The County purchased ROW for the CR 54/13 Roundabout Project which included a rental house and outbuildings. Because of CDOT grant funding associated with the project, the County is responsible for providing relocation assistance to the renter, Robert Lamb. The agreement is for an amount not to exceed $143, 243.50 with the break dawn being $23,000.50 for moving expenses, $6,108.00 for storage expenses, and $1 14,135.00 for either rental assistance or downpayment for a home. The OnBase Contract ID is 9900 for this agreement. The agreement was reviewed by the BOCC in a pass around that was returned on September 3, 2025. All five commissioners approved the request to place the relocation assistance agreement on the BOCC agenda. The County Attorney's office has reviewed the agreement. Public Works has included the cost for the relocation assistance agreement in its 2025 budget. I will attend the BOCC meeting to answer any questions the BOCC may have. Since there is a CDOT grant ($1,419,409) on the project, the County has to use follow the COOT ROW process. Loveland Ready Mix was renting the house and structures to Robert Lamb on a month -to -month basis. Because of the CDOT funding, CDOT is requiring that the County pay relocation assistance to Robert Lamb. The relocation assistance that we are responsible for paying is $23,000.50 for moving expenses, $6,108.00 for storage expenses, and $114,135.00 for either rent payments or a housing downpayment. Mr. Lamb has opted to purchase a property in Potter, Nebraska. The total amount of the agreement is for an amount not to exceed $143,243.50. What options exist for the Board? In order to get CDOT's approval of the project plans and the ROW acquisition, the BOCC could decide to: 1. approve the agreement for relocation assistance 2. request a work session to gather more information. Consequences: Failure to approve the relocation assistance agreement would result in CDOT failing to approve the construction plans and the ROW acquisition for the project. Impacts: If the BOCC decides not to enter into the relocation assistance agreement, the project would have to be constructed without the COOT grant and the County would have to fund the loss of $1,419,409 CDOT grant out of its funds. Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years): Public Works has planned for the relocation assistance for Mr. Lamb in the 2025 budget. Ross Oti AGREEMENT FOR TENANT RELOCATION AND FUNDING BETWEEN ROBERT LAMB AND WELD COUNTY FOR THE WELD COUNTY WCR 54/13 ROUNDABOUT PROJECT This Agreement ("Agreement") made and entered into the s i-rl day of n'jhCY, 2025 by and between Robert Lamb (hereinafter called "Mr. Lamb"), and Wed County (hereinafter called "County") acting by and through the Board of County Commissioners (hereinafter called "BOCC"), for the use and benefit of the Department of Public Works (hereinafter called "Department"). Mr. Lamb and the County (hereinafter called "Parties") hereby agree to the following terms and conditions. RECITALS A. Mr. Lamb previously leased a home at 1339 South Larimer County Road 1 which is located on property owned by Loveland Ready Mix, consisting of approximately 33.40 acres in Johnstown, Colorado adjacent to the WCR 54 and WCR 13 Roundabout Project. B. County purchased the property from Loveland Ready Mix on March 10, 2025. C. Pursuant to The Uniform Relocation Assistance and Real Property Acquisition Act of 1970, as amended, (the "URA") and Colorado Revised Statutes §24-56-101 et seq., County must provide Mr. Lamb with relocation planning and assistance as a result of using federal funding to construct the CR 54/13 Roundabout Project. D. County hired Western States Land Services LLC ("WSLS") to assist Mr. Lamb and to determine the level of relocation assistance required under the URA; E. WSLS determined that Mr. Lamb is entitled to $143,243.50 for relocation assistance which includes $23,000.50 for moving expenses, $6,108.00 for storage expenses, and $114,135.00 for replacement housing payments. F. Authority to enter into this Agreement exists in CRS §33-1-101, §33-1-104, §33-1-105, §33-9-101, §33-9-109, et seq., §33-10-101, §33-10-106, and §33-10-107 and funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance thereof remains available for payment. Required approvals, clearances, and coordination have been accomplished from and with appropriate agencies. Now Therefore, in consideration of the premises and the mutual covenants set forth herein and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows. 1. County Relocation Payment. County will pay Mr. Lamb an amount not to exceed $143,243.50 (the "Relocation Assistance") as needed and required pursuant to the URA and related WSLS "Relocation Determination" attached hereto as Exhibit A. The County has previously paid Mr. Lamb a total of $23,309.70 for moving and storage expenses. An amount not to exceed $114,135.00 will be delivered via wire transfer once the County is notified of a closing date and receives the final closing costs. 