The submitted material does not qualify as a "subdivision" as defined in section 30-28-101(10)(a) of the Colorado Revised Statutes ("C.R.S."). Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments regarding the proposed water supply. The comments will not state an opinion on the adequacy of the water supply or the ability of the water supply plan to satisfy any County regulations or requirements, and cannot be used to guarantee the physical availability of water or the issuance of a well permit. The application seeks to change the zoning on 49 acres consisting of 4 properties to match its historic use of agricultural production. The property will also be the future location for the West Greeley Conservation District office. The potable water source for the property is the City of Greeley. The applicant provided a copy of a water bill from the City of Greeley for the period of July 2, 2024 through August 1, 2024, confirming that water service is presently being provided to the property. This office considers the City of Greeley to be a reliable water source. According to records available to this office, the farmland has historically been irrigated with water from the Canal 3 Ditch. The Canal 3 Ditch is an acceptable source of irrigation water provided that the applicant has shares or rights that entitle them to the use of water from the ditch. In addition, well permit no. 14178-R was decreed in case no. W-1951 as Straight Well No. 14178 for the irrigation of 18 acres of land in the southeast quarters of Section 10, Township 5 North, Range 65 West, 6th P.M.
