HomeMy WebLinkAbout700016.tiff FINDINGS AND RESOLUTION CONCERNING CHANGE OF ZONE PETITION OF DR. SAM E. WIDNEY The petition of Dr. Sam E. Widney, 2000 16th Street, Greeley, Colorado, requesting a change of zone from "R" Residential District to "M-H" Mobile Home Dist rict, of a parcel of land described as follows, to-wit: Lots 7 and 8 in the Southwest Quarter (SW-1) of South- west Quarter (SW4) of Section 9, Township 5 North, Range 65 West of the 6th P. M. , Weld County, Colorado, containing 10. 00 acres, more or less, came on for hearing on Wednesday, November 30, 1970, at 2:00 o'clock P. M. , and the Board of County Commissioners of the County of Weld, having heard the testimony and evidence adduced upon said hearing, and having considered the testimony, evidence, and recommendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicant failed to sustain the burden of proof as to the need for a change of zone, or that the present zone is erroneous, or that circumstances warrant a change of zone at this time. 2. The evidence shows that the inhabitants of the immediate vicinity of the area sought to be re-zoned and predominately opposed to the change of zone. 3. The evidence discloses that the present zoning is compli- mentary to the surrounding area. 4. The evidence shows that two tracts of land containing 10 acres, more or less, immediately to the west of subject property, have already been zoned "M-H, " and that petitioner has shown no need for this additional area to be re-zoned. 5. That each of the preceding findings in and of themselves, and independent of each other, constitutes a separate and individual ground for denial of the change of zone. RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld, has heard the application of Dr. Sam E. Widney, 2000 16th Street, Greeley, Colorado, for a change of zone from "R" Residential District to "M-H" Mobile Home District, of a tract of land for a proposed mobile home trailer park, said area being more particularly described as follows: Lots 7 and 8 in the Southwest Quarter (SW4) of South- west Quarter (SW+) of Section 9, Township 5 North, Range 65 West of the 6th P. M. , Weld County, Colorado, containing 10. 00 acres, more or less; and 700016 WHEREAS, said Board has made its findings on the evidence and testimony submitted to it, which findings precede this Resolution, and by reference are incorporated herein and made a part hereof, and WHEREAS, the said Board has carefully considered the petition, evidence and testimony and the recommendations of the Weld County Planning Commission, and given the same such weight as it, in its discretion, deems proper, and is now fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED, that the petition of Dr. Sam E. Widney, 2000 16th Street, Greeley, Colorado, requesting a change of zone from "R" Residential District to "M-H" Mobile Home District to locate a mobile home trailer park on the land indicated above, be, and it hereby is denied, upon each of the grounds set forth in the Board's findings therein. We also wish to advise you that we own our own homes and pay our own utilities and taxes. We do not have any more, if as many children as any other group of residents of Weld County. We maintain our homes and our lawn as well or better than many people in the surrounding area and feel we are definitely en- titled to a modern, up-to-date place to live. In many instances the undersigned include a husband and wife both working in order to pay for the necessities above mentioned. We also understand that many of the objectors to the rezoning of the above described property are not legally qualified to object to this develop— ment. Change of Zone - Wic 2 November 30, 1970 Mr. 0ldhausen: I am Dale 0ldhausen, representing Dr. Widney, I live at 1804 Ponderosa Drive, Loveland, Colorado, The property is located on Twentieth Street adjacent to the existing Meadows - The Meadows Park, which Dr. Widney owns, and the park that has 75 units in it. This is right on the east end of the park - it is essentially an expansion of the present park. We have as .he records indicate taken this through the County Planning and the City for their recommendations and their revised and adjusted to meet the necessary requirements. We have 61 units on this plan, we have incorporated play areas, recreations areas, laundry and office facilities and this is directly adjacent to the park and with the intent that it would benefit the park. We also have a separate storage area of designated screening areas around the park. We have tried to p'.an the park as a separate entity and to be as pleasant and as acceptable to the community as possible. It is a typical unit development plan and thereby will have to be put in accordance with the plan that was approved - the plan will be as submitted. The