Resolution Action of the Board Concerning Refusal to Renew Public Hearing Phase I and Set Refusal to Renew Public Hearing Phase II Regarding Tavern (County) Liquor License — El Centenario Entertainment, LLC, dba El Centenario Nightclub Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, on the 25th day of June, 2025, the Board considered the application from El Centenario Entertainment, LLC, dba El Centenario Nightclub, for renewal of a Tavern (County) Liquor License for the sale of malt, vinous, and spirituous liquors for consumption on the premises only, subject to the rules and regulations found in Article 3, Title 44, C.R.S., and at the recommendation of staff regarding concerns presented by the Department of Planning Services and Mountain View Fire Rescue District, deemed it advisable to schedule a Refusal to Renew Public Hearing Phase I on July 21, 2025, at 9:00 a.m., regarding the establishment outside the corporate limits of any town or city in the County of Weld at the location described as follows: 10763 Turner Boulevard Unit #1 Longmont, Colorado 80504 Whereas, after hearing testimony from the Department of Planning Services, the Board makes the following Findings, pursuant to Section 12-2-40 of the Weld County Code: 1. Evidence that the licensee or applicant has violated, does not meet or has failed to comply with any of the terms, conditions or provisions of Chapter 12 of the Weld County Code, the Weld County Code overall, or any rules and regulations promulgated pursuant the Colorado Beer and Wine Code or the Colorado Liquor Code. Site Plan Review Permit, SPR18-0003, was reviewed in 2018 for the tenant finish associated with El Centenario Nightclub. Final inspections were never completed for Building Permits, CMA18-0091 and CMA24-0027, and therefore, the applicant never received final approval for the 900 square -foot interior remodel, including two restrooms. The property owner and applicant were directed to re -submit the appropriate Building Permits, and to date, the issue has not been remedied. The Department of Planning Services conducted an inspection on July 17, 2025, and observed further remodeling has occurred without permits. Stop work orders have been placed on the structure. United Power will be notified of the disconnection of the electric service. The gas service likewise needs to be disconnected. The Mountain View Fire Rescue District reported the sprinkler fire line was never completed for the entire building. The occupancy was to be the east most portion of the building, and until the fire sprinklers were completed, the occupancy was not to increase. The District designated the building as dangerous, issued a stop work order, and placed caution tape around it. 2. Evidence that the licensed premises have been operated in a manner that adversely affects the public health, welfare or safety of the immediate neighborhood in which the establishment is located, which evidence may include a continuing pattern of fights, violent activity, disorderly conduct, or violations of the Weld County Code. In particular, the Board finds that operating the facility in a dangerous building due to fire risk adversely affects the public health, welfare, and safety. Whereas, pursuant to Section 12-2-40 of the Weld County Code, and based on the findings as stated above, there is sufficient evidence to schedule a Refusal to Renew Public Hearing Phase II on August 11, 2025, at 9:00 a.m., and Whereas, the Board shall hear evidence and testimony from all interested parties at said Refusal to Renew Public Hearing Phase II. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Tavern (County) Liquor License of El Centenario Entertainment, LLC, dba El Centenario Nightclub, be, and hereby is, scheduled for a Refusal to Renew Public Hearing Phase II on August 11, 2025, at 9:00 a.m. The Board of County Commissioners of Weld County, Colorado, adopted the above and foregoing Resolution, on motion duly made and seconded, by the following vote on the 21st day of July, A.D., 2025: Perry L. The Board of County Commissioners may consider the following factors in a public hearing to determine if good cause exists to refuse the renewal of any liquor license. Such consideration is denoted as Phase I of the public hearing: A. Evidence that the licensee or applicant has violated, does not meet or has failed to comply with any of the terms, conditions or provisions of this Article, the Weld County Code, or any rules and regulations promulgated pursuant the Colorado Beer and Wine Code or the Colorado Liquor Code. B. Evidence that the licensee or applicant has failed to comply with any special terms or conditions that were placed on its license in prior disciplinary proceedings or arose in the context of potential disciplinary proceeding. C. Evidence that the licensed premises have been operated in a manner that adversely affects the public health, welfare or safety of the immediate neighborhood in which the establishment is located, which evidence may include a continuing pattern of fights, violent activity, disorderly conduct, or violations of the Weld County Code. For purposes of this Paragraph C., disorderly conduct has the meaning as provided for in C.R.S. § 18-9-106. D. Evidence that the licensee is no longer of good character. E. Whether there have been any violations in the last one-year period by the licensee or by any of the agents, servants or employees of the licensee of the provisions of the Colorado Liquor Code, or any of the rules or regulations authorized pursuant to the Colorado Liquor Code or Colorado Beer and Wine Code, or any of the terms, conditions or provisions under which the license was issued. F. Evidence showing excessive noise, rowdiness or disturbances on a continuous basis in the immediate area of the licensed premises which were substantially as a result of the operation of the licensed premises. G. Evidence of persons being convicted under C.R.S. §42-4-1301, of driving under the influence of alcohol or driving while alcohol impaired after becoming intoxicated at said licensed premises. H. Evidence that the reasonable requirements of the neighborhood are not being met. Please see attached photos. I found the liquor notice and resecured it to space #3 door. Also attached is the stop work orders placed on the structure along with caution tape placed by Mountain View fire. The fire district & I agreed that United power needs to be notified of disconnection of the electric service . The gas service also needs to be disconnected by the gas utility. The building owner just happened to have stopped by & since back rent is due. He had no concerns that the utilities would be disconnected on building # 2. A new violation needs to be generated.
