RESOLUTION -`-�"` "on:
WHEREAS, a public hearing was held on Friday, June 30, 1972, in
the chambers of the Board of County Commissioners, Weld County,
Colorado, for the purpose of hearing a petition of Mountain States
Telephone and Telegraph Co. , requesting a change of zone from "E"
_o Estate District to "T" Transitional District, and
WHEREAS, the petitioner was present and represented by counsel,
and
WHEREAS, there was no one present in opposition to the change of
zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioner and studied the recommendations of the Weld
County Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners that the petition of Mountain States Telephone and
Telegraph Co. for a change of zone from "E" Estate District to ' T"
Transitional District, said area being more particularly described as
follows:
A part of the Northeast Quarter of Section 23, Township 5
North, Range 66 West of the 6th P. M.
A tract of land lying in the Northeast Quarter (NE4) of Section
23, Township 5 North, Range 66 West of the 6th Principal
Meridian in Weld County, Colorado, being more particularly
described as follows:
Commencing at the Northeast Corner of said Section 23 and
considering the East line of the Northeast Quarter (NEI) of
said Section 23 to bear South 00° 59' 40" East and with all
other bearings contained herein relative thereto:
Thence South 00° 59' 40" East along the East line of the North-
east Quarter (NE4) of said Section 23, a distance of 1, 813. 92
feet to the Southeast corner of that property presently known
as the Elks Property, said point being the True Point of
Beginning:
Thence continuing South 00° 59' 40" East along the East line
of the Northeast Quarter (NE4) of said Section 23, 690. 28
feet: Thence South 89° 00' 00" West, 526. 12 feet; Thence
North 54° 311 00" West, 586. 43 feet, to a point on the south-
erly boundry of the Elks Property; Thence along the Southerly
line of said Elks Property by the following three courses and
distances:
North 77° 15' 00" East, 278. 00 feet:
North 33° 26' 00" East, 350. 00 feet;
North 89° 24' 00" East, 527. 62 feet to the True Point of
Beginning, said tract of land containing 11, 348 acres, more
or less,

is hereby granted under the conditions following:
1. Any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2, That a strip of land, as agreed upon, along the West side
of 35th Avenue be conveyed to Weld County for road
purposes, thus assuring uniform widening of 35th Avenue.
3. That existing ditch lines within the area rezoned shall
be preserved in their present condition.
4. That access to and from 35th Avenue be limited to a
single entrance and exit point.
5. All applicable subdivision regulations and zoning
regulations shall be followed and complied with in
accordance with the Weld County Zoning Resolutions.