2. Use of Relocation Assistance. Mr. Lamb agrees to use the Relocation Assistance as a payment toward the purchase of a permanent home. 3. Board of County Commissioners of Weld County Approval: This Agreement shall not be valid until it is signed by both parties and has been approved by the Board of County Commissioners of Weld County or its designee. 4. Agreement Binding: This writing, together with the exhibits, constitutes the entire Agreement between the parties hereto with respect to the subject matter herein, and shall be binding upon said parties their officers, employees, agents, and assigns and shall inure to the benefit of the respective survivors, heirs, personal representatives, successors and assigns of said parties. 5. No Third Party Beneficiary: It is expressly understood and agreed that the enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties, and nothing in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement. It is the expressed intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this Agreement shall be an incidental beneficiary only. 6. Time of the Essence: Time is of the essence in each and all the provisions of this Agreement. 7. Fund Availability: Financial obligations of the Board of County Commissioners of Weld County payable after the current fiscal year are contingent upon funds for that purpose being appropriated, budgeted and otherwise made available. By execution of this Agreement, County does not warrant that funds will be available to fund this Agreement beyond the current fiscal year. 8. Severability: If any term or condition of this Agreement shall be held to be invalid, illegal, or unenforceable, this Agreement shall be construed and enforced without such provision, to the extent that this Agreement is then capable of execution within the original intent of the parties. 9. Attorney Fees/Legal Costs: In the event of a dispute between County and Mr. Lamb, concerning this Agreement, the parties agree that neither parties shall be liable to or responsible for the payment of attorney fees and/or legal costs incurred by or on behalf of the other party. 10. Governmental Immunity: No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, 2 protections or other provisions, of the Colorado Governmental Immunity Act §§24- 10-101 et seq., as applicable now or hereafter amended. 11. Effective and Termination Dates. The Effective Date of this Agreement is the date upon which all Parties and the BOCC have signed the Agreement. The Termination Date shall be the date upon which Mr. Lamb purchases a new property. 12. Early Termination. The County is entering into this Agreement to comply with the URA. If this Agreement ceases to comply with the URA, the County, in its sole discretion, may terminate this Agreement in whole or in part. The County shall notify Mr. Lamb of such termination, specifying the effective date of the termination and whether it affects all or a portion of this Agreement. 13. Representations and Warranties. Mr. Lamb makes the following representations and warranties with regarding the purchase of the new property : a. Mr. Lamb is not subletting any part of the new property. b. Mr. Lamb does not hold any rights to the property, an option to purchase the Loveland Ready Mix Land or improvements thereon including but not limited to rights of first refusal, option to purchase, etc. c. There are no liens or encumbrances attached to the interest of the County. 14. Tenant Acknowledgement of 3rd Party Payments. Mr. Lamb acknowledges and agrees that the County will reimburse Mr. Lamb for vendors to pack and move their personal property and for housing. County has agreed to pay for full value protection insurance however; Mr. Lamb agrees to look solely to such vendors for any damage or liability incurred from their services and that the County is not liable for damages, if any, resulting from such third party vendors. 15. Notices and Representatives. Notices required to be given hereunder shall be hand delivered with receipt required or sent by certified or registered mail to the representative at the address set forth below. In addition to, but not in lieu of a hard - copy notice, notice also may be sent by e-mail to the e-mail addresses, if any, set forth below. Either Party may designate by written notice substitute addresses or persons to whom such notices shall be sent. Unless otherwise provided herein, all notices shall be effective upon receipt. Limitation of County Liability. Liability for claims for injuries to persons or property arising from the negligence of Weld County, its departments, institutions, agencies, boards, officials, and employees is controlled and limited by the provisions of CRS §24-10-101 et seq. (the CGIA) and CRS §24-30-1501, et seq. (risk management). 3 17. General Provisions a. Captions and Headings. The captions and headings in this Agreement are for convenience of reference only and shall not be used to interpret, define, or limit its provisions. b. Construction Against the Drafter. In the event of an ambiguity in this Agreement, the rule of construction that ambiguities shall be construed against the drafter shall not apply and the Parties hereto shall be treated as equals and no Party shall be treated with favor or disfavor. c. CORA Disclosure. To the extent not prohibited by federal law, this Agreement and the performance measures and standards under CRS §24-106-107, if any, are subject to public release through the Colorado Open Records Act, CRS §24-72-101, et seq. d. Counterparts. This Agreement may be executed in multiple identical original counterparts constituting one Agreement. e. Entire Understanding. This Agreement represents the complete integration of all understandings between the Parties and all prior representations and understandings, oral or written, are merged herein. Prior or contemporaneous additions, deletions, or other changes hereto shall not have any force or affect whatsoever, unless embodied herein. f. Indemnification. Mr. Lamb shall defend, indemnify, save, and hold harmless the County, its employees and agents, against any and all claims, damages, liability and court awards, together with costs, expenses, and attorney fees and related costs, incurred as a result of any act or omission by Mr. Lamb, or its employees, agents, subtenants, or assignees pursuant to the terms of this Agreement; however, the provisions hereof shall not be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protection, or other provisions, of the Colorado Governmental Immunity Act, CRS §24-10-101 et seq., or the Federal Tort Claims Act, 28 U.S.C. 2671 et seq., as applicable, as now or hereafter amended. g. Jurisdiction and Venue. All suits or actions related to this Agreement shall be filed and proceedings held in the State of Colorado and venue shall be in the County in which the Property is located. Venue shall be proper in any county in which the Property is located if it is situate in more than one county. h. Modification. By the Parties. Except as specifically provided in this Agreement, modifications hereof shall not be effective unless agreed to by the Parties in a written amendment hereto, properly executed and approved in accordance with applicable Colorado State Law. 4 ii. By Operation of Law. This Agreement is subject to such modifications as may be required by changes in Federal or Colorado State Law, or their implementing regulations. Any such required modification shall be automatically incorporated as part of this Agreement on the effective date of such change, as if fully set forth herein. i. Survival of Certain Agreement Terms. Notwithstanding anything herein to the contrary, provisions of this Agreement requiring continued performance, compliance, or effect after Closing or termination hereof, shall survive such Closing or termination and shall be enforceable by the County if Mr. Lamb fails to perform or comply as required. j• Taxes. The County is exempt from all federal excise taxes under IRC Chapter 32 (No. 84-730123K) and from all State and local government sales and use taxes under CRS §§39-26-101 et seq. and 201 et seq. Mr. Lamb shall be solely liable for paying such taxes as the State is prohibited from paying or reimbursing Mr. Lamb for such taxes. k. aiver. Waiver of any default under a term, provision, or requirement of this A reement, or any right or remedy hereunder, whether explicitly or by lack of e forcement, shall not be construed or deemed as a waiver of any subsequent default, provision or, requirement, or of any other term, provision, or requirement. WCR 13 and WCR 54 Roundabout Name: Robert Lamb Robert Lamb (Bob) is a 90 -day tenant residing in the dwelling located at 1339 S. CR 1 Johnstown, CO 80534. The property is being purchased by Weld County as a part of the Weld County Road 54 and Weld County Road 13 Roundabout project. Bob has a lease with the landlord and has lived there for 10 years. Bob pays $1,750/month for rent and $600 on utilities. The residence sits on a larger parcel containing approximately 7.75 acres and is currently zoned for Rural Residential (RR2). It has one residential building located at the intersection of WCR 13 and WCR 18. The displacement dwelling is a 3,514 sf. ranch style home built in 1991 with 4 bedrooms, 3 bathrooms, a living room, dining room, kitchen, laundry/mud room and 900 s£ detached garage. The kitchen includes a refrigerator, electric range, dishwasher and a microwave. The exterior includes a fenced yard. Bob lives in the home by himself but does have 40 dogs (large American Bullies) that would require a fenced yard. Bob also has two boats, four sheds, a fifth wheel, and a tractor that he stores on the property. A search for comparable rental replacement properties was conducted, and the best comparable is analyzed below: Comparable: 25060 Genesee Spring Road, Golden, CO 80401 This is a 4,000 sf. Ranch, 3 -bedroom, 4 -bathroom single family home. The kitchen includes a refrigerator, dishwasher, rangeloven, and microwave. This property has a two -car attached garage. This property allows dogs with a refundable pet deposit. Estimated monthly rent not including utilities = $3,600.00 Utilities Estimated to be approximately $253/month for a total cost of $3,853/month The HUD 2024 adjusted home income limits chart for Fort Collins, Colorado (attached) indicated that a single person household is considered low income if they earn less than $66,550, and Greeley, Colorado at $64,150. Bob earns $3,785.00 per month based on his Certification of Total Monthly Gross Household Income fora total of $45,420 Therefore, he does qualify as a Low - Income household. Base monthly rent should be calculated using the lesser of the: Average monthly costs for rent and utilities actually paid at the displacement dwelling; or 30% of the displaced person's average monthly gross household income, if classified as "Low Income" by the HUD annual survey of income limits; or the total amounts designated for shelter and utilities, if the displaced person is receiving welfare assistance from a program that designates these amounts. Using the average monthly costs for rent and utilities at the displacement dwelling, Bob's monthly rent is: $2,350.00/month Since Bob qualifies as "Low Income" according to the HUD annual survey, we should calculate his base monthly rent as 30% of his average monthly gross household income. Gross Monthly Household Income: $3,785.00 $3,785.00 x 30% = $1,135.50 base monthly rent SUMMARY: Monthly cost of comparable $3,853.00 Less the cost of displacement dwelling $1,135.50 $2,717.50 per month x 42 months Total Rent Supplement $114,135.00 The total rent supplement is $114,135.00 if Bob leases a replacement property that is $3,853.00 per month or more. This amount is also eligible for down payment assistance if he chooses to purchase a home. This amount exceeds the statutory limit of $9,570 which puts the Rent Supplement into Housing of Last Resort. Fed. Reg. 24.404 pg. 630. $9,570 for rent differential plus $104,565.00 for housing of last resort totals $114,135.00. Moving expenses: CDOT Form #455 10/B Previous editions are obsolete and may not be used Under 49 CFR 24.301, Bob is eligible for either a residential move (within 50 miles distance), or a self -move by fixed residential payment or actual cost. We enlisted the services of a commercial mover to prepare a move estimate. The result of the move estimate was $15,065.50 for his personal property, $355.00 to move the two boats totaling $710.00, $6,000 to move four sheds, $150.00 plus $5.00/mi to move his tractor, $825.00 to tow his tractor trailer. The total moving costs were $23,000.50. We attempted to gather another estimate, but due to the complexity of the move, we were only able to get one. Several other companies refused the service and therefore would not give a secondary estimate. Estimated Utility Costs: The attached Utility Allowance chart shows the estimated utility costs for the comparable analyzed above. The total estimated utility cost is $253/month. Based on discussions with Bob, it sounds like he is considering continuing to rent a house. COMPARABLE REPLACEMENT DWELLING A dwelling that is decent, safe, sanitary and functionally equivalent to the existing dwelling. The dwelling must be adequate in size to accommodate the displaced person(s) and in a similar neighborhood. It must be available on the private market and within the financial means of the displaced person(s). DECENT, SAFE AND SANITARY (DSS) DWELLING A dwelling that meets all applicable housing and occupancy codes and the following minimum standards: • structurally sound; 2 • weather tight and in good repair; • containing adequate and safe electrical wiring; • safe drinking water; • plumbing, heating and sewage disposal systems - all in proper working order; • adequate in size to accommodate the person and/or family with a functional kitchen area; and • has a separate, fully equipped, ventilated bathroom. DISPLACED PERSON A person who must permanently move or who must move personal property from real property as a direct result of a written Notice of Intent to Acquire or the Initiation of Negotiations for the acquisition of real property for a federal or federal -aid program or project. FINANCIAL MEANS For a homeowner, if a purchase supplement is needed and provided in addition to the acquisition price for your dwelling, then the replacement dwelling is considered to be within your financial means. For a tenant, the monthly rent and estimated average monthly utility cost for a comparable replacement dwelling is considered to be within financial means if, after receiving rental assistance, this amount does not exceed the base monthly rent for the dwelling from which the tenant is displaced. The Agency may need to calculate the base monthly rent using 30% of the displaced tenant's total monthly gross household income, if that income qualifies as low income in accordance with established low income amounts determined by the U.S. Department of Housing and Urban Development (HUD). The Agency will also evaluate the amounts designated for shelter and utilities for a tenant who receives government assistance. The rental assistance payment will be computed using the lesser of the three (rent and average 3 monthly utility cost; or 30% of the total monthly gross household income for a qualified low income tenant; or the total amount designated for shelter and utilities for a tenant receiving government assistance). FUNCTIONALLY EQUIVALENT The term functionally equivalent means that the comparable replacement dwelling performs the same function and provides the same utility as the acquired dwelling. While a comparable replacement dwelling need not possess every feature of the displacement dwelling, the principal features must be present. INITIATION OF NEGOTIATIONS The date on which the Agency delivers or presents to a property owner or their representative the Agency's first written offer of just compensation to purchase real property for a project. NEGOTIATION The process used by acquiring agencies to reach an amicable agreement with a property owner for the acquisition of needed property. An offer is made for the purchase of property in person or by mail, and the offer is discussed with the owner. NOTICE OF ELIGIBILITY FOR RELOCATION ASSISTANCE A written notice furnished to a person to be displaced that establishes eligibility for relocation benefits before the initiation of negotiations to acquire real property for a program or a project. PROGRAM OR PROJECT Any activity or series of activities undertaken by a federal agency or by an Agency using federal financial assistance in any phase of an undertaking in accordance with the federal funding agency guidelines. 4 Residential Relocation Assistance and Advisory Services A relocation agent will contact you and offer relocation assistance and advisory services if it is determined that you are an eligible displaced person. Any individual or family displaced by a federal or federally -assisted program shall be offered relocation assistance services for the purpose of locating a suitable replacement property. Relocation services are provided by qualified staff or contract relocation agents. It is their goal and desire to serve and assist you in any way possible to help you successfully relocate. Your relocation agent is there to help and advise you, so please be sure to make full use of their services. Do not hesitate to ask questions and be sure you fully understand all your rights and benefits. Individuals with disabilities will be provided the assistance needed to locate and move to a replacement dwelling or site. You should notify your relocation agent of any special requirements for assistance. Once the acquisition and relocation process begins for the property that you now occupy, you will receive a notice from your relocation agent giving assurance that you will not have to move for at least 90 days. A final notice to vacate will be issued at least 30 days prior to the date you will be required to move. Residential Assistance A relocation agent will interview you to find out your needs. Relocation services and payments will be explained in accordance with your eligibility. During the initial interview your housing needs and desires will be determined as well as your need for assistance. You will be provided with a current listing of comparable properties. You will also be provided a written determination of the amount of replacement housing payment for which you qualify. 5 If necessary, transportation will be offered to inspect replacement housing. Your relocation agent will provide information or help you get assistance from other sources as a means of minimizing hardships in adjusting to your new location. You will not be required to move unless at least one comparable decent, safe, and sanitary (DSS) replacement dwelling is made available to you. Please do not sign a sales contract or lease agreement for a new home until your relocation agent has inspected it and assured that it meets DSS standards. Region 1 U.S. Hwy. 6 Clear Creek Canyon: rock fall mitigation 6 Residential Relocation Payment Program The Relocation Payment Program is designed to help pay the expenses encountered in relocating. Two different kinds of payments are involved: 1. Moving Expenses Most owners and tenants of homes or mobile homes displaced by a project will be eligible to receive payment for their actual and reasonable expenses in moving themselves and their family, or their personal property. 