HomeMy WebLinkAbout730831.tiff • �o RESOLUTION G, 9- G - , 3 .' x ' 2-- WHEREAS, it has been determined by the Board of County Commissioners, Weld County, Colorado, that a proposed sale of a tract of land more particularly described as follows, to-wits A tract of land located in the W2 of Section 22, Township 6 North, Range 67 West, of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: Considering the N line of said Section 22 as bearing N 85°18'54" E and with all bearings contained herein relative thereto: Commencing at the Ne Corner of said Section 22, thence S 55°11'29" East, 2209.70 feet to a point which is designated by a PK nail, said point being the intersection of the Great Western Railroad and the Colorado and Southern Railroad; thence, along the centerline of the said Colorado and Southern Railroad S71°03'00" E, 55.37 feet; thence, S12°21'00" W, 50.33 feet to the True Point of Beginning; thence, along the Southern right-of-way of the Colorado and Southern Railroad 71°03'00" E, 209.00 feet; thence, S 12°21'00" W, 209.00 feet; thence, N71°03'00" W, 213.73 feet to a point on the Eastern right-of-way of the Great Western Railroad; thence along the said East right-of-way on the arc of a curve to the left whose radius is 2919.6 feet and whose long chord bears N13°58'32" E, 165.63 feet; thence, N 12°21'00" E, 42.90 feet to the True Point of Beginning. The above described tract contains 1.00 acres and is subject to all easements and rights-of-way now on record or indicated on the at- tached plat, to the Public Service Company of Colorado for the purpose of a sub- station site does not come within the purview of the definitions of the terms "Subdivision" and "subdivided land" as set forth in CRS 106-2-33, (3) (a) and (b) 1963, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, desires to exempt this particular division of land for the aforesaid reasons pursuant to its authority under CRS 106-2-33 (d) , 1963, as amended, NOW, THEREFORE, BE IT RESOLVED, that the proposed sale of the hereinabove described tract of land to the Public Service Company of Colorado for the sole purpose of erecting a sub-station be exempted from the definition of the terms "Subdivision" and "subdivided land" as provided for in the new Weld County Sub- division Regulations at Section 2-1, A., (3) , adopted August 30, 1972. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 28th day of March , 1973.
