Dickey and numerous others , a petition for the es— IN tablishment of a public highway between sections 32 and 33 , Twp . 6N . , Range 66 West , and WHEREAS, This Board appointed viewers in relattion to said road as provided by lair, and WHEREAS, said viewers reported to this Board on the 19th day of September, A. Schuyler appeared before the Board and again made application for a franchise over, along and across public highways throughout the county; after carefully considering the same and being legally advised in the premises by Honorable D. E. Carpenter, County Attorney, and Judge Harry N. Haynes , on motion the following resolution was unanimously passed and adopted, viz : -- WHEREAS , JOSEPH J . "The undersigned petitioners respectfully represent that they constitute a majority of the resident freeholders who are qualified electors residing within the proposed district hereinafter described, and have, during the past year, severally paid and caused to be paid property taxes upon their lands and real estate ; that said petitioners own a majority of the whole number of acres of land belonging to the resident electors and freeholders within the boundaries of said proposed district ; that petitioners are desirous of forming an irrigation district as provided by lint for the purpose e of purchasing and constructing ditches , reservoirs , and other water works in order to provide for the irrigation of the lands lying and being within the boundaries of said proposed district as hereinafter set forth . Putnam) . Upon motion duly made, seconded, and carried, it was ordered that the above described lands ( of P W Putnam and Mary A. Putnam) be excluded from the proposed district, and that the Bound- aries of said district as set forth in said petition, and as prayed to be established, be modi- fied ied so as to exclude from said district the lands last bbove described, as aforesaid ( of P W and Mary A. Putnam) . Whereupon S . Sanford presented a petition praying that the following lands owned by him be excluded from the said district in the formation and establishment thereof upon the grounds that the same are sufficiently irrigated and that the said l and s would not be benefitted by the irrierat ion works proposed to be secured by said district , to-wit : All the portions of the following divisions and descriptions of land being within the pro- posed boundaries of said district situate and being in secticns 15 , 17, 22, 23, township four (4) north, range sixty-two ( 62 ) West of the 6th p. m. , Weld county, Colorado, except the lands in said s eeti tna_ included within the right of way of the Bijou ditch. Upon motion duly made, seconded and carried, It Was Ordered that the above described lands be excluded from the proposed district and that the Boundaries of said district as set forth in said petition as first presented and filed on the fifth day of May , 1906 , herein, be so modi- fied as to exclude from said district all of said lands , except the parts thereof comprising the right of way of the canal of the Bijou Irrigation Company over end across the same, as afore- said . Whereupon A R Mackey presented a petition praying that the following lands be excluded from the said district in the formation and establishment thereof , upon the grounds that the same are sufficiently irrigated and that the said lands would not be benefitted by the irrigation works and water rights proposed to be secured by said district , to-wit : -- The southeast quarter of the northwest quarter of section 23 , and all the lands included within the boundaries of said district in section twenty-four, township four north, range sixty- two west , except the land included within the right of way for the Bijou Ditch in sections twenty- three and twenty-four, in said township four north, ranGe sixty-two west , in Weld county, Colo- rado . Upon motion duly made, seconded, and carried, it was ordered that the above descried lands be excluded from the proposed district and that the boundaries of said district as set forth in said petition as first presented to this Board on the fifth day of May, 1906, shall be so modified as to ,xclud e from said district all of the lands aforesaid, except such lands as are included in the right of way of the Bijou ditch as the same traverses and crosses said sections twenty-three and twenty-four, in said township and range . DeVinny presented and moved the adoption of the following resolutions , findings , recitals , and orders , for the consideration and final action of the Board in the premises : WHEREAS a petition has been duly presented signed by E . V. Warner, John T . Warren and S . Sanford and others, freeholders of the County of Weld and State of Colorado, for the formation of an irrigation di :itri ct as set forth in said petition and as provided by law ; and WHEREAS, The petition has been found to be in due and regular form, and that notice of the ✓; I I 130 presentation of the same has been regularly given and published as required by law, and that a bond has been duly filed and approved by the B; r ard, providing for the payment of the expenses all proceedings and the election in ease the district shall not be established ; and WHEREAS, sundry changes in the Boundaries in said district have been made by the exclusion of certain lands embraced therein proposed by said petitioners ; and WHEREAS, it has been shown to the satisfactionof this Board that all matters embraced in said petition and all objections thereto, toCether with all petitions for the exclusion or in- clusion of lands within or adjacent to the proposed boundaries as set forth in said petition and all other matters and thinGs proper to be considered upon the said hearing have been duly considered and determined as preliminary to the fixing and establishment of the said proposed district and the boundaries thereof ; that in the opinion of the Board all lands embraced within the said boundaries as modified herein are susceptible of one mode of irrigation by the same system of irrigation proposed in the formation of said district . That the Ninth day .of June, 1906 is hereby fixed for the holding of said election in the various precincts of said district and the polls are directed to be opened for that purpose at 133 7 a. me of that date , and kept open until 7 p . m. of the same date.