need for mobile homes in the area, as you are all aware of - we wont' belabor that point and we feel the area is suited for and visa versa. We feel that it is important that the existing park have these adjacent to it and the facilities that this will provide. We believe that the area is suited and it is justified for a park in this area, thank you. Mr. Billings: Do you have any comments you would like to make Dr. Wideny? Dr. Widney: I think this would be a definite addition to our present effect park and with the screening/I think it would complete the area involved. Mr. Billings: I note at this time as each one of you speak would you please give your came and address so that in typing the record we know who you are and your address. Would you like to make some comments from the Planning Commission? Mr. Scholl: On our recommendation subject to some approval of the City of Greeley Planning Commission on street alignments - 2-Way streets - these have been taken care of and they are shown on the corrected plan that we have in our file. Marshall Anderson: Are you talking about surface drainage? Mr. Scholl: Right, there storm water drainage. They are providing a retention pond for the storm run-off. Mr. Billings: The City Planning Commission also approved this? Mr. Scholl: Right. Marshall Anderson: Do you feel that the surface drainage for this area is adequate for the area. Mr. Scholl: Yes, they are talking about 24,000 square feet and 18 inches deep in the southeast corner of this property. Marshall Anderson: Along the road? Mr. Scholl: Yes. Marshall Anderson: Is it a sunken park or what is it? Mr. Scholl: Right, they are landscaping it and treating it as a park area. Mr. Billings: Have they made provisions for this drainage - what is the run-off' for this sunken park or whatever it is - when it is full of water. Mr. Scholl: Dale - isn't it a type of evaporation? Mr. 0ldhausen: Yes, we went through the City on this and submitted a complete design on it with run-off and they required a certain minimum area for a certain year storm. We have put this in one area plus we also have some intermediate parks which also pick up some drainage. So we have considerable overdesigned the original requirements. These parks in the center we have developed will also pick up drainage and hold it and evapprate the drain away. There is a proposed storm drain but the City has adjacent to this and at some future date this could be directed in there if it was necessary. By itself it is designed as a separate entity. Mr. Scholl: This is the same type of thing that they required on the Delta Mobile Home Park, Brenckle and Hoffner which is just south of there and they felt because of the expenses of putting in the -l.an;e Ln Zone -Vilaney 4 November 30, 1970 storm sewer at this time that this would be a good interium measure. Mr. Billings; Do you have any more questions, Marsh? Mr. Anderson: Not right now. Mr. Billings: At this time there are a number of people in the room is there a spokesman for the group? Are there any people here in the room who would like to make a statement in favor of this? Kenneth Hungenberq; My address is 605 East Eighteenth Street. I am a part owner in the property that lies directly east of this proposed trailer court. To start with I want to question the drainage provided I have a feeling that sooner there will be a county truck show up digging up my driveway putting in a culvert so the water can flow on over in my direction. Now you Commissioners probably know the whole area there is flat, there is no natural drainage. I feel that we ought have a developer that sometimes that can handle a storm sewer - if it is ever going to grow orderly. I don't think we need trailer courts popping up on every high spot of ground. I don't consider trailer courts what I would call economic progress anyway. I think they got a potential to force the value of our property down and the is the last thing we want of course. Mr. Billings: Your objection mainly is whether adequate drainage has been provided? Mr. Hungenberq: Well 24,000 square feet, that is what I heard wasn't it? Well I wonder what that would be a third of an acre. I was trying to visualize what 24,000 square feet would be. About half an acre- I have seen water in that particular field about half of the way. Maybe it doesn't bother trailer courts they are j$cked. up a ways. But the drainage is what I am concerned about. I know that I lay directly below this piece of ground. Mr. Billings: If there were proper drainage then would you not object to the trailer court - the reason you are objecting to the trailer court is proper drainage? Mr. Hungenberq: I am still objecting. I feel that eventually they will put the property value down in the whole area. Change of Zone W` " 'ey 5 November 30, 1970 