The Board of County Commissioners of Weld County, Colorado, met in regular session
in full conformity with the laws of the State of Colorado at the regular place of meeting in
the Weld County Administration Building, Greeley, Colorado, September 24, 2025, at the
hour of 9:00 a.m.
Roll Call: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Perry L. Buck, Chair
Commissioner Scott K. James, Pro-Tem
Commissioner Jason S. Maxey
Commissioner Lynette Peppier
Commissioner Kevin D. Ross

Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board
of County Commissioners meeting, as printed. Commissioner Peppler seconded the
motion and it carried unanimously.
1. Minutes from September 10, 2025
Certification of Hearings: Commissioner Ross moved to approve the below listed
Hearing Certificate. Commissioner James seconded the motion, which carried
unanimously.
1. RES24-0013 - Southeast Weld Fire Protection District, c/o Tom Beach
Amendments to Agenda: There were no amendments to the Agenda.
Consent Agenda: There being no request for public testimony concerning the following
item, as listed under `Consent Agenda — Miscellaneous', Commissioner James moved to
approve the Consent Agenda, as printed. Commissioner Ross seconded the motion and
it carried unanimously.

1 Partial Vacation, VAC25-0015, of Two -Lot Recorded Exemption, RE -1807, for
Removal of Lot B — R. M. Hiner Construction Company, Inc., do Sharon Hiner
Warrants:
1. General Warrants: Commissioner Maxey moved to approve the General
Warrants, as printed. Commissioner Ross seconded the motion and it carried
unanimously.
New Business — General:
1. Consider Contract ID #9934 Award Letter and Intergovernmental Agreement
for 2025 Paul Coverdell Forensic Science Improvement Grant for Northern
Colorado Regional Forensic Laboratory, and Authorize Chair and Sheriff's
Office to Sign: Thanh Matthews, Sheriff's Office, stated the County received grant
funding, in the amount of $26,446.00, with no local match required, to fund
three (3) digital media trainings for evidence processing. Commissioner Ross
moved to approve said award letter and agreement, and authorize the Chair and
Sheriff's Office to sign. The motion was seconded by Commissioner Maxey and it
carried unanimously.
2. Consider Contract ID #9912 Amendment #3 to Facility Usage License
Agreement and Rental Guidelines for Area Agency on Aging (AAA) "Friendly
Fork" Senior Nutrition Program, and Authorize Chair to Sign — Archdiocese
of Denver and Guardian Angels Catholic Church: Jamie Ulrich, Director of
the Department of Human Services, stated the facility used for the Friendly
Fork Program is located in Mead, Colorado, for the cost of $50.00 per week, or a
total of $2,350.00 for the year. Commissioner Ross moved to approve said
amendment and authorize the Chair to sign. The motion was seconded by
Commissioner Peppler and it carried unanimously.
3. Consider Contract ID #9923 Amendment #5 to Intergovernmental Grant
Agreement for Promoting Safe and Stable Families (PSSF) Program and
Authorize Chair to Sign: Ms. Ulrich stated the amendment provides additional
funding and extends the term through September 30, 2026, for the prevention team
to utilize. Commissioner Peppler moved to approve said amendment and authorize
the Chair to sign. The motion was seconded by Commissioner James and it carried
unanimously.
4. Consider Contract ID #9927 Amendment #1 to Agreement for Biometric
Fingerprinting Identification Services for Smart -E Kiosk Installation and
Authorize Chair to Sign — Idemia Identity and Security USA, LLC: Ms. Ulrich
stated the amendment allows for the installation of a self -serve smart electronic
kiosk to implement the latest technology for fingerprinting services and benefit the
general public, foster parents, and childcare providers, while also streamlining staff
hours. Commissioner Peppier moved to approve said amendment and authorize

the Chair to sign. The motion was seconded by Commissioner Ross and it carried
unanimously.
5. Consider Intergovernmental Agreement for Use of Weld County Oil and Gas
Energy Department Staff to Assist with 1041 Oil and Gas Location
Assessment Enforcement, and Authorize Chair to Sign — Town of Eaton:
Brett Cavanaugh, Director of the Department of Oil and Gas Energy, stated the
agreement allows for staff to assist the Town of Eaton in the collaborative efforts
enforcing the 1041 Weld Oil and Gas Location Assessments (WOGLA) permits.
Commissioner Ross moved to approve said agreement and authorize the Chair to
sign. The motion was seconded by Commissioner Peppier and it carried
unanimously.
6. Consider Contract ID #9936 Service Agreement for Weld County Jail Lobby
Security Station and 1 West Pods A, B and C Workstation Carpet
Replacement Project Pursuant to Cooperative Purchasing Contract Terms
and Conditions Between Sourcewell and Tarkett USA, Inc., and Authorize
Chair to Sign: Toby Taylor, Purchasing Department, stated the Facilities
Department desires to replace the carpet in the Sherrif's Office Jail Lobby Security
Station and the 1 West Pods A, B and C Workstation, by utilizing Sourcewell
cooperative purchasing contract #061323-TFU, for the purchase and installation
of the carpet. He explained Section 5-4-80 of the Weld County Code allows the
use of cooperative purchases for expenditures which are exempt from the
procurement process and may be purchased directly from the source. Therefore,
Mr. Taylor stated staff recommends Tarkett USA, Inc., as the approved vendor, for
the amount of $94,010.48. Commissioner Maxey moved to approve said
agreement and authorize the Chair to sign. The motion was seconded by
Commissioner Ross and it carried unanimously.
7. Consider Interlocal Contract for Cooperative Purchasing Membership and
Authorize Chair to Sign — Houston -Galveston Area Council, dba HGACBuy:
Mr. Taylor stated Weld County Code allows for purchases from cooperative
sources, and after evaluation staff recommends becoming a member of the
Houston -Galveston Area Council, dba HGACBuy, co-op for the benefit of
discounted rates. Commissioner Ross moved to approve said contract and
authorize the Chair to sign. The motion was seconded by Commissioner James
and it carried unanimously.
New Business — Planning:
1 Consider Vacation, VAC25-0014, of Amended Use by Special Review Permit,
AMUSR-1458 — Cataract Capital, LLC, c/o Blair Eklund, and Talons Capital 2,
LLC, c/o Andrew McCabe: Matthew VanEyll, Department of Planning Services,
explained, as a result of Conditions of Approval (COA) for Site Plan Reviews,
SPR25-0002 and SPR25-0003, staff received a request from the applicant to
vacate Amended Use by Special Review Permit, AMUSR-1458. He stated staff

recommends approval of the vacation to satisfy said COA. Commissioner James
moved to approve said vacation. The motion was seconded by
Commissioner Peppler and it carried unanimously.
Public Comment: There was no public comment.
Let the Minutes reflect that the above and foregoing actions were attested to and
respectfully submitted by the Clerk to the Board. There being no further business, this
meeting was adjourned at 9:13 a.m.
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Minutes, on motion duly made and seconded, by the following vote on the
