The proposal has been reviewed on behalf of the Weld County Department of Public Works and the
Department of Planning and Zoning. Staff comments made during this phase of the application process
may not be all-inclusive, as other issues may arise during the remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site -Specific Development Plan and Use by Special Review Permit, for 2 a
Residential Therapeutic Centers That Could House Up to 16 Residents in Each Center and a Residential
House, Outside of Subdivisions and Historic Townsites in the A (Agricultural) Zone District.
This project is north of and adjacent to CR 6 and is east of and adjacent to CR 13 — Colorado Blvd.

Access is onto CR 6.
ACCESS
Development Review has reviewed the application materials related to access.
The parcel has an existing, unpermitted access onto CR 6 approximately 295 feet east of the intersection
with CR 13 — Colorado Boulevard. This access point does not meet the Minimum Access Spacing Criteria,
as specified in Table 1 below. The application materials propose that the existing, unpermitted access point
be closed and reclaimed and that a new access point onto CR 6 be used.
It is noted that the County will be replacing the existing T -intersection with a round -about, that will require
additional right-of-way. During this process, the County will relocateckand permit the access for the
developer.
The applicant shall obtain an access permit for a location that meets the Minimum Access Spacing Criteria,
as specified in Table 1 below, and that meets the design configuration for the proposed round -about.

Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We
strongly encourage you to discuss your access with Development Review prior to laying out your site plan
to ensure the approved accesses are compatible with your layout. Per Sec. 24-8-40, when feasible, there
shall be no net increase in the number of accesses to a public road. Minimum access spacing are shown
in Weld County Code, Sec. 8-14-30 Table 1. Please refer to Chapter 8 of the Weld County Code for more
information regarding access.
ROADS AND RIGHTS -OF -WAY
County Road 6 is a paved road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. The applicant shall
delineate and label on the site map or plat the future and existing right-of-way (along with the documents
creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified
it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the
required setback is measured from the future right-of-way line. Be aware that physical roadways may not
be centered in the right-of-way. This road is maintained by Weld County.

Per Chapter 8, Article 13, Section 8-13-30, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Recent traffic counts (2022) on this portion of CR 6 counted 2,696 vehicles per day with 24% trucks.
The original application materials included a Preliminary Traffic Analysis .Narrative. Subsequently, a
revised application was submitted. The revised application did not include revised traffic information,
An acceptable Traffic Analysis, that addresses the revised application, shall be submitted. Based on the
Analysis, a road maintenance agreement or improvements agreement may be required.
TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to paved
roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For
access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road
base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction
unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not
allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior
to entering publicly maintained roadways. A variance request for alternatives to the tracking control
requirement can be submitted to Development Review for review and consideration.
This site requires double cattle guards and 100 ft. of asphalt or 300 ft. of asphalt.
DRAINAGE REQUIREMENTS
This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of
runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at
the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas.
The original application included a drainage narrative stating that the site will not increase imperviousness.
Subsequently, the application and associated site plan were revised to add additional imperviousness.
Therefore, an updated drainage report shall be submitted that addresses stormwater management to
include detention, shall be submitted.
No other stormwater management information is needed at this time
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Development Review for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. An acceptable Final Traffic Analysis is required. (Development Review)

C. The USR map shall be amended to delineate the following:

3. Show and label the proposed access location onto CR 6, the approved access width and the
appropriate turning radii on the site plan. The applicant must obtain an access permit in an
approved location prior to construction. Label the existing, unpermitted access point onto CR 6 as
"Close and Reclaim." (Development Review)
4. Show and label the approved tracking control on the site plan. (Development Review)
5. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around
the property. (Development Review)
6. Show and label the entrance gate if applicable. An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled
surface be less than 35 feet. (Development Review)

