The purpose of this MOU was to establish the roles and responsibilities for implementing the provisions of Section 121(C) of the Workforce Innovation and Opportunity Act (WIOA) of 2014. The Department is now requesting approval of Amendment #1 to incorporate a Co -Location provision, allowing WCDHS and RMSER to each have a dedicated workspace within the other's building. What options exist for the Board? Approval of Amendment #1 with Rocky Mountain SER. Deny approval of Amendment #1 with Rocky Mountain SER. Consequences: There will not be an amendment to add a Co -Location provision. Impacts: Rocky Mountain SER and Weld County DHS will not benefit from a Co -Location agreement to support each entity in their respective roles and responsibilities. Ross Pass -Around Memorandum; February 25, 2025 - CMS ID 9135 AGREEMENT AMENDMENT BETWEEN WELD COUNTY AND ROCKY MOUNTAIN SERVICE EMPLOYMENT REDEVLOPMENT (RMSER) This Agreement Amendment made and entered into 5ill day of Move, I^ I, 2025 by and between the Board of Weld County Commissioners, on behalf of the Weld County Department of Human Services, hereinafter referred to as the "County", and Rocky Mountain Service Employment Redevelopment (RMSER), hereinafter referred to as the "Partner". WHEREAS the parties entered into an Agreement to establish roles and responsibilities for implementation of the provisions of Section 121(C) of the Workforce Innovation and Opportunity Act (WIOA) of 2014, , (the "Original Agreement") identified by the Weld County Clerk to the Board of County Commissioners as document No. 2022-1136, approved on April 20, 2022. WHEREAS the parties hereby agree to amend the term of the Original Agreement in accordance with the terms of the Original Agreement and any previously adopted amendment, which is incorporated by reference herein, as well as the terms provided herein. NOW THEREFORE, in consideration of the premises, the parties hereto covenant and agree as follows: The Original Agreement will end on June 30, 2026. This Amendment, together with the Original Agreement, constitutes the entire understanding between the parties. The following additional changes are hereby made to the current Agreement as of March 17, 2025. 1. Add paragraph as follows: Co -Location Agreement & Benefits To strengthen service delivery and coordination, Partner staff will be co -located at both the Greeley and Fort Lupton One -Stop Centers, also known as Employment Services of Weld County (ESWC), while the Migrant Seasonal Farmworker (MSFW) Administrator will be granted space at Partner's designated office. 1. County will provide Partner the following Co -Location benefits to Partner's staff in the Greeley and Fort Lupton One -Stop Centers: a. Dedicated Workspace — A designated space within the One -Stop centers for Partner staff to meet with clients. b. Shared Access to Common Areas — Use of reception, waiting areas, and resource rooms for service delivery. c. Internet & Technology Access — The employees of Partner will be granted access to County's Wi-Fi and shared office resources. d. Meeting & Training Rooms — Ability to reserve conference rooms for client meetings, employer engagement, and training workshops. e. Marketing & Outreach Support — Inclusion of Partner services in One - Stop promotional materials and events. f. Collaboration in Workforce Activities — Opportunities to participate in job fairs, hiring events, and employer engagement initiatives. g. Cross -Training Opportunities — Joint staff training to enhance service coordination and knowledge sharing. 2. Partner will provide the following Co -Location benefits to County's MSFW Administrator at Partner's office: a. Puryose The purpose of this Memorandum of Understanding (MOU) is to establish an agreement between the County and the Partner, hereinafter referred to as the "Parties", concerning respective roles and responsibilities for implementation of the provisions of Section 121(e) of the Workforce Innovation and Opportunity Act (WIOA) of 2014. Additionally, this MOU is to coordinate resources to prevent duplication and ensure the effective and efficient delivery of workforce development services in Weld County. This MOU also establishes joint processes and procedures that will enable the Parties to integrate the current service delivery system, which will increase the opportunities for migrant and seasonal farmworkers to transition into occupations with high employment and wage growth potential, both within and outside the agricultural industry. Parties to this document will coordinate and perform the activities and services described herein within the scope of legislative requirements governing the Parties' respective programs, services and the requirements of our partner. Parties to this document also agree to the responsibilities, obligations, and accomplishment of the performance standards and desired outcomes described in this MOU. Term of this Memorandum of Understanding (MOU) This Memorandum of Understanding ("MOU" or "Agreement") shall be effective beginning July I, 2022 through June 30, 2026. Joint Roles and Responsibilities of both County and Partner I. Coordinate the scheduling and services of shared participants and develop a shared informal referral and follow up form. 2. Cross train staff to increase high quality services, referrals and access to programs. 3. Jointly case manage customers enrolled in programs under the County, Partner, or the National Farmworkers Jobs Program (NFJP) and share assessment results as appropriate. 4. Provide informational brochures to customers at each partners main location. 5. Coordinate job development and employer relations activities. 6. Review options for coordinating intake forms and data requirements. 7. Explore opportunities for coordination and submission of grants or other funding opportunities to enhance or strengthen employment opportunities for farmworkers. 8. Provide information on points of entry into ConnectingColorado. 9. Review job orders and other services and make referrals as appropriate. 10. Development of career pathways and sector partnerships. Roles and Responsibilities of Partner 1. Train the County and/or other Partner staff in the role and mission, goals and philosophy of the Partner. -//36 2. Provide program specific assessments for farmworkers and share the information with the County's shared customers. 3. Assist farmworkers in accessing ConnectingColorado at the Partner's office or provide information to customers on accessing ConnectingColorado at a point of entry that the customer desires. 4. Assist farmworkers in accessing permanent rental housing or temporary rental and utility assistance. 5. Provide opportunities for the County staff to attend Partner's training as appropriate. 6. Assist the Weld County Workforce Development Board (WCWDB) in an annual review of the systems access for farmworkers and provide input in technology assistance. 7. Participate in the Business Services strategies to include, but not limited to, hiring events, career events and job development for co -enrolled participants by targeting husiness engagement opportunities and expanding awareness of employment opportunities for farmworkers. 