Chichester, Jr. , Route 1, Box 81, Erie, Colorado, has requested permission for expansion of an existing egg production operation on the following described property, to-wit: Lot Eight (8), Ranch Eggs Subdivision within the North Half (Ni-) of the Northeast Quarter (NE4) of Section Thirty-three (33), Township One (1) North, Range Sixty-eight (68) West of the 6th P. M. , Weld County, Colorado. WHEREAS, the said requested expansion of an existing egg production operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (3)(c) of the Zoning Resolution of Weld County, said commercial egg production operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Weld County Planning Commission, by resolution, has recommended that expansion of this commercial egg production operation be approved; NOW, THEREFORE, BE IT RESOLVED, that the petition of Lewis G. Chichester, Jr. , Route 1, Box 81, Erie, Colorado, for expansion of an existing commercial egg production operation on the following described property, to-wit: Lot Eight (8), Ranch Eggs Subdivision within the North Half (Ni) of the Northeast Quarter (NE4) of Section Thirty-three (33), Township One (1) North, Range Sixty-eight (68) West of the 6th P. M. , Weld County, Colorado, and as provided by Section 3. 3 (3)(c) of the Zoning Resolution of Weld County, Colorado, is hereby granted under the conditions following: 1. Any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect the expansion of said commercial egg production operation and that he shall have up to one year from date hereof to begin expansion thereof. 3. That the manure accumulating as a result of the business operation conducted herein shall be removed from the premises at least annually. 4. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Chichester DISCUSSION : Mr. Lorenson stated Mr. Chichester would like to increase his chicken operation by 40,000 birds . The existing building houses 6 ,000 . Mr. Lorenson recommended approval . It has been approved by the Health Department however the waste inventory . doesn ' t show for any removal of manure . The deep pit system does not require cleaning for the life of the building. It should be approved subject to removal of the manure as required by the Health *Department , and construction within one year of approval : by ' the ;County Commissioners . Mr . Chichester stated the economic life 'of the building is approximately 10 years , however he would clean it any time he had any problem with disease and between flocks . Mr . Paul asked that when the manure is removed rfrom the buil:ding. that it be hauled away. Mrs . Sandra Davison r: stated she is a neighbor and has no objections to the chicken houses but when Mr. ;Chiches.ter. removes the manure from the build- ing he leaves it ':on. the,,,ground , As long as it remains there , there :is +no 'o der but when: it is hauled away it is unbearable . She felt there should ° be some kind of guarantee that it be hauled away when the chicken house is cleaned . Mr . Bowles stated the matter would be taken under advisement as a quorum was not present. RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to removal of manure as required by the Health Department . Motion by Mr . Bowles , second by Mr. Watson . A vote of "Aye" by Bowles , Watson , Nix and Heitman . Motion carried . Kimmel DISCUSSION : Mr. Lorenson stated this application was presented to Planning Commission last October. At that time it was recommended for approval subject to a plot plan . A letter from Mr. Kimmel was read giving in detail the type of operation it will be. Plot plan had been submitted . Mr. Kimmel stated the kennel would be for breeding and boarding. RESOLUTION: Be, i.t therefore resolved to recommend approval to the Board of County Commissioners subject to a maximum of 50 animals . Motion by Mr. Bowles , second by Mr. Heitman . APPLICANT: Stromquist Farms CASE NUMBER : SUP #111 tape 357 SUBJECT: Feed lot LOCATION : SZ Sec 21 T2 R68 APPEARANCE: Alan Stromquist and Milton Nelson• DISCUSSION: Mr. Nelson stated Mr . Stromquist is purchasing 300 acres from him at the designated location . Mr. Lorenson recommended the application for approval . It is compatible to the surrounding land use and zoning, except for one dwelling to the east. A petition favoring this use has been signed by the owner of the dwelling . Previous approval has been given to an egg production operation one-half mile to the northeast. Approval has been given by the Health Department , should be subject to the determination if a lagoon is necessary . An indication of proper design by the Soil Conservation Service , a ditch is running through the site and it may need to be protected from the feed lot run-off. Construction to begin within one year of approval of the County Commissioners . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners . Motion by Mr. Watson , second by Mr . Bowles , A vote of "A" by Bowles , Watson , Nix and Heitman . Motion carried. APPLICANT : Panhandle Western Gas Company CASE NUMBER : Z-183 • tape 357 SUBJECT: Zone change A - I LOCATION : SW4 Sec 33 T 3 R66 APPEARANCE : Walker Miller , Jack Ross , Clyde Anthem , George Minturn and Jay Smith DISCUSSION : Mr. Miller stated Panhandle Western Gas Company is a subsidiary of Panhandle Eastern which is a major company in the gas area . They.. are requesting zoning for a site where the gas will be transported by pipe line to this site where the impurities will be removed , it will then be transfered on to another company who is purchasing it from Panhandle Western . This will be a liquid terminal and booster site . Mr . Smith presented drawings of the system. and explained the process . Mr. Paul questioned if the facility would cause any air pollution . Mr. Smith stated the extent of their air pollution would be the exhaust off of a gas fired compressor . Mr . Paul stated they would have to comply with 6/22/71 554 I, ♦ a. the State Pollution Control of the State Health Department. Mr. Lorenson stated the Utility Coordinating Board has reviewed their pipelines and they have their permits for road cuts from the County Engineer . MOTION : By Mr. Bowles to take the matter under advisement. Second by Mr. Watson . A vote of "Aye" by Bowles , Watson , Nix and Heitman . Motion carried . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the approval of the Air Pollution Control of the State Health Department. Motion by Mr . Lorenson stated this item was on the agenda of 6/7/71 and was recommended for denial . Due to a misunderstanding Mr. Wenzel was not present . Mr . Lorenson requested the Planning Commission to consider the application again . Reasons given for denial were as follows : it would consitute spot zoning, garage services are available in Hudson and Ft. Lupton where zoning is available . It would create further change in the character of the land use from agriculture to urban uses . Mr. Wenzel stated the building he proposed to use is already in existence. Mr. Lorenson stated a business at this location would not be a related use to a farm. Mr . Wenzel voiced objections to the subdivision in the area . MOTION : By Mr . Heitman to take the matter under advisement . Second by Mr. Bowles . A unanimous vote of "Aye" Motion carried . Lorenson stated this is a replat of part of a Planned - - Uni-•t Deverlopm'ent . It was scheduled for condiminium use. The road is 60 ' in design and meets minimum standards but would be private , not maintained by the County. This would be similar to roads in a Mobile Home Park where they are maintained by the developer .,, Mr . Lorenson recommended that the replat be approved subject to the approval of easements by the Utility Board , a closure sheet of the exterior boundary, street profile and cross sections , the legal description on the plat state the exterior boundary and an indication of the acreage . Mr . Allison explained how -condiminiums are operated and the agreements regarding services and maintenance that are necessary. There was 6/22/71 555 discussion regarding the control of the private street. RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to the approval of the Utility Board and the recommended changes by Mr. Lorenson . SUBJECT: Weld County Opportunity Agency DISCUSSION : Mr. Lorenson read a letter from the Weld County Opportunity Agency regarding the development of the community of Wattenburg . A study is to be made regarding the feasibility of improvements and moving out of the Flood Plain zone. Mr . Lorenson was instructed to write a letter that the study should be made before any improvements are made . SUBJECT: Planning Coordinator DISCUSSION : Mr. Nix read a letter of resignation from Dennis Scholl , addressed to- Mr . Lorenson . Effective as of 7/1 /71 . SUBJECT : Building Permit DISCUSSION : Mr. Lorenson read a letter from Barney Elgin , building inspector. The letter informed the applicant his dwelling will be in the Flood Plain zone. There are no regulations restricting a building permit if the applicant elects to build in this location . SUBJECT: Modular housing DISCUSSION: Mr. Lorenson stated a bill on modular housing has recently been passed in the last session of the legislature. 6/22/71 556 4 s f -J ` The bill states that 'manufactured or modular housing will be certified statewide . This will meet whatever codes or s'tandardsEthat are set up in any county or residential zone , that will allow this . Committee is supposed to be set up by July 1st. It will be made up of thirteen people that are from the building industry and from the enforcement area. SUBJECT : Letter from Windsor DISCUSSION : Mr . Lorenson stated a letter had been received from Windsor regarding "Powderhorn" a proposed new town west of there . They indicated some of their growth they are expecting . They are concerned that Federal funding that may be made avail - able for this purpose and felt that it could be put to better use in existing communities , especially Windsor , where the greatest impact would occur. Also quoted other communities in the County. It was suggested the Regional Planning Com- mission look into the matter. SUBJECT: Enivronmental Problems DISCUSSION: Mr. Lorenson read a letter from the coordinator of Environmental Problems out of the Governor ' s office regarding a detailed statement prepared by the regulatory staff of the Atomic Energy Commission . They are requesting comments on the Public Service Company' s environmental impact report , filed with the Atomic Energy Commission . SUBJECT : Policy Board of the Regional Planning Commission DISCUSSION : Mr. Anderson stated that Larimer County and Weld County agreed that elected officials would comprise the Policy Board of the Regional Planning Commission . They will operate the same as the Planning Commissions of the two counties . The Advisory Board will be comprised of the Planning Commission members of the two counties . SUBJECT : Amendment of the "A" Agricultural zone DISCUSSION: The revised amendment of the "A" zone was reviewed . Chichester a Land Use Permit for another chicken house. This man cannot handle adequately his present operation of 6,000 chickens; how can he possibly expect to handle 46,000 chickens? He (and most of the other chicken farmers in Ranch Eggs Subdivision) apparently has no guaranteed plan for disposal of the waste material, having piled the drop- pings outside on the ground for approximately one week the last time he cleaned his barn. While this letter is being written, two other farmers (Korte and Hutton) have their manure piled outside and have had since July 6. If you have ever been around chickens, we don't have to describe the stench, much less the flies that this draws. Mr. Chichester has stated that the plans for his new chicken house do not require him ever to clean it! We might add that Mr. Chichester is one of the few--if not the only--persons on the west side of the road who do not have water supplied by Left Hand Water Supply Company. The water he has comes from a well on the east side of the road, which apparently is not very good water. All of the chicken farmers received their wa- ter from this source at one time, and they have stated that one of the effects the water has on the chickens is that it reacts like a cathartic. Apparently one of the reasons the manure has to be piled outside before it can be hauled is that the consistency is more liquid than solid. We respectfully request that, unless Mr. Chichester can offer some solution to his manure problem and concrete evidence that he can dispose of the waste products, you deny his request for a Land Use Permit. Chichester, Jr. has requested this office to furnish you with the soils information and interpretation for an area of land in the SW'1 NW's Sec. 34, T1N, R68W, Weld County, Colorado (Lot. 8, Ranch Eggs Subdivision) . The land in question is to be used for a feed mill with a homesite and septic tank filter field at some future date. The 'soil survey is made on the basis of 40 inch borings, although in most cases the borings are made to depths of 50 to 60 inches.
