This project consists of the proposed Oxy Bronco Centralized Gas Lift Station & Triton Electrical Substation within the Cervi Development. We have analyzed the effects, if any, that the proposed locations will have downstream. Due to existing soil conditions and lack of surrounding infrastructure, this project should not pose any adverse effects to land downstream of each site. From direct conversation with Weld County, these conditions qualify the proposed project for an exception from the stormwater detention requirements outlined in the Weld County Municipal Code. This exception dismisses the need for a complete drainage analysis and report for each site. We have written this letter to further discuss the project conditions and the requested stormwater detention exception. Project Description The proposed project consists of the construction and operation of one electrical substation and one centralized gas lift station. These sites will be located on land owned by Cervi Enterprises Inc. in Weld County, Colorado. Due to sandy soils with high infiltration rates and a lack of surrounding infrastructure, stormwater detention for each location would not be necessary to protect downstream property. We anticipate any stormwater runoff from the proposed sites will infiltrate before reaching downstream Cervi Enterprises Inc land. Permission was obtained from Cervi Enterprises Inc to accept any developed stormwater runoff that reaches these downstream parcels. In order to further analyze the drainage for the stations, an estimated flow path was sketched using 10 -meter Digital Elevation Model data and four infiltration tests were conducted in the project area. Figure 1 shows the location of the proposed sites, their drainage path and drainage basin, and the infiltration test locations for the Cervi Development. Figure 1. The soil in this area was found to be well -drained to excessively drained with a low runoff potential. A double ring infiltrometer test was performed at each location and the average infiltration rates ranged from approximately 5.8 to 11.1 inches per hour. According to one -hour point rainfall data obtained from the NOAA for the area, approximately 2.66 inches of rainfall would occur during a 100 -year storm event. The results from the infiltration tests indicate that a large storm event, such as the 100 -year, would drain into the soil in less than an hour. Therefore, it is unlikely that runoff would exit Cervi Enterprises Inc. property before infiltrating. Best Management Practices A combination of Best Management Practices (BMPs) will be implemented at each location to ensure proper water quality and sediment and erosion control. Site specific BMPs can be found for each site in the Use by Special Review which will be submitted separately. Typicals for these BMPs can be found enclosed with this letter. External Ditch and Berm Temporary diversion ditches and berms will be used to collect and direct on -site stormwater to sediment traps and outlets, as well as deflect and redirect off -site runoff around the disturbance area. These BMPs will provide a barrier that will collect runoff and allow suspended sediments to settle out before draining to sediment traps. If maintenance issues arise, the ditches and berms will be hydromulched for stability. Sediment Traps Sediment traps and outlets will be installed at the end of temporary diversion ditches to allow sediment to settle out of stormwater runoff. Sediment traps are sized according to the Kerr-McGee BMP Manual which uses modified MHFD typicals. In order to provide additional capture volume and treatment, sediment traps are designed to be oversized when possible. Sediment control logs and erosion control blankets will be installed along the outlets to provide an additional sediment barrier. Treated stormwater will exit the sediment traps onto undisturbed ground where the natural contours will drain stormwater away from the project area. Surface Roughening Surface roughening will be implemented on pad toe slopes as an erosion control measure. This will create variations in the soil surface that help minimize wind and water erosion. This BMP will provide temporary stabilization of these disturbed areas during the construction phase for each location. Stabilization Topsoil stockpiles will be straw crimped and seeded during both the construction phase and the production phase. Temporary and permanent seeding will increase stabilization of these disturbed areas and act as erosion control. On a permanent basis, the reclaimed area during the production phase will be re -seeded and re -vegetated once final grade is reached. Installation of permanent seeding will include seedbed preparation, selecting an appropriate seed mixture, using appropriate seeding equipment to ensure proper coverage and density, and protecting seeded areas with mulch or fabric until vegetation is established. Exception