Resolution Action of the Board Concerning Two -Lot Family Farm Division, FFD24-0048 — JYJY, LLC, c/o James Younger Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the request for Two -Lot Family Farm Division, FFD24-0048, was submitted by JYJY, LLC, c/o James Younger, 4820 County Road 37, Fort Lupton, Colorado 80621, for property which is located on the following described real estate, to -wit: Lot B of Recorded Exemption, RECX18-0063; being part of the N1/2 NW1/4 of Section 7, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado Whereas, at said hearing, the applicant was present, and Whereas, the Board of County Commissioners heard testimony and reviewed all other evidence presented therein, and deemed it advisable to refer the matter back to staff to work with the applicant and further discuss the easements and potential adjustments to the acreage proposed. Z814 The Department of Planning Services staff has reviewed this request and recommends that this request be denied for the following reason: The smaller lot exceeds the maximum lot size for Family Farm Divisions as stated in Section 24-7-20.D: 24-7-20. D. The smaller lot shall not be greater than ten (10) acres net. Narrative: The applicant is proposing to split the parcel with a Family Farm Division and create an approximately 12 - acre Lot A and an approximately 39 -acre Lot B. The proposed Lot A does not comply with Section 24-7-20.D. as it is greater than ten (10) acres which is the maximum size allowed in the Code. The applicant has several Agricultural buildings on the property for birds as well as utility and storage. The applicant would like to separate these buildings from the rest of the property and has stated that the ten (10) acres required by code is insufficient to allow for the layout of these existing buildings. Proposed Lot A is currently served by Well Permit #19161 for livestock use only. Well Permit #82917-F is located on proposed Lot B, and is serving the residence on proposed Lot A. A shared well agreement is a condition of approval if this FFD is approved. Proposed Lot A is served by Septic permit SP -1100013. Proposed Lot B will be served by a properly permitted on -site wastewater treatment systems (OWTS) if a new residence is proposed. Should the Board of County Commissioners approve this request, the Department of Planning Services recommends the following conditions be attached: 1. Prior to recording the plat: A. The applicant shall address the comments from the Division of Water Resources as stated in the referral response dated January 8, 2025. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. B. The applicant shall address the comments from the Town on Lochbuie as stated in the referral response dated January 9, 2025. Evidenoe of such shall be submitted in writing to the Weld County Department of Planning Services. C. The applicant shall satisfy the request from the Weld County School District Re -3J as stated in the referral response dated December 19, 2024. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. D. The application materials indicate that the two lots are proposed to share a common well. Therefore, the applicant shall submit a document providing for shared well operation and maintenance by both parcels of land. The declaration shall be recorded, and the recordation number indicated on the plat. A joint easement agreement shall be indicated on the plat. 2. The draft plat shall be amended as follows: A. The map shall be prepared per Section 24-7-50 of the Weld County Code. B. Each page of the plat shall be titled: Family Farm Division No. FFD24-0048. C. The plat shall include the attached Weld County Plat Notes listed in Section 3 of this document. D. The plat shall bear the certifications shown in Appendix 24-C of the Weld County Code. E. The plat shall contain a historical list of the land division and amendments which resulted in the parent parcel. Reference previous land divisions by case number, reception number and recording date of plat or deed. F. The Family Farm Division lots shall be designated in alphabetical order from smallest to largest in acreage on the plat map and legal description. FFD24-0048 I JYJY, LLC. Page 2 of 5 G. The smaller lot of the Family Farm Division shall not be less than one (1) acre in size if served by a public water source or two and one-half (2.5) acres if served by a water well. H. The larger lot shall not be less than thirty-five (35) acres. I. Show and label all recorded easements and rights -of -way by book and page number or reception number and date. J. Show and label any conflicting boundary evidence such as fences or structures. K. County Road 12 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate and label on the plat the existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. If the existing right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code Section 23-1-90, the required setback is measured from the right-of-way line. This road is maintained by Weld County. L. County Road 37 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a collector road, which requires 80 feet of right-of-way at full buildout. The applicant shall delineate and label on the plat the existing and future right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. If the existing right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code Section 23-1-90, the required setback is measured from the future right-of-way line. This road is maintained by Weld County. M. Show and label all access points for proposed Lots A and B onto CR 12 & CR 37. Include in the label all applicable access types (Agricultural, Residential, and/or Oil & Gas). Development Review will review the access locations as a part of the plat submittal. 