Mr. Hungenberg: Now I have heard about other trailer courts that have asked for rezoning and they all have the same idea - that build ponds - well that is going to put our whole little area full of ponds. That doesn't seem like very good planning to me. I suppose it works but I would just as soon see a developer that could give us one large storm tile in there somewhere and someday the rest of us could grow a bit rather than each one of us dig our own little pond. I am opposed to these trailer courts. They mention very few children in a trailer court, they won't crowd our schools any, but I don't think there is anything down in black and white that regulates who comes and who goes. They are free to take in anyone they want, which is at it should be of course, but you do find a lot of homes there, housing units - on a little tiny plot of ground. They can't have too big of a tax base per unit - so I am generally opposed to it altogether. As far as the Weld County Planning Commission,' gees I think they haven't hardly got out there to look - I consider it very poor planning. Mr. Billings: Does someone else care to comment? Earl Wolfe: I live at 412 East Eighteenth, my primary objection is two of course but the main one is that this area out there is zoned for estates and I think that everyone that is living out there now moved out there to have a little bit of privacy and a little bit of ground around them and you know - we wanted to be out in the country a little bit. I don't want to see this taken away and this is what it will amount to sooner or later with this they will just keep moving trailer in there. Like Mr. Hungenberg said the tax isn't going to help us any out there. If there were a few houses on there - if there were 10 houses built out there and there was 3 children that would only increase your school by 30 but if you put 67 trailers in there then and assuming that they let people in there with children well sooner or later we are going to be 100 and some more children. That is my primary objection but I think the people out there feel we should keep this area as estates that was what it was orginally designed for and planned for. That is what we like and we would kind of like to keep our school there - not let it grow so terribly large. I don't believe that the owners or anyone else can control these people Change of Zone Widney 6 November 30, 1970 Mr. Wolfe: that live in these trailers. There is going to be a large number to the south of that and there are a lot of children out there and I am just against it. Mr. Scholl: I have two comments one on the drainage, we - the City indicated that the drainage would be about 65 percent over what was on the farmland and with the information that has been submitted to them I feel that the retention pond that is proposed is adequate if it is built as it was designed and as shown on the plan and the zoning both to the north, south, east and west - I am sorry the west property is all "R" and to the west of where they are proposing the mobile home park is existing mobile home park zoning. So rather than the Estate it is an "R" residential which is smaller lot size than the estate. That was done when they were rezoning the County and it fell in the Delta rezoning study. Mr. Billings: Are there other people who would like to comment? Wellington Farrell: I live at 2128 Bluebell Avenue, I was at the Delta School when they zoned that out there and they told us that it was estates zoning and if it has ever been changed we never heard of it. Mr. Scholl: But the surrounding property in the area is zoned "R" according to our zoning map. Mr. Farrell: Well I understand that the Brenckle place over there has for trailers already been approved/and that is going to put in a lot more and come straight through we are going to be housed in by trailers you can't even see out. You will be if they come the way they figure they will be within 300 feet of our Bluebell Avenue to the west and they don't have any tax base, the way I understand, that is nothing compared with property. The way I understand it, I don't know if I am right or not, they don't pay near the expense for a water tap that we do for one house, even if there are only two people. I think most of our people out there are opposed to trailer houses. Mr. Billings: I don't know what the fees the City would set for a water tap and that sort of thing - I don't know if the fee would be the same as a for a house or a trailer Change of Zone Wide 7 November 30, 1970 depending on how many outlets and the facilities within the trailer but I can't answer your question. Mr. Farrell: We put a water line down there this summer and the new ones that hooked on it cost them right at $1,200.00 a piece and I' ll bet you money that you don't get $1,200.00 for every trailer