HomeMy WebLinkAbout20251756.tiffResolution Approve Consent to Enforcement of 2024 International Fire Code, with Amendments, Within Certain Areas of Unincorporated Weld County Lying Within Platteville-Gilcrest Fire Protection District Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, C.R.S. §32-1-1002 (1)(d), provides that a fire code promulgated by a fire district may not be enforced in unincorporated portions of Weld County without the consent of the Weld County Board of Commissioners, and Whereas, the Platteville-Gilcrest Fire Protection District Board of Directors has presented a Resolution adopting the 2024 International Fire Code, with certain amendments, and Whereas, after review, the Board deems it advisable to consent to the enforcement of the 2024 International Fire Code, with certain amendments detailed in the attached Resolution of the Board of Directors of the Platteville-Gilcrest Fire Protection District, within the unincorporated areas of Weld County that are also within the geographic boundaries of the Platteville-Gilcrest Fire Protection District. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Board hereby consents to the enforcement of the 2024 International Fire Code, with certain amendments detailed in the attached Resolution of the Board of Directors of the Platteville-Gilcrest Fire Protection District, within the unincorporated areas of Weld County that are also within the geographic boundaries of the Platteville-Gilcrest Fire Protection District. Be it further resolved that any further amendments to the 2024 International Fire Code by the Platteville-Gilcrest Fire Protection District shall not be effective within unincorporated Weld County without the presentation to, and consent of, the Weld County Board of Commissioners. cc'. Box 407 Platteville, CO 80651 970.785.2232 • FAX 970.785.1224 May 8th 2025 BEFORE THE BOARD OF DIRECTORS OF THE PLATTEVILLE GILCREST FIRE PROTECTION DISTRICT RESOLUTION 2025-03 A RESOLUTION ADOPTING THE 2024 INTERNATIONAL FIRE CODE AS PUBLISHED BY THE INTERNATIONAL CODE COUNCIL WITH CERTAIN AMENDMENTS THERETO, TO ESTABLISH REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM THE FIRE, HAZARDOUS MATERIALS OR EXPLOSIONS; TO PROVIDE SAFETY TO FIREFIGHTERS AND EMERGENCY RESPONDERS; AND TO PROVIDE FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE WHEREAS the Platteville Gilcrest Fire Protection District (PGFPD) is a political subdivision of the State of Colorado, formed pursuant to Title 32, Colorado Revised Statutes (CRS) to provide fire suppression, fire prevention. emergency medical, emergency rescue, and hazardous materials services to the citizens and their property within its jurisdiction, and to individuals passing through its jurisdiction. WHEREAS, portions of the District's jurisdiction lie within the municipal boundaries of Platteville and Gilcrest, as well as within unincorporated Weld County. WHEREAS, pursuant to Section 32-1-1002(1)(d), CRS, the Districts Board of Directors ("Board") is authorized to adopt and enforce a fire code within the District's jurisdiction, but no such code shall apply within any municipality or the unincorporated portion of any county unless the governing body of such municipality or County adopts a resolution stating that such code shall be adopted within the District's boundaries; WHEREAS, the board hereby finds and determines that it is in the best interest of the residents, taxpayers, and visitors of the District to maintain adequate and updated regulations by means of adopting by reference the 2024 International Fire Code as amended herein for application within the District for the purpose of establishing rules 2025-1756 and standards for the protection of life, health, property, security and welfare of the residents, taxpayers and visitors of the District 1 On and after January 1st 2025 any previously adopted fire code hereby repealed and the 2024 International Fire Code,(IFC) as amended herein, shall be adopted as the Fire Code of the District and the Fire Code shall be administered and enforced within the Distnct by the Fire Chief or his/her authorized representative, as required and provided form the Special Distnct Act, and all other applicable federal, state, or local laws, rules and ordinances, or common law (Applicable Law), 2 The District's Fire Marshall, for the purpose of enforcing the Fire Code on and after the effective date, is an authonzed representative of the Fire chief This section shall not limit the designation of additional authorized representatives if the Fire Chief deems it necessary for the effective enforcement of the Fire Code, 3 Nothing contained in this resolution shall be construed as modifying or limiting in any manner the powers, duties, and responsibilities of the Distnct and the District's Fire Chief, or his/her authorized representative(s), set forth in the Special District Act, or as otherwise provided by applicable laws, 4 The most current version of the NFPA 1, 13, 25, 72, 101, 853, 855 including all chapters and appendices, is hereby adopted with the following amendments 5 The 2024 International Fire Code (IFC), International Building Code 2024 (IBC), and the International Residential Code 2024(IRC) including all chapters and appendices, is hereby adopted with the following