2. Replacement Housing Payments a. Replacement Housing Supplements Home -owner occupants who are unable to purchase comparable replacement housing at price levels equal to what they received from the Agency for their home may be eligible to receive a Supplemental Payment. b. Rent Assistance Program Tenants and owner -occupants of residential units who are unable to rent comparable residential units at price levels equal to the rent they are paying at the time they move may be eligible to receive a Supplemental Payment. 7 Relocation Payments Not Considered Income You do not have to pay income taxes on relocation payments. Relocation payments for displaced persons are not considered as income for the purpose of the Internal Revenue Code of 1954, which has been re -designated as the Internal Revenue Code of 1986 (Title 26, US Code). No relocation payment received will be considered income for the purposes of determining eligibility or the extent of eligibility of any person for assistance under the Social Security Act (42 US Code 301 et seq.) or any other federal law, except for any federal law providing low income housing assistance. The following pages explain these payments in greater detail. If you have any questions not covered here, please ask your relocation agent. 8 Residential Moving Cost Reimbursement The Agency will reimburse the actual, reasonable and necessary costs incurred to move persons or personal property from property that has been acquired for a transportation program or project. With the Agency's prior approval, you may receive payment for other related costs, such as transportation to the new location, moving insurance, and storage of personal property. Displaced persons may choose to use a "Commercial Mover" or perform one of two available "Self Move" options. Regardless of which option you choose, be sure to discuss it with your relocation agent. Commercial Mover You may hire a commercial moving company to handle the entire move. An inventory of all personal property must be taken before the move begins (pre -inventory) and after the move is complete (post -inventory). You must sign the inventory certifying that it is true and correct. Move estimates must be obtained. Based on the complexity of a move the Agency will require one or two estimates. In cases where two estimates are obtained, reimbursement will be limited to the amount of the lower bid. You may choose a mover other than the one with the lower estimate, but the Agency's reimbursement payment will be based on the lower estimate. Other related costs incurred during your move that were not considered within the estimate may be reimbursed if approved by the Agency. You must show proof of these costs by saving all receipts and other documentation to submit when you file a claim with the Agency. Also, in this brochure there is a listing of eligible and ineligible moving expenses for your review. Your relocation agent can explain these to you. Self Move Option 1 - Fixed Move Cost Schedule The schedule is a pre -calculated moving expense determination, developed by the Federal Highway Administration, based on the number of rooms of personal 9 property that must be moved The Agency may allow an increase in a room count when a room contains sufficient items to constitute an additional room The reimbursement amount will be based on the number of rooms in your current dwelling. The payment for the self -move will be the lesser of the move cost estimate or the documented 'actual expenses incurred. Pre -move and post -move inventories must be taken and 10 signed by you and the relocation agent. Note: If the occupants of the residence are not displaced, but there is personal property in the area being acquired that must be moved, the move cost may be reimbursed based only on self documented expenses or either a commercial estimate or the Agency's estimate. Reimbursable Moving Costs The following move expenses may be reimbursable if they are the actual, reasonable, and necessary moving costs incurred when using a commercial moving company, or performing a self -move based on the actual, documented expenses: • Transporting residential displacees and personal property for a distance of no more than 50 miles to the replacement site (in special circumstances the Agency may approve a move of more than 50 miles); • Packing, crating, unpacking, and uncrating of the personal property; • Disconnecting, dismantling, removing, reassembling, and reinstalling household appliances and other personal property; • Storage of personal property for up to twelve (12) months at the Agency's discretion, if immediate occupancy of the replacement site is not possible through no fault of the displaced owner or tenant; • Insurance for the replacement value of the property in connection with the commercial move; • Actual, reasonable costs of meals and lodging when determined necessary by the Agency when immediate occupancy of the replacement dwelling is not possible; and • Other moving related expenses as determined by the Agency. 