In follow up to the notice provided to the County on September 12, 2024, this notice is being provided to advise
you that at a public meeting held on November 13, 2024, and continued on December 11, 2024, the Greater
Brighton Fire Protection District ("District") Board of Directors approved a Resolution establishing a fire impact
fee and adopting an impact fee schedule pursuant to the authority granted under C.R.S. § 32-1-1002(1)(d.5)(l). A
copy of the Resolution is enclosed herewith.
The fire impact fee will be imposed on all new buildings, structures, facilities, or improvements, including oil or
gas wells and related equipment, on previously improved or unimproved real property within the District's
jurisdictional boundaries (collectively, "New Development") for which a completed development permit
application is submitted to the County on or after December 25, 2024.
As provided by C.R.S. § 32-1-1001(1)(d.5)(VI), the County is required to notify the District of the issuance of a
building permit for the construction of New Development within the District's jurisdictional boundaries at the
time of issuance. Please provide all such notices, along with contact information for the developer, to the
District's Contractor Portal at https://brightonfire.org/contractor-portal-login/. The District also would
appreciate receiving notice of the filing of any completed development permit application so that it can connect
with the developer regarding the fire impact fee, and avoid any developer surprise that may result if they are not
apprised of the fire impact fee until after the building permit is issued.

BOARD OF DIRECTORS
GREATER BRIGHTON FIRE PROTECTION DISTRICT
RESOLUTION ESTABLISHING A FIRE IMPACT FEE AND ADOPTING AN IMPACT FEE SCHEDULE
WHEREAS, the Greater Brighton Fire Protection District ("District") is a political subdivision of the State
of Colorado, organized pursuant to the Special District Act, C.R.S. § 32-1-101, et seq., to provide fire protection,
fire prevention, public education, rescue, hazardous materials, ambulance, and emergency medical services to the
citizens and property within its jurisdiction, and to individuals passing through its jurisdiction;
WHEREAS, pursuant to C.R.S. § 32-1-1002(l)(d.5)(I), the District is authorized to receive and spend an
impact fee ("Fire Impact Fee") on the construction of new buildings, structures, facilities, or improvements,
including oil or gas wells and related equipment, on previously improved or unimproved real property within its
jurisdictional boundaries (collectively, "New Development");
WHEREAS, the District obtained an Impact Fee Study dated July 2024, to evaluate the nexus between
New Development within the District's jurisdictional boundaries and the projected impact that such New
Development has on the District's capital facilities ("Nexus Study");
WHEREAS, in accordance with C.R.S. § 32-1-1002(1)(d.5)(II), the Nexus Study quantified the reasonable
impacts of both new residential development and new non-residential development on the District's capital facilities,
and based thereon, the District's Chief Staff recommended an impact fee schedule at levels no greater than necessary
to defray such impacts directly related to the New Development within the District's jurisdiction ("Impact Fee
Schedule"). A copy of the proposed Impact Fee Schedule is attached as Attachment A; and
WHEREAS, the District's Board of Directors has determined it is in the best interests of the District and
the citizens it serves to establish a Fire Impact Fee and approve the attached Impact Fee Schedule.
NOW THEREFORE, be it resolved by the Board of Directors of the Greater Brighton Fire Protection
District that:
1. The Impact Fee Schedule attached as Attachment A is hereby adopted and approved;
2. No developer is required to provide any site -specific dedication or improvement to meet the same
need for capital facilities for which a Fire Impact Fee is imposed pursuant to the Impact Fee Schedule;
3. The District may waive the Fire Impact Fee on the development of low- or moderate -income
housing or affordable employee housing; and
4. The District and a developer may mutually determine whether an "in -kind" contribution may be
made by the developer in lieu of paying all or a portion of a Fire Impact Fee.

Re: Notice Pursuant to SB24-194 of the Greater Brighton Fire Protection District Board
of Directors' Intent to Adopt an Impact Fee Schedule
Dear County Commissioners:
This notice is being provided in accordance with Section 3 of Colorado Senate Bill 24-194, to advise
you that the Greater Brighton Fire Protection District ("District") Board of Directors ("Board")
intends to adopt a resolution establishing an impact fee schedule.
The impact fee schedule that the Board will consider adopting will be established at levels no greater
than necessary to defray the reasonable impacts on the District's existing capital facilities that are
directly related to proposed construction within the District's jurisdiction. Such impact fee levels
have been determined by the District's July 2024 Impact Fee Study conducted by BBC Research &
Consulting. Pursuant to the Impact Fee Study, the maximum fees that may be established as part of
the proposed impact fee schedule are:
Impact Fee per Single Family Residential Unit
Impact Fee per Multifamily Residential Unit
Impact Fee per Square Foot Nonresidential Floor Area

The Board will consider the adoption of the impact fee schedule at a public meeting to be conducted
at 5:30 p.m. on Wednesday, November 13. In accordance with Section 3 of SB24-194, the County has
the opportunity to submit comments regarding the proposed impact fee schedule prior to the public
meeting at which the adoption of the impact fee schedule will be considered. Please direct the
County's comments to the Board at:
