USE BY SPECIAL REVIEW PLANNING QUESTIONNAIRE
1. Explain the proposed use and business name.
ENGIE Development, LLC is proposing to construct and operate the Keenesburg Solar Project
(Project) in Weld County on Parcel ID number 121536200006. The Project will include an
approximately 7.2-MWac capacity photovoltaic (PV) array and will be constructed on approximately
194 -acre parcel (42 acres of leased area) of private land owned by MCBC. The PV panels will be
installed on a single -axis tracker racking system, and additional site alterations will include
perimeter fencing, a gravel access drive, and concrete pads to support electrical equipment. The
Project site has previously been used as a coal mine and has since been reclaimed per permits issued
by Weld County, the Division of Reclamation & Mine Safety, and the CDPHE.
2. Explain the need for the proposed use.
A mix of energy sources is required to ensure long-term energy security for the United States.
Community -level solar projects such as Keenesburg Solar contribute to this mix and provide locally
generated energy to the electrical grid.
3. Describe the current and previous use of the land.
The area containing the Project is privately owned and located within the Weld County Agricultural
"A" Zone District. The Project area has previously been used for mining and oil and gas extraction.
There are a total of six oil and gas wells within the Project area, and all are plugged and abandoned.
4. Describe the proximity of the proposed use to residences.
The nearest residence is located approximately 5 miles south of the Project area.
5. Describe the surrounding land uses of the site and how the proposed use is compatible with them.
The surrounding land is primarily non-residential and commercially zoned. The Project will continue
the commercial use of the property and is compatible with the rural surroundings. The Project will
have minimal sound and noise impacts, and ENGIE will be planting a native seed mixture to support
the soil health of the site.
d. Describe the hours and days of operation.
Construction will take place Monday through Friday from 7:00 AM to 5:00 PM. After construction
is completed, occasional maintenance will occur up to four times per year between 7:00 AM and
7:00 PM as needed for ongoing operations and maintenance. Deviations from this schedule could be
approved on a case -by -case basis to support project needs accordingly.
7. Describe the number of employees including full-time, part-time and contractors. If shift work is
proposed, detail number of employees, schedule, and duration of shifts.
Construction may require up to 50 workers to be onsite at one time during the peak of construction.
Construction typically requires multiple trades including civil, electrical, mechanical, site
management, safety, etc. The number of onsite personnel varies throughout the construction
lifecycle with typical projects averaging 40-50 onsite crewmembers at any given time. During
operations, two to four employees may be needed for maintenance, up to four times per year for
regular maintenance and other times, as needed.
8. Describe the maximum number of users, patrons, members, buyers, or other visitors that the site will
accommodate at any one time.
No users, patrons, members, buyers, or other visitors are expected to be on the site at any time.
9. List the types and maximum numbers of animals to be on the site at any one time (for dairies,
livestock confinement operations, kennels, etc.).
No animals are expected to be on the site at any time.
10. List the types and number of operating and processing equipment.
There will be approximately 58 inverters mounted on steel beams as well as 3 transformers among
other pad mounted electrical equipment. Solar modules will be mounted with a minimum of 2 feet
ground clearance and rack mounted electrical equipment will be mounted at a minimum of 3 feet
ground clearance.
11. List the types, number, and uses of the existing and proposed structures.
There are no existing structures on the Project site, and the proposed structures for the Project will
include:
• Approximately 16,588 PV Modules
• Anticipated 12 concrete pads to support electrical equipment (quantity is subject to
change while awaiting finalized design).
• Anticipated 4 utility poles (quantity is subject to change while awaiting finalized
design).
• Anticipated 58 inverters (quantity is subject to change while awaiting finalized
design).
• Anticipated 3 transformers (quantity is subject to change while awaiting finalized
design).
• Anticipated 9 additional pad mounted equipment (quantity is subject to change while
awaiting finalized design).
12. Describe the size of any stockpile, storage, or waste areas.
During construction, a temporary laydown area located within the limits of the Project area will be
used to store project facility items and construction materials. During operations, there will be no
open stockpiling, uncovered storage, or waste areas. ENGIE anticipates using 3 storage containers
(LWH: 40ft x loft x loft) to store spare parts, tools, and equipment on -site during construction and
operations.
13. Describe the method and time schedule of removal or disposal of debris, junk and other wastes
associated with the proposed use.
Debris, junk, and other wastes will be stored in appropriate waste receptacles during construction. A
waste management contractor will be retained to regularly remove waste associated with
construction of the project from the receptacles and dispose of the waste in accordance with local
laws and regulations and CDPHE requirements. Maintenance contractors will properly dispose of
any waste generated during project operation.
14. Include a timetable showing the periods of time required for the construction of the operation.

