Home My WebLink About740370.tiff RESOLUTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, heretofore adopted a Uniform Building Code pursuant to law and by resolution, to be the guiding standard for all construction and building in Weld County, Colorado, and WHEREAS, Section 204 of said Uniform Building Code provides for a Board of Appeals to handle interpretation of said code, including determination of permissible alternate materials and methods of con- struction pursuant to said code, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, has investigated and found a need for the creation of such Board of Appeals to interpret the Uniform Building Code as adopted by the Board of County Commissioners of Weld County, Colorado, and to determine the suitability of alternative materials and methods of con- struction for buildings located in Weld County, Colorado, and WHEREAS, the said Board of County Commissioners believes that the creation of such Board of Appeals for the interpretation of the Uniform Building Code and determination of the suitability of alternative materials and methods of construction, will aid the Board of County Commissioners materially in its administration of the Uniform Building Code, and the laws of the State of Colorado, and best serve the interests of the people of Weld County, Colorado; NOW, THEREFORE, BE IT RESOLVED: 1. That there be and hereby is created "THE WELD COUNTY UNIFORM BUILDING CODE BOARD OF APPEALS". 2, That the functions and duties of the Weld County Uniform Building Code Board of Appeals are to determine the suitability of alter- native methods of construction and alternate materials, and to provide reasonable interpretation of the provisions of the Uniform Building Code. 3. That such Board shall consist of five (5) members, who shall be qualified by experience and training to consider and determine matters pertaining to building construction; and that at least three (3) members of said Board shall be engineers and/or architects registered in the State of Colorado, and such other members as may be appointed by the Board of County Commissioners from time to time. 4. That said members of the Board of Appeals shall hold office at the pleasure of the Weld County Board of County Commissioners and shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the building officials with a duplicate copy to the appellant who is appealing an order of the building officials or building department, and a copy to the Weld County Board of County Commissioners. 5, That said Board of Appeals shall consist of five (5) members to be appointed by the Board of County Commissioners of Weld County, Colorado, in the first instance by this resolution, and thereafter as here- inafter provided. 6. That the members of the Weld County Uniform Building Code Board of Appeals for the year 1974, and until their successors shall be / `'6086 740370 appointed as hereinafter provided, shall be: V. D. Einsphahr Jim Robenstein Paul Lundquist Harold G. Evans Richard L. Straub 7. That the following named member of the Weld County Uniform Building Code Board of Appeals shall serve a term of one (1) year during the calendar year of 1974, and until his successor shall have been appointed: V. D. Einsphahr 8. That the following members of the Weld County Uniform Building Code Board of Appeals shall serve a term of two (2) years during the calen- dar years of 1974 and 1975, and until their successors are appointed: Jim Robenstein Paul Lundquist 9. That the following members of the Weld County Uniform Building Code Board of Appeals shall serve a term of three (3) years for the calendar years of 1974, 1975 and 1976, and until their successors are appointed: Harold G. Evans Richard L. Straub 10. That the terms of office of each member of the Weld County Uniform Building Code Board of Appeals after the first appointment afore- said shall be for a term of three (3) years. 11 . In the event of a vacancy among the members of the Weld County Uniform Building Code Board of Appeals, the Weld County Board of County Commissioners shall select a qualified resident of Weld County to fill such vacancy. Any member of the Uniform Building Code Board of Appeals may be removed by the Board of County Commissioners of Weld County upon recommendation to the Board of County Commissioners by members of the Board of Appeals pursuant to its rules and regulations. 12. That the expenses incurred by said Board shall be paid by County warrants upon proper vouchers delivered to the Board of County Commis- sioners of the County of Weld, State of Colorado, as provided by law. 13. That the members of the Uniform Building Code Board of Appeals shall serve without compensation and that the members thereof may be re- moved by the Board of County Commissioners of Weld County for non- performance of duty or misconduct. -2- Approved and adopted this 25th day of September, A.D. , 1974.