3. The following Weld County Plat Notes shall be placed on the plat: 1) The purpose of this Family Farm Division, FFD24-0048, is a one-time only land division to create a separate, buildable lot to support a family farm or ranch. 2) No lot may be amended or divided except in accordance with Chapter 24 of the Weld County Code, as amended. 3) Any future structures or uses on site must obtain the appropriate zoning and building permits. 4) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 5) The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. 6) Any work that may occupy and or encroach upon any County right-of-way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. 7) Access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. 8) The historical flow patterns and runoff amounts will be maintained on Lots A and B of FFD24-0048. 9) This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e., domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet FFD24-0048 I JYJY, LLC. Page 3 of 5 all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. 10) Water service may be obtained from an appropriately permitted well. 11) The parcels are currently not served by a municipal sanitary sewer system. Sewage disposal may be by on -site wastewater treatment systems (OWTS) designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division, and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 12) Activity or use on the surface of the ground over any part of the OWTS must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. 13) All buildings shall comply with the setback from oil and gas wells per Section 23-4-700, as amended. 14) Building permits may be required, for any new construction, set up of manufactured structures, or change of use of existing buildings per Section 29-3-10 of the Weld County Code. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2018 International Building Codes, 2018 International Energy Code, and 2023 National Electrical Code, and Chapter 29 of the Weld County Code. A Building Permit Application must be completed and two (2) complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A Geotechnical Engineering Report, performed by a Colorado registered engineer, shall be required or an Open Hole Inspection. A building permit must be issued prior to the start of construction. 15) Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Facility Fee, County -Wide Road Impact Fee, and Drainage Impact Fee Programs. 16) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested. The legal description on such deed shall include the Lot designation and Family Farm Division number. 17) Prior to the release of building permits on Lot B, the applicant shall submit evidence to the Department of Planning Services the lot has an adequate water supply of sufficient quality, quantity and dependability. 4. Next Steps: Per Section 24-7-50 of the Weld County Code: A. The Family Farm Division revised draft plat shall be submitted once an application is approved. The applicant shall electronically submit the draft plat in PDF format to the Department of Planning Services for Planning and Public Works review. Planning staff will send the draft plat back to the applicant with redline comments to be incorporated in the revised plat. There may be subsequent rounds of review. B. Upon approval of the draft plat and completion of the conditions of approval, the applicant shall submit the signed and notarized approved plat to the Department of Planning Services. The approved plat shall be recorded in the Office of the Weld County Clerk and Recorder by the Department of Planning Services. The approved plat and additional requirements shall be recorded within one hundred twenty (120) days from the date the administrative review was signed or from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fee. FFD24-0048 I JYJY, LLC. Page 4 of 5 5. Enforcement: Per Section 24-7-60 of the Weld County Code: A. If the Family Farm Division plat has not been recorded within one hundred twenty (120) days from the date the Staff Report was administratively signed or the date of approval by the Board of County Commissioners, or if an applicant is unable to meet any of the conditions within one hundred twenty (120) days of approval, the Director of -Planning Services may grant an extension for a period not to exceed one (1) year, for good cause shown, upon a written request by the applicant. If the applicant is unwilling to meet any of the conditions of approval or the extension expires, the application will be forwarded to the Board of County Commissioners for reconsideration. The entire application may be considered for denial by the Board of County Commissioners. Alternatively, the Board of County Commissioners may consider upholding, modifying, or removing the contested conditions of approval. B. The property owner shall comply with the recorded plat notes and lot configuration. Noncompliance may result in locking of the lots and withholding Weld County permits. C. The Board of County Commissioners shall have the power to bring an action to enjoin any subdivider from selling, agreeing to sell or offering to sell subdivided land before a plat for such subdivided land has been approved and recorded per Section 30-28-110(4), C.R.S. 6. Plat Recording Process: Per Section 24-7-40 and Appendix 5-J of the Weld County Code: A. Upon completion of the conditions of approval and acceptance of the plat, the plat may be submitted for recording with the recording fee to the Planner. The plat shall be signed and notarized by the property owners. If approved by the Department of Planning Services, the Planning Director shall sign the plat. If approved by the Board of County Commissioners, the Chair of the Board shall sign the plat. B. The Department of Planning Services shall submit the plat to the Weld County Clerk and Recorder for recording. C. The Family Farm Division is approved and binding the date the plat is recorded with