Monday, August 4, 2025
The Board of County Commissioners of Weld County, Colorado, met in regular session
in full conformity with the laws of the State of Colorado at the regular place of meeting in
the Weld County Administration Building, Greeley, Colorado, August 4, 2025, at the hour
of 9:00 a.m.
Roll Call: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Perry L. Buck, Chair
Commissioner Scott K. James, Pro-Tem
Commissioner Jason S. Maxey
Commissioner Lynette Peppler— Arrived at 9:03 a.m.
Commissioner Kevin D. Ross
Also present:

Chief Financial Officer, Cheryl Pattelli
Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board
of County Commissioners meeting, as printed. Commissioner James seconded the
motion and it carried unanimously.
1. Minutes from July 21, 2025
Certification of Hearings: Commissioner Maxey moved to approve the below listed
Hearing Certificate. Commissioner James seconded the motion, which carried
unanimously.
1. Refusal to Renew Phase I concerning Tavern (County) Liquor License, pursuant
to Section 12-2-40 of the Weld County Code and §44-3-302(1)(c), C.R.S. —
El Centenario Entertainment, LLC, dba El Centenario Nightclub
Amendments to Agenda: There were no amendments to the Agenda.
Consent Agenda: Commissioner Ross moved to approve the Consent Agenda, as
printed. Commissioner Maxey seconded the motion and it carried unanimously.

(Clerk's Note: Chair Buck indicated Commissioner Peppier was present at 9:03 a.m., and
have the record reflect that all five (5) Commissioners are now present.)
Warrants:
1. General Warrants: Commissioner Ross moved to approve the General Warrants,
as printed. Commissioner James seconded the motion and it carried unanimously.
Bids:
1. Approve Bid #B2500093, House and Accessory Structures Demolition for
1339 South Larimer County Road (LCR) 1 Construction Project — Department
of Public Works: Toby Taylor, Purchasing Department, stated staff recommends
selecting the lowest bidder who met specifications, Custom Excavating and
Grading, LLC, for a total amount of $58,600.00. Commissioner Maxey moved to
approve said bid. The motion was seconded by Commissioner Ross and it carried
unanimously.
New Business — General:
1. Consider Contract ID #9806 Acceptance of Notification of Award Letter, Small
Dollar Grant Award Statement of Work, and Purchase Order Terms and
Conditions for 2025 Emergency Management Performance Grant (EMPG)
Funds, and Authorize Office of Emergency Management to Disburse Funds:
Roy Rudisill, Director of the Office of Emergency Management, stated the County
received funds, in the amount of $73,285.00, used to support various needs of the
Office of Emergency Management (OEM). Commissioner Ross moved to accept
said award letter, statement of work, and purchase order, and authorize the Office
of Emergency Management to disburse funds. The motion was seconded by
Commissioner Peppler and it carried unanimously.
2. Consider Contract ID #9799 Tax Incentive Agreement Pursuant to
C.R.S. §30-11-123 and Authorize Chair to Sign — EcoMod, LLC: Cheryl Pattelli,
Chief Financial Officer and Director of the Department of Finance, stated EcoMod,
LLC, specializes in manufacturing prefabricated housing units by utilizing shipping
containers as their base material. She explained the agreement provides a
personal property tax rebate up to 50% of the amount of personal property taxes
paid by the company for their new facility located in the Town of Hudson, Colorado,
for an estimated amount of $11,817.00, over a period of ten (10) years.
Commissioner James moved to approve said agreement and authorize the Chair
to sign. The motion was seconded by Commissioner Maxey and it carried
unanimously.

New Business — Planning:
1. Consider Certification to Weld County Treasurer of Zoning Violation
Penalties as Special Assessment — Donald Harris and Christina Elam
(Continued from 4/7/2025): Adria Schiel, Assistant County Attorney, reviewed the
long-standing violations of the property, since 2018, indicated the case has been
continued several times to allow Donald Harris and Christina Elam additional time
to bring the property into compliance, with the last date being April 7, 2025, and
now has daily penalties amounting to $12,540.00. She explained a tax lien sale
took place on July 17, 2025, where the property was purchased and conveyed to
Buffalo Plains 22, LLC, and as a result, the County will have to start the Court
proceedings on the property with the new owners. Therefore, Ms. Schiel stated
staff recommends dismissing the violation and not certify said penalties, in the
amount of $12,540.00. Commissioner James moved to dismiss said certification
and declared said civil penalties no longer due or owing. The motion was seconded
by Commissioner Peppler. Commissioner Ross encouraged staff to pursue the
court proceedings with Buffalo Plains 22, LLC, due to the status of the property still
being out of compliance with the Weld County Code. In response to
Commissioners Ross and Maxey, Ms. Schiel clarified the tax lien sale process
which confirms that there is no further opportunity for the former property owners
and the burden now falls on the newly conveyed property owners. There being no
further discussion, the motion carried unanimously.
Public Comment: No public comment was offered.
Let the Minutes reflect that the above and foregoing actions were attested to and
respectfully submitted by the Clerk to the Board. There being no further business, this
meeting was adjourned at 9:11 a.m.
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Minutes, on motion duly made and seconded, by the following vote on the
18th day of August, A.D., 2025:
