Right-of-Way A parcel of land lying in the SW4 of Section 5, Township 1 North, Range 66 West of the 6th Principal Meridian, County of Weld, State of Colorado, described as follows: Beginning at a point on the East boundary of the Union Pacific Railroad right-of-way and 300. 0 feet northerly of the South boundary line of said SW-1- of Section 5; thence northerly along said East boundary line of the Union Pacific Railroad a distance of 360. 0 feet, more or less, to a point on the North line of the existing Public Service Company right-of-way as described in Book 1216 at Page 226 of the Weld County Records; thence easterly along said North right-of-way line a distance of 175. 0 feet to a point; thence southerly and parallel to the East boundary line of the Union Pacific Railroad right-of-way a distance of 360. 0 feet, more or less, to a point; thence westerly and parallel to the South boundary line of said SW 4 of Section 5 a distance of 175. 0 feet, more or less, to the point of beginning, to be used for an electrical substation to serve the Fort Lupton area and associate right-of-way into said subdivision does not come within the purview of the definitions of the terms "Subdivision" and "subdivided land" as set forth in CRS 106-2-33, (3) (a) and (b) 1963, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, desires to exempt this particular division of land for the aforesaid reasons pursuant to its authority under CRS 106-2-33 (d), 1963, as amended, 720557 NOW, THEREFORE, BE IT RESOLVED, that the hereinabove described tract of land and adjoining right of way, being the property of the Public Service Company of Colorado and to be used solely as an electrical substation to serve the Fort Lupton area, be exempted from the definition of the terms "Subdivision" and "subdivided land" as provided for in Weld County Subdivision Regulations at Section 2-1, A. , (3), adopted August 30, 1972, The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 8th day of November, 1972. Bearly Dear -Glenn : This letter is written to request an exemption from the provisions of Senate Bill No . 35 , pursuant to C.R. S . (1963) 106-2-33 (3) (d) , as amended. The situation as I explained to you and with which I believe Mr. Ashley is familiar, is this : Mr. Bearly is the owner of property located in Weld County , a copy of a map of his property being enclosed herewith. Mr. Bearly entered into an Agreement with Mr . Leo V. Gormally,, under the terms of which Mr. Gormally was to build a house for Mr. Bearly on the North 5 acres of Mr. Bearly ' s property. Mr. Gormally would then trade the house to Mr. Bearly for the remaining 10 acres , it being Mr. Gormally ' s intention in order to come out on the -project that he would divide that remaining 10 acres into two 5-acre parcels and would build a house on each of those parcels . We believe that this request for exemption does not violate in principle , Senate Bill No . 35 . I do not find a purpose clause in C .R. S. , Chapter , 106 , Article II , but C . R.S . 106-2-14 does set forth some considerations regarding the public welfare , , etc. We believe the granting and exception in this case does no violence to that provision. • We have adequate water, a copy o£ a letter from the Little Thompson Valley Water District is enclosed, and we have contacted Mr. Glenn Paul and he advises us that the soil situation is more than adequate to take care of 3 septic tank systems . We would very much appreciate it if you could take this matter up at your earliest convenience , and would hope it could be taken • care of at your meeting on October 18 , 1972 . The continued subdivision of land in this area in a piecemeal fashion may lead to road, water, and sewer pro- blems, and conflicts with agriculture in the future. There is no 'existing public access to two of the proposed lots. The Minor Subdivilsion procedure is available for two-lot splits.
