Resolution Approve Acceptance of Quit Claim Deed for Transfer of Land Under West 30 Feet of County Road 35, and North 30 Feet of County Road 46 Public Road Rights-of-Way Adjacent to Minor Subdivision Final Plan, MINF24-0001 - Daniel and Debra Baker Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with a Quit Claim Deed for the transfer of land under the west 30 feet of County Road 35, and the north 30 feet of County Road 46 public road rights-of-way adjacent to Minor Subdivision Final Plan, MINF24-0001, to the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Planning Services, from Daniel and Debra Baker, with further terms and conditions being as stated in said deed, and Whereas, after review, the Board deems it advisable to approve and accept said deed, a copy of which is attached hereto and incorporated herein by reference. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Quit Claim Deed for the transfer of land under the west 30 feet of County Road 35, and the north 30 feet of County Road 46 public road rights-of-way adjacent to Minor Subdivision Final Plan, MINF24-0001, to the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Planning Services, from Daniel and Debra Baker, be, and hereby is, approved and accepted. From: Maxwell Nader, Planning Manager E 4 Date: October 17, 2025 COUNTY, CO Re: Acceptance of ROW associated with MINF24-0001 Purpose The purpose of this memo is to request formal acceptance by the Board of County Commissioners of the transfer by deed of the land under the west 30 feet of the right-of-way (ROW) of WCR 35 and land under the north 30 feet of right-of-way (ROW) of WCR 46, both being adjacent to MINF24-0001. Background The Applicants want the lots in MINF24-0001 to end at the west right-of-way line for WCR 35 and the north right-of-way line for WCR 46, instead of at the centerline (Section Line). That would leave the property under the WCR 35 and WCR 46 ROW to the west and north of the centerline still owned by the Applicant. The Applicant does not wish to continue to be taxed for that property. Therefore, to avoid such taxation, the Applicant is willing to transfer the ROW by deed to Weld County free of charge.
