Petersen, Keenesburg, Colorado, has requested permission to locate a dairy farm operation and distribution center on the following described property, to-wit: A parcel of land located in the South Half (S+) of the Northwest Quarter (NW4) of the Southwest Quarter (SW-1) of Section Thirty-two (32), Township Two (2) North, Range Sixty-four (64) West and the North Half (NZ) of the Southwest Quarter (SW4) of the Southwest Quarter (SW4) of Section Thirty-two (32), Township Two (2) North, Range Sixty-four (64) West of the 6th P. M. , Weld County, Colorado, con- taining 40 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the location of this dairy farm operation and distribution center on the above-described premises, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the said requested dairy farm operation and distribution center is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (3)(c) of the Zoning Resolution of Weld County, said dairy farm operation and distribution center may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Weld County Planning Commission, by resolution, has recommended that this dairy farm operation and distribution center be approved. NOW, THEREFORE, BE IT RESOLVED, that the petition of Harvey J. Petersen, to locate a dairy farm operation and distribution center on the following described property, to-wit: A parcel of land located in the South Half (SZ) of the North- west Quarter (NW4) of the Southwest Quarter (SW4) of Section Thirty-two (32), Township Two (2) North, Range Sixty-four (64) West and the North Half (Nz) of the South- west Quarter (SW-1) of the Southwest Quarter (SW4) of Section Thirty-two (32), Township Two (2) North, Range Sixty-four (64) West of the 6th P. M. , Weld County, Colorado, containing 40 acres, more or less, as provided by Section 3. 3(3)(c) of the Zoning Resolution of Weld County, Colorado, is hereby granted under the conditions following: 1. Any water and sanitation facilities to be installed shall be approved by the State Health Department. PL0665 710316 2. That petitioner shall proceed with due diligence to construct said dairy farm operation and distribution center and that he shall have up to one year from date hereof to begin construction of said dairy farm operation and distribution center. 3. That said dairy farm operation shall not contain more than 500 animals at any one time, 4. Subject to a retention pond being constructed to prevent pollution of Jim Creek. 5. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Peterson stated he was trying to set up a dairy and processing plant. He plans to start with 50 milk cows , expand as is necessary and process the milk and sell it house to house . Mr . Lorenson he has conferred with the County Attorney regarding the "C" zone and the potential hazard of the variety of uses that can be placed on a Commercial zone . Mr. Connell feels this could be an agricultural use rather than a rezoning application . Mr. Lorenson stated he would endorse this and he would recommend , to the Planning Commission that the fee be returned to the applicant if we can proceed under this process and consider it as a total Special Use Permit . He would recommend approval be- , cause it is compatible with the surrounding land use and subject to the Health Department ' s request for a sealed retention pond to prevent pollution of Jim Creek and to begin within one year of approval by the County Commissioners , maximum number of animals ' be limited to 500 . A soils report has not been submitted but felt a sealed lagoon would take care of that problem. Mr. Peterson stated they would possibly go into other dairy products 4t a later date, Mr. Lorenson suggested that it be approved under the "A" zone and later if he going into the manufacturing of other dairy products , that he request a zone change "C" that time . RESOLUTION : Be it therefore resolved to recommend approval to the Board 1 of County Commissioners for a special use permit for the dairy operation and milk distribution , subject to the recommendations t of Mr. Lorenson . Motion by Mr. Bowles , second by Mr . Bartels . A vote of "Aye" by Heitman , Bowles , Nix, Bartels . Mr. Petersen wishes this information for septic tank filter fields and animal waste sewage disposal system. The soil is mapped as 30-B, Haverson loam, 1-3% slope ; 40-B, Colby loam, 1-3% slope; 40V-CD, Colby-Adena-Norka complex, 3-9%, slopes , and 41-B, Weld loam, 1-37 slope. Haverson soil is deep , medium textured , strati- fied with thin lifie. Of sand and clay loams and occupies the bottom- land of Jim Creek in the area of De Remer Lakes. A holding or retention pond in this area would necessitate a blanket of impervious material. Colby, Colby complex and Weld soils are deep, medium to moderately fine textured and moderately well drained. These soils are well suited for holding or retention ponds and have slight to moderate limitations for septic tank sewage disposal systems.
