IN THE MATTER OF
TRANSFERRING FUNDS.
The following resolution was unanimcusly passed and adopted, viz:--
WHEREAS, It appearing to the Board that an overdraft now exists in the General County
Fund, and
WHEREAS, It appearing that there is a balance to the credit of the ContinGent fund in the
sum of $4277.22;
THEREFORE RESOLVED, That the County Treasurer be and he is hereby authorized and directed
to transfer to the General County Fund the balance now to the credit of the Contingent Fund
for the purpose of reducing the overdraft now in the said General County Fund.

Acting under paragraph SIXTH of Section ONE of an Act
entitled "FEES--District Attorneys", page 223, Session Laws of 1391 the following resolution
- was unanimously passed and adopted, viz: --
RESOLVED, That for the year ending January 9, 1906 the amount paid the Deputy District
Attorney of WEld County shall not exceed the sum of $1000. for said year, provided however that
whatever amount not in excess of $1000. paid such Deputy District Attorney shall first be
earned as fees by said Deputy District Attorney.

The report of J F Reed, 0 M McElroy and E Rosling, viewers
appointed March 14th 1905 to view the following described line of road, viz:--
Commencing at the quarter corners common to section 4, Tp. 5 N. , R. 65 W. and section 33,
Tp. 6N. , R. 65 West and running thence due South about three quarters of a mile along one—half
section line through section 4, Pp. 5N. , R. 65 W. and connecting with the Main Street road
that runs East from the city of Greeley—=WAS PRESENTED to the Board when the following action
was taken and entered of record, to—wit :--
The Board having carefully considered the report of the viewers herein, as well as the
objections made thereto, and finding the report correct as to form, and believing the Public
Ik good requires the laying oft of the road as recommended by the viewers, it was on motion
ordered that the report be approved and adopted, and the read therein described and recommended
by the viewers be .and is hereby declared a p .blic highway. The clerk is directed to record the
1;o o report, plat the road, draw warrants in favdr of parties for damages awarded, and cause
notices to be posted of the opening of said road, and notify the road overseer of the proper
district to open the same to travel in sixty days as required by 'aw.
/ IN THE MATTER OF APPROPRIATION.
Honorable W. L. Clayton, C. H. Wheeler and B. D. Sanborn a
committee representing the Business men' s club appeared before the Board and requested that an
appropriation of $150. be made by the County for the purpose of entertaining the members of the
National "Good Roads Convention" who are tote in Greeley on or about July 21, 1905; after
carefully considering the matter and being fully advised in the premises it was on motion
ordered that an appropriation of $100. be made.
The following claims were then presented, examined and on motion approved and warrants

The report of S. A. Bradfield, J. S. Newell and Wm.
Peterson, viewers appointed June 15, 1905 to view the following line of road, viz:--
Commencing at a point about Twenty-five rods north of the Southeast Corner of Section 12,
Tp. 6N. , R. 67 West and running thence west through the S.- S.E. of said section 12 for a
distance of about one quarter of a mile, thence running in a southwesterly direction to sec-
tion line between sections 12 and 13; thence continuing along section line for a distance of
about one and one half miles at which point said road turns north so that the center of said
road is 30 feet north of section line; thence continuing west to the S.W. corner of section
11--6--67, t he last named point being the terminus thereof
was presented to the Board when the following -action was taken and entered of record, viz:--
The Board having carefully considered the report of the viewers herein, as we 11 as the

WHEREAS, On November 19, 1904 there was filed and presented to this Board a'petition signed

Townships 3. & 4 North Range 64 West,and also praying for the abandonment and vacation of a por
tion of a ceatain road in Townships 3 & 4 nbrth Range 64 west, and
WHHEREASIthis board appointdd viewers in, relation to said road as provided by law and
WHEREAS, said viewers reported to this board on the 14th day of June 1905,and recommended
the establishment of said highway,and
WHEREAS,this board after coming in of said report and after considering the sane approved
and adopted said report and declared the said road a public highway,and ordered the abandonment
and vacation of the public highway mentioned in said petition,and
WHEREAS,it has come to the attention of this Board that said petit ion was not signed by
ten free holders residing within two mil s of said proposed road ,and neither was the same sign-
ed by two-thirds of the owners of the lands adjoining the road proposed to be vacated and aban-
doned;
THEREFORE BE IT RESOLVED, That in view of the foregoing facts and by reason that said peti-
tion was not signed by the necessary persons as required by law that this board at this time does
hereby reconsider their proceedings heretofore had upon said petition and do hereby set aside all
. this boards actions,orders,and proceedings heretofore had and entered of record upon said petition
establishing said highway,and do hereby declare said petition not a legal or suffioient petition
giving this Board jurisdiction to act thereon.

SF - Section 15, Tp. 5N. , R. 65 was sold for taxes in the year 1878 for the taxes of 1877 and
that said tax sale is represented by tax sale certificate No. 62--1878, and at that time viz:
1878 the above described land was government landand also that the tax sale certificate No.
62--1875 is not in existence or can not be found, Therefore Be It Resolved that the County
Treasurer of Weld County be and is hereby instructed to issue a redemption certificate upon
the payment to the county of fees only without the formal surrender of said lost certificate.

WAY AND UTILITY COMPANY appeared before the Board wIth his attorney, Mr. Fishback, and presented
his petition prayinG for an amendment bf franchise and extension of time to a certain franchise
granted to him by this Board on the 7th day of' October A. D. 1903; after carefully considering
said petition and the Board being fully advised in the premises, on motion of Commissioner
DeVinny and seconded by Commissioner Bradfield the following resolution was unanimously passed
and adopted, viz:--

WHEREAS, The Greeley and Northern Railway and Utility Company represents to this Board that
it is a duly organized corporation under the laws of Colorado for the purpose of building an
electric line or lines of railway in Weld County, Colorado and adjacent counties, and is the
assignee of George J. Spear who obtained grant and franchise from the Board on October 7, 1903,
under certain terms and conditions to use certain portions of certain public highways in said
Weld County for the construction and operation of an electric railway thereon, which public

office of the County Clerk and Recorder of Weld County, Colorado, on the 28th day of December,
1904, as required by said grant of' franchise, and which original grant or franchise was amended
by this Honorable Board on November 10, 1904.
WHEREAS, it is now represented to this Board by petition , filed by said The Greeley and
Northern Railway and Utility Company that earnest effort has been made by the officers of said
corporation to finance said enterprise and to construct and have in operation an electric line
of railway accordinG to the terms and conditions of said grant and franchise, but that so far
such efforts have been unsuccessful, and that if further time be Granted as prayed in said
verified petition filed said electric road will be constructed and operated, and
WHEREAS, this Board believes the successful prosecution of said enterprise will materially
increase the taxable property of the county of Weld and be for the material advantaGe and benefit
of its citizens and taxpayers, and therefore desires to encouraGe the same;
NOW THEREFORE, Be It Resolved, that in consideration of the premises, there be and hereby is
stricken from said original grant or franchise of this Board of date October 7, 1903, paragraphs
numbered "4th" and "5th" thereof, and all the conditions and limitations in said paraGraphs
stated, and that said grant or franchise be further amended by inserting in lieu of said para-
graphs numbered "4th" and "5th" so stricken new paragraphs numbered 4th and 5th containing new
limitations and conditions, the same being in words and figures as follows:
"4th. On or before the 31st day of December, 1906, there must be filed with said County
Clerk and Recorder affidavit by an officer of said corporation showing actual construction and
operation of at least twenty miles of said electric railway, and that adequate capital to have
constructed and equipped a total of forty miles thereof durinG the year 1907 is in the treasury
of said company either in cash or notes of solvent subscribers payable during said year, if not
otherwise provided for. A failure to comply with this provision shall operate as a forfeitul'e
of all rights on or over roads designated in said map not then actually occupied by line of
electric road then in operation. "
"5th. In like manner each year thereafter until and including the year 1913, a similar af-
fidavit must be filed in said County Clerk' s office showing construction and operation of such
electric railway with a •total of at least forty miles by December 31, 1907, Fifty miles by De-
cember 31, 1908, Sixty miles by December 31, 1909, and so on. A failure to comply with this pro-
vision any of said years shall operate as a forfeiture of all rights on or over public roads
designated in said map not actually occupied by a line of said electric railway in operation on
the 31st day of December of the year when said failure to file affidavit first occurs."

The justice account of W. D. Young, Justice of the Peace in and for Justice precinct No. 5
was then presented, examined and on motion allowed for the amount stated thereon and ordered
placed on file.

NO. 17, SALES OF 1872.
Susan C. Smith having filed her affidavit showing that on June 3, 1572
Henry C. Sherman became the purchaser of tax sale certificate No. 17, sales of 1372 for the
taxes of 1871, for lot 2 in Block 1G2, Greeley; that said certificate of purchase has. since been
lost, and after diligent search affiant has been and still is unable to find the same; that said
tax sale standinG upon the records of the county unredeemed is a cloud upon the title to said
lot and asks that the Board, by proper order entered of record, authorize the County Treasurer
of Weld County to issue his redemption certificate from said tax sale.
It appearinG to the Board that said Susan C. Smith has filed her indemnifying bond in the
penal sum of $25. to save and keep harmless the said county of Weld and all of its officials
from all damages occasioned by said redemption without the surrender of the original certificate
of purchase, it was on motion ordered that the County Treasurer be and he is hereby authorized
and empowered to issue proper redemption certificate for said lot from said tax sale of 1872 up-
on the payment of the proper fee therefor.

