elbe, Sheriff's Office (SO),‘ stated when thinking of the SO personnel, often the focus is the sworn positions, such as the deputies, but he took the opportunity to highlight the unsworn civilian and administrative personnel who allow the SO, as a whole, to operate efficiently He shared dunng Dance Knowlton's career with the SO, she has been a Law Enforcement Technician in Jail Booking, and recently transitioned to the customer service front desk where she brought her tenacity and positive attitude Captain Elbe expressed his gratitude to Ms Knowlton and stated she will be greatly missed Mary Shannon and Lynette Boehm, Law Enforcement Booking Technician Supervisors, shared several heart -felt stories, stated she always brought joy, laughter, and a lighthearted smile Ms Knowlton extended her appreciation for the recognition; and thanked her peers for her wonderful expenences throughout her career The Board expressed appreciation for her inspirational work ethic and light-hearted disposition in a challenging role for her nearly 20 years of service to the citizens of Weld County (Clerk's Note The group gathered for a photo opportunity ) Warrants: 1 Beds: i General Warrants: Commissioner Ross moved to approve the General Warrants, as pnnted Commissioner Peppier seconded the motion and it carned unanimously I" 1 3; Approve Bid #62500032, 2025 Sign Material — Department of Public Works: Toby Taylor, Purchasing Department, stated staff recommends selecting Centerline Supply, Inc , US Standard Sign, and Osburn Associates, Inc , as the lowest bidders who met specifications for each of the 87 line items identified in the record Commissioner James moved to approve said bid The motion was seconded by Commissioner Ross, and it carned unanimously 2 lEil Present Bid #B2500031, Land Use Application and Building Permit Fee Study — Department of Planning Services: Mr Taylor stated two (2) bids were received and staff will make a recommendation on Apnl 14, 2025 3 Present Bid #B2500035, Jail -1 East Hot Water Boilers and Storage Tank Replacement — Facilities Department: Mr Taylor stated five (5) bids were received and staff will make a recommendation on Apnl 14, 2025 2025-0882 BC0016 Page 3 Monday, March 31, 2025 www weld gov New Business — General: 1. f' Consider Application for 2026-2027 Hazardous Materials Emergency Preparedness (HMEP) Grant and Authorize Chair and Department of Finance to Sign: Roy Ruth&II, Director of the Office of Emergency Management, requested to submit the 2026-2027 grant application for Hazardous Matenals Emergency Preparedness (HMEP) He stated, if awarded, the County will receive funds, in the amount of $589,583 00, with a required match of $117,996 00, to be utilized for chemical safety planning, training; and exercises Commissioner Maxey moved to approve said application and authonze the Chair and the Department of Finance to sign The motion was seconded by Commissioner Peppier, and it carned unanimously 2. t; Consider Contract ID #9234, Energy and Mineral Impact Assistance Fund (EIAF) Program Grant Application for Construction of New Keenesburg Grader Shed (31164 County Road 6 [Tier I — April Cycle% and Authorize Facilities Department to Submit Electronically: Elizabeth Relford, Department of Finance, on behalf of the Facilities Department, requested to submit a Tier I Application to the Department of Local Affairs (DOLA), for the amount of $200,000 00, to use as leverage of taxpayer dollars for the construction of a new Grader Shed location in Keenesburg, Colorado, which is estimated to cost a total of $1 4 Million Commissioner Ross moved to approve said application and authorize the Chair to sign The motion was seconded by Commissioner Maxey, which carned unanimously Consider Contract ID #9235, Energy and Mineral Impact Assistance Fund (EIAF) Program Grant Application for Construction of New Motor Pool Complex (Tier II — April Cycle) and Authorize Departments of Fleet Services and Facilities to Submit Electronically: Ms Relford requested to submit a Tier II Application to DOLA, for the amount of $1 Million, to use as leverage of taxpayer dollars for the construction of a new Motor Pool Complex, which is estimated to cost a total of $15 3 Million Commissioner Ross moved to approve said application and authonze the Chair to sign ; The motion was seconded by Commissioner James and the motion carried unanimously i' Consider Temporary Closure of County Road 28 Between County Roads 19 and 21: Kevin Hettinger, Department of Public Works, stated the closure will begin Apnl 7, 2025, and go through, Apnl 11, 2025, for the replacement of an irngation culvert He stated the detour route is paved and message boards will be placed in advance of said closure Commissioner Maxey moved to approve said temporary closure The motion was seconded by Commissioner Peppier and it carned unanimously 2025-0882 BC0016 Page 4 Monday, March 31, 2025 www weld gov 5. P' i Consider Biennial Renewal Application for Fermented Malt Beverage On -Premises (County) License and Authorize Chair to Sign — Ana M. Lucero, dba Polio Feliz: Matthew Conroy, Assistant County Attorney, reviewed the location as a small enclave of unincorporated Weld County and the history of the establishment, indicated there are no concerns from referral agencies, and stated staff recommends approval Commissioner Ross moved to approve said application and authorize the Chair to sign The motion was seconded by Commissioner Maxey and it carned unanimously 6. Consider Resolution Establishing Commissioner Redistricting Commission Pursuant to C.R.S. §30-10-306.1 and Redistricting Process Deadlines Pursuant to C.R.S. §30-10-306.4: Mr Conroy stated the Colorado Supreme Court ordered Weld County to undergo a redistncting process, and as part of said process, he explained it is necessary to establish a Redistncting Commission and correlating deadlines Mr Conroy indicated the Board of County Commissioners will sit as the members of the Redistncting Commission beginning at the end of June 2025, and in the meantime, staff and an advisory committee will proceed with the necessary work Mr Conroy noted the entire process will be completed by September 30, 2025, through a senes of public hearings to allow for input In response to Commissioner James, Mr Conroy explained said Commission has broad latitude for who the members are and how many there should be He further explained this Commission will be a quasi-judicial role the Commissioners will