Mary Ann Feuerstein, Recorder RESOLUTION WHEREAS, a public hearing was held on Monday, March 22, Li 1971, at 10:30 o'clock A. M. in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing a petition of Clyde L. Davis, 923 - 16th Street, Greeley, Colorado, requesting change of zone from "A" Agricultural District to "B-UD" Business-Unit Development District, in accordance with official development plat and plan, copy attached, to be recorded in the office of the Weld County Clerk and Recorder, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the petition of Clyde L. Davis, 923 -16th Street, Greeley, Colorado, for change of zone from "A" Agricultural District to "B-UD" Business - Unit Development District, said area being more particularly described as follows: A tract of land located in the Southeast Quarter of the Southeast Quarter (SEISE+) of Section Thirty-six (36), Township Six (6) North, Range Sixty-seven (67) West of the 6th P. M. , Weld County, Colorado, being more particularly described as follows: Beginning at the Southeast corner (SE corner) of said Section 36 and considering the East line of the South- east Quarter (SE4) of said Section 36 to bear North 0° East with all bearings contained herein being relative thereto; Thence North 90° West along the South line of the Southeast Quarter (SE+) of said Section 36, 1, 385 feet more or less; Thence North 0° East, 480 feet more or less to an existing fence; Thence along said fence the following three courses and distances: North 89° East, 200 feet; North 72° East, 200 feet; North 34° East, 140 feet; Thence, leaving said fence, North 90° East, 900 feet more or less to the East line of the Southeast Quarter (SEI) of said Section 36; Thence South 0° West along the East line of the Southeast Quarter (SE4-) of said Section 36, 620 feet more or less to the true point of beginning, containing 19 acres more or less, all as shown on official development plat and plan, hereinabove mentioned, copy of which is attached hereto and made a part hereof by reference, be, and it hereby is granted under the conditions following: 710014 e ' 'x'78 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolution of Weld County, Colorado. Chairman Date N I I • SKI-FUN VALLEY B-UD REGULATIONS USES Winter recreational uses requiring a snow cover such as skiing, sledding, and tobogganing, developed as a business interprise for public use. Related uses will also be provided in the form of a parking lot, an office- refreshment-storage building to serve customers, and a rental service of winter recreational equipment. PARKING A gravel surface parking lot shall be provided capable of containing T10 autos. If usage exceeds the quantity provided, an additional area to the south is available as overflow parking. STRUCTURES One building shall be provided to house a small office, warming area, storage, snack bar, and restrooms. The maximum size of this building shall be 24 x 40 feet. Ski tow equipment shall also be provided, but will 7 not be housed within a structure. LIGHTING Flood lighting shall te provided in activity areas. Lighting shall be directed away from adjoining property. SIGNING One identificati-on sign will be provided. It shall set back from the County road 25 feet and shall not exceed -a total area per face of 25 square feet. The sign, if lighted, will not have any flashing or rotating lights. Maximum height shall not exceed 8 feet, and will be designed as a low profile sign. SETBACKS All structures shall be set back at least 25 feet from any property line or dedicated road. OPERATION The use is primarily seasonal , operating in winter months during daylight and evening hours up to seven days a week. CONSTRUCTION SCHEDULE Construction and operation will commence within one year of the date hereon approved by the Weld County Board of County Commissioners. UTILITIES Water source will be the City of Greeley. Water lines run through the property. Sewage treatment will originally be approved chemical toilets, eventually a septic tank and leach field will be provided meeting the requirements of the Health Department.
