WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a tract of land more
particularly described as follows, to-wit:
A tract of land, 200 feet by 200 feet, in the NE1 of Section
34, Township 2 North, Range 66 West, said tract being
more particularly described as follows:
COMMENCING at the Northeast corner of the NEB'- of
Section 34-2N-66W; thence in a westerly direction with
and along the North property line of said NE4 of Section
34, 456. 1 feet to a point on said North property line;
thence South 0° 20' West, 260 feet to the PLACE OF
BEGINNING; thence South 0° 20' West, 200 feet to a point;
thence North 89° 40' West, 200 feet to a point; thence
North 0° 20' East, 200 feet to a point; thence South 89°
40' East, 200 feet to the place of beginning, containing
. 918 acres, more or less,
representing an easement granted to Colorado Interstate Corporation,
a Delaware corporation, from Emma Lee Anderson, for the purpose of
erecting thereon natural gas meter, regulator and all related facilities
does not come within the purview of the definitions of the terms
"Subdivision" and "subdivided land" as set forth in CRS 106-2-33, (3)
(a) and (b) 1963, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land for the
aforesaid reasons pursuant to its authority under CRS 106-2-33 (d), 1963,
as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land, being an easement granted to Colorado Interstate
Corporation by Emma Lee Anderson to be used solely for the purpose of
erecting and maintaining thereon natural gas meters, regulators and all
related facilities be exempted from the definition of the terms "Subdivision"
and "subdivided land" as provided for in the new Weld County Subdivision
Regulations at Section 24, A. , (3), adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 8th day of November,
1972.

The Meld County Utilities Coordinating Board held a regular
meeting Thursday , November 2 , 1972 at 10 : 00 A. M. in the Blue
Flame Room of the Greeley ' Gas Company.
Roll call was as follows :

As a quorum was present , the Weld County Utilities Coordinating

SUBJECT : Minutes

MOTION : By Mr . Ewing approve the minutes of the last regular
meeting as mailed . Second by Mr . Anderson . A unanimous
vote of -"Aye " . Motion carried .
APPLICANT : Colorado Interstate Gas Company
SUBJECT : Spindle meter station
LOCATION : NE4 Sec 34 T2 R66
APPEARANCE : B . C . Stenzel , C .I . G.
r DISCUSSION : Mr. Stenzel stated they proposed to build a 6" natural
gas pipe line starting in Sec 34 T2 R67 , approximately 4 miles
west of Ft . Lupton . It will take casing head gas from Amoco
plant , mostly across privately held land , and will ultimately
deliver to Western Slope Gas Line in the NE4 Sec 34 T2 R66 .
Until the Amoco plant is operating , they will take their. oas
with impurities through their line and will build a 6" line 3 mi .
north to their Wattenburg meter station and put it into their
line at that point , Mr . Stenzel presented pictures of the
facilities . A part of their facilities are included in the
Amoco plant application . Mr . Lorenson read a letter previously
written to Mr. Chapman with respect to subdivisions . A request
for a subdivision exemption is currently in process . A build-
ing permit can be issued when a resolution from the County Com-
missioners is received .
MOTION : By Mr . Anderson to approve the location of the spindle meter
station . Second by Mr. Kelly . A unanimous vote of "Aye" .

APPLICANT : Weld County Planning Commission
CASE NUMBER : Z-210
SUBJECT : Zone change MH to A
LOCATION : NW4 Sec 3 T3 R68
APPEARANCE : Jim Kanemoto , Gil Olsen
DISCUSSION : Mr . Lorenson stated this parcel was platted and recorded .
in 1963 and relatively unused . The roads have been graded in
and later in the 1960s the developer': requested a zone change to
"MH" . The zone change was granted by the County Commissioners .

The recommendation by the Planning Commission was for 6 months
temporary zoning . A plan was submitted which relotted the area
but was never recorded or the plan carried out. Mr . Kanemoto
would like to develop the area as was originally platted , known
as Fairways Living Ranchettes as residential . The Planning Com-
mission is initiating the rezoning , with the approval of Mr .
Kanemoto . Mr. Kanemoto stated the telephone lines are in on.
poles . They plan to have them put underground . Mr . Fagan state
arrangements have been made for Little Thompson Water , lines
will be in the streets . The Board requested that a composite
map of the utilities be presented . Mr. Kanemoto stated they
planned to pave the streets and have all under ground utilities .
Mr. Olsen stated he is representing the surrounding property
owners and they are very much in favor of the zone change back
to Agriculture . Mr . Ewing stated the only problem is the ROW
which only shows 40 ' and 50 ' is normally required . Mr . Kanemoto
stated there is an existing house on Lot 2 and they have contracts
on two other lots . Mr . Ewing stated this will never be a through
road as they do not have access to the Interstate .
MOTION : By Mr . Ewing to approve the plat subject to review of a
utility plat and if need be ,modifications made . Second by Mr .
Mauldin . A unanimous vote of "Aye" Motion carried .
SUBJECT : Proposed regulations for reservoirs and ditch companies . -
DISCUSSION : Mr . Lorenson stated several meetings previous , there
was a set of regulations presented that Larimer County is using
with respect to ditch companies and reservoirs for ditch ROW.
` A letter has been received from Mr. Walker Miller representing
Union REA stating he would like to discuss this before anything
, is adopted . Mr . Miller introduced John Wolken who is ROW agent
for Union REA. Mr. Miller stated the regulations adopted by .
Larimer County were very objectionable . He felt if policy such
as this were adopted , it would be extending ditch companies
legal rights . After further discussion , Mr. Mauldin proposed
that no action be taken at this time . Mr . Anderson stated he
is a member of the Larimer County Utility Board which is not a
legal board as the Weld County Board is . He felt the regulations
were intended expressly for subdivisions . Mr ! Anderson suggested
• this set of regulations be presented to. the County Attorney for
revision . Mr . Miller stated he would be glad .to present a
written memorandum of why they are objecting to the proposed
regulations .