the Weld County Clerk and Recorder. D. Should the plat not be recorded within the required one hundred twenty (120) days from the date the Administrative Review was signed, a $50.00 Recording Continuance fee shall be assessed for each additional three (3) month period that the plat has not been recorded beyond the initial one hundred twenty (120) days. 7. Recording New Deeds: The applicant shall create and record deeds for all the newly created lots; deeds shall include the legal description of each lot and the reception number of the Family Farm Division plat. New deeds are required even if lots will remain under the same ownership. Defects, liens, encumbrances, adverse claims or other matters: (a) created, suffered or agreed to by the Assured;(b) not known to the Company, not recorded in the Public Records as of the Date, but known to the Assured as ofthe Date; or (c) attaching or creating subsequent to the Date. 3. Prosecution of Actions 1. The Company shall have the right at its own costs to institute and prosecute any action or proceeding or do any other act which in its opinion may be necessary or desirable to establish or confirm the matters herein assured; and the Company may take any appropriate action under the terms of this Binder, whether or not it shall be liable thereunder and shall not thereby concede liability or waive any provision hereof. 2 2. In all cases where the Company does not institute and prosecute any action or proceeding, the Assured shall permit the Company to use, at its option, the name of the Assured for this purpose. Whenever requested, by the Company, the Assured shall give the Company all reasonable aid in prosecuting such action or proceeding, and the Company shall reimburse the Assured for any expense so incurred. 4. Notice of Loss - Limitation of Action A statement in writing of any loss or damage for which it is claimed the Company is liable under this Binder shall be furnished to the Company within sixty days after such loss or damage shall have been determined, . . and no right of action shall accrue to the Assured under this Binder until thirty days after such statement shall have been furnished, and no recovery shall be had by the Assured under this Binder unless action shall be commenced thereon with two years after expiration of the thirty day period. Failure to furnish the statement of loss or damage or to commence the action within the time herinbefore specified, shall be conclusive bar against maintenance by the Assured of any action under this Binder. . 5. Option to Pay, Settle or Compromise Claims The Company shall have the option to pay, settle or compromise for or in the name of the Assured any claim which could result in loss to the Assured within the coverage of this Binder, or to pay the full amount of this Binder. Such payment or tender of payment of the full amount of the Binder shall terminate all liability of the Company hereunder. 6. Limitation of Liability - Payment of Loss 1. The liability of the Company under this Binder shall be limitedto the amount of actual loss sustained by the Assured because of reliance upon the assurances herein set forth, but in no event shall the liability exceed the amount of the liability stated on the face page hereof. 2. The Company will pay all costs imposed upon the Assured in litigation carried on by the Company for the Assured, and all costs and attorneys' fees in litigation carried on by the Assured with the written authorization of the Company. 3. No claim for loss or damages shall arise or be maintainable under this Binder (1) if the Company after having received notice of any alleged defect, lien or encumbrance not shown as an Exception or excluded herein removes such defect, lien or encumbrance within a reasonable time after receipt of such notice, or (2) for liability voluntarily assumed by the Assured in settling any claim or suit without written consent of the Company. 4.All payments under this Binder, except for attorney's fees as provided for in paragraph 6(b) thereof, shall reduce the amount of the liability hereunder pro tanto, and no payment shall be made without producing this Binder or an acceptable copy thereof for endorsement of the payment unless the Binder be lost or destroyed, in which case proof of the loss or destruction shall be furnished to the satisfaction of the Company. 5. When liability has been definitely fixed in accordance with the conditions of this Binder, the loss or damage shall be payable within thirty days thereafter. 7. Subrogation Upon Payment or Settlement Whenever the Company shall have settled a claim under this Binder, all right of subrogation shall vest in the Company unaffected by any act of the Assured, and it shall be subrogated to and be entitled to all rights and remedies which the Assured would have had against any person or property in respect to the claim had this Binder not been issued. If the payment does not cover the loss of the Assured, the Company shall be subrogated to the rights and remedies in the proportion which the payment bears to the amount of said loss. The Assured, if requested by the Company, shall transfer to the Company all rights and remedies against any person or property necessary in order to perfect the right of subrogation, and shall permit the Company to use the name of the Assured in any transaction or litigation involving the rights or remedies. 8. Binder Entire Contract 3 Any action or actions or rights of action that the Assured may have or may bring against the Company arising out of the subject matter hereof must be based on the provisions of this Binder. No provision or condition of this Binder can be waived or changed except by a writing endorsed or attached hereto signed by the President, a Vice President, the Secretary, an Assistant Secretary or other validating officer of the Company. 9. Notices.
