STATIONERY PROPOSALS .
It nownam being 10 : 00 a. me , the hour set for opening the bids received for
furnishing the county with Books , records , Stationery etc . for the ensuing year, and The W. H .
Kistler Stationery Company, The C . F. Hoeckel Blank Book Company and The Out West PrintinG and
Stationery Company having submitted proposals in accordance with the Advertisement published
in The Greeley Sun for three consecutive weeks, the several proposals were opened and read aloud
in the presence of the Board and representatives of said Stationery Companies ; the Board then
took the several proposals under consideration and the Bid of The Out West Preinting and Sta-
tionery Company being considered the lowest and most satisfactory bid received, on motion it
was ordered that the proposal of said Company be accepted and the contract be and hereby is
afforded to said Company for the part year ending January 1 , 1907 .

OF JUSTICE OF THE PEACE, PRECT . NO . 22 .
The resignation of Robert Allred as Justice of the Peace
in and for Justice Precinct No . 22, Beebe Drum, was presented, examined, and after carefully
considering same it w,gs on motion ordered that it be and is hereby accepted, and that s ai d
office be declared as vacant .
A communication was received from Attorney McCallum of Ft . Collins who has a client now in
the County Jail of this County complaining of the attenUkxv given, after carefully considering
same and believinrr him to be in error the clerk was directed to Refer said communication to
the sheriff with request that he answer the same.
The Petition of M. S , Adams & Company praying for a rebate of taxes for the year 1903 and
1904 on account of Double assessment on personal property was then taken up and after carefully
considering same and being well advised in the premises it was on motion ordered that said peti-
tion be granted and that two warrants , one for the year 1903 and 1904, be drawn therefor.
The petition of H . M. DeVotie praying for a rebate of 1905 Military Poll tax was presented
examined and on motion ordered granted.

was presented, examined and on motion approved and ordered placed on file.. .

t. WHEREAS, On September 12 , 1905 there was filed and presented to this Board a petition

signed by J . F . Moody, D. H . Barber, J . B . Dickey and numerous others , a petition for the es—

tablishment of a public highway between sections 32 and 33 , Twp . 6N . , Range 66 West , and
WHEREAS, This Board appointed viewers in relattion to said road as provided by lair, and
WHEREAS, said viewers reported to this Board on the 19th day of September, A. D . 1905, and
° recommended the establishment of said highway, and
ic ' Whereas , This Board after the coming in of said report have found that the notices purported
' to have been posted as ordered September 12 , 1905, the day said viewers were appointed, was not
posted in conformity to section 3934 Mills Annotated Statutes for the full period of Five days
preceding the meeting of the• viewers appointed by this Board;
THEREFORE BE IT RESOLVED, That in view of the foregoing facts that this Board at this time
does hereby reconsider their proceedings heretofore had upon said petition and do hereby set
aside all this Board' s actions , orders and proceedings s heretofore had and entered of record upon

COUNTY- ROADS FOR ELECTRIC TRANSMISSION LINES .
Joseph J . Henry , Trustee and his attorney, Mr .
Schuyler appeared before the Board and again made application for a franchise over, along and
across public highways throughout the county; after carefully considering the same and being
legally advised in the premises by Honorable D. E. Carpenter, County Attorney, and Judge Harry N.
Haynes , on motion the following resolution was unanimously passed and adopted, viz : --
WHEREAS , JOSEPH J . HENRY, Trustee, is about to organize a corporation with power and au-
thority to construct , build and operate a Power Plant at or near the town of Lafayette in the
County of Boulder, for the purposes of generating, transmitting and selling electrical energy

it a necessary condition precedent to inducing capital and persons of experience to proceed there-
with, that he as said promoter be granted by this Board the conditional rights , privileges and
franchises herein below specified, to be by him in due time assigned and transferred to said cor-
poration when organized with means and ability to carry said enterprise to an, actual and suc-
cessful result ; and,
WHEREAS, The Board of County Commissioners of the County of Weld, after due and careful
investigation, believe and understand that the successful prosecution of said enterprise will
materially increase and enhance the taxable property of the said County, and will be of great
and, material benefit to said County and the inhabitants and citizens thereof , and that said en-
terprise should be promoted and encouraged in every possible way,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, State of
Colorado, in meeting duly assembled, that for the considerations aforesaid, and the benefits to be
derived by the County of Weld, and the citizens and tax payers thereof, and subject to the
several conditions b el ow stated, the Board of County Commissioners of Weld County, State of