No parking or handicap -accessible parking spaces are proposed to be added to the Project area.
17. Describe the existing and proposed fencing and screening for the site including all parking and
outdoor storage areas.
There are existing fences on site that consist of T -posts and barbed wire, about 3 ft tall. This will be
removed in the Project area and a 7 ft game fence with wooden posts will be installed around the
solar energy facility with one 30 ft wide access gate and at least one emergency personnel gate. No
tree or other landscaping plants or screening are proposed.
18. Describe the existing and proposed landscaping for the site.
The existing landscaping of the site consists of shallow slopes that do not exceed 10% and are
seeded with tall grasses. The soils are sandy. There is an existing fence and an existing access road
that leads to the site, however, all fences within the solar array area will be removed and portions of
the access road will be removed and replaced to accommodate vehicles delivering construction
materials. The landscape within the project area will be reseeded with native wildflowers and grasses
once mechanical completion has been reached.
19. Describe reclamation procedures to be employed as stages of the operation are phased out or upon
cessation of the Use by Special Review activity.
ENGIE is responsible for the decommissioning of the Project and will commence the
decommissioning process within 12 months after power production has permanently ceased. The
decommissioning will include the removal of all non -utility owned equipment to a depth of 3 feet.
Further detail of Project decommissioning is provided in the Decommissioning Plan in Appendix L.
20. Describe the proposed fire protection measures.
The Project is located within the Southeast Weld Fire Protection District and will comply with all
Colorado Public Utilities Commission requirements as well as national codes and standards for
construction, electrical, and fire. ENGIE will also utilize a supervisory control and data acquisition
(SCADA) system to remotely monitor the Project area.
21. Explain how this proposal is consistent with the Weld County Comprehensive Plan per Chapter 22
of the Weld County Code.
The proposed Project is in accordance with the Weld County Comprehensive Plan as detailed below:
• The Project does not interfere with any agricultural operations near the Project area or within
Weld County. It will have minimal noise and visual impacts that will not disturb the
agricultural heritage of the County.
• The Project does not infringe upon the rights of private property owners in the vicinity. The
Project would allow for the owners of the property to utilize the land in accordance with local
regulations.
• The Project promotes economic growth and stability in Weld County by providing a source
of income and tax revenue.
• The Project protects the health, safety, and general welfare of the citizens of Weld County by
providing an emissions -free source of energy.
22. Explain how this proposal is consistent with the intent of the zone district in which it is located.
(Intent statements can be found at the beginning of each zone district section in Article III of Chapter
23 of the Weld County Code.)
The Project will be located within the Agricultural "A" Zone District which allows for natural
resource extraction and energy development. The proposed development will not disrupt the
agricultural operations of the district where it will be located. Once the solar system and all site
improvements have been installed, ENGIE will be planting a seed mixture containing native grasses
and wildflowers to provide habitat for pollinator species and promote soil health.
23. Explain how this proposal will be compatible with future development of the surrounding area or
ado Dted master -,Mans of affected munici Dalities.
The Project will be located within the Keenesburg Intergovernmental Agreement area (IGA) and the
development classification is annexation and urban. The Project area is not included in the maps in
the 2005 Keenesburg Comprehensive Plan and therefore not further discussed in the plan. The
Project area lie within the growth boundary of the most recent Keenesburg Land Use Map from
2022, where the southern part of the Project area is shown as a planned industrial zone; the northern
part of the Project area is beyond the Keenesburg growth boundary. The surrounding uses are
agricultural and industrial, which are compatible uses with the proposed Project, as it will cause
minimal disruption to surrounding activities and businesses. The Project will also support the
continued growth of Keenesburg by reducing the burden on the electrical grid and contributing to the
local energy infrastructure.
24. Explain how this proposal impacts the protection of the health, safety, and welfare of the inhabitants
of the neighborhood and the County.
The Project is not expected to adversely affect the health, safety, or welfare of Weld County
residents. Project design will comply with Colorado Public Utilities Commission requirements and
national codes and standards for construction, electrical, and fire. Activity on the property will
comply with the Colorado Air Quality Commission's air quality regulations.
25. Describe any irrigation features. If the proposed use is to be located in the A (Agricultural) Zone
District, explain your efforts to conserve prime agricultural land in the locational decision for the
proposed use.
Once the solar system and all project components have been installed, a seed mix with native grasses
and wildflowers will be installed that will grow deep-rooted vegetation that minimizes erosion and
increases soil infiltration (compared to turf grasses). This native vegetation will create a habitat for
pollinator species as well. The native grasses and wildflowers will require close monitoring and
maintenance for the first 3-4 years after seeding, including spot spraying pesticide -free herbicides on
invasive weeds and mowing. Once the native plants have matured, maintenance will be minimized
as invasives will be crowded out and discouraged from growing on -site, so mowing shouldn't be
needed after this 3 -4 -year time period.
Stormwater flows onto the Project area from the southwest, flows across the site to the northeast, and
flows offsite to the northeast. Minor grading improvements will be made to optimize pile lengths in
the tracker racking system. However, overall drainage patterns will not be affected by this minor
grading and stormwater will still flow on -site and off -site in the same preconstruction directions.
26. Explain how this proposal complies with Article V and Article XI of Chapter 23 if the proposal is
located within any Overlay Zoning District (Airport, Geologic Hazard, or Historic Townsites
Overlay Districts) or a Special Flood Hazard Area identified by maps officially adopted by the
County.
The Project area is not located within any Overlay Zoning District or Special Flood Hazard Area.
27. Detail known State or Federal permits required for your proposed use(s) and the status of each
permit. Provide a copy of any application or permit.
The Project does not require any Federal Permits.
The Project may require the following two State permits during construction activities:

1 INTRODUCTION AND SUMMARY OF PROPOSED USE
ENGIE Distributed Renewables Development LLC (ENGIE and/or Applicant), is filing this application
for a use by special review (USR) permit in accordance with Weld County Charter and County Code
(Code) Chapter 23, Article II, Division 4 Uses by Special Review and Chapter 23, Article IV, Division 15
Solar Facility. This application is for the proposed construction and operation of the Keenesburg Solar
Project (Project), which would consist of a 7.2 -megawatt with alternating current (MWac) solar
photovoltaic (PV) generation facility in unincorporated private land in Weld County, Colorado. The land
is owned by the Molson Coors Beverage Company (MCBC). The solar facility would consist of PV
panels installed on a single -axis tracker system supported by steel foundation posts driven directly into
the soil. Electricity generated from the Project would be added to on -site Xcel Energy transmission lines.
The proposed Project would be located at 40°11'09.0"N 104°29'26.6"W, approximately 5 miles northeast
of Keenesburg, CO, and would occupy approximately a 194 -acre parcel (42 acres of leased area) of
private land within the Weld County Agricultural "A" Zone District (Project area), (Figure 1). The
property was formerly used for a coal mine and has been reclaimed in accordance with the Weld County,
Colorado Division of Reclamation & Mine Safety, and Colorado Department of Public Health and
Environment requirements. No former pit sites are located within the Project area. The Project area would
be accessed via an existing private road connecting to an unmaintained section of County Road 59. The
existing private road access would be upgraded to support transportation during Project construction and
operation.

2.2 Compliance with Weld County Code
2.2.1 Development Standards Statement
The proposed Project is in the Weld County Zone "A" and is more than five (5) acres but less than three -
hundred twenty (320) acres thus is governed by the requirements set forth in Code Chapter 23, Article II,
Division 4. The following statements describe how the Project meets the Weld County development
standards.
Height limitation. The ground -mounted solar collectors shall not exceed twenty-five (25) feet in height,
measured from the highest grade below each solar panel to the highest extent of the solar panel rotation.
The Project ground -mounted solar collectors would have a minimum ground clearance of 2 feet in height
up to 10 feet fully rotated.
Glare. Concentrated solar glare from solar collectors shall not be directed toward or onto nearby
properties or roadways at any time of the day. The solar modules used for this project have an anti -
reflective coating on the semi -tempered glass module face. The Project is proposing the use of anti -
reflective PV modules.
Setbacks. The improved area shall conform to the setback requirements of the underlying zone.
Additionally, the improved area must be at least five hundred (500) feet from existing residential

buildings and residential lots of a platted subdivision or planned unit development. The residential
setback requirement may be reduced if appropriate screening through landscape or an opaque fence is
installed, or upon submittal to Weld County of a waiver or informed consent signed by the residence
owner agreeing to the lesser setback. If landscaping or opaque fencing is substituted for setback, a
landscaping plan or fencing plan shall first be submitted to and approved by the Department of Planning
Services. The proposed Project is at least 500 feet from existing residential buildings and lots. There is no
proposed landscaping. The proposed fencing is provided in the documents titled Keenesburg
Solar Elevation Drawings and Keenesburg Solar Pre -application meeting.
Dust mitigation. The operators shall continuously employ the practices for control of fugitive dust
detailed in their dust mitigation plan submitted as required by Subsection B.2., above. A Dust Mitigation
Plan is provided in the document titled Keenesburg Solar Dust and Weed Abatement Plan.
Underground cables. All electrical cables on the improved area shall be buried, except for direct current
string wires that connect between solar collectors, direct current collection circuits between rows of solar
arrays that are no more than four (4) feet above grade crossings, substations, switchyards, and circuit
voltages greater than 34.5 kilovolts (where necessary). The Project will utilize an above -ground cable
management system between tracker rows and transition to direct burial cables and cables in conduits
when routed to the equipment pads. Conduit detailing is provided in the documents titled Keenesburg
Solar USR Map and Keenesburg Solar Elevation Drawings.
Fencing. The Project shall be enclosed with a security fence as approved pursuant to a fencing plan
submitted to the Department of Planning Services. Appropriate signage shall be placed upon such fencing
that warns the public of the high voltage therein. Security fence specifications are provided in the
documents titled Keenesburg Solar Elevation Drawings and Keenesburg Solar Pre -application meeting.
Stormwater management. The Operator shall submit a drainage report to comply with required Storm
Drainage Criteria pursuant to Chapter 8, Article XI of this Code. Additional requirements for Municipal
Separate Storm Sewer System (MS4) areas may be applicable pursuant to Chapter 8, Article IX of this
Code. Ground -mounted solar collector systems shall be exempt from impervious surface calculations if
the soil under the collectors is designated hydrologic A or B soil groups by the Natural Resources
Conservation Service (MRCS). The proposed Project is not within an MS4 area. The proposed Project is
in an area having NRCS designated hydrologic A soils, as shown in Keenesburg Solar Soil Report.
Access permit. Prior to construction, the applicant shall apply for and obtain an approved. Access Permit
from the Weld County Department of Public Works, pursuant to the provisions of Article XIV of Chapter
8 of this Code. This standard does not apply as described in the pre -application meeting minutes shown in
Keenesburg Solar Pre -application meeting.
Existing irrigation systems. The nature and location or expansion of the facility must not unreasonably
interfere with any irrigation systems on or adjacent to the solar facility. The Project is not proposed on or
adjacent to any irrigation systems and will not interfere with irrigation systems. No landscaping plants or
associated irrigation are proposed.
2.2.2 Alternatives Statement
Several potential locations were considered on MCBC owned land in this area. This site was selected as
an ideal site for re -use after coal mining and for its proximity to existing electrical transmission lines. The
proposed Project is compatible with community interests because it aligns with the current zoning and
future planned land uses in the region. The site is relatively remote and will not be readily visible by the

