INTRODUCTION The following report has been prepared pursuant to Section 31-12-108.5 of the Colorado Revised Statutes (C.R.S.) and concerns the proposed annexation by Front Range Farms, Inc. of certain real property known as the Front Range Farms Property (Property) to the City of Dacono (City). The Applicant is proposing an annexation comprising a total of 156.760 acres, more or less, including road rights -of -way located in Section 11, of Township 1, Range 68 West of the 6th Principal Meridian, Weld County, Colorado. The Property is generally located at the northwest corner of the intersection between York Street (Weld County Road 11) and Speedway Boulevard (Weld County Road 10). A. CURRENT ZONING/USES/PROCESS Zoning The Property is currently zoned Agricultural (A) by Weld County. The Weld County website identifies the following uses as allowed in this district: animal boarding and animal training facilities; temporary asphalt or concrete batch plants; camping, fishing, hunting, and noncommercial water skiing; county grader sheds; farming and gardening (including structures for storage of ag equipment and products, including livestock); noncommercial towers no taller than 70 feet; emergency services stations; public parks; public schools; sand, soil, and aggregate mining; one single-family or group home; telecommunications antenna towers no taller than 35 feet; utility service facilities; and water tanks related to agriculture use. The City proposes to zone the property as Planned Unit Development (PUD) to allow data center uses concurrent with annexation. Land Uses The Property is currently vacant with limited oil and gas operations present on the site. The current zoning and surrounding land uses are as follows: North: Agricultural (A) Vacant / Oil & Gas Operations (Weld County) West: Light Industrial (I-1) Colorado National Speedway (City of Dacono) South: Residential (R-1) Residential Use (City of Dacono) East: Agricultural (A) Residential Use (Weld County) Residential (R-2) Vacant / Future Residential Use (City of Dacono) Process The Annexation Petition for the Property was submitted to the City of Dacono. The Dacono City Council approved a Resolution of Substantial Compliance (Resolution No. 25-52) on August 25, 2025, acknowledging receipt of the petition for annexation for the Property, adopting findings regarding said Property, and setting the date, time, and place for the Public Hearing as October 27, 2025, at 6:00 p.m., at the Dacono City Hall, 512 Cherry Ave, Building C, Dacono, CO 80514. B. ANNEXATION IMPACT REPORT REQUIREMENTS This section is divided into the six elements that correspond to Section 31-12-108.5(1)(a), C.R.S. 1. MAPS - C.R.S. § 31-12-108.5(1)(a) Five maps are included as exhibits to this report as required by Subparagraph (a) of C.R.S. 31- 12-108.5: Exhibit A: Annexation Maps The attached annexation map illustrates the Property's compliance with applicable Colorado Revised Statutes, including the requirement that one sixth of the Property's perimeter be contiguous with the City of Dacono's existing boundaries. Exhibit B: Conceptual Utility Service Maps The proposed annexation of the Property requires only minor improvements to existing streets. No electrical utilities or ditches will be impacted. Regarding water and sewer utilities, while the site is not currently connected, the necessary infrastructure to establish these connections is located nearby. Major trunk water mains and sewer interceptors are situated along York Street and Speedway Boulevard, in close proximity to the subject property, making extension and connection feasible. Specific details of these extensions, including connection points and any required easements, would be determined during the planning phase of any future development on the site. At this time, no other utility -related issues have been identified. The current infrastructure in the vicinity is adequate to support the annexation without requiring significant changes. Exhibit C: Weld County Land Use Map Current Weld County land use map outlining the zoning in the immediate area. PRE -ANNEXATION AGREEMENT — C.R.S. § 31-12-108.5(1)(b) An annexation agreement is being negotiated with the Annexor. It is anticipated the annexation agreement will be considered by the Dacono City Council at a City Council meeting on or before December 8, 2025. 3. EXTENSION & PROVISION OF MUNICIPAL SERVICES - C.R.S. § 31- 12-108.5(1)(c) For all facilities and services, the Annexor will have the obligation to develop and install all on -site and off -site transmission and/or infrastructure facilities necessary to serve the Property with water, wastewater, stormwater facilities and other municipal services. Water: The Property has no water connection. However, Central Weld County Water District water mains are present near the site to the east along York Street and to the south along Speedway Boulevard. Wastewater: The Property is not currently connected to the St. Vrain Sanitation District's wastewater system. However, sewer mains are located near the site to the west by Colorado National Speedway and to the east near Eagle Meadow Subdivision. Stormwater: The Property does not have an existing stormwater connection. Any future development on the site will be evaluated for stormwater management in accordance with the City's standards and requirements. Other Dry Utilities: Telephone, gas, electric and cable television/internet services are not provided by the City, but are provided by private providers in the area. Emergency Services: The Dacono Police Department will provide law enforcement services. The Mountain View Fire Rescue District will provide fire protection. Open Space, Parks, Schools, and Public Land Dedications: The annexation agreement and the Dacono Municipal Code contain requirements for public land dedications and/or fees that will provide suitable parks, schools, fire and other public facilities, as appropriate. Streets: The developer will be responsible for constructing and funding any future public road improvements required to serve the property. All such improvements are subject to City review and approval. 4. FINANCING SERVICE EXTENSIONS - C.R.S. § 31-12-108.5(1)(d) Under the City's policy of requiring growth to pay its own way, Annexor will be required to pay for the extension of City services to the Property. Real property taxes on the Property will fund police protection and other general City services. 