SUBJECT : Replat of three lots in Rainbow Acres
LOCATION : SE4 Sec 10 T5 R65
APPEARANCE : Dennis Mesner
DISCUSSION : Mr . Lorenson presented the proposed replat . Three lots
will be platted into 2 lots . They previously faced onto 16th
St . and will now face Elder Avenue . The zoning is appropriate
but the utility easements will have to be reestablished to see
if they are appropriate . They are requesting a variance from the
subdivision regulations in regard to ratio of lot length , which
is more than 3 to 1 . There was discussion regarding access on
to 16th St . Mr . Lorenson stated there can be a notation on the

plat to this effect .
MOTION : By Mr. Fouts to approve the easements as shown -on the
plat subject to no access onto 16th St . Second by Mr . Ander-
son . A unanimous vote of "Aye" . Motion carried .
APPLICANT : Western Slope Gas Company
SUBJECT : Metering station in Aristocrat Ranchettes
APPEARANCE : Douglas H. Smith and J . P . Longman
DISCUSSION : Mr . Smith presented their plans stating the building
will contain regulators and meters . They are purchasing an
entire lot in the subdivision . It will have a set-back of
110 ' from the centerlineof the road or the section line , Mr.
Lorenson stated they can be issued a building permit by pre-
senting a deed showing they own the entire lot .
MOTION : By Mr . Ewing to approve the location of the metering station .
Second by Mr. Fouts . A unanimous vote of "Aye" . Motion carried .
SUBJECT : Map of Mt . Bell facilities
Mr. Mauldin presented a map showing the telephone- facilities
in Greeley and the surrounding area . More copies may be ob-
tained for a fee .
SUBJECT : Utility Installation Agreement
DISCUSSION : Mr. Lorenson read the minutes of the Planning Commis-
sion meeting regarding the proposed utility installation agree-
ment. No action was taken by the Planning Commission . Mr.
Lorenson stated the Utility Board could poassibly, take some
action regarding the agreement .. Mr. Ewing suggested some
arrangement could be made by the utility companies to have the
developer sign the agreement before the Clearance Record is
signed by the utility company. Mr . Ewing stated he felt be-
fore the Utility Board takes any action regarding this agree- .
ment , they should get a consensus of opinion from all utilities
represented . A cover letter could be sent out stating this
agreement is under consideration as a requirement in the sub-
dividing process and to make their comments known and would
they be in favor of adopting this . Mr. Mauldin agreed to write
the cover letter. The letter along with the proposed agree-
ment will be mailed to all utilities .

EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
THAT the undersigned, hereinafter called First Party, whether one or
more, in consideration of the sum of Ten Dollars ($10.00) and other good and
valuable consideration in hand paid by COLORADO INTERSTATE CORPORATION, a
Delaware corporation, hereinafter called Second Party, the receipt of which
is hereby acknowledged, does grant, sell and convey unto said Colorado
Interstate Corporation, its successors and assigns, the right, privilege and
authority to construct, operate and maintain natural gas meter and regulator
facilities, pipelines, odorization facilities, and all other necessary and
related facilities, for use in connection with Second Party's natural gas
pipelines on the following described property situate in the County of Weld,
State of Colorado:
A tract of land, 200 feet by 200 feet, in the NE's•, of
Section 34, Township 2 North, Range 66 West, said
tract being more particularly described as follows:
COMMENCING at the Northeast corner of the NEk of
Section 34-2N-66W; thence in a westerly direction

First Party further grants unto said Colorado Interstate Corporation
the exclusive use of the surface of the above described property for the
purposes stated above, together with the right of ingress and egress to and
from said facilities and lines for the purpose of maintenance, replacement,
repair and operation.
All structures placed upon said premises shall, regardless of the char-
acter thereof, remain the personal property of Second Party, and shall be
removed therefrom at the expiration of this grant.
It is also agreed that this easement shall be assignable in whole or in
part. It is also agreed that the easement herein granted to Colorado Inter-
state Corporation is a perpetual easement, but that the same will revert to
First Party upon abandonment by Second Party.
