Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, the Board has been presented with an Energy and Mineral Impact Assistance
Fund (EIAF) Program Grant Application for the Construction of a New Keenesburg Grader
Shed, located at 31164 County Road 6 (Tier I — April Cycle) from the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County,
on behalf of the Facilities Department, to the Colorado Department of Local Affairs,
Division of Local Government, with further terms and conditions being as stated in said
application, and
Whereas, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.

In accordance with the Commissioner briefing on March 19, 2025, staff is requesting
the Board submit a Tier 1 DOLA application for a $200,000 Energy Impact Assistance
+Fund (EIAF) grant to leverage taxpayer dollars on the construction of a new
Keenesburg Grader Shed to be located at 31164 Weld County Road 6. The project is
estimated to cost $1,400,000 and if awarded, the grant would allow the Facilities
Department to obtain a qualified contractor through the county's competitive bid
process.
The Tier 2 DOLA application request is for a $1,000,000 Energy Impact Assistance
Fund (EIAF) grant to leverage taxpayer dollars on the construction of a new $15.3
million dollar Motor Pool Complex for the Fleet Department. The new complex will
include construction of a new 16,000 square foot small vehicle maintenance building,
a new 36,000 square foot large vehicle maintenance shop, and renovating the existing
24,000 square foot structure to add a body shop with upfit operations along with
second floor expansion for a more centralized operations center that includes but is
not limited to, parts storage, break room, locker rooms, training facility, and employee
offices. This project supports the Facilities Master Plan, which identified the Motor Pool
Complex as a 2025 high priority improvement for the Facilities Department.
Staff recommends the Board submit both DOLA applications by the April 1, 2025,

The Department of Local Affairs (DOLA) Energy and Mineral Impact Assistance Fund (EIAF) program was created to assist political
subdivisions that are socially and/or economically impacted by the development, processing, or energy conversion of minerals and
mineral fuels. Funds come from the state severance tax on energy and mineral production and from a portion of the states share of
royalties paid to the federal government for mining and drilling of minerals and mineral fuels on federally -owned land. The creation of
the fund is outlined in C.R.S. 34-63-102 (Federal Mineral Lease) and C.R.S. 39-29-110 (Severance). Grant dollars are to be awarded for
the planning, design, construction, maintenance of public facilities. and for the provision of public services by political subdivisions.
Requests in this Cycle 25-07 may be for:
EIAF Tier I: up to $200.000 with a 1:1 match
EIAF Tier II: over $200,001 and up to $1,000,000 with a 1:1 match
Tier I award notifications are anticipated in early June 2025. All other application presentations are scheduled for mid -June 2025, with
funding decisions anticipated mid -July 2025. More information and additional documentation on the EIAF program, including the two

With the growth occurring in many of our 32 municipalities, the location of our existing 2 -bay grader shed building has limited
capacity and has aged beyond effectiveness to help support maintaining the roads impacted by the oil and gas industry. Therefore,
we need to construct a new grader shed building further away from the Keenesburg town limits to better serve our residents and
industry partners.

The purpose of this grant would assist with contracting the construction of a new 4,800 square foot 3 -bay grader shed building
that includes a small office and restrooms. This project will support the Gravel Roads Division improving their maintenance level
of service.

The statutory purpose of the Energy and Mineral Impact Assistance program is to provide financial assistance to political subdivisions
socially or economically impacted by the development, processing or energy conversion of minerals and mineral fuels.

This project is needed because Keenesburg is a low-income disproportionally impacted community with many needs. By
constructing a new grader shed further outside of town, the county can give the existing 2 -bay shed property to the Town for $1
to help them support their community service needs. Weld County has outgrown this shed and the location is in the heart of
Keenesburg.

This project will help support the Town of Keenesburg by offering another building to help assist them with providing town
services to their community. In addition, by constructing a new grader shed in unincorporated Weld County, we can better serve
our residents by increasing our storage capacity to be more responsive to county road maintenance complaints created by heavy
duty oil and gas truck traffic.

The Keenesburg grader shed has been identified in the Facilities 2025 Capital Fund. The Keenesburg grader shed has not been
updated for more than thirty-one years. This project will allow for another 30 -50 years of building life before needing to be re-
evaluated in the future.

This grader shed was deferred to other grader shed locations taking priority due to extreme population growth occurring in the
southwest part of the county.

The Facilities Capital Fund has limited property tax dollars to allocate throughout the many county buildings. The new Facilities
Master Plan will support grader shed replacements that follow a long-term replacement plan.

Weld County does collect a Capital Expansion Impact Fee for unincorporated portions of the county. The impact fee was
reviewed and updated in 2021. For 2025, Weld County is anticipating collecting approximately $225,000 in revenues to
assist with the entire $81M in Capital Fund needs for this year. On average, a single-family dwelling capital expansion impact
fee is $1,573.