fill as the designated members In response to Commissioner Ross, Bruce Barker, County Attorney, stated the appointment of the Advisory Committee will take place in Apnl 2025 Commissioner James moved to approve said Resolution The motion was seconded by Commissioner Ross and it carried unanimously (Clerk's Note This item of business was reconsidered by the Weld County Board of Commissioners on Apnl 2, 2025) 7. ►'=1 Consider Appointment to Area Agency on Aging Advisory Board: Commissioner Maxey moved to approve said appointment The motion was seconded by Commissioner James and it carried unanimously New Business — Planning: 1 ri Consider Certification to, Treasurer of County Compliance Violation Penalties as Special Assessment — Brian Rector (Continued from 9/30/2024): Adna Schiel, Assistant County Attorney, stated that both cases for consideration have been continued from September 30, 2024 She recalled the various violations and outstanding daily court -ordered penalties, in the amount of $22,700 00, and indicated the property owner is currently working with the Department of Planning Services to address said violation's Nicole Brick, Code Compliance Officer for the Department of Planning Services; displayed images of the property's status, and confirmed that Mr Rector has applied for a Use by Special Review Permit (USR) that is currently being reviewed, and she also confirmed the garage structure has 2025-0882 BC0016 Page 5 Monday, March 31, 2025 www weld goy received its building permit as well In response to Commissioner Maxey, Ms Bnck provided further clanfication for him and Commiss'ioner Peppier who were not Commissioners at the time of the last heanng of the case Bnan Rector, property owner, was present and introduced himself for the record, and David Huwa, Colorado Civil Group Engineer and representative of Mr Rector, provided a bnef status update of the property compliance He indicated costs related to the submittal of the building structure permit, in addition to the USR application permit, are roughly $35,000 00, and noted the potential of $22,700 00 in penalties are at stake Mr Huwa requested, if it is the Board's purview, to suspend the daily penalties from accruing, since they are actively working with staff to correct the violations In response to Commissioner James, Maxwell Nader, Department of Planning Services, confirmed review the pre -application for the USR is finalized as of this morning and staff will be reaching out for next steps, thus, he recommended a six (6) month continuance for staff to complete the USR process and allow for the property to come into substantial compliance with the Weld County Code Commissioners Maxey and Ross expressed their appreciation for the property owner's diligence in working to correct the issues on his property Commissioner James moved to continue said certification to September 29, 2025, at 9 00 a m The motion was seconded by Commissioner Ross and it carned unanimously 2r`i Consider Certification to Treasurer of County Compliance Violation Penalties as Special Assessment — Chevy Truck Parts, LLC, c/o Douglas Ruppel (Continued from 9/30/2024): Ms Schiel recalled the vanous violations and outstanding daily court -ordered penalties, in the amount of $24,200 00, and indicated the property owner has made some progress to some of the identified violations Ms Bnck displayed images of the property's status, and explained Doug Ruppel's business was compliant with the state, however, the property is not compliant with proper land use permitting with Weld County to operate said business However, she clarified, with the tire recycling business vacating the property, some of the initial violations are no longer applicable She further stated, it is staff's understanding that an oil and gas support business is the new potential lessee, and indicated, if that were the case, then Mr Ruppel would need to start over with his land; use application process Due to the lack of progress, Ms Schiel indicated staff's recommendation is certifying said penalties Doug Ruppel, property owner, was present and gave an overview of the items he has been working on with staff to bring his property into compliance, and confirmed a geothermal company, known as, Dandelion Energy, will be leasing the property In response to Commissioner James, Ms Brick stated there is not a confirmed permit application for a geothermal company submitted for review at this time In response to Commissioner Ross, Mr Ruppel noted said geothermal company has not a signed lease, but he anticipated to have a fully executed lease by the end of the week Commissioner Maxey, expressed appreciation to Mr Ruppel for his testimony but expressed his concerns with signing a new lease when there are outstanding land use issues and the USR process has not been addressed, thus, 2025-0882 BC0016 Page 6 Monday, March 31, 2025 www weld gov "putting the cart before the horse " In response to Commissioner James, Ms Brick clanfied the property is located in the I-3 (Industnal/Commercial) Zone Distnct, and commercial storage is permitted, with a USR permit through the County Mr Nader further clanfied the outstanding requirements of the land use permit, from 2023 He explained that he would need to have a Site Plan Review (SPR) before moving forward with the USR process for said geothermal company, and confirmed all requirements were disclosed up front Dawn Anderson, Department of Planning Services — Development Review„ concurred with Mr Nader's statements and explained the outstanding code requirements and necessary documentation to finalize the process After further discussion, Commissioner James moved to approve said certification The motion was seconded by Commissioner Ross and it carried four (4) to one (1), with Commissioner Peppler being opposed Public Comment: No public comment was offered Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board There being no further business, this meeting was adjourned at 10 03 a m The Board of County Commissioners of Weld County, Colorado, approved the above and foregoing Minutes, on motion duly made and seconded, by the following vote on the 14th day of Apnl, A D , 2025 Perry L Buck, Chair Aye Scott K James/Pro-Tem Aye Jason S Maxey Aye Lynette Peppler Aye Kevin D Ross Aye Attest: Esther E Gesick, Clerk to the Board 2025-0882 BC0016 ATTENDANCE LIST 3/51/7 EMAIL COUNTY RESIDENCE OF SPEAKING NAME - PLEASE PRINT LEGIBLY ADDRESS (CITY, STATE ZIP) (Y/N)?