public. The Project will not adversely affect the health, safety, and welfare of the inhabitants of the
county.
2.2.3 Conservation of Prime Farmland
The Project is not proposed on prime farmland. The Project is proposed on a former coal mine site.
2.2.4 Compliance with Design Standards
The proposed Project complies with Weld County design standards Section 23-2-240 of the Weld County
Code as described below.
No water service is proposed for the operation of the Project and bottled water will be provided to
workers on -site during construction. The Project will not require sewer service as there is no proposed
operations and maintenance building. The existing soil conditions are conducive to supporting solar PV
arrays. Fire protection measures are adequate and available for the site. The proposed Project complies
with the stormwater drainage criteria as described in the drainage letter in Keenesburg Solar Drainage
Narrative. No permanent parking or loading areas are proposed. One temporary laydown area is proposed
in the Project area during construction.
The proposed Project meets the Bulk requirements in Section 23-3-70 for the "A" Zone District. The lot
size is larger than 35 acres, the Project would meet the minimum setback of twenty (20) feet from public
right of way, and sources of light would be shielded so that beams and rays would not shine directly onto
adjacent properties.
2.2.5 Compliance with Operation Standards
The Project complies with Weld County's operation standards in Section 23-2-250 of the Weld County
Code as described below.
The operation of the Project would meet and not exceed acceptable noise levels. Noise from construction
activities would vary, depending on such factors as equipment used, operations schedule, and
meteorological conditions. Truck traffic and heavy equipment would cause elevated noise levels at and
near active construction sites. Noise would also be generated along the existing private access road by
vehicles transporting workers and materials during construction. Most construction activities will occur
during the day, and nighttime noise levels are anticipated to drop to the background levels of the site.
Once in operation, the inverters that are dispersed in the solar arrays would be the primary sources of
noise and these are not louder than other typical activities in the area, for example, traffic during the
busiest time of day for road travel. The noise levels from the Project are not anticipated to exceed 55 A -
weighted decibels (dBA) at the site's property line, the approximate equivalent of an average household
refrigerator 1.
The operation shall comply with the air quality regulations promulgated by the Colorado Air Quality
Control Commission. The Dust Mitigation plan is provided in the document titled Keenesburg Solar Dust
and Weed Abatement Plan. The Project will comply with the water quality regulations promulgated by
the Colorado Water Quality Control Commission and requirements of Weld County.

Proposed sources of light for the Project are limited and will not shine directly onto adjacent properties or
cause a nuisance or interfere with the use on the adjacent properties. No light source will reflect light onto
public or private streets or roads that may create a traffic hazard to operators of motor vehicles. No
colored lights will be used that may be confused with traffic control devices.
The Project will not emit heat so as to raise the temperature of the air more than five degrees (5°)
Fahrenheit at or beyond the lot line. The Project area will be maintained in such a manner that grasses and
weeds are not permitted to grow taller than twelve (12) inches. The Project area will be maintained in
such a manner that Colorado noxious weeds will not be allowed to grow or proliferate. See Keenesburg
Solar Dust and Weed Abatement Plan for information on weed management.
2.2.6 Persons or entities with an interest in property proposed to
be physically disturbed or crossed by the activity

1. Describe the access location and applicable use types (i.e., agricultural, residential,
commercial/industrial, and/or oil and gas) of all existing and proposed accesses to the
parcel. Include the approximate distance each access is (or will be if proposed) from an
intersecting county road. State that no existing access is present or that no new access is
proposed, if applicable.
No new access is proposed, and the Project will use an existing access road that connects
to County Rd. 59.
2. Describe any anticipated change(s) to an existing access, if applicable.
No changes to the existing access road are proposed.
3. Describe in detail any existing or proposed access gate including its location.
There is an existing fence/gate that ENGIE proposes to remove near the site entrance off
County Road 59 (e40ft west of the intersection with our access road), per the below
drawing. There is another fence/gate at the west side of our parcel, that will be removed
to build the solar array. ENGIE is proposing a new access gate, incorporated into the
fence surrounding our array, at the to the planned array, as shown in drawings included
herein.

4. Describe the location of all existing accesses on adjacent parcels and on parcels located
on the opposite side of the road. Include the approximate distance each access is from an
intersecting county road.
Neighboring parcels contain private access roads that connect to the unmaintained section
of County Road 59. The neighboring parcel to the south (WJW Properties LLC) has a
driveway intersecting County Road 59 about 700ft south of our access road. The
neighboring parcel to the east (DCP Midstream LP) has a driveway intersecting County
Road 59 about 1300ft north of our access road. About 350ft north of our access road
there is a road running eastbound from County Road 59 to County Road 57, across the
Gutterson Ranches LLC property.
5. Describe any difficulties seeing oncoming traffic from an existing access and any
anticipated difficulties seeing oncoming traffic from a proposed access.
No new access is proposed, and ENGIE does not anticipate any difficulties with visibility
of oncoming traffic. There are no tall structures nearby that could encumber the view, and
there is minor vegetation surrounding the Project access road. The Project area is located
at the end of a long road and the area receives limited traffic.
6. Describe any horizontal curve (using terms like mild curve, sharp curve, reverse curve,
etc.) in the vicinity of an existing or proposed access.
Driving south from the Project access, the road remains straight for approximately 1,900
feet before a 90° curve to the west. To the north of the Project access, the road continues
straight for approximately 1,000 feet before a minor curve.
7. Describe the topography (using terms like flat, slight hills, steep hills, etc.) of the road in
the vicinity of an existing or proposed access.
The topography of the Project area and access road is predominantly flat (less than 3%
slope) with good visibility. Project area generally has slopes between 1-3%, per the
below drawing. The access road is also generally flat, with slopes no greater than 8% in
the direction of travel.