1st . The rights, privileges , powers and license herein granted shall be subject always , to
the rights of the public in and to the free and untrammeled use of such highways and t

considered as exclusive, and shall in no event attach to any public or county road within th
County of Weld until the said line or lines shall have been actually constructed thereon, an

4th. That the rights , privileges , powers and license herein granted, in no event shall be
construed as granting any rights in the public highways of Weld County for railway purposes .
5th. That all poles and appliances for the operation of said transmission lines shall. e _ .^

Company of near bond or bonds with good and satisfactory surety to be approved by said Board.
IT IS FURTHER AGREED, That all the terms hereof are to be considered as conditions and
that the failure to comply with any of the same shall work a forfeiture of all rights granted .

' December 31, 1905, commencing back at the beginning of their present term of office, or floror the
full time that the present incumbent has held his said office and make report of their findings

appointed Justice of the Peace in and for said Justice Precinct No. S to fill the vacancy just
caused by the resignation of Mr. Parks ; provided that said John W. Morton will qualify by

WHIREAS, It appearing to the Board that an overdraft now exists in the Interest fund, and
WHEREAS , It appearinG that there is a balance to the credit of the contingent fund in ex-
cess of the overdraft in said Interest Fund;
THEREFORE RESOLVED, That the County Treasurer be and he is hereby authorized and directed - _
to transfer to s-aid interest fund the sum of 02107 .84 from the Contingent Fund to cover said
overdraft .'

A petition signed by J , W. Hodgell and , several others praying
for a FORTY foot road described as fo ilows , viz : --
Commencing at the quarter corners common to sections 15 and 16 , Tp . 5N . , Range 65 West and
running thence due East and along one half section lines through the center of section 15 and
section 14 a distance of one and one half miles to the center of said section 14 thereof ;
Thence due North and alonG one half section line a distance of Three quarters of a mile to the
center of the South Half of Section 11, Tp . 5N. , Range 65 West and connecting with the present
County Road running East and West through the center of the South Half of said Section 11 . The
last named point being the terminus thereof .

b0 It appearing to the Board That the right of way for said road through patented lands is
donated by the owners thereof, and the Board believing that the public good requires the laying
out of said road, on motion it was ordered that the prayer of the petitioners be granted, and
the line of road prayed for be and is hereby granted and declared a public highway . The Clerk
is directed to record the petition, plat the road as granted, and notify the road overseer of the
proper district to open said road to travel at once .

Colorado, as prayed in said petition, first presented to said Board and filed therewith on May
5th, 1906 , as aforesaid, the hearing thereof beinG continued from said date to the eighth day
of May, 1906 , and from said eighth day of May, 1906 , to this late, again appered before the Board
in person, and by their attorney, Charles F . Tew, Esquire, and the matter of said petition here-
tofore duly presented, as aforesaid, and adjourned from time to time to this date, was again
taken up, together with the notice of the publication of the hearing of said petition, and the
prayer of said petition, that an irrigation district be formed as in and said petition prayed and
set forth .

duly filed with said Board of County Commissioners , were and are in words , and figures , as fol-

