Home My WebLink About740360 ` rJ RESOLUTION WHEREAS, a public hearing was held on June 10, 1974 in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Mile High Turkey Hatchery, Inc. , 711 South Bowen, Longmont, Colorado, requesting approval to locate a turkey farm operation on the following described property, to-wit: The Southeast Quarter (SE4), and the Northwest Quarter (NW4) of the Northeast Quarter (NE4), and the South Half (Si) of the Northeast Quarter (NE4) of Section 19, Township 3 North, Range 65 West of the 6th P. M. , Weld County, Colorado, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the location of a turkey farm operation, and WHEREAS, according to Section 3. 3 (3) (c) of the Zoning Resolution of Weld County, said request to locate a turkey farm operation may be authorized upon the approval of the Board of County Commissioners, Weld County, Colorado, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Mile High Turkey Hatchery, Inc. , 711 South Bowen, Longmont, Colorado, to locate a turkey farm operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to construct said turkey farm operation and that he shall have up to one year from date hereof to begin construction thereof. 3. That when said turkey farm operation is completed same shall be limited in pen size as indicated on plans as submitted. 4. That said turkey farm operation shall not be expanded to house more than 60, 000 turkeys. 5. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the zoning resolutions of Weld County, Colorado. There has not been enough time for notification of certain State agencies in several instances. There also has not been enough time for their response before the meeting date. It's difficult to write staff comments and discuss them with the applicant(s) . It is recommended we allow 30 days lead time on all cases (SUP, Zone Changes, etc. ) . This will allow sufficient time for return input plus comply with State regulations. Planning Commission has the right to set reasonable procedures outside anything else. Procedure by policy has to be approved by the Planning Commission, the staff can't just do it on their own. MOTION: By Mr. Heitman, To approve a 30 day pre-submittal time on all appli- cations. Seconded by Mr. Nix. A vote of "Aye" by Watson, Nix, Anderson and Heitman. Motion carried. SUBJECT: George Nordon, Zoning Violation Tape 543 LOCATION: Lot 2 Schmidts Estates Subdivision DISCUSSION: Mr. Watson read letter from Mr. Kavalec, Zoning Inspector, regarding the violation of storage of heavy equipment in an agricultural zone. Mr. Nordon has been notified that he was in violation and had ten days to comply with the zoning regulations. Since he was notified, Mr. Nordon has moved in more equipment and does not appear to be complying. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners that legal action be taken against Mr. George Nordon. Motion by Mr. Nix, seconded by Mr. Anderson. VI Soils have severe limitations that make them generally unsuited to cultivation and limit their use largely to pasture or range , woodland or wildlife food and cover ; (2 ) The adopted Aquifer Recharge Map indicates the proposed subdivision is in an aquifer re- charge area . The water study report submitted confirms this and makes recommendations as to well depths ; (3 ) Utility Board recommends approval ; (4 ) Weld County Health Dept . recommends approval on individual water supply and individual septic systems ; and (5 ) State Engineer recommends conditional approval - (a ) Reduce lawn area to a quarter acre per unit , - ( b ) Will have to go deeper on the wells in order to go into the Laramie Fox Aquifer later on . Mr . Lorenson stated that one other thing needed to be taken into consideration . There are several other approved subdi - visions in the area . This is also removed from any of the growth areas . It appears , however , that there are already a number of available lots in the general area . Mr . Froman stated the land belongs to his sister and he doesn ' t feel the ground is farmable . Contains about 20 acres ; wants 9 lots . There is some question at this time if there is really a need for this . School District RE3-J has been notified , but no comment received to date . MOTION : By Mr . Weigand , To take this under advisement . Seconded by Mr. Heitman . A vote of "Aye" by Watson , Weigand , Heitman , Elliott and Severin . Mr .