that is hooked on to the water. Marshall Anderson: Shorty, is that Twentieth Street water line that you are talking about? Mr. Farrell: Yes. Marshall Anderson: Its the new one that gone in there the last 10years Mr. Farrell: Yes. Marshall Anderson: That was orginally a private water line wasn't it? Mr. Farrell: Well it still is - I don't think the City has made it anything the last I heard, so it still belongs to that Delta pipeline or you have to get your taps from private party. Mr. Werkheiser: My name is Werkheiser and as long as you are talking about that you don't know what you are talking about. You just got hooked somebody just stuck you - you can buy taps on that line for $300.00 and there is is $500.00 out of 700 taps can be bought. Mr. Farrell: You don't what you are talking about Mr. Werkheiser: I know about that Mr. Farrell: You can buy them for $180 Mr. Werkheiser: I' ll sell them for $140 Mr. Billings: I don't know if all of you can see this or not this is First Avenue here and Eighteenth Street running here, this area in here is zoned mobile homes, this is the area we are talking about which is part residential at this time and now there are estates up here to the north of that, then the lots over here on First Avenue and Eighteenth Street are business, this is where the sale barn goes to. Then east of the sale barn the area is zone for estates. This south of it is zoned "R" Residential and still further on down it is residential. Audience: Is that part of Balsam Avenue there? Mr Billings: This doean' t show what Avenue it is, this is Lot 1 and 2 in Section 9. Audience: That don't mean anything to me - but its never been changed. Change of Zone Wig y 8 November 30, 1970 Mr. Billings: I am looking for the date on this but it is just a copy of a zoning map. This is the present zoning then right along south of East Twentieth Street over to where it is now it is zoned High Density and then east of that is zoned "R" residential. We are talking about the area between Eighteenth Street and Twentieth Streets and First Avenue. Marshall Anderson: The 10 acres east of the sale barn. Mr. Billings: It will be the 10 acres east of the sale barn is zoned estates or approximately 10 acres which is Section 9 on the southeast corner of Section 9. Mr. Telep: What you are talking about Mr. Chairman is - this area here is southeast - south of East Eighteenth Street and north of East Twentieth Street and all east of First Avenue. Audience: And that is R-1? Between the two is R-1? Wolfe) Mr. Telep: We are talking about all of them because this area is chopped up in Lots and the "B" that was mentioned as being the sale barn is Lots 3 and 4 and to the east of that Lots 1 and 2. There are 10 acres in there and that is zoned estates immediately to the south of the estates is presently zoned residential and this is what we are having this hearing about today. C. E. Johnson: I live on Bluebell Avenue, does residential cover an operation of this sort or does it come under a different heading? Mr. Telep: It comes under a different - you would have to change the zone to mobile homes if they want to put mobile homes in there. Mr. Johnson: Is this land purchased for the express idea of putting mobile homes in it? Mr. Telep: I don't know that is something we can acertain - it has not been answered. Mr. Johnson: In other words what I am trying to get at, if the Doctor has already purchased this with the idea it has to be changed after he buys it - I don't know that is one of the Mr. Telep: Sir that is a question of economics we don't go in to that. Mr. Billings: I might say in regards as to who purchased the land or whether its been purchased there has been no assurance on any change of zone from this Board. There is another gentlemen back who has a list of names that he left on my desk which states, " The following residents petition the Commissioners of Weld County to deny the zoning change reuested for and they 2-159 and it should be Z-159 I would like to enter this into the record. Mr. Telep it is a list of names of the people in the area of those people within the area it looks like according to addresses. Is there anyone else who would like to make any statements? Doris Hood: I live at 420 East Eighteenth Street and I just don't like trailer period. I would really be against them, and that includes 502 East Eighteenth too. 420 East Eighteenth Street and 502 East Eighteenth Street. Mr. Billings: Are there any other comments? Don Kelly: I live at 2003 Bluebell Avenue and I am heard of an instance down here on South Eleventh from one of the fellows, he has had an expensive coat stollen and a dog - south of the trailer houses There is already too many kide out there and no place for the kids to play or anything they are going to be in our irrigation ditches