" To the Honorable Board of County Commissi_ oners of the county of Weld and Mate of Colorado.
"The undersigned petitioners respectfully represent that they constitute a majority of the
resident freeholders who are qualified electors residing within the proposed district hereinafter
described, and have, during the past year, severally paid and caused to be paid property taxes
upon their lands and real estate ; that said petitioners own a majority of the whole number of
acres of land belonging to the resident electors and freeholders within the boundaries of said
proposed district ; that petitioners are desirous of forming an irrigation district as provided
by lint for the purpose e of purchasing and constructing ditches , reservoirs , and other water works
in order to provide for the irrigation of the lands lying and being within the boundaries of
said proposed district as hereinafter set forth . That in the formation of such district , and the
proceedings thereunder, the said petitioners are acting and desire to act in pursuance of the
provisions of a certain act of the general assembly of the state of Colorado, entitled, ' An Act
in relation to irrigation districts , " Approved May 3 , 1905, and according to other acts per-
taining to the same subject , said irrigation district to consist of all the territory situated
in the county of Weld and the state of Colorado, bounded and described as follows : to-wit :
"Commencing at the south bank of the South Platte river on the section line between sec-
tions 17 and l3, township 4 north, range 62 west , and extending south along said section line
between sections 19 and 20 of said township and range to the south line of the right-of-way of
the Bijou ditch as the same is laid out and constructed across said section; thence following
the south line of the right-of-way of the Bijou ditch by various meanderings , courses and dis-
tances to a point on the center line of section 25, tp . 4n. , R . 61, about 500 feet south of the
north line of said section 25, _ where said right--of-ray of said ditch crosses said line; thence
north along said center line of said section 25 to the north line of said section 25 ; thence
west along the section , line on the north of said section 25 to a point on the north line of
section 26 in said township and range 1320 feet east of the west line of said section 26 ; thence
north to the Putnam ditch as now constructed ; thence west along the south line of the right
of way of said ditch to the point where the right of way of said ditch crosses the center line
of section 19, in said township and range; thence south to the center of said section 19 ; thence
west to the west quarter corner of section 24 in township 4 north of range 62 west ; thence
north about 200 feet to the point where the south line of the right of way of the Corona Ranch
ditch crosses the west line of said section 24; thence west alonGT the south line of the right

"That all the territory included in the above described lines is situate in the county of
Weld and state of Colorado, and all the lands embraced therein lying under the line and are
capable of being irrigated from that certain canal known as the Bijou irrigation ditch or
canal and said river and Bijou ditch are the only means by which water can be supplied and
carried to said lands ; that said lands are susceptible of irrigation from one mode of irrigation
and from a common source of supply and by means of the same system of waterworks and supplies
of water; that said district is proposed to , be formed for the purpose of purchasing a sufficient

number of water rights from the Bijou ditch and from the reservoir of The Riverside Reservoir
and Land Company, lying North of said River and to be used by a system of exchanges through said
river to supply the lands embraced in said district with water for the irrigation thereof and for
the additional purposes of acquiring by purchase or otherwise all other ditches , water rights,
franchises , acid appropriations and to construct such water works as may be found necessary to
furnish an adequate supply of water for the irrigation of said lands embraced within the s az,_d
district.
"That the name proposed for the said irrigation district is ' The Green City Irrigation
District ' , by which name the said district is hereafter to be known and described. The under-
signed petitioners further appoint and empower E V Warner, S . Sanford and John T . Warren, to act
as a committee to publish this petition and a notice of the hearing thereof , and present the
s ame to the Board of County Commissioners of the county of Wf ,ld in form and manner as provided
by law.
" And your petitioners pray that your honorable Board do forthwith proceed according to the
law upon presentation hereof to determine the boundaries of said proposed irrigation district
and the question of the organization of the same into an irrigation district , and that the same
be submitted to the qualified electors residing in said district to vote upon the question
of such organization and to do and perform all other acts and things in the premises as required
by law .

The foregoing notice and petition after being presented, and read were on motion taken up
by the Board for consideration and action.
Whereupon P . W. Putnam presented a petition that the following lends be excluded from the
said district in the formation and establishment thereof, upon the grounds that the same are
sufficiently irrigated and now have sufficient water supply therefor and that the said lands
would not be benefited by the irritation works proposed to be secured by said district , to-wit :
The north three-quarters of the north-half (N-3/4 N-a) of section twenty-eight (2& ) township
four (4) north, range sixty-one (61 ) west , situate, lying and being in the county of Weld and
State of Colorado, (belonging to said P . W. Putnam. )
Also the southeast quarter of the southwest quarter ( SFe SW 2,0 and southwest quarter of
Southeast quarter ( S SFe ) of section twenty-one (2.1 ) , township four (4) north, range sixty-
one (61 ) west of the 6th p . m. , situate lying and being in the County of Weld and the state of
Colorado, ( belonging to the said P . W. Putnam. )
Also the southeast quarter of the southeast quarter ( SF S ) of section twenty-one (21 )
and the south half of the southwest quarter ( S-a Sw4 ) of section twenty-two ( 22 ) , township four,
(4) north, range sixty-one ( 61 ) west of the 6th p. m. , situate, lying and being in the County of

