The 179 D tax deduction is a program that enables building owners to claim a tax deduction for installing qualifying systems in buildings. If the system is installed on federal, state, or local government property, the 179 D tax deduction may be taken by the person responsible for the system's design. To qualify G2 Consulting Engineers for the credit the AGBI Group needs the attached form allocating the 179D tax credit to G2 Consulting Engineers signed by the building owner, the chairman of the board, and be allowed to inspect the two projects designed by the G2 Consulting Engineers. What options exist for the Board? (include consequences, impacts, costs, etc. of options): Sign the documents allocating the 179 D tax credit for G2 Consulting Engineers work on the Weld County Health Department and Weld County North Jail projects and allow the AGBi Group to inspect the projects designed by G2 Consulting Engineers. Recommendation: We recommend singing the certification and allowing the walk through of the county facilities. The intent of the tax code is to incentivize energy efficient construction and upgrades to the interior lighting systems, HVAC and hot water systems, or building envelope systems of commercial buildings in the United States. In the case of government owned buildings, !RC §1790(d)(4) and Notice 2008-40 provides guidance for government building owners to allocate the 179D deduction to designers. A designer is a person that creates the technical specifications for the installation of energy efficient commercial building property.