Discussion The information and analysis of existing conditions presented in this letter display evidence in support of stormwater detention being unnecessary for the Cervi Development proposed electrical substation and centralized gas lift station. Best Management Practices will be implemented at both locations to ensure appropriate water quality and sediment and erosion control. The planned designs will protect public health, safety, general welfare, and have no adverse impacts on off -site properties. The development includes eleven proposed oil and gas production pads (pads). Four infiltration tests were performed at four separate proposed pad locations within each of the distinct drainage basins identified by Occidental Petroleum Corporation (Oxy) (Appendix A, Figures 1-4). Visual classification of the soils encountered and Web Soil Survey maps (Appendix B) via the United States Department of Agriculture (USDA) website (2022) indicated a sandy soil at the site. Average infiltration rates obtained at the four testing locations ranged from approximately 5.8 to 11.1 inches per hour indicating a hydrologic soil type A soil with high infiltration rates and low runoff rates consistent with the observed soil at the test locations and the mapped soil type. This executive summary has been prepared solely to provide a general overview and should not be relied upon for any purpose except for that for which it was prepared. 2.0 PURPOSE AND SCOPE OF STUDY r Tetra Tech conducted a field investigation program consisting of performing four double ring infiltrometer tests, one per each of the four distinct drainage basins that the eleven proposed pads will reside within. The infiltration tests were performed to obtain information on the average infiltration rates of the surface soils within each drainage basin residing in Cervi Ranch which is located in Weld County, Colorado. The field program was performed in accordance with Tetra Tech's proposal to Oxy with authorization received November 3, 2022. Results of the field investigation were calculated using the data collected and analyzed to determine the infiltration rates at the testing locations within each drainage basin. This report summarizes the field data and presents conclusions and information on soil infiltration rates and soil hydrologic groups encountered at each testing location. 3.0 SITE CONDITIONS The proposed Cervi development is located within Cervi Ranch in Weld County, Colorado. The eleven proposed pads are located within Township 4 North and Range 63 West, Township 3 North and Range 63 West, and Township 3 North and Range 62 West. Cervi Ranch is bounded partially on the north by Highway 34 and partially on the south by Interstate 76. The proposed development site is currently undeveloped ranchland except for scattered oil and gas facilities and dirt roads. Existing topography is relatively flat, with some minor hills and basins. Surface soils along the established road corridor where infiltration testing occurred estimated to be greater than 97 percent sand according to a custom soil report generated by Web Soil Survey Maps prepared by the USDA (Appendix B). Per the USDA, the primary soil units at the site are the Valent sand and the Osgood sand. Both of these soils are of eolian origin and have an "excessively drained to well -drained" drainage class, a "very low" runoff class, and a depth of greater than six feet to the water table or to a water infiltration limiting layer. The soils where the infiltration testing occurred are mapped as having a K Factor of 0.02 — the lowest K Factor a soil can have per the USDA. The K Factor is the susceptibility of a soil to sheet and rill erosion by water. The hydrologic soil group of the soils where infiltration testing occurred is mapped by the USDA as group A. The soils in this group have a high infiltration rate with low runoff potential when thoroughly wet. Well -drained to excessively drained sands and gravelly sands fall into this group and (m) TETRA TECH 1 November 2022 Infiltration Investigation - Cervi Ranch Tetra Tech these soils have a high rate of water transmission. Soil conditions were confirmed in the field via visual analysis by a Tetra Tech Field Geologist. The soil at all four testing locations appeared to be a fine to coarse grained sand with less than 10 percent fines. 