Upon motion duly made, seconded, and carried, it was ordered that the above described lands
( of P W Putnam and Mary A. Putnam) be excluded from the proposed district, and that the Bound-
aries of said district as set forth in said petition, and as prayed to be established, be modi-
fied ied so as to exclude from said district the lands last bbove described, as aforesaid ( of P W
and Mary A. Putnam) .
Whereupon S . Sanford presented a petition praying that the following lands owned by him
be excluded from the said district in the formation and establishment thereof upon the grounds
that the same are sufficiently irrigated and that the said l and s would not be benefitted by the
irrierat ion works proposed to be secured by said district , to-wit :
All the portions of the following divisions and descriptions of land being within the pro-
posed boundaries of said district situate and being in secticns 15 , 17, 22, 23, township four
(4) north, range sixty-two ( 62 ) West of the 6th p. m. , Weld county, Colorado, except the lands
in said s eeti tna_ included within the right of way of the Bijou ditch.
Upon motion duly made, seconded and carried, It Was Ordered that the above described lands
be excluded from the proposed district and that the Boundaries of said district as set forth
in said petition as first presented and filed on the fifth day of May , 1906 , herein, be so modi-
fied as to exclude from said district all of said lands , except the parts thereof comprising
the right of way of the canal of the Bijou Irrigation Company over end across the same, as afore-
said .
Whereupon A R Mackey presented a petition praying that the following lands be excluded from
the said district in the formation and establishment thereof , upon the grounds that the same are
sufficiently irrigated and that the said lands would not be benefitted by the irrigation works
and water rights proposed to be secured by said district , to-wit : --
The southeast quarter of the northwest quarter of section 23 , and all the lands included
within the boundaries of said district in section twenty-four, township four north, range sixty-
two west , except the land included within the right of way for the Bijou Ditch in sections twenty-
three and twenty-four, in said township four north, ranGe sixty-two west , in Weld county, Colo-
rado .
Upon motion duly made, seconded, and carried, it was ordered that the above descried
lands be excluded from the proposed district and that the boundaries of said district as set forth
in said petition as first presented to this Board on the fifth day of May, 1906, shall be so
modified as to ,xclud e from said district all of the lands aforesaid, except such lands as are
included in the right of way of the Bijou ditch as the same traverses and crosses said sections
twenty-three and twenty-four, in said township and range .
Whereupon. commissioner R . W . DeVinny presented and moved the adoption of the following
resolutions , findings , recitals , and orders , for the consideration and final action of the Board
in the premises :
WHEREAS a petition has been duly presented signed by E . V. Warner, John T . Warren and S .
Sanford and others, freeholders of the County of Weld and State of Colorado, for the formation
of an irrigation di :itri ct as set forth in said petition and as provided by law ; and
WHEREAS, The petition has been found to be in due and regular form, and that notice of the

presentation of the same has been regularly given and published as required by law, and that a
bond has been duly filed and approved by the B; r ard, providing for the payment of the expenses
all proceedings and the election in ease the district shall not be established ; and
WHEREAS, sundry changes in the Boundaries in said district have been made by the exclusion
of certain lands embraced therein proposed by said petitioners ; and
WHEREAS, it has been shown to the satisfactionof this Board that all matters embraced in
said petition and all objections thereto, toCether with all petitions for the exclusion or in-
clusion of lands within or adjacent to the proposed boundaries as set forth in said petition
and all other matters and thinGs proper to be considered upon the said hearing have been duly
considered and determined as preliminary to the fixing and establishment of the said proposed
district and the boundaries thereof ; that in the opinion of the Board all lands embraced within
the said boundaries as modified herein are susceptible of one mode of irrigation by the same
system of irrigation proposed in the formation of said district .
IT IS THEREFORE ORDERED that the prayer of said petitioners should be Gr ent ed and the
Boundaries of said proposed district fixed and determined in accordance with said petition as
modified by the action of the Board thereon as above set forth.
AND IT IS FURTHER ORDERED that the said proposed district BE and the same is HERF. 3Y, CREATED
AND ESTABLISHED subject to the vote and election of the freeholders residing within the same,
consisting of all that part of Weld County, state of Colorado, the Boundaries of which said dis-
trict are established and defined as follows :
Commencing at the south bank of the South Platte River on the section line between sections

section line between sections nineteen and twenty of said township and range to the south line
of the right of way of the Bijou ditch as the same is laid out and constructed across said