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off -site tracking. (Development Review)
3. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire
an approved Right -of -Way Use Permit prior to commencement. (Development Review)
4. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a Site -Specific
Development Plan and Use By Special Review Permit, for a Residential Therapeutic
Center, outside of subdivisions and historic townsites in the A (Agricultural) Zone.
The existing residence has a tap from Central Weld County Water District and an On -
site Wastewater Treatment System (OWTS) that is permitted for 6 bedrooms (SP -
0400266). An OWTS was permitted in 2019 (SP -1900111) to replace an existing failing
system. An engineer review is required to ensure the OWTS is adequate for additional
usage. The future residential treatment facility will require an engineered OWTS for
commercial use. The proposed private residence may also require an engineered
OWTS due to slow percolation rates.
Central Weld County Water District indicated in an email dated November 21, 2023: "At
this point the District has no immediate concerns that would prevent Jordan from
moving forward with his application. We will review any changes that may occur during
the application process and respond during the referral phase if any additional District
requirements must be met."
The Colorado Department of Public Health and Environment has specific regulations
which are outlined in 6 CCR 1011-1 Chapter 7. Additional licenses or registrations may
be required from Weld County Department of Human Services and the Colorado
Department of Human Services.
Environmental Health Services recommends the following requirement is met prior to
recording the plat:
1. As the applicant intends to utilize the existing On -site Wastewater Treatment
system the system shall be reviewed by a Colorado Registered Professional
Engineer. The review shall consist of observation of the system and a technical

review describing the system's ability to handle the proposed hydraulic load. The
review shall be submitted to the Environmental Health Services Division of the
Weld County Department of Public Health and Environment. In the event the
system is found to be inadequately sized or constructed the system shall be
brought into compliance with current Regulations.
Environmental Health Services recommends the following requirement is incorporated
into the permit as a condition that must be met prior to the issuance of any Certificate of
Occupancy:
1. On -site Wastewater Treatment systems are required for the proposed facility and
shall be installed according to the Weld County On -site Wastewater Treatment
System Regulations. The OWTS are required to be designed by a Colorado
Registered Professional Engineer according to the Weld County On -site
Wastewater Treatment System Regulations.
Environmental Health Services recommends the following requirements be incorporated
into the permit as development standards:
1. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
2. Fugitive dust should attempt to be confined on the property. Uses on the
property should comply with the Colorado Air Quality Commission's air quality
regulations.
3. Adequate drinking, handwashing and toilet facilities shall be provided for the
facility, at all times. A permanent, adequate water supply shall be provided for
drinking and sanitary purposes.
4. Any On -site Wastewater Treatment System located on the property must comply
with all provisions of the Weld County Code, pertaining to On -site Wastewater
Treatment Systems.
5. If an On -site Wastewater Treatment System serves twenty or more people per
day, the facility shall submit an Underground Injection Control (UIC) Class V
Injection Well permit to the Environmental Protection Agency (EPA).
6. The facility shall comply with the Colorado Department of Public Health and
Environment, Colorado Department of Human Services, and the Weld County
Department of Human Services, rules and regulations regarding registration and
licensing requirements.
7. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

I have reviewed the submitted material pertaining to the Site Development Plan and Use by Special Review Permit for a
change of use from a single family residence to an assisted living facility for 16 residents at 6045 County Road 6 (Case
Number USR23-0046). The Fire District does not object to the request for Change in Use provided the requirements of
the Fire District can be met. All applicable codes as they pertain to building construction, fire protection systems, water
supply for fire protection (fire hydrants), fire department access, etc. must be met.
Construction plans and plans for all fire protection system installation or modification must be submitted to an approved
prior to the issuance of any building permits.

I wish to submit the following information regarding the above referenced project.
The concerns of Farmers Reservoir and Irrigation Company are in the area of
encroachment to the Right of Way of the canal. FRICO requires a minimum of 25' on
each side of the canal for a maintenance road plus the distance to the toe of the ditch
embankment. The boundaries of the Right of Way must be agreed upon.
Drainage is another concern that must be addressed as FRICO does not allow any
developed storm flow into our canals. This will apply if any development happens.
Property concerns need to be resolved.
No construction of any structure can be put on our ROW. No use of any sort
including pedestrian or vehicle on our ROW is approved.
Please send drainage study and additional information regarding your project so that
we may complete our review and that review criteria can be sent to you, if applicable.
FRICO does not accept retention ponds adjacent to our facilities, however, we may
grant a variance with submittal of application and engineering deposit for review of
drainage plan and other documents.
Canal road may not be used for access without approval and executed agreement.

A water study has not been completed for this project. The District requires that the applicant submit fire
flow requirements (or proof that the servicing fire department has reviewed the project and has no requirements),
water usage comparisons from similar operations, and study fees to the District in order to determine if the
existing tap is adequate for the project as proposed.
