HomeMy WebLinkAbout20250845.tiffResolution Approve Memorandum of Understanding for Child Welfare Student Referral Information for Rebalance Program and Authorize Chair to Sign — Northern Colorado Youth for Christ Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with a Memorandum of Understanding for Child Welfare Student Referral Information for the Rebalance Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Northern Colorado Youth for Christ, commencing March 1, 2025, with further terms and conditions being as stated in said memorandum of understanding, and Whereas, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding for Child Welfare Student Referral Information for the Rebalance Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Northern Colorado Youth for Christ, be, and hereby is, approved. Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign said memorandum of understanding. The information shared will assist in building collaboration with the Department, NCYC, and Greeley School District 6, and assist with maximizing program funding for youth who are in need of services. The term of this MOU is March 1, 2025 and will remain in effect until either party terminates the agreement as outlined in the agreement. The MOU has been reviewed and approved by Legal (B. Howell). What options exist for the Board? Approval of the MOU with NCYC. Deny approval of the MOU with NCYC. Consequences: The Department will not be able to access shared information regarding NCYC Rebalance program referrals. Impacts: School District and Department funding will not be maximized for youth in need of services. Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years): • Funded through Child Welfare Core Funding • Cost: The Core Services contracted rate for the Rebalance program will be paid for children that are approved by the Department. Ross SUDDort Recommendation Place on BOCC Agenda -371/1 Pass -Around Memorandum; March 18, 2025 - CMS ID 9227 S edul Work Session Other/Comments: MEMORANDUM OF UNDERSTANDING BETWEEN THE WELD COUNTY DEPARTMENT OF HUMAN SERVICES AND NORTHERN COLORADO YOUTH FOR CHRIST th THIS MEMORANDUM OF UNDERSTANDING is entered into this ZED day of Mr vein , 2025, by and between the Board of County Commissioners, on behalf of the Weld County Department of Human Services, hereinafter referred to as "Department," Northern Colorado Youth for Christ hereinafter referred to as "NCYC". Purpose The purpose of this Memorandum of Understanding (MOU) is to share information regarding youth who have been referred to the NCYC Rebalance program by the Greeley/Evans School District 6 and who may have open assessments and/or cases with the Department. The information shared will assist in building collaboration with the Department, NCYC, and Greeley School District 6 and assist with maximizing program funding for youth who are in need of these services. Term of this Memorandum of Understanding This Memorandum of Understanding CMOU" or "Agreement") shall be effective beginning March 1, 2025, and will remain in effect until either party terminates the agreement as outlined below. NCYC Roles and Responsibilities 1. NCYC will share with the Department the following information received from Greeley/Evans School District 6: a. Directory of Information b. Student first and last name c. Student date of birth d. Student place of birth e. Student photo f. Student contact information as needed 2. Student information will be sent by the Rebalance Program Director or designee via email to the Department's Clinical Care Unit at(HS-CWServiceReferral(a�weld.gov). Emails may be followed up by phone call to Department staff. 3. If it is determined that the student has an open assessment and/or case with the Weld County Child Welfare and/or Prevention Divisions, NCYC will work with the Department to ensure that student's participation in the Rebalance program is funded through Weld County Core Services funding. 4. NCYC will abide by all terms and conditions for students that are deemed eligible for Core Services funding as outlined in the executed Professional Service Agreement for the Rebalance program. 5. For students who are approved for the Core Services funded Rebalance program, NCYC will share updates and progress with the assigned Department caseworker and/or prevention worker, and the Department's Clinical Care Unit. Department Roles and Responsibilities 1. The Department's Clinical Care Unit will receive shared student information from NCYC via email. 2. The Department will determine if the shared information is for a student who has an open assessment and/or case with the Department's Child Welfare and/or Prevention Divisions within one week of receiving student information from NCYC. 3. If it is determined that the student has an open assessment or case with the Department, the Department will become the funding source for the Rebalance program through the Core Services program for that identified student. 4. The Department's Clinical Care Unit will coordinate with the assigned caseworker and/or prevention worker to submit a service referral to NCYC, as outlined within the terms and conditions of the executed Professional Services Agreement for the Rebalance program. General Provisions The parties agree to comply with the applicable standards, implementation specifications, and requirements regarding protected health information (PHI), as defined by the Health Insurance Portability and Accountability Act (HIPAA) and outlined within the Code of Federal Regulations, 45 CFR 164.302 through 164.318. Modifications. This Agreement may be modified in writing, in whole or in part, upon approval of the signers. Termination. This Agreement may be terminated at any time by either party giving thirty (30) days written notice to the signers. No portion of this MOU shall be deemed to create an obligation on the part of the County of Weld, State of Colorado, to expend funds not otherwise appropriated, as this MOU is subject to the availabilky of funding. Therefore, the Department may terminate this MOU at any time if the source of funding for the services made available to NCYC is no longer available to the Department, or for any other reason. NCYC reserves the right to suspend services to clients if funding is no longer available. Entire Agreement. This MOU contains the entire agreement and understanding between the parties with respect to the subject matter hereof and may not be changed or modified except as stated herein. This MOU shall be binding upon the parties hereto, their successors, heirs, legal representatives, and assigns. NCYC and the Department may not assign any of its rights or obligations hereunder without the prior consent of both parties. No Third -Party Beneficiary. It is expressly understood and agreed that the enforcement of the terms and conditions of this MOU, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any claim or right of action whatsoever by any other person not included in this MOU. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this MOU shall be an incidental beneficiary only. Governmental Immunity. No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other provisions, of the Colorado Governmental Immunity Act §§24-10-101 et seq., as applicable now or hereafter amended. Independent Contractor. NCYC agrees that it is an Independent Contractor and that NCYC officers, agents or employees will not become employees of the Department, nor entitled to any employee benefits from the Department as a result of the execution of this MOU. NCYC shall perform its duties hereunder as an Independent Contractor. NCYC shall be solely responsible for its acts and those of its agents and employees for all acts performed pursuant to this MOU. NCYC, its employees and agents are not entitled to unemployment insurance or workers' compensation benefits through the Department and the Department shall not pay for or otherwise provide such coverage for NCYC or any of its agents or employees. Unemployment insurance benefits will be available to NCYC and its employees and agents only if such coverage is made available by NCYC or a third party. NCYC shall pay when due all applicable employment taxes and income taxes and local head taxes (if applicable) incurred pursuant to this MOU. Severabilitv. If any term or condition of this MOU shall be held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, this MOU shall be construed and enforced without such provision, to the extent that this MOU is then capable of execution within the original intent of the parties.