On motion duly made, seconded, and carried, it was ordered that the proposed irrigation dis-
tract be divided into three divisions as follows :
DIVISION NO . 1 . Bounded on the south, east and North, by the ext eri or lines of s ai d dis-
tract , and on the west by section line between sections twenty-two and twenty-three, twenty-seven
and twenty-six, in township four north, range sixty-one west of the sixth p . m.
DIVISION NO . 2 : Bounded on the south and North by the exterior lines of said district ;
on the east by the section line between secti cis twenty-two and twenty-three, twenty-seven and
twenty-six, township four north, range sixty-one west , and on the west by the township line,
between townships four North, Range sixty-one west , and township four north, range sixty-two
west .
DIVISION NO 3 : Bounded on the south, north and west by the exterior lines of the district ,
and on the east by the section line, between said township four north, range sixty-one west and
township four north, range sixty-two west 6th p . m.
IT IS FURTHER ORDERED, that each of said divisions above described be and is hereby con-
stituted a voting precinct for all the purposes of said irrigation thstrict as provided by law
and that the polling places within said precincts for the holding of elections are hereby fixed

Moved by Commissioner R W DeVinny and seconded by Commissioner Fritz Wattenberg, that the
entire prayer of the petition herein be end is hereby granted, as hereinabove modified, and that
an election is hereby ordered and directed to be held within said proposed irrigation district
and in the various precincts thereof above described, for the purpose of submitting to the vote
of the qualified electors the formation, establishment , and organization of the said irrigation
district , under and by virtue, and in accordance with law, and the election of a board of di-
rectors for said district as by law provided.
That the Ninth day .of June, 1906 is hereby fixed for the holding of said election in the
various precincts of said district and the polls are directed to be opened for that purpose at

7 a. me of that date , and kept open until 7 p . m. of the same date.
The foregoing motion being put to a vote was carried unanimously .
The following Judges of Election were appointed :

The following resolution was presented:
IT TS FURTHER ORDERED That a notice of said election be made, given, and published as re-
quired by law ; that said notice shall be given under the hand of the Chairmen of the Board of
County Commissioners of the county of Weld and state of Colorado, attested by the clerk of s a7 d
Board, and shall be duly published in the Greeley Sun, a weekly newspaper published in the city
of Greeley, in the county of Weld and state of Colorado, for a period of four successive weeks
preceding the date of said election, the, proof of said publication of said notice to be duly
filed herein upon the completion thereof by the publisher of said weekly newspaper with the clerk
of this Board on or before the canvass of the returns of the said election by the Board as, pro-
vided by law.
The above arid foregoing resolution and order was upon consideration and motion duly made and
seconded unanimously adopted
The Board then commenced the checkin of the Books and accounts of the County Treasurer for

the months of March and April and continued thereat the remainder of the day, pending the com-
pletion thereof an adjournment was ordered taken to 9 o' clock a. m. Friday, May 11 , 1906 .

The Board was duly called to order by Chairman Bradfield and the minut es of the proceedings
held April 13 and 14 also May 2--3--4--5- S--9--10--11--12 were read and on motion ordered
approved .
Justice account of L, B . Willard, Justice of the Peace in and for Justice Precinct No . 7,
in the case of the people vs . Jesse Gordon was presented, examined and on motion ordered allowed
for the amounts stated thereon.
IN THE MATTER OF COUNTY
PRINTING AND ADVERTISING.
The several bids for the County PrintinG and Advertising were then
taken up for final consideration, and after carefully investigating each and all of them it was
on motion duly made and seconded ordered that the same be awarded to the Greeley Sun Printing and
Publishing Company, provided that said Company is willing to sign a contract to publish all
Local notices at the rate of 10 cents per line for first insertion and 5 cents per line for each
subsequent insertion; and on leGal work, such as the County Treasurer' s Tax List , the County
Clerk ' s Semi-annual Statement , Commissioner' s proceedings and Legal Notices at the rate of 5
cents per line or sixty cents per inch for first insertion and three cents per lint or thirty-
six cents per inch for each subsequent insertion.

