Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Assistant County Attorney, Matthew Conroy The following business was transacted: I hereby certify that pursuant to a Notice dated July 17, 2025, and duly published July 19, 2025, in the Greeley Tribune, a Public Hearing of the Board of County Commissioners of Weld County, Colorado, was conducted on July 30, 2025, and continued to August 6, 2025, to consider Adoption of the Map Establishing Boundary Lines of Commissioner Districts in Weld County, Colorado. Bruce Barker, County Attorney, made this a matter of record. Matthew Conroy, Assistant County Attorney, clarified the Board of Commissioners are sitting in their quasi-judicial role as the Redistricting Commission ("the Commission), indicated there is an item of business listed for consideration during the regularly scheduled meeting for the Board of Weld County Commissioners ("the Board"). He explained the Board, while sitting as the Commission, are not authorized to take final Legislative action for approval and adoption of the Final Plan map, and are only authorized to do so while sitting as the Board, pursuant to C.R.S. §30-10-306(2) and §30-10-306.4(1). Commissioner Maxey acknowledged the importance and impact of the decision being made and asserted it is not being taken lightly. He further expressed his appreciation to those who participated in the public meetings and provided feedback, as well as to the CC: CR(CK/Rs), cA (RLL', Tao cc NO o foS (25 2025-2189 CR0036 Hearing Certification — Redistricting Public Input Page 2 Redistricting Advisory Committee ("the Committee") for their hours of dedication and cooperative work to provide three (3) initial maps. Commissioner Maxey expressed his opinion of there being very little difference between the maps provided by the Committee, explained curiosity lead his reasoning behind going through the process to submit a map of his own for consideration, and he acknowledged the selection of maps simply boils down to preference. Commissioner Maxey stated all four (4) maps comply with the statutorily required criteria of Colorado Revised Statute (C.R.S) §30-10-306.3, and cited his findings for the record to support the South Platte Map, including: 1) compliance with C.R.S §30-10-306.3; 2) compliance with the Federal Voting Rights Act of 1965, and does not preclude any citizen from voting; 3) the map does not protect any incumbent, or political party; 4) the districts are as compact as reasonably possible; 5) all territory within each district is contiguous, 6) communities of interest and political subdivisions are kept in the same district as much as reasonably possible, and 7) even distribution of population. Commissioner James inquired for further clarification as to the parliamentary process of there being two (2) separate motions: 1) to adopt one of the proposed maps, and 2) legislatively approve said map as the Final Plan for the Commissioner District Boundary Lines to be adhered to until the next redistricting year. Mr. Conroy confirmed the process, as described, and explained the legislative authority which reinforced his advocation for the Commission and the Board to be comprised of the same individuals. Commissioner James echoed the sentiments of Commissioner Maxey regarding appreciation for the public participation in the process and representation of "Communities of Interest". He expressed his support of the Poudre map by stating, not only does the Poudre map meet the statutory required criteria of C.R.S §30-10-306.3, but it best reflects Weld County's way of life it terms of living, working, and traveling; respects Municipal boundaries as much as possible; and uses natural corridors, such as U.S. Highway 85, Interstate 25, and U.S. Highway 34 to anchor "Communities of Interest." Commissioner James cited his findings for the record: 1) pursuant to C.R.S. §30-10-306.3(1)(a) and §30-10-306.7, the Poudre map provides nearly equal representation of registered voters, maintains an approximate three percent (3%) deviation of any given district which is below the five percent (5%) threshold, which provides evidence of a good faith effort to achieve mathematical population equality; 2) pursuant to C.R.S. §30-10-306.3(1)(b), the Poudre map preserves the largest Hispanic community in Weld County located on the east side of the Cities of Greeley and Evans, in addition to several unincorporated communities in close proximity, to retain their ability to elect candidates of choice and influence elections; 3) pursuant to C.R.S. §30-10-306.2(2)(a), the Poudre map groups municipalities with shared economic and commuting patterns that reflect documented travel shed divisions; 4) pursuant to C.R.S. §30-10-306.3(2)(b), the Poudre map creates compact, contiguous and logical boundaries that follow roads, municipal lines, and geographic features; and 5) pursuant to C.R.S. §30-10-306.3(3)(a) the Poudre map was created by a bi-partisan citizen's Committee without consideration of incumbents or partisan advantage, maximizes 2025-2189 CR0036 Hearing Certification — Redistricting Public Input Page 3 political competitiveness consistent with required criteria while reflecting modest registered partisan differences and large affiliated voter shares to give all voters a meaningful voice and preserving fairness. Commissioner Ross further echoed the sentiments of Commissioners Maxey and James regarding the efforts of all involved in the process with the Community participation. He closely mirrored his support of the South Platte map to Commissioner Maxey. Commissioner Peppier acknowledged there will never be a perfect map; however, she extended her gratitude to the efforts of those who participated in the process which allowed the Committee to produce the maps. She stated her findings supporting the good -faith effort of the South Platte map, which also satisfies all statutorily required criteria, and she believes it does the best in keeping Communities of Interest as whole and compact as possible. Commissioner James moved to approve and adopt the Poudre map, based on his previously stated findings. Seconded by Commissioner Peppier, and upon a roll call vote of three (3) to two (2), the motion carried with Commissioners Maxey and Ross opposed. There being no further discussion, the hearing was completed at 9:24.m. The Board of County Commissioners of Weld County, Colorado, approved the above and foregoing Hearing Certification, on motion duly made and seconded, by the following vote on the 20th day of August, A.D., 2025: Perry L.