and our corrals and everything else. Its seems as though the law can't stop them we had a farm west of town and tried to irrigate they stole his tubes and got into his ditches, made holes in them so he sold the land and moved out. Mr. Billings: Are there any more comments? Douglas Uyemura: Of 1116 East 20th Street I realize you have to have these places for trailer courts but at least the area I live in is a doctor or I think is just a nice an area as/anyone else.lives in and I don't see any reason it should be flooded with trailer courts. You have got to have this spread out a little bit right now within the last six months or so we have got - the whole section out there - it seems you either want to change the zoning on it or you've got trailers out there Change of Zone Wit v 10 November 30, 1970 I just think if you would - you are doing this and it is pretty poor planning here. You are ruining a pretty nice area. Mr. Billings: How close do you live to this change of zone? Dr. Uyemura: One half mile to three quarters east of there. Mr. Billings: Are there any other comments? Earl Steele: I live at 409 East Eighteenth Street. We live in the midst of this little area zoned estate. Adjoining it immediately and a very short distance of the area to be rezoned. We have a nice neighborhood, nice homes all around us and I think we are pretty much happyi°country people and we moved out there for this purpose so I vote, if I have a vote, not to grant this request or rezoning of the area in question. Mr. Billings: Is there anyone else? Fred Leis: I live at 1017 East Twentieth Street, I have two questions first of all has anyone checked in to how over crowded our school is at the present time and secondly wasn't this brought before the this Commission less than about a year ago? Question as to whether this had been acted on recently. Mr. Billings stated that we would check our records. Mr. Leis: I thought it had been posted - I live out there and have only been there for about two years now and this is twice. To me this is kind of ridculous they pulled this in other section of town, they don't get it the first time, the just keep coming back. The people out there are strictly opposed to it we would like a little congenality. in our thoughts out there. We do have quite a thing at steak all of us put together. Mr. Scholl : On the schools the schools have been notified and we haven't gotten any letter back from them stating their position at all. Mr. Leis: You don't have to read a letter - just drive by there because they built one last year and they built one the year before that ought to answer your question. Change of Zone Wir' y 11 November 30, 1970 Mr. Billings: Are there any other comments? Mr. Wolfe: (?) I have a little wording on the trailers. They have ground ready now there are enough trailers for 175 total and they plan to have those in by the 15th of December by the latest and I was told about it by Mr. Clarkson, the developers out there and they have plans for 600 trailers just south of Twentieth Street, 600. Joanne Weinmeister: I live at 2125 Bluebell Avenue, we moved out there because we liked the area, we do not like to see all the trailer houses out there. Mr. Billings: Is there anyone else who would like to make a comment? At this time I would ask for all of those who are against the approval of this application to raise their hands so we may put this in the record. Against - 25 Let the record show that there are 25 against the request for this change of zone. At this time I would ask for those who are in favor of this change of zone? Let the record show that there are two people here in favor of the change of zone. Are there any more people in favor of the change of zone. Let the record show that there are 3 people here in favor of the change of zone. If we may elaborate on this a little bit not indicating in any which way of the approval or whether we wouldn't. I have been in a number of housing meetings this last few months - someway we are going to have to provide homes for these young people starting out. This Board has set up laws that if we approve of any of these, whether it be this one or any other, we are putting in requirement into these mobile homes which are quite strict and make things as nice or much better than they are at this time, we are requiring curb and gutter and asphalt street, underground utilities and anything which we weren't requiring before. We hope that all of you wouldn't be looking at this mobile home such as some as you see spring up within Weld County the last few years. We realize there is a problem and we have to have some mobile home parks somewhere. We have built in some very stringent requirements on these parks of today it is compatible with what is in the area. Do you have any comments Marshall?