The Project will not utilize a public water tap or require any water supply. Bottled water will be
used during construction, as agreed upon in the PRE23-0060 pre -application meeting.
2. Discuss the existing and proposed sewage disposal system. What type of sewage disposal system
is on the property? If utilizing an existing on -site wastewater treatment system, provide the on -
site wastewater treatment permit number. (If there is no on -site wastewater treatment permit due
to the age of the existing on -site wastewater treatment system, apply for a on -site wastewater
treatment permit through the Department of Public Health and Environment prior to submitting
this application.) If a new on -site wastewater treatment system will be installed, please state "a
new on -site wastewater treatment system is proposed." (Only propose portable toilets if the use is
consistent with the Department of Public Health and Environment's portable toilet policy.)
There is no existing sewage disposal system within the Project area and the Project will not
require the development of a wastewater treatment system. Portable toilets will be used during
construction, as agreed upon in the PRE23-0060 pre -application meeting. The use of portable
toilets will comply with the Colorado Department of Public Health and Environment's (CDPHE)
portable toilet policy.
3. If storage or warehousing is proposed, what type of items will be stored?
ENGIE will establish a laydown area to store construction materials and project facility items
during the construction phase of the Project. During operations there will be 2-3 storage
containers (LWH: 40ftx l Oft0 l Oft) to store spare parts, tools, and electrical equipment. There will
be no open stockpiling, uncovered storage, or waste areas during Project operation.
4. Describe where and how storage and/or stockpile of wastes, chemicals, and/or petroleum will
occur on this site.
Dumpsters will be provided and maintained to manage waste and recyclables during the
construction of the Project. Potential storage and/or stockpile of wastes, chemicals, and/or
petroleum will comply with the CDPHE requirements.
5. If there will be fuel storage on site, indicate the gallons and the secondary containment. State the
number of tanks and gallons per tank.
There will be no fuel storage on site.
6. If there will be washing of vehicles or equipment on site, indicate how the wash water will be
contained.

Decommissioning Plan for the Keenesburg Solar Project
ENGIE Distributed Renewables Development LLC (ENGIE) submits this decommissioning plan for the
Keenesburg Solar Project (Project) in accordance with the requirements of the Weld County Zoning
Ordinance listed in Chapter 23 of the Weld County Code (Code) specifically, Section 23-4-1030.B4.
ENGIE is proposing the development of the Keenesburg Solar Project on a parcel approximately 5 miles
northeast of Keenesburg, CO. The property is owned by the Molson Coors Beverage Company (MCBC).
Decommissioning process
ENGIE is the developer of the Project and responsible for the decommissioning of the Project. The
Project's anticipated life span is 28.5 years, and unless the facility is retrofitted for further use,
decommissioning will begin within 12 months after power production has permanently ceased. The
decommissioning of the Project will include the removal of all non -utility owned equipment, including
the photovoltaic panels, racking system, steel foundation piles, concrete pads, and electrical equipment to
a depth of 3 feet. Graveled areas, access roads and fencing will also be removed during the
decommissioning process. After equipment is removed, any holes or voids caused by poles, concrete pads
or other equipment will be filled in with soil to restore the property to a condition reasonably similar to its
condition prior to the development of the Project. All activities related to the decommissioning of the
Project will follow best management practices (BMPs) for stormwater management, erosion control, soil
conservation and reclamation. Decommissioning of the Project will be completed within 12 months of the
start date of the decommissioning work.
Cost estimates
ENGIE estimates the total cost of Project decommissioning will be approximately $439,616 in 2024
($765,382 in 2053). Prior to Project construction, ENGIE will submit an irrevocable standby letter of
credit, bond, or alternate form of Security in an amount sufficient to fund the estimated costs of the
decommissioning of the Project. This Security will be issued in accordance with the guidelines in Code
Section 23-4-1030.B4(g) as listed below.
o Name the Board of County Commissioners of Weld County as the sole beneficiary of the letter of
credit;
o Be issued by an A -rated financial institution based upon a rating provided by S&P, Moody's,
Fitch, AM Best, or other rating agency with similar credentials;
o Include an automatic extension provision or "evergreen clause"; and
o Be "bankruptcy remote," meaning the Security will be unaffected by the bankruptcy of the SEF
operator.
Keenesburg Solar Decommissioning Plan
A detailed cost estimate will be provided prior to construction, in advance of the Security and will address
the elements listed in Code Section 23-4-1030.B4(f) as listed below.
o All labor, equipment, transportation, and disposal costs associated with the removal of all facility
components from the facility site;
o All costs associated with full reclamation of the facility site, including removal of non-native
soils, fences, and constructed access roads;
o All costs associated with reclamation of any primary agricultural soils at the facility site to ensure
each area of direct impact shall be materially similar to the condition it was before construction;
o All decommissioning/reclamation activity management, site supervision, site safety costs;
o Any other costs, including administrative costs, associated with the decommissioning and
reclamation of the facility site; and
o The estimated date of submission of the Security to Weld County.
This cost estimate will be updated every 5 years from the establishment and submittal of the Security. If
ENGIE has not initiated decommissioning activities within 90 days of the Board of County
Commissioner's order to do so, Weld County will have the right to draw upon the Security provided by
ENGIE to fund the decommissioning of the Project.

The proposed Project is in the Weld County Zone "A" and is more than five (5) acres but less than three -
hundred twenty (320) acres thus is governed by the requirements set forth in Code Chapter 23, Article II,
Division 4. The following statements describe how the Project meets the Weld County development
standards.
Height limitation. The ground -mounted solar collectors shall not exceed twenty-five (25) feet in height,
measured from the highest grade below each solar panel to the highest extent of the solar panel rotation.
The Project ground -mounted solar collectors would have a minimum ground clearance of 2 feet in height
up to 10 feet fully rotated.
Glare. Concentrated solar glare from solar collectors shall not be directed toward or onto nearby
properties or roadways at any time of the day. The solar modules used for this project have an anti -
reflective coating on the semi -tempered glass module face. The Project is proposing the use of anti -
reflective PV modules.
Setbacks. The improved area shall conform to the setback requirements of the underlying zone.
Additionally, the improved area must be at least five hundred (500) feet from existing residential

buildings and residential lots of a platted subdivision or planned unit development. The residential
setback requirement may be reduced if appropriate screening through landscape or an opaque fence is
installed, or upon submittal to Weld County of a waiver or informed consent signed by the residence
owner agreeing to the lesser setback. If landscaping or opaque fencing is substituted for setback, a
landscaping plan or fencing plan shall first be submitted to and approved by the Department of Planning
Services. The proposed Project is at least 500 feet from existing residential buildings and lots. There is no
proposed landscaping. The proposed fencing is provided in the documents titled Keenesburg
Solar_Elevation Drawings and Keenesburg Solar Pre -application meeting.
Dust mitigation. The operators shall continuously employ the practices for control of fugitive dust
detailed in their dust mitigation plan submitted as required by Subsection B.2., above. A Dust Mitigation
Plan is provided in the document titled Keenesburg Solar Dust and Weed Abatement Plan.
Underground cables. All electrical cables on the improved area shall be buried, except for direct current
string wires that connect between solar collectors, direct current collection circuits between rows of solar
arrays that are no more than four (4) feet above grade crossings, substations, switchyards, and circuit
voltages greater than 34.5 kilovolts (where necessary). The Project will utilize an above -ground cable
management system between tracker rows and transition to direct burial cables and cables in conduits
when routed to the equipment pads. Conduit detailing is provided in the documents titled Keenesburg
Solar USR Map and Keenesburg Solar Elevation Drawings.
Fencing. The Project shall be enclosed with a security fence as approved pursuant to a fencing plan
submitted to the Department of Planning Services. Appropriate signage shall be placed upon such fencing
that warns the public of the high voltage therein. Security fence specifications are provided in the
documents titled Keenesburg Solar_ Elevation Drawings and Keenesburg Solar_Pre-application meeting.
Stormwater management. The Operator shall submit a drainage report to comply with required Storm
Drainage Criteria pursuant to Chapter 8, Article XI of this Code. Additional requirements for Municipal
Separate Storm Sewer System (MS4) areas may be applicable pursuant to Chapter 8, Article IX of this
Code. Ground -mounted solar collector systems shall be exempt from impervious surface calculations if
the soil under the collectors is designated hydrologic A or B soil groups by the Natural Resources
Conservation Service (MRCS). The proposed Project is not within an MS4 area. The proposed Project is
in an area having NRCS designated hydrologic A soils, as shown in Keenesburg Solar Soil Report.
Access permit. Prior to construction, the applicant shall apply for and obtain an approved. Access Permit
from the Weld County Department of Public Works, pursuant to the provisions of Article XIV of Chapter
8 of this Code. This standard does not apply as described in the pre -application meeting minutes shown in
Keenesburg Solar Pre -application meeting.
Existing irrigation systems. The nature and location or expansion of the facility must not unreasonably
interfere with any irrigation systems on or adjacent to the solar facility. The Project is not proposed on or
adjacent to any irrigation systems and will not interfere with irrigation systems. No landscaping plants or
associated irrigation are proposed.
2.2.2 Alternatives Statement
23-4-1030.D.
Several potential locations were considered on MCBC owned land in this area. This site was selected as
an ideal site for re -use after coal mining and for its proximity to existing electrical transmission lines. The
proposed Project is compatible with community interests because it aligns with the current zoning and
future planned land uses in the region. The site is relatively remote and will not be readily visible by the

public. The Project will not adversely affect the health, safety, and welfare of the inhabitants of the
county.
2.2.3 Conservation of Prime Farmland
23-2-220.A.6.
The Project is not proposed on prime farmland. The Project is proposed on a former coal mine site.
2.2.4 Compliance with Design Standards
23-2-240.
The proposed Project complies with Weld County design standards Section 23-2-240 of the Weld County
Code as described below.
No water service is proposed for the operation of the Project and bottled water will be provided to
workers on -site during construction. The Project will not require sewer service as there is no proposed
operations and maintenance building. The existing soil conditions are conducive to supporting solar PV
arrays. Fire protection measures are adequate and available for the site. The proposed Project complies
with the stormwater drainage criteria as described in the drainage letter in Keenesburg Solar Drainage
Narrative. No permanent parking or loading areas are proposed. One temporary laydown area is proposed
in the Project area during construction.
The proposed Project meets the Bulk requirements in Section 23-3-70 for the "A" Zone District. The lot
size is larger than 35 acres, the Project would meet the minimum setback of twenty (20) feet from public
right of way, and sources of light would be shielded so that beams and rays would not shine directly onto
adjacent properties.
2.2.5 Compliance with Operation Standards
23-2-250.
The Project complies with Weld County's operation standards in Section 23-2-250 of the Weld County
Code as described below.
The operation of the Project would meet and not exceed acceptable noise levels. Noise from construction
activities would vary, depending on such factors as equipment used, operations schedule, and
meteorological conditions. Truck traffic and heavy equipment would cause elevated noise levels at and
near active construction sites. Noise would also be generated along the existing private access road by
vehicles transporting workers and materials during construction. Most construction activities will occur
during the day, and nighttime noise levels are anticipated to drop to the background levels of the site.
Once in operation, the inverters that are dispersed in the solar arrays would be the primary sources of
noise and these are not louder than other typical activities in the area, for example, traffic during the
busiest time of day for road travel. The noise levels from the Project are not anticipated to exceed 55 A -
weighted decibels (dBA) at the site's property line, the approximate equivalent of an average household
refrigerator 1.
The operation shall comply with the air quality regulations promulgated by the Colorado Air Quality
Control Commission. The Dust Mitigation plan is provided in the document titled Keenesburg Solar Dust
and Weed Abatement Plan. The Project will comply with the water quality regulations promulgated by
the Colorado Water Quality Control Commission and requirements of Weld County.

Proposed sources of light for the Project are limited and will not shine directly onto adjacent properties or
cause a nuisance or interfere with the use on the adjacent properties. No light source will reflect light onto
public or private streets or roads that may create a traffic hazard to operators of motor vehicles. No
colored lights will be used that may be confused with traffic control devices.
The Project will not emit heat so as to raise the temperature of the air more than five degrees (5°)
Fahrenheit at or beyond the lot line. The Project area will be maintained in such a manner that grasses and
weeds are not permitted to grow taller than twelve (12) inches. The Project area will be maintained in
such a manner that Colorado noxious weeds will not be allowed to grow or proliferate. See Keenesburg
Solar Dust and Weed Abatement Plan for information on weed management.

Subject: Drainage Narrative
This drainage narrative describes the necessary items from the Weld County, Colorado
Charter and County Code, Section 8-11-40.1. B. The site is located on County Road 59, Keenesburg,
CO in Weld County, approximately five miles northeast of downtown Keenesburg. Improvements to
the parcel will consist of the installation of a 7.2Mwac solar farm to be installed on approximately 60
acres. The solar farm consists of photovoltaic panels installed on a single -axis tracker racking system.
The racking system is supported on W6x10.5 and W6x12 driven pile foundations. Additional site
improvements include perimeter fencing, a gravel access drive, and concrete pads that will support
electrical equipment.
The installed equipment will be supported on steel foundation piles driven into the soil. Therefore the
impacts to drainage patterns on and off -site and infiltration will be negligible. The soil conditions in the
project areas are classified as Hydrologic Group A, which according to the Weld County, Colorado
Charter and County Code, Section 23-4-1030-B, makes this project exempt from impervious area
calculations.
Once the solar system and all project components have been installed, a seed mix with native
grasses and wildflowers will be installed that will grow deep-rooted vegetation that minimizes erosion
and increases soil infiltration (compared to turf grasses). This native vegetation will create a habitat
for pollinator species as well. The native grasses and wildflowers will require close monitoring and
maintenance for the first 3-4 years after seeding, including spot spraying pesticide -free herbicides on
invasive weeds and mowing. Once the native plants have matured, maintenance will be minimized as
invasives will be crowded out and discouraged from growing on -site, so mowing shouldn't be needed
after this 3-4 year time period.
The site is relatively flat with slopes at 7% at their steepest. Stormwater flows onto the project area
from the southwest, flows across the site to the northeast, and flows offsite to the northeast. Minor
grading improvements will be made to optimize pile lengths in the tracker racking system. However,
overall drainage patterns will not be affected by this minor grading and stormwater will still flow on -site
and off -site in the same preconstruction directions.
There are no known previous drainage problems that have occurred on the property
There are no known irrigation facilities adjacent to or near the project area.
This site was previously used as a coal mine but has been reclaimed per permits issued by Weld
County, the Division of Reclamation & Mine Safety, and the Colorado Department of Public Health.
The former coal pits will be avoided by all temporary and permanent construction improvements.

Subject: Dust Abatement Plan
The purpose and intent of this Dust Abatement Plan is to ensure that the Project complies with
applicable state and federal air quality standards. The Environmental Protection Agency (EPA) sets
forth the National Ambient Air Quality Standards (NAAQs) pursuant to the Clean Air Act. Air quality
impacts associated with construction projects generally arise from fugitive dust generation during the
operation of heavy equipment. Colorado administers the NAAQS through issuance of the Air Pollutant
Emission Notice (APEN). The Project will not exceed the NAAQS and will follow best management
practices to ensure that the production of dust will be controlled by the regular application of water to
the Project. The Project will obtain an APEN permit prior to construction. Minimal dust is expected to
be generated during construction and operations due to the planned use of dust suppression best
management practices and soil stabilization following construction and throughout operations. During
construction, ENGIE NA and their contractors will control dust by applying water to disturbed soils and
soil piles to control fugitive dust from blowing and impairing air quality.
Once mechanical completion has been reached, ENGIE NA will work with land restoration specialists
to plant a permanent seed mix consisting of wildflowers and grasses native to the region. This
practice will inhibit the formation of dust by creating an ecologically balanced ground surface.
Once the construction phase is completed, herbicide of invasive plant species and site mowing will be
completed 2-4 times per year for the first 3-4 years post construction, then little vegetation
maintenance will be required for the remainder of the project's life cycle.

Local Regulations
The Keenesburg Solar Site is in Weld County, Colorado. Chapter 21, Article VII, Division 3 of the Weld
County Charter and County Code describes the requirements for a permit for site selection of a solar
energy facility and states that noise impacts must be analyzed.
Chapter 14, Article IX of the Weld County Charter and County Code describes the noise regulations in
Weld County, and Section 14-9-30 of this article states that a violation of this ordinance includes
knowingly making, causing, or permitting to be made any excess noise or exceeding the sound levels
provided in Section 14-9-40 of the Weld County Charter and County Code. The maximum permissible
noise levels permitted for different land uses are shown in Table 1.

Conclusions
The Keenesburg Solar Site is located west of CO Road 59 and surrounded by adjacent agricultural
fields. The Keenesburg Solar Site will be constructed on previous agricultural land. The existing parcel
has no residential zones immediately adjacent.
Through analyzing the Keenesburg Solar Site anticipated operation sound levels throughout the
proposed solar site, it has been determined that sound mitigation measures will not be necessary at this
time since the anticipated operational sound levels will remain below the Weld County Charter and
County Code allowable noise levels as seen in Table 1.

Road Access Narrative
The proposed Project will be accessed via an established private road that connects to an unmaintained
section of County Road 59. The primary access route for vehicles related to construction, operation, and
maintenance of the Project will, from there, travel south onto County Road 18 and Market Street in
Keenesburg to reach Interstate 76. Alternatively, vehicles may also travel via County Road 18 and County
Road 49 to leave the area.
ENGIE anticipates the Project will be constructed over 6 months and that this phase will require up to
three roundtrips daily for up to six passenger cars and/or pickup trucks. A maximum of eight tandem
trucks and/or semi -trucks will make up to five roundtrips daily.
The Project is proposed to operate for 20-25 years, during which ENGIE anticipates four operations and
maintenance visits annually. Each of these visits will require up to two roundtrips for up to two passenger
cars and/or pickup trucks. Additional travel may be required for maintenance on an as -needed basis.

The Colorado Department of Public Health and Environment (CDPHE) Hazardous Materials and
Waste Management Division (Division) received a Site Geometry Plan (Plan) for a renewable energy
project at the Keenesburg Ash Disposal facility (Facility) located at 13495 Weld County Road 61
near Keenesburg, Colorado on December 11, 2024. The Facility's historic operations included solid
waste disposal of fly and bottom ash from its coal-fired power plant (located at the Coors Brewing
complex in Golden, Colorado) along with construction and demolition debris into Disposal Pits A
and B pursuant to a permit from the Colorado Division of Reclamation, Mining and Safety, and a
Certificate of Designation issued by Weld County. This property is subject to Environmental Use
Restrictions imposed by CDPHE pursuant to section 25-15-321.5 of the Colorado Revised Statutes,
filed as institutional control ID RSNOT00054, due to the metal and polycyclic aromatic hydrocarbon
contaminants associated with coal combustion residuals present in Disposal Pits A and B.
The Plan, prepared by SoCore Engineering on December 10, 2024 on behalf of Engie North America
Inc., shows a renewable energy facility to be constructed in a "non -impact area" the west side of
the Facility. The renewable energy project will be located outside the surveyed bounds of the
exclusion zones for historic Disposal Pits A and B, and its infrastructure and future operations will
not overlap with existing institutional controls (i.e., final cover) and monitoring points. In addition
to the terms and conditions of the environmental use restriction for the facility, temporary
construction fencing wilt be used as necessary to demarcate and protect the final cover of the
Disposal Pits and all monitoring points (e.g., groundwater monitoring well PC -1) during
development.
The Division reviewed the Plan pursuant to 6 CCR 1007-2, Part 1, the Regulations Pertaining to
Solid Waste Sites and Facilities (Regulations), the Facility's Post -Closure Care Plan, and the
Facility's Post -Closure Groundwater Monitoring Plan. The Division also had a phone discussion with
the Facility on December 5, 2024 regarding the Plan. Based on this review, the Division has no

Ben Moline at Coors Energy Company has informed me that you would like my Division to provide information
to you related to the permit boundary for the Keenesburg Strip Mine (DBMS Permit No. C-1981-028).
Please see the first enclosure, the Permit Area Map (Appendix A-1) for this permit. It clearly shows that all but
a very small portion of the permit boundary is north of Section 36 of Township 3 North, Range 64 West (6t'
Principal Meridian). The second enclosure, Site Geometry Plan for the Keenesburg Solar project, illustrates that
the project is entirely south of the line delineating Section 25 and Section 36. It also shows that within the area
where the Division permit extends slightly into Section 36 (near the northeast corner of the project), there will
be no construction activity.
In addition, Coors Energy Company filed for a Permit Revision (PR -03). The relevant permit modification was
to Section XVI. Rule 4.16 Post -Mining Land Use that now allows for Industrial and Commercial uses. Attached
is the Final Findings for PR -03. The Division's final approval of PR -03 is scheduled for December 17, 2024,
barring any objections from the public. Once this permit revision is approved, the Division will not have any
concerns with the project presented by Coors Energy Company.

Good afternoon Diane,
My name is Stephanie, and I am the Planning & Zoning coordinator for the Town of Keenesburg.
Coors Energy CO reached out to us to get a Notice of Inquiry form signed for their solar energy project.
On this form, which we signed and returned, we expressed interest in entering into a pre -annexation agreement
with the applicant, so that there is no push back if and when the town would like to annex.
Today, we met with the applicants, and we agreed to work through this pre -annexation agreement following the
issuance of the USR permit that they are requesting through the county. They asked that I reach out to let you know
of our discussion, in case there is any hold up with the permit due to the indication that The Town of Keenesburg
wanted to annex.