5. EXISTING DISTRICTS IN THE AREA TO BE ANNEXED - C.R.S. § 31- 12-108.5(1)(e) The Weld County Treasurer's office records reflect that the Property is subject to the following taxing authorities: Tax District Levy Central Weld County Water (CWC) High Plains Library District Longmont Conservation District Mountain View Fire Protection District Northern Colorado Water (NCW) RE1J-Longmont School District Weld County 0.000 3.179 0.000 16.247 1.000 57.168 15.956 Total 93.550 6. EFFECT ON SCHOOL DISTRICT - C.R.S. § 31-12-108.5(1)(f) The annexation of the Front Range Farms Property is not expected to affect the local school system. Because the property is designated for light -industrial development, specifically data centers, it is unlikely to generate new residential growth or contribute to additional student enrollment. As part of this petition, your petitioners further state to the City Council that: 1. It is desirable and necessary that the territory described in Exhibit A be annexed to the City of Dacono. 2. The requirements of Sections 31-12-104 and 31-12-105, C.R.S., as amended, exist or have been met in that: Not less than one -sixth of the perimeter of the area proposed to be annexed is contiguous with the City of Dacono or will be contiguous with the City of Dacono within such time as required by Section 31-12-104. b. A community of interest exists between the area proposed to be annexed and the City of Dacono. c. The area proposed to be annexed is urban or will be urbanized in the near future. d. The area proposed to be annexed is integrated with or is capable of being integrated with the City of Dacono. e. No land within the boundary of the territory proposed to be annexed which is held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, has been divided into separate parts or parcels without the written consent of the landowner or landowners thereof, unless such tracts or parcels were separated by a dedicated street, road, or other public way. f. No land within the boundary of the area proposed to be annexed which is held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, comprises twenty acres or more, and which, together with the buildings and 1 improvements situated thereon, has an assessed value in excess of two hundred thousand dollars ($200,000.00) for ad valorem tax purposes for the year next preceding the annexation, has been included within the area proposed to be annexed without the written consent of the landowner or landowners. g. No annexation proceedings have been commenced for any portion of the territory proposed to be annexed for the annexation of such territory to another municipality. h. The annexation of the territory proposed to be annexed will not result in the detachment of area from any school district. i. The annexation of the territory proposed to be annexed will not have the effect of extending the boundary of the City of Dacono more than three miles in any direction from any point of the boundary of the City of Dacono in any one year. j. The territory proposed to be annexed is 160.379 acres in total area. k. Prior to completion of the annexation of the area proposed to be annexed, a plan will be in place, pursuant to Section 31-12-105(1)(e), C.R.S., which generally describes the proposed location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks , aviation fields, other public ways, grounds, open spaces, public utilities, and terminals for water, light, sanitation, transportation, and power to be provided by the City of Dacono; and the proposed land uses for the area; such plan to be updated at least once annually. In establishing the boundary of the area proposed to be annexed, if a portion of a platted street or alley is to be annexed, the entire width of the street or alley has been included within the area annexed, and reasonable access will not be denied to any landowners, owners of any easement, or the owners of any franchise adjoining any platted street or alley which is to be annexed to the City of Dacono but is not bounded on both sides by the City of Dacono. If required, an impact report will be prepared and filed pursuant to Section 31-12-108.5, C.R.S. 3. The owners of more than fifty percent of the area proposed to be annexed, exclusive of dedicated streets and alleys, have signed this petition and hereby petition for annexation of such territory. The signatures on this petition comprise one -hundred percent (100%) of the 2 landowners of the territory to be annexed and said landowners attesting to the facts and agreeing to the conditions herein contained will negate the necessity of any annexation election. 4. Accompanying this petition are four copies of an annexation map containing the following information: a. A written legal description of the boundaries of the area proposed to be annexed; b. A map showing the boundary of the area proposed to be annexed, said map prepared by and containing the seal of a registered surveyor; c. Within the annexation boundary map, a showing of the location of each ownership tract in unplatted land and, if part or all of the area is platted, the boundaries and the plat numbers of plots or of lots and blocks; d. Next to the boundary of the area proposed to be annexed, a drawing of the contiguous boundary of the City of Dacono and the contiguous boundary of any other municipality abutting the area proposed to be annexed, and a showing of the dimensions of such contiguous boundaries. 5. Upon the annexation ordinance becoming effective, all lands within the area proposed to be annexed will become subject to all ordinances, resolutions, rules, and regulations of the City of Dacono, except for general property taxes of the City of Dacono, which shall be come effective as of the January 1 next ensuing. 6. The zoning classification requested for the area proposed to be annexed is Planned Unit Development (PUD). The petitioners agree that said annexed land shall be brought under the provisions of Chapter 16 of the Dacono Municipal Code within ninety (90) day from the effective date of the annexation ordinance. 7. There shall be no duty or obligation upon the City of Dacono to furnish water or sanitary sewer facilities to the area proposed to be annexed. Such services will be provided at such time, in the sole discretion of the City, when such services for water and sanitary sewer can be economically and reasonably installed to service a sufficient number of inhabitants within the area so as to make the construction and establishment of such services feasible and at no additional cost for the same or similar type of services provided to inhabitants within the existing corporate limits of the City. 8. If required by the City, an annexation agreement has been or will be executed by the 3 petitioners herein and the City of Dacono relating to this annexation and the petitioners hereby expressly consent to the terms and conditions set forth in the annexation agreement. 9. The petitioners agree to the following terms and conditions, which shall be covenants running with the land, and which may, at the option of the City, appear on the annexation map: a. Water rights shall be provided pursuant to City ordinance. b. All conditions set out in the annexation agreement executed by the petitioner. c.