Weld County is the #1 oil and gas producing county in the State of Colorado and therefore is the most energy impacted county.
There are 15,828 active wells in the county, which produce 100,507,560 barrels of oil and 776.552.001 million cubic feet (MCF) of
natural gas. The oil and gas industry traffic exists throughout Weld County using both the paved and gravel roads system to access
facilities.
J. RESILIENCY CRITERIA
The Energy and Mineral Impact Assistance Program is required to integrate resilience criteria into the program. By bringing resiliency
considerations into project planning and implementation, projects should be better poised to benefit a number of sectors (economy,
health, infrastructure, etc.), minimize long-term risks, and anticipate or be better prepared to respond to changing conditions faced by
Colorado communities.
For clarification or further guidance on how the Resiliency Criteria can be incorporated into projects, visit the Resiliency Prioritization
Criteria section of the Colorado Resiliency Playbook. The Colorado Resiliency Framework site can also be used to develop a focused

This project was identified in the Facilities Capital Fund Improvement Program. Weld County has eighteen (18) grader shed
buildings located throughout the county. While the existing grader shed is more than thirty-five years old, this project creates
long-term gains for the community because the Town is also pursuing acquisition of the adjacent parcel to the existing grader
shed to improve their long-term community needs.

This project helps support the Town of Keenesburg, which is a low-income disproportionately impacted community. By
essentially donating the existing grader shed building to Keenesburg, it helps support the town in providing services to their
residents, so they are more responsive and not adversely impacted by disasters or other economic stressors.

The State of Colorado requires local governments to adopt Comprehensive (Master) Plans per C.R.S. 30-28-106 (for counties) and
31-23-206 (for municipalities). When funding comprehensive plans, DOLA requires that the following project components be
included in the scope of work:
• An inclusive community outreach and engagement plan to ensure participation from underrepresented groups.
• The plan must assess and address housing needs of current and future residents at all levels of affordability. It must
include locally -appropriate goals, strategies, and actions to promote affordable housing development. This work must use
the best available data (e.g., State Demography Office data or a recent housing needs assessment). When it comes time to
consider implementation strategies, jurisdictions may find the Strong Communities list of Land Use Best Practices helpful
in this work.
• Risks of natural and human -caused hazards to life, property, and public resources, and consideration of their impact to
vulnerable communities. Include goals, strategies, and/or actions to address and mitigate these hazards (must identify and
address all potential hazards as described in the county Hazard Mitigation Plan). Communities may find DOLAs Planning
for Hazards guide helpful in this work.
• In the spirit of the states goal to engage with disproportionately impacted communities (C.R.S. 24-4-109), the plan must
use an environmental justice lens, particularly when it comes to the impacts of hazards, resources, and amenities to
promote equitable outcomes.
• The plan must address the community water supply and water quality goals. Per C.R.S. 31-23-206(1)(d) and 30-28-106(3)
(a)(IV), the community must:
• Consult and coordinate with local water provider(s),
• Include water conservation policies, and
• Identify in the plan water supplies and facilities sufficient to meet public and private infrastructure needs reasonably
anticipated or identified in the planning process.
Within the first six months of receiving the grant, awardees must submit a self -assessment, such as the Colorado Growing Water
Smart: Community Self -Assessment. to include water supply and demand status and trends, existing water conservation and
efficiency goals and policies. Consult the DOLA Land Use and Water Planner before or immediately following award for free
technical assistance.
• The plan must include an action plan that prioritizes actions necessary to implement the plan, creates a timeline for
implementation, and assigns responsibility for actions.
• And, for municipalities only, a plan for three miles outside municipal boundaries, also known as the three mile plan, per
C.R.S. 31-12-105(1)(e)(I).
The department strongly encourages the following:
• Land use code updates: Because the land use code implements a comprehensive plan, a land use code update is strongly
recommended to immediately follow a comprehensive plan update.
• Policies and strategies in the comprehensive plan and land use code to plan for the community's aging demographic.
• Policies and strategies to address energy efficiency, reduce greenhouse gas emissions, and increase the use of renewable
energy sources where applicable.
• Intergovernmental agreement(s) (IGA) with neighboring jurisdiction(s) to cooperatively plan for areas of mutual interest

On behalf of the Town of Keenesburg, I am pleased to express our strong support for Weld County's
application for grant funding through the Colorado Department of Local Affairs (DOLA) for the
construction of a new grader shed near Keenesburg. This project is of great value not only to the County,
but also to the Town of Keenesburg and its residents.
The construction of a new grader shed will allow Weld County- to enhance its operations and
infrastructure maintenance capabilities, ensuring efficient service delivery across the region.
Additionally, this project presents a unique opportunity for the Town of Keenesburg, as we will be able
to obtain the existing grader shed facility and parcel once the new one is built. This transition will enable
the Town to utilize the current facility to expand our ability to provide essential community services,
supporting both our residents and municipal operations.
Acquiring the existing grader shed will allow the Town to improve its service capabilities, including
Public Works operations, equipment storage, and maintenance functions. This additional space is critical
to our ability to continue growing and effectively meet the needs of our community. We appreciate
Weld County's collaboration in making this transition possible and recognize the shared benefits this
project will bring to both the County and the Town.
