site is located within the Greeley's Long Range Expected Growth Area (LREGA), the area in which the
community anticipates annexation and urban development to occur in the future. The Comprehensive Plan
indicates this property as future Suburban areas.

Dear Ms. Aungst:
We have reviewed the above referenced application for a Change of Zone. The submitted material
does not qualify as a "subdivision" as defined in section 30-28-101(10)(a) of the Colorado Revised
Statutes ("C.R.S."). Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the
referral information and provide comments regarding the proposed water supply. The comments will
not state an opinion on the adequacy of the water supply or the ability of the water supply plan to
satisfy any County regulations or requirements, and cannot be used to guarantee the physical
availability of water or the issuance of a well permit.
The application seeks to change the zoning on 49 acres consisting of 4 properties to match its historic
use of agricultural production. The property will also be the future location for the West Greeley
Conservation District office.
The potable water source for the property is the City of Greeley. The applicant provided a copy of a
water bill from the City of Greeley for the period of July 2, 2024 through August 1, 2024, confirming
that water service is presently being provided to the property. This office considers the City of
Greeley to be a reliable water source.
According to records available to this office, the farmland has historically been irrigated with water
from the Canal 3 Ditch. The Canal 3 Ditch is an acceptable source of irrigation water provided that
the applicant has shares or rights that entitle them to the use of water from the ditch. In addition,
well permit no. 14178-R was decreed in case no. W-1951 as Straight Well No. 14178 for the irrigation
of 18 acres of land in the southeast quarters of Section 10, Township 5 North, Range 65 West, 6th
P.M. The Straight Well No. 14178 is included in the Cache la Poudre Water Users Association plan for
augmentation decreed in case no. W-7921 ("Poudre Plan"). The well may supply the proposed

for augmentation.

Public Service Company of Colorado's (PSCo) Right of Way & Permits Referral Desk
has reviewed the request for the above -mentioned Rezone.
Please be advised that Public Service Company has existing overhead electric
distribution facilities along and within the areas indicated in this proposed rezone. Public
Service Company has no objection to this proposed rezone, contingent upon PSCo's
ability to maintain all existing rights and this amendment should not hinder our ability for
future expansion, including all present and any future accommodations for natural gas
transmission and electric transmission related facilities, and that our current
use/enjoyment of the area would continue to be an accepted use on the property and
that it be "grandfathered" into these changes.