4.0 FIELD INVESTIGATION Infiltration testing was conducted on November 10th and 11th of 2022. Locations of the infiltration tests were pre -planned on ArcGIS using the "Cervi Drainage and Soils Maps" provided by Oxy. Infiltration Test 1 was to be located within the proposed footprint of pads 1 and 2 within the northwestern drainage basin. Infiltration Test 2 was to be located within the proposed footprint of pad 4 within the central drainage basin. Infiltration Test 3 was to be located within the proposed footprint of pad 11 within the southeastern drainage basin. Upon further review with the client, it was determined that Infiltration Test 3 was to be moved to pad 6 which kept it within the original targeted drainage basin but allowed for easier accessibility. Infiltration Test 4 was to be located within the proposed footprint of pad 8 within the southwestern drainage basin. In accordance with the "Cervi Ranch Rules" document that was provided by Oxy and because of site conditions making it difficult to drive off -road the pre -planned infiltration testing locations were moved prior to field testing to locations that were closer to an established road. These new testing locations were still within close proximity (less than 100 feet) to their original proposed pad location and were still performed in each distinct drainage basin. The Double Ring Infiltrometer Test was conducted in general accordance with ASTM D3385. An inner ring with a diameter of approximately 1 foot and an outer ring with a diameter of approximately 2 feet were driven into the subgrade to approximately 6 inches in depth. The rings were then filled with water to a constant head that did not differ by more than 5 millimeters in depth between the rings. Two Mariotte tubes were used to maintain a constant head in each of the rings during the test. Twelve trials were run until infiltration rates stabilized. The trials ranged in length from 5 to 15 minutes. At the beginning and end of each trial the depth of water in both Mariotte tubes was measured to determine the volume of water that was added to it's corresponding ring during each trial period. Water temperature was also taken at the beginning and end of each trial. 5.0 INFILTRATION ANALYSIS Data collected in the field during testing were input into a spreadsheet to calculate average infiltration rates of both the inner and annular rings. Results were chosen when rates stabilized for both rings. Average infiltration rates for each testing location were calculated in inches per hour using the inner ring's data and these results are presented below in Table 1. KMOG operate nearly 5,000 oil and gas wells in the Denver-Julesburg (DJ) Basin with the vast majority being in Weld County, Colorado. The electric substation and gas lift compression station will support the operations of the Bronco Oil and Gas Comprehensive Development Plan (CDP). The proposed site is located on parcel 121723 000003 and is owned by Cervi Enterprises Inc. The site is located approximately seven miles south of the intersection of Weld County Road 69 and State Highway 34. It is currently zoned Agriculture and surrounded by parcels that are also zoned Agriculture. This proposed site is very remote, and the nearest residences are over three miles away. The site will be approximately 12 acre in size and will be fenced in. The electrical substation and gas lift station will support the Bronco Oil and Gas CDP (nine oil and gas locations and 141 wells). Section 22-2-10(D) emphasizes the "Extraction of natural resources as an important part of the economy of Weld County. Such extraction operations should minimize the impacts on agricultural lands and agricultural operations. " This electric substation will contribute to the expansion of the County's economic base by providing increased capacity for future oil production. The proposed addition of a electric substation in this location conserves land by eliminating the need for these facilities elsewhere in Weld County. 3. CONSISTENCY WITH THE INTENT OF THE WELD COUNTY CODE, CHAPTER 23 (ZONING) AND THE ZONE DISTRICT IN WHICH IT IS LOCATED. Oil and gas facilities are allowed as a use by right in the A (Agricultural) Zone District. However, oil and gas support and service operations such as an electric substation require the approval of a Use by Special Review Permit. The proposed use is consistent with the intent of the A (Agricultural) Zone District. Section 23-3-40.A.2 of the Weld County Code provides for Oil and Gas Support and Service facilities. 4. SURROUNDING USES AND COMPATIBILITY WITH SURROUNDING USES. There are currently no USR permits on the proposed site. The proposed facility does not interfere with the existing use of the area and remains compatible with the current zoning. The proposed electric substation will connect to the nearby Tri-State Lost Creek Tap in section 15. Tri- State will amend their USR for the new additional equipment for this connection. 