amendments 6 The most stringent adopted code shall be followed This includes all NFPA and ICC code(s) and reference material The International Fire Code (IFC) 2024 is adopted in its entirety to include all appendices The amended codes are as follows Chapter 1. Administration. (IFC) Subsection 101.1 is hereby amended to read as follows 101.1 Title. These regulations shall be known as the Fire Code of Platteville Gilcrest Fire Protection District, hereinafter referred to as "this code or the code '' 2 Subsection 105.5.36. is hereby amended to read as follows 105.5.36 Open burning. No such permit shall be required where burning is regulated pursuant to regulations promulgated under 25-7-123 C R S and regulated by the Weld County Health Department or municipal authorities Exception Recreational fires Subsection 105.5.40 is hereby amended to read as follows 105.5.40. Outdoor assembly event. An operational permit is required to conduct an outdoor event where planned attendance exceeds 350 persons Subsection 105.5.42. is hereby amended to read as follows 105.5.42 Plant extraction systems. An operational permit is required to use plant extraction systems Chapter 2. - Defiimtions: Section 202 General Definitions is hereby amended by the following additions Board. Where the term "Board' is used, it shall be held to mean the Board of Directors of the Platteville Gilcrest Fire Protection District District. Wherever the word "District" is used, it shall be held to mean the Platteville Gilcrest Fire Protection District (PGFPD) Jurisdiction. Wherever the word "Junsdiction" is used it shall be held to mean to the inclusive boundaries of the fire protection distract Fire Marshal. Is appointed by the Fire Chief The Fire Marshal shall be the designated fire code official for the District Chapter 3 - General Requirements: Subsection 307 ts hereby amended to read as follows 307 1.1 Prohibited open burning. Open burning shall be prohibited when atmospheric conditions or local circumstances make such fire hazardous Open burning shall be specifically prohibited dunng Red Flag Warnings 3 Exceptions: 1 Prescribed burning for the purpose of reducing the impact of wildland fire when authonzed by the fire code official 2 Agncultural burning that is approved by the Weld County Health Department burn permit process and is conducted in accordance with Colorado Air Quality Control Commission Regulation Number 9 (5 CCR 1001-11) 307.2 is hereby amended to read as follows 307.2 Permit required. A permit shall be obtained from the Weld County Health Department pnor to kindling a fire recognized silvicultural or range or wildlife management practices, or prevention or control of disease or pests Application for such approval shall only be presented by and permits issued to the owner of the land on which the fire is to be kindled 307.2.2 Is added to read as follows 307.2.2 The fire code official shall be able to implement a fire restriction ban when the National Weather Service (NWS) has issued a Fire Weather Watch with high winds and active ground cover fires within the jurisdiction Chapter 5 - Fire Service Features: Subsection 503.2.1 is hereby amended to read as follows 503.2.1 Dimensions. Fire apparatus access roads shall have an unobstructed width of not less than 26 feet, exclusive of shoulders, except for approved secunty gates in accordance with section 503 6, and an unobstructed vertical clearance of not less than 14 feet Section 507.5.5 shall be added to read as follow Section 507.5.5 There shall be a minimum of 20" clearance between the bottom of the nut on the steamer cap and the ground or decorative matenal, thus allowing the free swing of the hydrant wrench, while taking the cap off and ensuring adequate access to make connections with the fire hose 4 Chapter 9 - Fire Protection Systems: Section 901.1 Is hereby amended to read as follows 901.1 Scope. The provisions of this chapter shall specify where fire protection and life safety systems are required and shall apply to the design, installation, inspection, operation, testing and maintenance of all fire protection systems Where requirements of this code and the International Building Code (IBC), National Fire Protection Association (NFPA) are m conflict, the more restrictive shall apply Section 907. Fire Alarm and Detection Systems is hereby amended to read as follows Section 907.2 Paragraph two shall be amended to read as follows Not fewer than one manual fire alarm box shall be provided in an approved location to initiate a fire alarm signal for fire alarm systems employing automatic fire detectors or waterflow detection devices Where other sections of this code allow elimination of fire alarm boxes due to spnnlders, the fire code official may require more fire alarm boxes than a single fire alarm box to be installed for fire and life safety concerns Section 907.5.2 is hereby amended to read as follows 907.5.2 Alarm notification appliances. Alarm notification appliances shall provide full occupant notification throughout the entire building or structure, and shall be designed and installed in accordance with NFPA 72 Alarm notification appliances shall be listed for their purpose Chapter 31 - Tents, Temporary Special Event Structures and Other Membrane Structures 3103.2 Approval Required.
