HomeMy WebLinkAbout20252394.tiffRecord of Proceedings Minutes Board of County Commissioners Weld County, Colorado Monday, August 25, 2025 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, August 25, 2025, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Perry L. Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Chief Financial Officer, Cheryl Pattelli Minutes: Commissioner Maxey moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner James seconded the motion and it carried unanimously. 1. Minutes from August 11, 2025 Certification of Hearings: Commissioner Ross moved to approve the below listed Hearing Certificate. Commissioner James seconded the motion, which carried unanimously. 1. Refusal to Renew Public Hearing Phase II concerning Tavern (County) Liquor License, pursuant to Section 12-2-50 of the Weld County Code and §44-3-302(1)(c), C.R.S. — El Centenario Entertainment, LLC, dba El Centenario Nightclub Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as printed. Commissioner Ross seconded the motion and it carried unanimously. q19 2025-2394 BC0016 Page 2 Monday, August 25, 2025 www.weld.gov Warrants: 1. General Warrants: Commissioner Maxey moved to approve the General Warrants, as printed. Commissioner James seconded the motion, and upon a roll call vote of four (4) to zero (0), it passed, with Commissioner Peppier abstained. Bids: 1. Approve Bid #B2500092, Department of Human Services (Building B) Heating, Ventilation, and Air Conditioning (HVAC) Upgrade — Facilities Department: Toby Taylor, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, NoCo Energy Solutions, for a total amount of $998,189.00. Commissioner Ross moved to approve said bid. The motion was seconded by Commissioner James and it carried unanimously. 2. Approve Bid #B2500101, 2025 Annual Concrete — Department of Public Works: After consulting with Department of Public Works staff, Mr. Taylor requested to continue this matter to August 27, 2025. Commissioner James moved to continue said bid to August 27, 2025, at 9:00 a.m. The motion was seconded by Commissioner Maxey and it carried unanimously. New Business — General: 1. Consider 2025 Report of Valuation for Assessment of All Taxable Real and Personal Property, and Master Protest Log: Brenda Dones, Weld County Assessor, presented the 2025 preliminary evaluation of assessment, a listing of real and personal property protested at the Assessor's level, a listing of accounts that did not report a personal property declaration, and a list of oil and gas drilling rigs valued by Weld County. She explained 2025 is a reappraisal year and provided an overview of the number of property tax appeals and non -filing companies, which will be audited for accurate amounts to be included in the final Abstract to be presented in November, which will also be conveyed to the special districts for their budget planning needs. The Board expressed its appreciation for the quality work completed by the Assessor's Office. Commissioner Ross moved to accept and approve said documents. The motion was seconded by Commissioner Maxey and it carried unanimously. 2. Consider Mini -Grant Application for 2025-2026 Preventative Block Grant (PBG) Program Funds for Northern Colorado Regional Assessment Collaborative Partnership and Authorize Department of Public Health and Environment to Submit Electronically: Jason Chessher, Director of the Department of Public Health and Environment, requested to submit said application for grant funds, in the amount of $50,000.00, to allow for the continued collaborative partnership and gain a deeper understanding of the Weld County Community Health Survey results based on the focus group data collected. Commissioner James moved to approve said application and authorize the 2025-2394 BC0016 Page 3 Monday, August 25, 2025 www.weld.gov Department of Public Health and Environment to submit electronically. The motion was seconded by Commissioner Peppier and it carried unanimously. 3. Consider Contract ID #9841 Data Use Agreement for Technical Services Program Integration of Real -Time Air Quality Conditions from Three (3) Weld County Monitoring Station Locations and Authorize Chair to Sign: Mr. Chessher stated the agreement allows the state to fulfill a goal of their air program by allowing them access to the data collected from three (3) methane ambient air quality monitoring stations, located at the Missile Site Park, Orchard, and Hereford. He explained the collected data will be integrated onto their website for access to real-time air quality conditions in Weld County. Commissioner Maxey moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Ross and it carried unanimously. 4. Consider Contract ID #9853 Amendment #1 to Task Order Contract for High- Impact Human Immunodeficiency Virus (HIV) Prevention Program and Authorize Chair to Sign: Mr. Chessher explained Weld County continues to rank among the top six (6) counties in the state for new HIV diagnoses and stated the amendment provides additional federal funds, in the approximate amount of $90,000.00, to be utilized for testing, preventative measures, community engagement, and connecting individuals to healthcare providers. Commissioner Ross moved to approve said amendment and authorize the Chair to sign. The motion was seconded by Commissioner Peppier and it carried unanimously. 5. Consider Contract ID #9855 Memorandum of Agreement for Purchase of Property Interest for Acquisition of Right -of -Way and Easements for Design -Build Project of High Plains Boulevard (aka County Road 9.5) Between County Roads 32 and 34, and Authorize Chair to Sign — Burch Family, LLLP, c/o Catherine DiGregorio: Cameron Parrott, Department of Public Works, stated the agreement with the property owners allows the County to purchase 10.51 acres of right-of-way and 5.51 acres of easements in the northwest corner of the intersection of County Roads 9.5 and 32. He explained this project has been in progress under an approved Possession and Use Agreement, with this agreement being the final agreed upon compensation. Mr. Parrott indicated the only difference is reflected in damages, in the amount $125,000.00, for the property owner's inability to irrigate nearly 24 -acres of land, bringing the total compensation to $1,423,800.00. Commissioner James moved to approve said agreement and authorize the Chair to sign. Consider Extension to Temporary Closure of County Road 41 Between State Highway 52 and County Road 22: Amy Mutchie, Department of Public Works, presented the request for the extension of closure for an additional three (3) days, through September 8, 2025, on behalf of AB Underground. She explained the extension will provide a safer environment to place traffic control devices and signage while creating less confusion to the public as the contractor transitions to the next phase of the project. Commissioner Maxey moved to approve said extension. The motion was seconded by Commissioner Ross and it carried unanimously. 7. Consider Temporary Closure of County Road 41 Between State Highway 52 and County Road 8: Ms. Mutchie requested, on behalf of AB Underground, said closure, which is slated to begin on September 8, 2025, and go through October 31, 2025, for the next phase of intersection improvements. She stated the detour is paved with continued message boards in place that will be updated as needed throughout the project. Commissioner Maxey moved to approve said temporary closure. The motion was seconded by Commissioner Ross and it carried unanimously. 8. Consider Temporary Closure of County Road 4 Between County Roads 17 and 19: Ms. Mutchie requested, on behalf of Public Service Company of Colorado, an Xcel Energy Company, said closure retroactively, which began on August 22, 2025, and will go through August 28, 2025, to allow for additional space required for maintenance of a 16 -inch high pressure natural gas pipeline. Commissioner Maxey moved to approve said temporary closure, retroactively. The motion was seconded by Commissioner Peppier and it carried unanimously. (Clerk's Note: Chair Buck took prerogative to extend the Board's condolences to families and friends of the individuals who tragically lost their lives in the incident that took place at the Prospect Valley dairy farm.) Public Comment: No public comment was offered. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