5. DETAILS OF BOTH SITES (GAS LIFT COMPRESSOR AND ELECTRIC SUBSTATION) a. Number of people who will use this site There will not be any permanent employees on the electric substation nor the gas lift compression station. These sites will be visited by a KMOG employee or contractor on a periodic basis. The employee is typically not on site for longer than one to two hours at a time. Given the short amount of time an employee is on site, permanent water and sewer service is not necessary for either site. Bottled water and a port -a -let will be utilized by personnel visiting the site during the construction phase. b. Number of employees proposed to be employed at this site There will be no full-time employees on either site. One or more employees may visit the sites on a daily basis. c. Hours of operation The site will be accessed primarily during daylight hours; however, it should be available 24 hours a day 7 days a week on demand. d. Type and number of structures to be built on this site There will not be any structure built on this site. Sewage disposal system There is no need for a sewer disposal system. Employees will have access to use a port -o -let at nearby Kerr McGee Oil and Gas location. j. Storage or warehousing No additional storage or warehousing is proposed for this facility. 6. PROPOSED LANDSCAPING The site will be fenced with a chain link fence or cattle fence. Due to the remote location of this site, no additional screening or landscaping is proposed for this application. 7. RECLAMATION PROCEDURES Upon termination of the proposed project, all equipment would be removed. The ground would be re- graded to accommodate agricultural uses or be re -vegetated to 80% of pre -disturbance vegetative cover in accordance with the Colorado Energy & Carbon Management Commission (ECMC) 1000 Series Rules. The pre -disturbance vegetation cover shall be determined by the undisturbed surrounding area. KMOG would also be willing to evaluate coordinating reclamation efforts with Weld County Extension, Public Works, and the Soil Conservation District. 8. STORM WATER DRAINAGE Drainage plan exemption was requested and approved. 9. CONSTRUCTION PERIOD Construction of the proposed facility is expected to commence shortly after the site plan and Use by Special Review application are approved. Construction expected to be complete by the end of Q4 2025. 10. STORAGE & STOCKPILING OF WASTES / WASTE HANDLING PLAN No waste is anticipated to be generated at this site. OPERATION STANDARDS a. Noise Control The operation of the electric substation and gas lift compression station shall comply with the noise standards enumerated in Section 802 of the ECMC Amended Rules 2008. The dBA noise levels for the Gas Lift Compressor equipment in the Bronco CDP (on the Cervi Ranch) do not have a noise point of compliance to measure to (no RBU's within 2000 feet). The below Gas Lift Compressor equipment dBA contour map measurements demonstrates that the dBA levels measured out to a 2000' buffer (the outer ring shown below) are within compliance per Weld County Noise Level Standards in Sec 21-5-435 A(2) for this location. Air and Water Quality All activities will be in compliance with the permit and control provisions of the Colorado Air Quality Control Program, Title 25, Article 7, C.R.S. as applicable. No wastewater will be discharged within the site. All water and waste are carried by vehicle off the site. c. Lighting Lighting will be provided for security, evening maintenance, and emergency work. Any source of lighting on the site shall be shielded so that light will not shine directly onto adjacent properties. Nor will direct or reflected light from any source on the project site create a traffic hazard to operators of motor vehicles on the adjacent road access. d. Weed Control The site will be kept free of weeds, rubbish, and other waste material. The area will be treated if necessary and as practicable to prevent invasion of undesirable species and noxious weeks. 3. REQUIRED PERMITS a. Weld County A Use by Special Review Permit is required to be approved by the Weld County Board of County Commissioners prior to construction, including release of grading permits for this facility. KMOG will submit any additional permits necessary for county approval prior to commencement of construction site. Access Permit The access point for the is located off HWY 34. This entry point already exists and meets all of KMOG access requirements. A CDOT access permit has been approved and copy is included in the Appendix. fi Right -of -Way (RCM) Use Permit A Right -of -Way Use Permit if necessary, will be obtained through Weld County in the event any work is performed in the public right-of-way. g. Construction Stormwater Permit A Construction Stormwater Permit is needed for disturbing more than 1 acres. KMOG estimates 40-50 trips per day during the construction phase. DUST ABATEMENT PLAN During the construction phase of the project, KMOG will use or contract to have water trucks utilized to maintain dust suppression and fugitive particulate emissions. Also, the Stormwater Management Plan will be followed to mitigate soil erosion during construction. After completion of construction, the perimeter of the property will be stabilized using appropriate native vegetation, usually a combination of dry land /grass mixture or crop. Additionally, KMOG will gravel all access and driving surfaces affected. Areas inside the fence line will be compacted and stabilized. 