11 Non -Reimbursable Moving Costs ® Cost of moving structures, improvements, or other real property purchased by the Agency, but retained by the displaced person; ® Interest on loans to cover moving expenses, • Personal injury; • Any legal fee or other cost for preparing a claim for a relocation payment or for legal representation during a relocation appeal, • Expenses for searching for a replacement dwelling, • Costs of storage of personal property on real property already owned or leased by the displaced person, and Refundable utility and security deposits 12 Replacement Housing Pad menu Replacement Housing Payments are separated into three basic types: 1) Purchase Supplement 2) Rent Supplement, and 3) Down Payment Supplement. The type of payment depends on whether you are an owner or a tenant, and how long you have lived in the property being acquired prior to the initiation of negotiations. To be eligible for any of the payments described in this section, you must occupy a replacement dwelling within one year of vacating the dwelling acquired by the Agency for the program or project. Before making a commitment to purchase or rent a dwelling, ask your relocation agent to do a housing inspection to ensure the replacement dwelling is decent, safe and sanitary (DSS). Owners and tenants of mobile homes, with some limitations, qualify for the same basic entitlements as persons displaced from conventional dwellings. Replacement Housing Payments are explained below: Owner -Occupants Owners who have occupied the residence to be acquired for at least 90 days before the initiation of negotiations may be eligible for the following payments: 1) Purchase Supplement If you elect to purchase replacement housing, you may receive payment of up to $31,000 for all costs necessary to purchase a comparable replacement dwelling. The total amount of this payment must be applied towards the purchase of a decent, safe and sanitary replacement dwelling. 13 a. Price Differential Payment - This payment is for the difference, if any, between the acquisition price paid for the acquired dwelling vs. the reasonable cost to purchase a comparable replacement, or the actual cost of the replacement dwelling, whichever is less. Before you move, your relocation agent must determine the reasonable cost of purchasing a comparable dwelling and notify you of this amount. b. Increased Mortgage Interest Costs - You may be reimbursed for increased mortgage interest costs if the interest rate on your new mortgage exceeds that of your present mortgage. c. Incidental Expense Payment - This payment is to reimburse you for the necessary and reasonable costs actually incurred by you incidental to the purchase of your replacement dwelling, and which are customarily paid by the buyer, including closing costs, fees for title search/insurance, fees (recording, lender, appraisal, loan origination, etc.), and other related costs, but not prepaid expenses for taxes or insurance. 2) Rent Supplement If you elect to rent replacement housing, you may receive a rent supplement payment if the rental rate of your replacement dwelling exceeds the fair market rental rate of the acquired dwelling. The amount of this payment is limited to X7,200, the amount of the eligible purchase supplement as computed under (1) of this section, or the actual difference in base monthly rent due for the period of 42 months, whichever is less. Tenants and Other Occupants Tenants who have occupied the dwelling to be acquired for at least 90 days prior to the initiation of negotiations may be eligible for the following payments: 2) Rent Supplement If you elect to rent replacement housing, you may receive payment of up to $7,200. The payment, if any, is 14 determined by subtracting the base monthly rent paid at the acquired dwelling (talk to your agent about this calculation) from the lesser of either: a. the reasonable cost of renting a comparable DSS replacement dwelling (rent + estimated average utilities) or: b. the actual DSS replacement rent + estimated average utilities If the result of this calculation is more than $-0-, the Rent Supplement Payment = Calculated Monthly Differential x 42 (not to exceed $7,200). Before you move, your relocation agent must determine the reasonable cost of renting a comparable dwelling and notify you of this amount. 