Rea Case #: USR25-0003
This is in regards to the above mentioned case. I ant John Johnson of Johnson Dairy located at
23 016 County Road 74, Eaton, Colorado.
My concerns are basically the drainage, there are already drainage issues existing with the current
gas plant running across the road and through my property. The ditch is extremely level and
culverts are potentially too small. I see that there is a proposed retention ponds on both the
northeast and southeast corners and my concern is how those retention ponds will end up draining
when full and where the water is going to go, to the south or to the north, what the size of the
drainage ponds are, will they retain an amount of more than 1 to 2" of rainfall.
In addition, I think there needs to be a three or four foot berm between those to ponds to divert
additional runoff in the middle of that proposed site to those two holding ponds to allow for
controlled drainage.
The current driveway is way too flat and all the water drains straight down the road and across my
property. The driveway needs to be extremely crowned so it drains from side to side and some
kind of drainage into the drainage ditch or diverted into the retention ponds. There might need to
be a third retention pond on the north side of the driveway.
These are my concerns, this has been a continual ongoing problem.. These problems were
discussed when the gas plant went in and nothing was accomplished then. I begged the county to
make the right decision and demand that the property keep the runoff on the property instead of
coming across the road and flooding out my facility.
I appreciate your consideration in this matter and request a response from planning prior to the
May 5, 2025 meeting to ensure the right decisions are made. Hopefully, decisions are made that
we can follow up with during construction to make sure they are enforced.
Do not hesitate to contact me should you wish to discuss.
Sincerely,
Job Ds Johnson

shared with DCP Midstream Compressor
Station.
• Updated access permit anticipated
Access gate internal to site (not off CR 47)
• Post construction vehicles/day:
• Light Duty: 2vehicles/day
• Semi -Trucks: 15 vehicles/day
Traffic split: 70% from Colt/Maverick, 30%
from West Pony
Semi -truck trips spread evenly over 10 -
hour shifts

•
•
•
Designed to be low -impact
No lighting.
No permanent structures.
Incorporates measures to minimize noise, dust,
and traffic disturbances.
The facility is situated as far as possible from
residences and the exterior of the overall lot,
The topography provides additional visual
buffer.
Planned fencing will further reduce any
potential impacts from visibility and operations.

Max noise levels remain under County thresholds:
• On WCR 47 and 74: at 55 mph trucks have an avg.
noise emission of 84 d6(A) measured 50' away
from the source
• On private drive within the site: speeds at or
below 25 mph, avg. noise level drops to 76 d6(A)
or less as measured 50' away from the source
Construction will be the most intensive period of
activity but will only take 30 days
• Noise Control Measures:
• Staggered truck arrivals (2/hour over 10 -hour
shift for up to 20 semi -truck trips/day)
• No overnight parking or idling
• Daytime -only operations
• Short-term loading/unloading only
Conclusion: Noise impacts remain below County
thresholds; no significant impact to nearby residents
expected.

Other Environmental Health Considerations
•
•
•
•
Water: Bottled water; no permanent
potable tap (less than 2 full-time
employees on site)
Sanitation: Portable toilets with regular
servicing
Waste: Noon-site disposal; all trash
hauled off -site
Air: Dust abatement via water truck and
speed control (coordinated with Weld
County approved vendors, as needed)

Specifics of Request for Use by Special Review (USR25-0003)
•
•
Request: Site -Specific Development
Plan and Use by Special Review Permit
Special Use: Oil and Gas Support and
Service
• Additional Context: Outside of
subdivisions and historic townsites in the
A (Agricultural) Zone District
• Surface Ownership: The project will be
located on land owned by Noble Energy
Inc. (a.k.a. Chevron)
Mineral Interests: Two mineral interests
were identified and notified.
•
•
•
•
•
Comprehensive Plan Consistency
Agricultural Heritage: Avoids prime ag land and supports
natural resource development. Site is on inactive, non -irrigated
ag land; avoids disrupting active farming.
Private Property Rights: Respects neighboring landowners
and private property rights. Neighbors were notified; site
design revised to address concerns.
Economic Growth: Supports economic stability and reduces
regional truck mileage. Reduces transport distances, improves
construction efficiency, supports regional energy development.
Health & Safety: Dust control, stormwater management,
limited hours, and traffic mitigation all support public welfare.
Additional Goals Met:
• Maintains rural density
• Respects water resource practices
• Recognizes lawful agricultural operations as non -nuisance
13
Zone District Intent
•
•
The site is in the Agricultural (A) Zone
District, which supports ag activities,
natural resource extraction, and energy
development.
The proposed use (material storage
yard for oil and gas support) aligns with
the zone's intent by:
• Supporting energy development
• Not interfering with surrounding
agricultural operations
14
Summary of Referral Agency Coordination
•
•
•
•
Colorado Parks and Wildlife (CPW)
Environmental Health
Engineering/ Development Services
Galeton Fire Department
15
Community Outreach
• Chevron has made efforts to respect the
rights of neighboring landowners.
• Community outreach letter sent at the
beginning of design process in May 2024:
• 14 parcels/20 owner records
• 10 total owners
• Included detailed maps and information
on the proposed project's operational
needs and site design layout.
• Amended the site design to address
initial concerns from neighboring
landowners and operators such as DCP
Midstream.
• Additional neighboring property owner
comments received on 4/29.
16
Development Standards & Conditions of Approval
•
•
•
•
Provided by Staff on 4/29
No initial concerns or conflicts
with the Development Standards
or Conditions.
Ongoing coordination with Staff
to ensure language is accurate