6. FIRE AND EMERGENCY RESPONSE All roads leading to the site and within the site will be designated and maintained to support fire apparatus. A turnaround may be constructed as necessary to accommodate fire apparatus. In addition to above -referenced rules and regulations, KMOG is also subject to ECMC Rule 6064 pertaining to fire prevention and protection. PERMIT EXPIRATION 1. A permit shall be considered expired if the access is not under construction within one year of the permit issue date or before the expiration of any authorized extension. When the permittee is unable to commence construction within one year after the permit issue date, the permittee may request a one year extension from the issuing authority. No more than two one-year extensions may be granted under any circumstances. If the access is not under construction within three years from date of issue the permit will be considered expired. Any request for an extension must be in writing and submitted to the issuing authority before the permit expires. The request should state the reasons why the extension is necessary, when construction is anticipated, and include a copy of page 1 (face of permit) of the access permit. Extension approvals shall be in writing. The local issuing authority shall obtain the concurrence of the Department prior to the approval of an extension, and shall notify the Department of all denied extensions within ten days. Any person wishing to reestablish an access permit that has expired may begin again with the application procedures. An approved Notice to Proceed, automatically renews the access permit for the period of the Notice to Proceed. CONSTRUCTION 1. Construction may not begin until a Notice to Proceed is approved. (Code subsection 2.41 2. All materials used in the construction of the access within the highway right-of-way or on permanent easements, become public property. The permittee shall notify the individual or the office specified on the permit or Notice to Proceed at least two working days prior to any construction within state highway right-of-way. Construction of the access shall not proceed until both the access permit and the Notice to Proceed are issued. The access shall be completed in an expeditious and safe manner and shall be finished within 45 days from initiation of construction within the highway right-of-way. A construction time extension not to exceed 30 working days may be requested from the individual or office specified on the permit. 4. The issuing authority and the Department may inspect the access during construction and upon completion of the access to ensure that all terms and conditions of the permit are met. Inspectors are authorized to enforce the conditions of the permit during construction and to halt any activities within state right-of-way that do not comply with the provisions of the permit, that conflict with concurrent highway construction or maintenance work, that endanger highway property, natural or cultural resources protected by law, or the health and safety of workers or the public. 5. Prior to using the access, the permittee is required to complete the construction according to the terms and conditions of the permit. Failure by the permittee to abide by all permit terms and conditions shall be sufficient cause for the Department or issuing authority to initiate action to suspend or revoke the permit and chose the access. If in the determination of the Department or issuing authority the failure to comply with or complete the construction requirements of the permit create a highway safety hazard, such shall be sufficient cause for the summary suspension of the permit, If the permittee wishes to use the access prior to completion, arrangements must be approved by the issuing authority and Department and included in the permit, The Department or issuing authority may order a halt to any unauthorized use of the access pursuant to statutory and regulatory powers. Reconstruction or improvement of the access may be required when the permittee has failed to meet required specifications of design or materials. If any construction element fails within two years due to improper construction or material specifications, the permittee shall be responsible for all repairs. Failure to make such repairs may result in suspension of the permit and closure of the access. 6. The permittee shall provide construction traffic control devices at all times during access construction, in conformance with the M.U.T.C.D. as required by section 42- 4-104, C.R.S., as amended. 