SUBJECT: RES24-0013 - SW Weld Fire Protection District - Revised 2025-07-02
The proposal has been reviewed by Development Review on behalf of the Weld County Department of Public Works
and the Department of Planning Services. Staff comments made during this phase of the application process may
not be all-inclusive as other issues may arise during the remaining application process.
COMMENTS:
Parcel: 130106002006
The project proposes to create: Resubdivision to combine lots, and vacate right-of-way established in the Town of
Roggen plat.
Access for this project will be from: 2nd Street.
ACCESS
Development Review has reviewed the application materials related to access. The proposed draft plat indicates
the applicant will combine parcels 130106002006 and 130106002010 with the platted Harrison Street right-of-way
located east of and adjacent to parcel 130106002006. Per the applicant's questionnaire, this proposed resubdivision
will improve the District's ability to use the available land and enhance future development opportunities for District
facilities.
The proposed combined parcel will use the existing, unpermitted accesses on 2nd Street that are located south of
and adjacent to parcel 130106002010. Per Section 8-14-30, an Access Permit is required for access to Weld County
maintained roadways. The applicant shall contact the Development Review Access Group to inquire about the need
for an access permit. Please refer to Chapter 8 of the Weld County Code for more information regarding access.
ROADS AND RIGHT-OF-WAY
2nd Street is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance
2017-01) as a local road, which requires 60 feet of right-of-way. Pursuant to the definition of setback in the Weld
County Code, Section 23-1-90, the required setback is measured from the right-of-way line. The physical location
of 2nd Street may not be centered in the right-of-way. This road is maintained by Weld County.
Harrison Street (the street south of 2nd Street that aligns with the right-of-way to be vacated) is a gravel road and
is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which
requires 60 feet of right-of-way. Pursuant to the definition of setback in the Weld County Code, Section 23-1-90, the
required setback is measured from the right-of-way line. The physical location of Harrison Street may not be
centered in the right-of-way. This road is maintained by Weld County.
Per Chapter 8, Article 13, Section 8-13-30, a Weld County Right -of -Way Use Permit is required for any project that
will be occupying, constructing or excavating facilities within, and or encroaching upon, any County rights -of -way or
easement. Right -of -Way Use Permit instructions and application can be found at:

VACATION OF RIGHT-OF-WAY
Any vacation of right-of-way associated with this resubdivision shall be in accordance with Section 24-9-90, of the
Weld County Code. Please note that a title commitment is required when vacating right-of-way.
The resubdivision plat shall include the following right-of-way vacation statements:
• Any persons owning dedicated and recorded easements and rights -of -way for the use of the right-of-way
to be vacated by this plat, shall not be affected by the right-of-way vacation.
• Weld County shall retain any mineral interests it may possess in the rights -of -way vacated by this plat.
Rights -of -way vacated by this plat shall in no way affect such mineral interests.
• Existing utilities within any rights -of -way to be vacated by this plat shall be protected.
The resubdivision plat shall provide and delineate a utility easement (at a width specified by the utility owner) for
any existing utility located within any right-of-way to be vacated.
DRAINAGE REQUIREMENTS
This area is within a Non -urbanizing Drainage Area. Non -urbanizing Drainage Areas typically require detention of
stormwater runoff from the 1 -hour, 100 -year storm event falling on the developed site and release of the detained
water at the historic runoff rate of the 1 -hour, 10 -year storm event falling on the undeveloped site having a 2%
impervious value.
In compliance with Section 8-11-45.B.10., of the Weld County Code, the applicant has submitted a Drainage
Narrative meeting the requirements for an exception to stormwater detention. The qualifying exception reads, "In -
fill development parcels with total area less than, or equal to, one (1.0) gross acre."
Historic Flows
The applicant will be required to maintain the historic drainage flows and run-off amounts that exist from the
property.
CONDITIONS OF APPROVAL
The plat shall be amended to delineate the following:
1. Include the following right-of-way vacation notes:
a. Any persons owning dedicated and recorded easements and rights -of -way for the use of the right-of-way
to be vacated by this plat, shall not be affected by the right-of-way vacation. (Development Review)
b. Weld County shall retain any mineral interests it may possess in the right-of-way vacated by this plat. Right-
of-way vacated by this plat shall in no way affect such mineral interests. (Development Review)
c. Any existing utilities within the right-of-way to be vacated by this plat shall be protected. (Development
Review)
2. Include language for the vacated right-of-way in the plat title. (Development Review)
3. Provide and delineate a utility easement (at a width specified by the utility owner) for any existing utility located
within any right-of-way to be vacated. (Development Review)
4. Provide a Board of County Commissioner signature block. (Development Review)

(along with its creating documents) and the physical location of 2nd Street. (Development Review)
6. Harrison Street is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road. Delineate and label on the plat the physical location of the 2nd
Street/Harrison Street intersection. (Development Review)
DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to
Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. Access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or
offsite tracking. (Development Review)
3. The historical flow patterns and stormwater runoff amounts on the site will be maintained on the subject