8. Remove barriers and disincentives to serving farmworkers and increase the access that Migrant and Seasonal Farmworkers have to services provided through the One -Stop system, including services provided by other One -Stop partner agencies. 9. Develop methods of collaboration, coordination and service delivery enhancement leading to optimal use of NFJP resources within the One -Stop system that promote employment, earnings and training opportunities for farmworkers through the One -Stop system. 10. Provide the full range of services available as appropriate for co -enrolled participants which would include: a. Counseling and guidance provided directly by a counselor during the individual's plan of services. b. Training services. c. Placement services. d. Supportive services. Roles and Responsibilities of County 1. Provide opportunities for cross training staff, which may include but is not limited to: a. Use of the One -Stop Resources. b. Utilization of the open job orders list, distributed weekly. c. Assisting job seekers with accessing and completing applications in ConnectingColorado. d. Providing the following information regarding services available at the County for participants co -enrolled in partner programs: i. Orientation to the programs. Intake and eligibility processing. Basic assessment. iv. Career planning. v. Case management. vi. Coordinated job search, job development, and job placement activities. vii. Hiring and career development events. viii. Follow-up as required by funding sources. 2. Maintain a website that provides on-line information regarding services that are available at the County. Performance The Parties jointly agree to high performance for the workforce development system and farmworkers. it is the intent of each partner to support continuous improvement for program delivery and high -quality services through the workforce system wherever participants access services. Performance will be measured by: 1. Sharing results of participant satisfaction surveys. 2. Sharing performance expectations by funding sources and the performance outcomes as requested. Resources Resources available to the County under the operating cost of the Workforce Development System include: 1. Wagner-Peyser: Basic Labor Exchange for employers and job seekers. 2. WIOA: Adult, youth, dislocated workers. 3. Colorado Works Temporary Assistance for Needy Families (TANF): Cash assistance recipients. 4. Employment First: Supplemental Nutrition Assistance Program (SNAP) recipients. 5. Weld County Youth Conservation Corps' (WCYCC) AmeriCorps. 6. Other programs and discretionary projects that may become available. Resources available to the Partner to serve farmworkers with barriers through NFJP and in -kind contributions within the workforce system in Weld County: 1. Partner funded professional training on NFJP and the programs available for farmworkers will be made available to County staff when appropriate. 2. Temporary rental and utility assistance to families and individuals who are facing hardship due to seasonal agricultural employment. 3. Permanent rental housing options made available through NFJP 4. Staff resources available to assist in the co -enrollment of migrant and seasonal farmworkers in programs available through One -Stop partner agencies. 5. Staff resources to assist Business Services as appropriate. 6. Staff resources to assist customers in accessing one -stop services available in ConnectingColorado, such as reviews of open job orders and quality job applications. 7. Joint case management as appropriate. Modifications This Agreement may be modified in writing, in whole or in part, upon approval of the signers. Termination This Agreement may be terminated at any time by either party giving thirty (30) days written notice to the signers. No portion of this MOU shall be deemed to create an obligation on the part of the County of Weld, State of Colorado, to expend funds not otherwise appropriated, as this MOU is subject to the availability of funding. Therefore, the County may terminate this MOU at any time if the source of funding for the services made available to Partner is no longer available to the County, or for any other reason. Partner reserves the right to suspend services to participants if funding is no longer available. Entire Agreement This MOU contains the entire agreement and understanding between the parties with respect to the subject matter hereof and may not be changed or modified except as stated herein. This MOU shall be binding upon the parties hereto, their successors, heirs, legal representatives, and assigns. Partner and the County may not assign any of its rights or obligations hereunder without the prior consent of both parties. No Third -Party Beneficiary It is expressly understood and agreed that the enforcement of the terms and conditions of this MOU, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any claim or right of action whatsoever by any other person not included in this MOU. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this MOU shall be an incidental beneficiary only. Governmental Imm unity No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other provisions, of the Colorado Governmental Immunity Act §§24-10-101 et seq., as applicable now or hereafter amended. Independent Organization Partner agrees that it is an Independent Organization and that the Partner's officers, agents or employees will not become employees of the County, nor entitled to any employee benefits from the County as a result of the execution of this MOU. Partner shall perform its duties hereunder as an Independent Organization. Partner shall be solely responsible for its acts and those of its agents and employees for all acts performed pursuant to this MOU. Partner, its employees and agents are not entitled to unemployment insurance or workers' compensation benefits through the County and the County shall not pay for or otherwise provide such coverage for Partner or any of its agents or employees. Unemployment insurance benefits will be available to Partner and its employees and agents only if such coverage is made available by Partner or a third party. Partner shall pay when due all applicable employment taxes and income taxes and local head taxes (if applicable) incurred pursuant to this MOU. Severability If any term or condition of this MOU shall be held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, this MOU shall be construed and enforced without such provision, to the extent that this MOU is then capable of execution within the original intent of the parties. The grant applicant also assures that, as a recipient of WIOA Title I financial assistance, it will comply with 29 CFR part 38 and all other regulations implementing the laws listed above. This assurance applies to the grant applicant's operation of the WIOA Title I -financially assisted program or activity, and to all agreements the grant applicant makes to carry out the WIOA Title I -financially assisted program or activity.