7. A utility permit shall be obtained for any utility work within highway right-of-way. Where necessary to remove, relocate, or repair a traffic control device or public or private utilities for the construction of a permitted access, the relocation, removal or repair shall be accomplished by the permittee without cost to the Department or issuing authority, and at the direction of the Department or utility company. Any damage to the state highway or other public right-of-way beyond that which is allowed in the permit shall be repaired immediately. The permittee is responsible for the repair of any utility damaged in the course of access construction, reconstruction or repair. 8. In the event it becomes necessary to remove any right- of-way fence, the posts on either side of the access shall be securely braced with an approved end post before the fence is cut to prevent any slacking of the remaining fence. All posts and wire removed are Department property and shall be turned over to a representative of the Department. 9. The permittee shall ensure that a copy of the permit is available for review at the construction site at all times. The permit may require the contractor to notify the individual or office specified on the permit at any specified phases in construction to allow the field inspector to inspect various aspects of construction such as concrete forms, subbase, base course compaction, and materials specifications. Minor changes and additions may be ordered by the Department or local authority field inspector to meet unanticipated site conditions. 10. Each access shall be constructed in a manner that shall not cause water to enter onto the roadway or shoulder, and shall not interfere with the existing drainage system on the right-of-way or any adopted municipal system and drainage plan. 11. By accepting the permit, permittee agrees to save, indemnify, and hold harmless to the extent allowed by law, the issuing authority, the Department, its officers, and employees from suits, actions, claims of any type or character brought because of injuries or damage sustained by any person resulting from the permittee's use of the access permit during the construction of the access. CHANGES IN ACCESS USE AND PERMIT VIOLATIONS 1. It is the responsibility of the property owner and permittee to ensure that the use of the access to the property is not in violation of the Code, permit terms and conditions or the Act. The terms and conditions of any permit are binding upon all assigns, successors -in -interest, heirs and occupants. If any significant changes are made or will be made in the use of the property which will affect access operation, traffic volume and or vehicle type, the permittee or property owner shall contact the local issuing authority or the Department to determine if a new access permit and modifications to the access are required. 2. When an access is constructed or used in violation of the Code, section 43-2-147(5)(c), C.RS., of the Act applies. The Department or issuing authority may summarily suspend an access permit and immediately order closure of the access when its continued use presents an immediate threat to public health, welfare or safety. Summary suspension shall comply with article 4 of title 24, C.R.S. MAINTENANCE 1. The permittee, his or her heirs, successorsain-interest, assigns, and occupants of the property serviced by the access shall be responsible for meeting the terms and conditions of the permit, the repair and maintenance of the access beyond the edge of the roadway including any cattle guard and gate, and the removal or clearance of snow or ice upon the access even though deposited on the access in the course of Department snow removal operations. Within unincorporated areas the Department will keep access culverts clean as part of maintenance of the highway drainage system. However, the permittee is responsible for the repair and replacement of any access -related culverts within the right-of-way. Within incorporated areas, drainage responsibilities for municipalities are determined by statute and local ordinance. All major changes to the plan must be approved in writing by the Department prior to commencement of any work on or within the State Highway right-of-way. 13. Reconstruction and improvements to the access may be required when the Permittee has failed to meet the required design and/or material specifications. If any construction element fails within two years due to improper construction or material specifications, the Permittee is responsible for all such repairs. 14. The Department retains the right to perform any necessary maintenance work in this area. 15. Routine, periodic maintenance and emergency repairs may be performed within the State Highway right-of-way, under general terms and conditions of the permit. Any significant repairs such as culvert replacement, resurfacing, or changes in design or specifications, will require written authorization from the Department The Department shall be given proper advance notice whenever maintenance work will affect the movement or safety of traffic on the State Highway. In an emergency, the Department Region Office and the State Patrol shall immediately be notified of possible hazards.