3) Down -payment Supplement If you elect to purchase replacement housing instead of renting, you may receive a payment of at least the amount computed under (1) above, or, at the Agency's discretion, an amount up to $7,200 towards the purchase of replacement housing. The total amount of the payment must be applied to the purchase and/or related incidental expenses of a decent, safe and sanitary replacement dwelling. Payment may be made to an escrow account prior to closure of the loan provided the loan agency agrees to return the payment should the sale not be consummated. Housing of Last Resort When such housing cannot be provided under the provisions for replacement housing payments, the Uniform Act provides for Housing of Last Resort. Housing of Last Resort involves the use of payments in excess of statutory maximums or the use of other unusual methods of providing comparable housing. Your relocation agent can explain this process. 15 a I You should file a relocation claim as soon as possible after the move and expenses have been incurred. The relocation agent will assist you with additional information, provide advisory services and provide the necessary forms and assistance for you to file a claim. If you are an owner you are allowed up to 18 months from the date that you move or 18 months from the date of the final acquisition payment, to file your claim for moving expenses. However, you are encouraged to submit your claim as soon as possible. You should receive payment within 30 days after your claim is approved. Right to Appeal You may file a written appeal with the Agency if you believe that the Agency has failed to properly determine eligibility for, or the amount of, a relocation payment. Payment limitations that have statutory maximums such as site search expenses or reestablishment expenses cannot be appealed. If you submit an appeal, you will be given a prompt and full opportunity to be heard. You will also have the right to be represented by legal counsel or other representation in connection with the appeal, but solely at your own expense. Your relocation agent will provide assistance as needed in completing the appeal form and will explain the appeal process to you. A written appeal must be submitted to the relocation agent, and the Agency will conduct an informal review of the case. Estimate for 50 mile radius is $355.00 per unit. He has not found a new long term rental that he liked. 12/05/24 Holly Allen and Stephanie Bruan completed two DSS checks on two comparable rentals for a replacement dwelling. 12/11/24 I called Bob and let him know that I had submitted a relocation determination to CDOT and I would let him know as soon as I knew what the next steps were. Bob let me know that he has moved Y. of his dogs to a boarding facility which he is renting, and he plans to move into his camper until he gets things figured out. I called him back but was unable to connect with him. 12/19/24 Bob called me back and we discussed in detail the steps that I had to follow to submit a relo determination. I explained that I had to find a comparable rental that was fitting in both size of lot and dwelling and I was having a hard time finding any that would stay online long enough to finalize and submit a relo determination. I explained how he would be given a portion of the determination for moving costs and that he would either have to use the companies that we found the estimates with, or he could do the moving himself, but he would have to keep strict receipts showing his expenses that we could turn in for reimbursement. 1/2/25 Bob sent me a text message and asked if we had made any progress yet. I replied and let him know that I am still hung up on finding an available comparable. 1/8/25 Bob called me and left me a voicemail saying he needed to talk this out and get something moving. I called Bob back and he let me know that he was getting desperate and couldn't afford the way he was living any longer. He said he had a powerful rich friend that would front him the money but he had to be sure he could pay him back. I let him know that there are rules and regulations that we must follow and there was not a whole lot I could do to move this faster. He said, "I don't mean this as a threat, but if I borrow this money and can't pay it back, he'll be coming for it and it won't be from me." I told Bob that I could not tell him what to do, but that if he decides to take the money that is his business and on him. I told him that since he hasn't gotten his 90 day notice, he doesn't have to be out of his original rental yet, so that was his decision to move half out. He explained that he doesn't think he can move all of his stuff in 90 days, and he thinks the mover underestimated how much it will take to move his stuff. I reiterated to Bob that I cannot tell him how much he will get as there is not an approved determination. I also reiterated to Bob that this is not a money making thing. I explained that he will have to use it or he won't get it. I also explained that he must be in a DSS dwelling within a year to receive the benefits.
