Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: Amendment to Pelican Shores PUD to adjust the internal lot lines between Tract A and Tract B. This project is north of and adjacent to County Road 26 and is west of and adjacent to County Road 13. Parcel numbers: 120736401027 & 120736402018. Access is from County Roads 13 & 26. ACCESS Development Review has reviewed the application materials related to access. The PUD currently has two (2) existing accesses onto county roads. Pelican Shores North has an existing access on County Road 13 at a location approximately 3,195 feet north of County Road 26. Pelican Shores South has an access on County Road 26 at a location approximately 1,275 feet west of County Road 13. No new accesses are proposed with this amendment. ROADS AND RIGHTS -OF -WAY County Road 26 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. Pursuant to the definition of setback in the Weld County Code, Section 23-1- 90, the required setback is measured from the right-of- way line. Be aware that the road may not be centered in the right-of-way. This road is maintained by Weld County. The Pelican Shores North access is located on a portion of County Road 13 under the jurisdiction of the Town of Firestone. TRAFFIC Latest ADT on County Road 26 counted 295 vpd with 2% trucks. The 85th percentile speed is 42 mph. No traffic data is available for this portion of County Road 13. DRAINAGE REQUIREMENTS There are no drainage requirements with this amendment. CONDITIONS OF APPROVAL The plat shall be amended to delineate the following: 1. County Road 26 is a paved road and is designated on the Weld County Functional Classification Map as a local road which requires 60 feet of right-of-way. Delineate and label the existing right-of-way (along with its creating document), the existing access, and the physical location of the road. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. (Development Review) 2. This portion of County Road 13 is under the jurisdiction of the Town of Firestone. Show and label the right-of-way, the existing access, and the physical location of the road. Include the Town of Firestone access permit number if applicable. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE PLAT) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off -site tracking. (Development Review) 3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized. (Development Review) 4. Any work that may occupy and/or encroach upon any County rights -of -way or easement shall require an approved Right -of -Way Use Permit prior to commencement. (Development Review) 5. The historical flow patterns and runoff amounts will be maintained on the site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to runoff rate and velocity increases, diversions, concentration and/or unplanned ponding of stormwater runoff. (Development Review) 6. Weld County is not responsible for the maintenance of on -site drainage related features. The recommended plat notes are in accordance with PF-1011. We recommend the following appear as notes on the Final plat: 1. Water service may be obtained from Central Weld County Water District and Little Thompson Water District. 2. Sewer service shall be obtained from the St. Vrain Sanitation District. 3. Passive and active recreational uses shall be defined. 4. Permanent restroom and handwashing facilities shall be provided within easy access of the public gathering areas. 5. The recreational uses on the lakes will require compliance with the water quality standards of the Colorado Department of Public Health and Environment Swimming Pool and Mineral Bath Regulations. 6. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 7. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 8. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. If land development creates more than a 25 -acre contiguous disturbance, or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 10. DELINEATE ON THE PLAT: Show the floodplain and floodway boundaries on the plat. Label the floodplain boundaries with the FEMA Flood Zone and FEMA Map Panel Number or appropriate study. PLAT NOTES: 1. A Flood Hazard Development Permit is required for all construction or development occurring in the floodplain or floodway as delineated on Federal Emergency Management Agency (FEMA) FIRM Community Panel Maps # 08123C -1890F, date November 30, 2023 (St. Vrain Creek). Any development shall comply with all applicable Weld County requirements, Colorado Water Conservation Board requirements as described in Rules and Regulations for Regulatory Floodplains in Colorado, and FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65.