On motion duly made and seconded the following resolu-
tion was unanimously passed and adopted, viz : --
WHEREAS, A. M. and Jennie S . McClenahan and S . B . A. Haynes have by Quit Claim Deeds of
dates May 8, 1906 and May 17, 1906, by each of them duly acknowledged and delivered and duly re-

have dedicated to the county of Weld in the State of Colorado for road purposes the following
described strips of land, viz : --

THEREFORE, Be it Resolved by the Board of County Commissioners of Weld County, Colorado
for and on behalf of Weld County and for the use and benefit of the travelling public that said

offers of dedication of said strips of land for the use and purpose of a public highway, as
above described, be and the same are hereby established as and declared to be a public highway.

AND CREATING NEW PRECINCTS NO. 45-_x__47 AND 48 .
WHEREAS, It appearing to the Board that at the
last General Election held November S, 1904, more than 500 votes were cast in the Hillsboro
Voting Precinct No. 3, west Eaton Voting Precinct No . 13 and Ault Voting Precinct No. 35, and in
order to comply with the statutes thereto as well as giving due consideration to certain peti-

tions filed with the clerk of this Board it becomes necessary to change the boundary lines of
several precincts
TREREF ORE, It was on mot i on ordered that the Boundary lines of s ai d Voting Precincts 3--13
and 35 as well as those of Windsor Voting Precinct No. 4; North Windsor Voting Precinct No. 19 ;
LaGrange Voting Precinct No. 24, which said precincts are situated wholly :within the County of
Weld and State of Colorado, be and the same are hereby changed, and said precincts shall be situ-
ated within the following boundary lines ,
HILLSBORO VOTING PRECINCT - NO . 3--That all the territory lying within the following described
boundary lines be and the same is hereby made and constituted Hillsboro Voting Precinct No. 3 ,
viz : --Commencing at the Southwest corner of section 34, Tp. 4N . , R. 67 West and runniflg thence
due East and along section line a distance of about one and one fourth of a mile to the center of
the main channel of the South Platte River ; Thence in a Northeasterly direction and following
the center t of the main channel of said river to a point where said river crosses the section
line between sections 3 and 4, Tp. 4N . , R. 66 W. ; thence North along section line to the N . E.
corner of said section 4; thence West four miles to the Northwest corner of section 1 , Tp . 4N . , R.
67 West ; thence North three miles to the Northeast corner of section 23 , Tp . 5N . ,, R. 67 W;
thence West two miles to the Northwest corner of section 22--5--67 ; thence due South and along
section lines nine miles to the place of beginning. The voting place in said precinct to be at
Hillsboro.
WINDSOR VOTING PRECINCT NO , 4--That all the territory . Lying within the following described
boundary lines be and the same is hereby made and constituted Windsor Voting Precinct No. 4, viz :
Commencing on the , County County Li -ie at the Southwest corner , of of section 18, Tp . 6N . R . 67 W. and run-
ning thence due East three miles to the Southwest corner of section 15 ; thence South and along
section lines six miles to the southwest corner of section 15--5--67; thence East two miles to
the southeast corner of section 14; thence North and alonG section lines about three and one
quarter miles to . the the center of the main channel of the Cache is Pbudre river; thence East and
following the center of the main channel of said river to a point where said river crosses the
section line on the east side of section 36--6---67; thence North and alonG section ,lines a dis-
tance , of about three and one half miles to Northeast corner of section 13 , Tp . 6N . , R. 67 W. ;
Thence West two and one half miles to a point one half mile east of the Northwest corner of
section 15--6--67 ; thence North two miles to a point one half mile east of the Northwest corner
of section „ 3--6--67 ; thence due West and along township line to the West line of Weld County;
thence South and along the West line of said County to the place of beginning. The Voting place
in said precinct shall be at Windsor.
WEST EATON VOTING PRECINCT NO . 13 : --That all the territory lying within the following de-
scribed , Boundary lines be and the same is hereby made and constituted West Eaton Voting Precinct
No. 13, viz : --Commencing at the Southwest corner of the southeast quarter of section 4, Tp. 6N , ,
R. 66 West and running thence due East three and one half miles to the Southeast corner of Sec-
