Staff comments made during this phase of the application process may not be all-inclusive as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Final Plan for a Minor Subdivision (5 lots with 1-2 (Medium Industrial) Zoning). This project is north of and adjacent to CR 46 and is west of and adjacent to CR 35. Parcel numbers 105711400002. Access is from CR 46. ACCESS Weld County Development Review has reviewed the application materials related to access. The applicant is proposing to have one (1) access on County Road 46 located approximately 1,590 feet west of County Road 35. An access for a subdivision onto a county -maintained road is considered an intersection when referring to Table 1, of Section 8-14-30, of the Weld County Code. (Table 1 contains the minimum access spacing requirements between accesses, and between accesses and intersections.) The proposed access location does not meet the minimum 660 -foot spacing requirement between an intersection and an access on a collector road, as prescribed in Table 1. Finding a location on County Road 46 that meets the minimum spacing requirements is not possible due to number and location of existing accesses on both sides of County Road 46. As a result, the proposed location will likely be approved by Development Review if it is determined to be safe for the traveling public. ACCESS PERMIT Per Section 8-14-30 of the Weld County Code, an Access Permit is required for access to Weld County maintained roadways. All "preliminarily approved" accesses are subject to change during the access permitting process. ROADS AND RIGHTS -OF -WAY County Road 35 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. Pursuant to the definition of setback in the Weld County Code, Section 23-1-90, the required setback is measured from the future right-of-way line. The physical location of CR 35 may not be centered in the right-of-way. This road is maintained by Weld County. County Road 46 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a collector road, which requires 80 feet of right-of-way. Pursuant to the definition of setback in the Weld County Code, Section 23-1-90, the required setback is measured from the future right- of-way line. The physical location of CR 46 may not be centered in the right-of-way. This road is maintained by Weld County. Per Chapter 8, Article 13, Section 8-13-30, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and or encroaching upon, any County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at: https://www.weld.gov/Government/Departments/Public-Works/Permits/Right-of-Way-Permits Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC The latest average daily traffic (ADT) on County Road 46 counted 1,638 vehicle per day, with 35% trucks. The 85th percentile speed on this section of County Road 46 is 61 mph. A preliminary Traffic Impact Study (TIS) was submitted with the application for review. According to the TIS, the proposed project is anticipated to generate approximately 347 daily weekday trips, 37 AM peak hour trips, and 39 PM peak hour trips. Per the Colorado State Highway Access Code, none of the AM or PM peak hour turning movement trips at the site's entrance trigger the need for auxiliary turn lanes on CR 46. In addition, the TIS states that the project's site generated traffic does not increase traffic at the US 85/CR 46 intersection by 20% or more (CDOT's trigger for requiring auxiliary lanes). The project's percent traffic impact at the foregoing intersection is less than 1.6%. A final accepted TIS completed by a Colorado Licensed Professional Engineer is required prior to recording the plat. TRACKING CONTROL POLICY Tracking control is required to prevent tracking onto county -maintained roadways. As specified in Section 24-5-20.A.17., the internal road shall be paved as it is tying into a paved county -maintained roadway (County Road 46). The paved internal road will function as the required tracking control. DRAINAGE REQUIREMENTS This area is within a Non -urbanizing Drainage Area. Non -urbanizing Drainage Areas typically require detention of stormwater runoff from the 1 -hour, 100 -year storm event falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm event falling on the undeveloped site having a 2% impervious value. A drainage report with a proposed retention pond (completed by a Colorado Licensed Professional Engineer) was submitted with the application. The report includes a variance request to use retention instead of detention and to waive the need to have an emergency spillway due to the project site's topography. A final drainage report completed by a Colorado Licensed Professional Engineer is required prior to recording the plat. The drainage report must include a certification of compliance stamped and signed by the PE. A Certification of Compliance form can be found on the Public Works Development Review website. General drainage report checklist is available on the engineering website. More complete checklists are available upon request. Subdivision drainage features shall be shown and labeled on the final plat. Historic Flows: The applicant will be required to maintain the historic drainage flows and run-off amounts from the property. INTERNAL ROAD Per Sections 24-3-20.A.1., 24-3-20.A.12., and 24-3-20.A.13., subdivisions are required to have an internal roadway that serves each lot with the roadway geometry and pavement design specified in the Weld County Engineering and Construction Criteria (WCECC) manual. A construction set drawings was submitted with the application. Per Section 4.6, of the WCECC manual, the maximum cul-de-sac length between intersecting roads (from centerline to centerline) is 1,500 feet. The proposed cul-de-sac exceeds the maximum length by approximately 460 feet. Therefore, the road shall be redesigned not to exceed the maximum allowed length prescribed by Weld County Code. Per Section 10.3.4, of the WCEDD manual, the applicant shall submit a soils report and associated pavement design to ensure the proper design of the internal road. IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT Per Section 24-2-40, the applicant shall submit a signed subdivision Improvements Agreement to construct the required improvements as shown on the approved plat and other supporting documents/construction plans. Collateral will be required per Section 2-3-30 of the Weld County Code to ensure the improvements are completed (and maintained during construction) and to cover any repairs needed during the warranty period. Approval of the Improvements Agreement will be a condition of approval for the subdivision and shall be approved by the Board of County Commissioners prior to recording the subdivision final plat. An example Improvements Agreement is available at: https://www.weld.gov/files/sharedassets/public/v/1 /departments/public-works/documents/usr-spr-permits- improvements-agreement-template.pdf The Improvements Agreement will detail the approved haul route(s), outline when offsite improvements will be triggered (if determined necessary upon review if the TIS), and include a maintenance agreement for the haul routes. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and any future off -site roadway improvement triggers. CONSTRUCTION SCHEDULE The applicant shall submit a construction schedule to be included in the Improvements Agreement. The schedule shall show the approximate dates for construction to begin and end. It shall also describe the anticipated stages associated with the development, the number of buildings/structures to be constructed in each stage, and the common open space areas (with quantities) to be completed in each stage. CONSTRUCTION COST ESTIMATE The applicant shall submit a construction cost estimate as defined in Section 8-2-50., of the Weld County Code to be included in the Improvements Agreement. UTILITY MAP A Utility Map showing the vehicular circulation system, gas lines, waterlines, electrical lines (above or below ground), telecommunication lines (if applicable), sewer lines (if applicable), utility and drainage easements with labels, culverts, and structures is required. The Utility Map shall be recorded with the Final Plan plat. CONSTRUCTION PLANS A construction set of plans was submitted with the application. The plan set shall include at a minimum: • Cover Sheet • Final Plat • Typical Cross Sections • Horizontal Control Plan • Right -of -Way Exhibit • Roadway Plan and Profile Sheets • Intersection Details • Utility Map • Grading Plan • Sediment and Erosion Control Plan • Detail Sheets Additional sheets may be required if determined necessary. GRADING PERMIT Per Weld County Code, Section 8-12-30.B, a Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permits are issued after the planning process is complete (Final Plat recorded). An Early Release Request Form may be entertained only after the applicant, Development Review, and the Planning Department have reviewed the referral and surrounding property owner comments and the case has been heard by the Board of County Commissioners (or the case has been approved by the Director of Planning Services if it is a case not requiring Board approval). The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact Development Review from the Department of Planning Services for more information. The Application Fee for a grading permit is $500. COLORADO STORMWATER PERMIT A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. CONDITIONS OF APPROVAL A. An Improvements and Road Maintenance Agreement is required for on -site improvements at this location. Road maintenance includes, but is not limited to, dust control and damage repair to specified haul routes. The Agreement shall include provisions addressing engineering requirements, submission of collateral, and testing and approval of completed improvements. (Development Review) B. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional Engineer registered in the State of Colorado is required. (Development Review) C. A final accepted TIS stamped and signed by a Colorado Licensed Professional Engineer is required. D. The Final Plan map shall be amended to delineate the following: 1. County Road 35 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. The applicant shall delineate and label on the Final Plan map the existing and future rights -of -way (along with the documents creating the existing right-of-way) and the physical location of County Road 35. If the existing right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code Section 23-1-90, the required setback is measured from the right- of-way line. This road is maintained by Weld County. The applicant must obtain an access permit in an approved location prior to construction. (Development Review) 4. Show and label the accepted drainage features and drainage flow arrows. Stormwater ponds should be labeled as "Stormwater Detention, No -Build or Storage Area" and shall include the calculated volume. (Development Review) 5. Show and label the required utility easements for each lot. (Development Review) 6. The applicant shall show on -site parking areas, if applicable. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE FINAL PLAN MAP) A. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) B. The access on the site shall be maintained to mitigate any impacts to the public road including damages and/or off -site tracking. (Development Review) C. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. (Development Review) D. The historical flow patterns and runoff amounts on the site will be maintained. (Development Review) E. Weld County is not responsible for the maintenance of onsite drainage related features. FIRE DISTRICT REFERRAL COMMENTS 1. These comments are provided in accordance with the 2018 International Fire Code and any other applicable standards and are based on the materials provided. 2. All work shall be completed in accordance with the 2018 IFC. 3. All construction/demolition shall comply with IFC Chapter 33. There must be an acceptable driving surface for emergency vehicles provided prior to and throughout construction. 4. All roads within the site and at the entrance shall be able to accommodate the weight of our heaviest fire apparatus and meet the requirements of IFC 503 & Appendix D throughout regular operations at the site. This driving surface shall always be maintained. 5. All street dimensions shall meet the requirements of IFC 503 & Appendix D. 6. Any dead-end streets shall meet the requirements of IFC 503 & Appendix D, or a turnaround feature will be required to be installed on all roads in excess of 150' meeting the IFC requirement 7. Fire hydrant spacing shall meet the requirements of IFC Appendix C. 8. Verification is required that the proposed water main and fire hydrants will meet the required minimum fire flow requirements as detailed in the Water Supply Requirements for the Baker Subdivision provided from the LaSalle Fire Protection District on July 11, 2024. 9. A clear space of not less than three (3) feet around fire hydrants shall always be maintained in accordance with IFC 507.5.5 10. Any construction near current or old oil and gas facilities, wells, pipelines, etc. Shall meet the requirements of the La Salle Fire Protection District, Weld County and the ECMC (Colorado Energy and Carbon Management Commission). Proper documentation is required that all pipelines have been accounted for and that the developer is aware of these. 11.
