HomeMy WebLinkAbout730727.tiff RESOLUTION RE: REGULATING INSTALLATION OF UNDERGROUND UTILITY LINES IN COUNTY ROAD RIGHTS OF WAY. WHEREAS, it has come to the attention of the Board of County Commissioners, Weld County, Colorado, that there has been ex- cessive damage to county road rights of way caused by installations of utility lines, although through no negligence or fault of utility companies, and WHEREAS, the Board has determined that no utility company, regardless of its sincerity or diligence practiced in the installation of its physical facilities within county road rights of way, has been able to return said disturbed right of way to its original condition, and WHEREAS, the Board has further determined that there will be future demands for utility services in the County and that county road rights of way will be additionally burdened with utility lines, thus creating additional maintenance problems for the County, and WHEREAS, the Board believes it to be in the best interests of the County to take all steps and precautions which it considers necessary to impose reasonable uniform fees for use of its County rights of way for utility installations in the County, and WHEREAS, the Board is vested with the authority to issue or withhold permits and to impose conditions upon utility companies relative to installation of their utility lines within county road rights of way. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, and it hereby authorizes and directs the Clerk to the Board to issue permits for installation of utilities within County owned rights of way only after application therefor is properly made and in accordance with uniform fee schedule, marked Exhibit A, copy attached herewith and made a part hereof by reference. BE IT FURTHER RESOLVED, that the aforementioned uniform fee schedule, marked Exhibit A, be and it hereby is adopted and shall be in effect as of 12:00 o'clock noon, July 18, 1973, and shall continue until further order of the Board. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 18th day of July, 1973. For cables (power and communication) less than 1" in diameter - $0. 01 per inch circumference per lineal foot installed in road rights of way. 2. For cables (power and communication) 1" in diameter and greater - $0. 01 per inch diameter per lineal foot installed in road rights of way. 3. For pipelines carrying fluids - $0. 01 per inside diameter inch per lineal foot installed in road rights of way. 4. For non-fluid pipelines - $0. 01 per inside diameter inch per lineal foot installed in road rights of way. 5. For encasements (pipe) - $0. 01 per inside diameter inch per lineal foot installed in road rights of way. 6. For encasements (concrete) - $0. 01 per outside diameter inch of pipe encased per lineal foot installed in road rights of way. 7. For all non ferrous pipelines installed in road rights of way a copper locating wire shall be installed on top of the pipeline with suitable service loops at convenient intervals to facilitate future pipe- line location. The above fee schedule and conditions do not relieve any utility company, its agents, contractors, or personnel of any conditions out- lined, or duties required as specified in the utility permit required. TITLE: Uniform Fee Schedule For The Use Of Road Right-of-Way For Utility I Installation In Weld County, Colorado. REASONS: No utility company, regardless of sincereity or diligence practiced during the installation of their physical plant within road right-of-way has been able to return the right-of-way disturbed to its original condition. The results have been: 1. Countless tons of road gravel lost to settling soils. 2. Many needless hours of extra maintenance. 3. Impassable roads during inclement weather conditions. 4. Public complaints have increased. 5. Traffic has had to be rerouted and roads closed.. . 6. Weld County's Road 8 Bridge departments are primarily responsible for the safe movement of people, goods, and services; not the maintenance of utility trenches. CONCLUSIONS: 1. We fully realize the physical plant of all utilities is going to expand due to the increased population and demand upon services. 2. We also realize that because of these expansions we are going to have additional maintenance problems as the result. 3. We do not intend to bear these additional burdens without compensation for the time, materials, and all resulting extra efforts. 4. We do not wish to penalize any company or individual for the use of road right-of-way. RESULT: The result is the uniform fee for the use of road right-of-way for utility installation in Weld County, Colorado. 1. Dear Sir: We understand that you have been having trouble with some pipeline companies and other utilities as to their method of finishing ditches on county property, and as a result you are proposing a charge on a per-foot basis. We doubt that this would be an equitable way of approaching the problem. We feel under this condition that some of us who do our work properly would be penalized for so doing. We would like to suggest that a more equitable method of approach would be as follows. When a permit is issued for a particular job, require the company to make a deposit which you feel would cover any damages or repairs that you might have to make. Then if the job is not completed to your satisfaction, you would not have to refund the money. If after the job is completed and your inspectors have made their inspection and they find that the job is done to your satisfaction, then at that time you could refund whatever deposit was made. In this way, only those who violate your regulations would be penalized. Rest assured that the Greeley Gas Company will work with the county to the best of their ability as we always have.