The report of Ed. Riker, Wm. Parkin and Fritz Wattenberg, viewers
appointed September 7, 1905 to view the following described line of road, viz:--
Commencing at the NE corner of the NW k Nalv of Section 31, Tp. 5N. , Range 67 West and run
due West one quatter of a mile, being 50 feet wide for that distance or 25 feet off
each side of the section line; thence continuing on west and along section point
where The Hillsboro Ditch makes a turn to the South; Thence runninG around said:an. on the
south side thereof until it again strikes the section line; thence running due Vest and
along the section line to the west line of said sections 30 and 31. The last one half mile
being 6o feet in width, or 30 feet on each side of section line
was presented to the Board when the following action was taken P:nd entered of record, to-wit:--
The Board having carefully considered the report of the viewers herein, as well as the
objections made thereto, and finding the report correct as to form, and believing the public
good requires the laying out of the road as recommended by the viewers, it was on motion ordered
that the report be approved and adopted, and the road therein described and recommended by the
viewers be and is hereby declared a public highway. The clerk is directed to record the report,
plat the road, draw warrants in favor of parties for damages awarded, and cause notices to be
posted of opening of said road, and notify the road overseer of the proper district to open same
to travel in sixty days as required by law.

ROLLER COMPANY appeared before the Board and urged them to purchase for the benefit of the County
one of their Road Rollers, and after listening to his argument on behalf of same and looking into
the matter very carefully and fully believing that by the purchase of the same it would be a
savinG to the tax payers of the County in the way of making more substantial roads, it was on
motion ordered that the county purchase one and the following agreement was entered into in du-
plicate, viz:--

We propose to furnish you with one of our 20000* Steam
Road Rollers, delivered at Greeley, Colo. for the sum of THIRTY-TWO HUNDRED & FIFTY -(3250) Dollars
payable upon acceptance of roller by Weld County, warrant falling due June let, 1906 without in-
terest.
We guarantee this machine to be well made, of good material and durable with proper care,
and we agree to furnish, free of expense to you, for a period of one (1) year any part which may
prove defective in either workmanship or material.
We will further agree to send, without expense to you, a competent expert, who will unload
the machine, operate it for six (6) days and give instructions to such person as you may select to
have charge of it. Roller to be lettered "WELD CO. COLO." Machine to be equipped with band wheel
for power purposes and long arm extension draw bar for side hitch. Also with ejector and 25 ft.
suction hose for filling tasks or wagon. Guaranteed to draw a plow or grader, to run a stone
crusher; and to spike and roll a road to your entire satisfaction before acceptance. You to furn-
ish necessary timber and common labor for unloading.

REAL PROPERTY HELD BY WELD COUNTY.
Mr. C. M. Ireland came before the Board and represented that the
N.E.,T of Section 10, Tp. 1 N. , Range 65 West was sold to Weld County in 1892 for taxes of prior

years and that .he was desirous -of purchasing the certificates from the county, provided that he
could obtain .the same upon satisfactory t erms,i as the amount of taxes, interest and penalties
due thereon are a great deal more than the property is worth, and offered to pay the sum of $100.
for an assignment of said certificates.
After carefully considering the matter and believing it for the best interest of the county
to dispose of said certificates, the Board on motion ordered that his offer of $100. be and is
hereby accepted and the clerk is hereby authorized to notify the County Treasurer to make the
proper assiGnment to Mr. Ireland, or to whom he may designate, upon payment of the said sum of
$100.00.

WHEREAS, On this 23rd day of October A. D. 1905, Charles E.
Southard appearing before the Board of County Commissioners in regard to Certificates of Purchase
Nos . 1235--1236--1237--1238 and 1239, purchased by the County of Weld an or about the 9th day
of December A. D. 1896 for delinquent taxes for the year of 1895, on the Southeast quarter (SFe)
and the Southeast quarter of the Northeast Quarter ( SEe of NE+) of Section 9, Township Four (4)
North, Range Sixty—five (65) West. AND WHEREAS, It appears on the Treasurer' s Tax Sale Record
that the said Certificates of Purchase were assigned to Charles E. Southard by the said County
of Weld for the sum and amount- of $45.40 on or about the 7th day- of February 1898; that the said
sum of $45.40 was the sum and amount due at that time. And it further appearinG that the said
assignments by the said County of Weld do not appear of record in the County Clerk' s Tax Sale
record or in the Minutes of the Board of County Commissi onerm of that day. And WHEREAS, It fur-
ther appearing that on or about the 18th day of September 1901, alleGed assignments of said Cer—
tificates Nos. 1235--1236--1237-- --1238--1239 on that day were endorsed by the County of

Weld by the County Clerk to Chas. E. Southard, which said alleged assignments do not appear of
record in any place save and except as aforesaid. AND WHEREAS, It appearing that the true and
correct date of said assignments of said Certificates Nos. 1235, 1236, 1237, 1233 and 1239 was on
or about the 7th day of February 1898 in the manner and form as appears of record in the Treas-
urer's Tax Sale Record, and that the proper endorsements upon the said Certificates Nos. 1235,
1236, 1237, 1238 and 1239 were not made, and that, by a clerical mistake or ommission, the
proper notations of said assignments were not made in the County Clerkes Tax Sale Record. NOW
THEREFORE,
BE IT RESOLVED By the Board of County Commissioners of Weld County, Colorado that the al—
leGed assignments as endorsed upon the said. certificates Nos. 1235, 1236, 1237, 1238 and 1239
be stricken therefrom, and that the assignments be made by the proper officers therefor to the
said Chas . E: Southard in the manner and form as provided by law, upon the said certificates Nos.
