A public hearing was conducted on September 10, 2025, at 10:00 a.m., with the following
present:
Commissioner Perry L. Buck, Chair
Commissioner Scott K. James, Pro-Tem
Commissioner Jason S. Maxey — Excused
Commissioner Lynette Peppler
Commissioner Kevin D. Ross — Excused
Also present:

The following business was transacted:
I hereby certify that pursuant to a Notice dated August 28, 2025, and duly published
August 30, 2025, in the Greeley Tribune, a public hearing was conducted to consider the
request of the Southeast Weld Fire Protection District, do Tom Beach, for a
Resubdivision, RES24-0013, to vacate dedicated rights -of -way and combine
Lots 25 through 32, Block 5, Town of Roggen, and Roggen Resubdivision No. 1, Lot 1,
to create one (1) parcel. Karin McDougal, Deputy County Attorney, made this a matter of
record.
Molly Wright, Department of Planning Services, presented a brief summary of the
proposal to vacate a portion of Harrison Street right-of-way and combine with Lots 25
through 32, which will result in one (1) lot. She described the sign posting, pointed out the
depiction of the site, and displayed the approval criteria. Ms. Wright entered the favorable
recommendation of the Planning Commission into the record, as written, and displayed
images of the site and surrounding views.
Cathy Tallerico, Lyons Gaddis, PC, represented the applicant. She narrated a short
PowerPoint presentation (Exhibit B) which depicted the location of the site and the
Harrison Street right-of-way, a part of which is the requested vacation.
Commissioner James stated he had no objections.

Glenn Teets, Roggen resident, inquired concerning the Fire District's intended use of the
vacated right-of-way property. Ms. Tallerico shared there are currently no plans, other
than for potential future growth of the Fire District.
The Board reviewed the draft Resolution as presented; however, no changes or
corrections were made.
In response to Chair Buck, Ms. Tallerico, on behalf of the applicant, indicated they have
reviewed, and agreed to abide by, the Conditions of Approval, as presented.
Commissioner James moved to approve the request of the Southeast Weld Fire
Protection District, do Tom Beach, for a Resubdivision, RES24-0013, to vacate
dedicated rights -of -way and combine Lots 25 through 32, Block 5, Town of Roggen, and
Roggen Resubdivision No. 1, Lot 1, to create one (1) parcel, based on the
recommendations of Planning staff, with the Conditions of Approval, as presented. The
motion was seconded by Commissioner Peppier and it carried unanimously. There being
no further discussion, the hearing was completed at 10:10 a.m. (Clerk's Note: Teams

The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Hearing Certification, on motion duly made and seconded, by the following
vote on the 24th day of September, A.D., 2025:
