Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross - Excused Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Maxwell Nader Department of Public Health and Environment Representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a Notice dated December 6, 2024, and duly published December 11, 2024, in the Greeley Tribune, a public hearing was conducted to consider the request of Daniel and Debra Baker, for Minor Subdivision Final Plan, MINF24-0001, for 5 lots with 1-2 (Medium Industrial) Zoning. Karin McDougal, Deputy County Attorney, made this a matter of record. El Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal, and shared the site is currently zoned 1-2 (Medium Industrial), following approval of Change of Zone, COZ20-0007, in 2021. He stated the site is currently used for Dan's Garage, permitted under SPR21-0001, and the Minor Subdivision Sketch Plan was reviewed and finalized by staff and sent to the applicant in May, 2024. He explained the sign posting, and relayed 13 surrounding property owners (SPOs) were sent Notice, and one letter was received back with no concerns. He shared, per the Development Review staff, access will be onto County Road (CR) 46, which is designated on the Weld County Functional Classification map as a paved collector road, and Section 24-5-20 of the Weld County Code, stipulates the internal road shall be paved. He relayed the latest average daily traffic counts 1,638 vehicles per day, with 35% trucks, the 85th percentile speed is 61 mph, the proposed project is anticipated to generate approximately 347 daily weekday trips, 37 a.m. peak hour trips and 39 p.m. peak hour trips. He stated the applicant submitted a Preliminary Drainage Report and Retention Pond design for review, cc 'S P L (DE/Mu ttm /KR) 02/2 I/25 2025-0256 PL2776 Hearing Certification (MINF24-0001) — Daniel and Debra Baker Page 2 a Final Drainage Report is required, and a Grading Permit is required if more than one (1) acre of land is disturbed, during construction. Mr. Nader entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. E Lauren Light, Department of Public Health and Environment, shared the site will be served by the Central Weld Water District, a receipt for purchase of five (5) taps was submitted with the application, commercial septic systems are required to be designed by an Engineer, to serve each lot, and specific details will be reviewed as each business comes in through the Site Plan Review phase. She stated the department has recommended several notes for the plat that relate to water, sewer, and dust control during development. '. Chair Buck reviewed the procedures to follow should this case result in a tie vote, due to four (4) Commissioners being present and Commissioner Ross being excused. E Eric Wernsman represented the applicant, and shared he is available to answer any questions regarding the application. In response to Chair Buck, indicated the applicants had not had contact with any of the Commissioners regarding this case. IEI Commissioner Maxey commented this is a rezoned parcel being split up, and zoning allows for Uses by Right, as well as potential land uses through the Site Plan Review process. In response to Commissioner Maxey, Mr. Wernsman agreed a Site Plan Review process will be performed, and stated any future use would provide mitigation, per staff recommendations, and he agreed the applicants are willing to work with SPOs. El The Board reviewed the Conditions of Approval and Development Standards, and no changes or corrections were made. 1.1 In response to Chair Buck, Mr. Wernsman, on behalf of the applicants, indicated they have reviewed, and agreed to abide by, the Conditions of Approval, as presented. Commissioner Maxey moved to approve the request of Daniel and Debra Baker for Minor Subdivision Final Plan, MINF24-0001, for 5 lots with 1-2 (Medium Industrial) Zoning, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Peppler, and it carried unanimously.
