Water Division 1, Water District 5 Dear Diana Aungst, We have received your April 16, 2025 proposal to adjust the property line boundary between two parcels know as Tracts A and B of Pelican Shores PUD 2nd Amended Final Plat and located in the E' of Sec. 36, Twp. 3N, Rng. 68W, 6th P.M., Weld County. This application proposes adjusting the boundary between Tracts A and B of Pelican Shores PUD 2nd Amended Final Plat to help facilitate a more equitable share of maintenance responsibility between the two respective parcel owners (Pelican Shores North and Pelican Shores South HOA). Currently, the parcel boundary that divides the two HOAs is not centered on the St. Vrain River. Our comments related to the water supply demands and water supply source for Pelican Shores Subdivision were outlined in a letter from our office dated August 31, 2004. Ullmann, State Engineer/Director Pelican Shores PUDF 2nd Amended Final Plat Page 2 of 3 May 7 2025 Water Supply Demand Water supply demands and uses for Tracts A and B were not included with the application documents. However, a water supply information summary sheet previously sent to our office by Weld County for the Pelican Shores Subdivision indicated that 7,800 gallons per day (8.7 acre-feet annually) is required to serve the 26 single-family lots inside the 240 -acre Pelican Shores Subdivision. Source of Water Supply The source of water supply for Tracts A and B were not identified in the application documents. However, a will serve letter dated January 17, 2002 previously sent to our office by Weld County for the Pelican Shores Subdivision indicated the Central Weld County Water District ("District") is committed to serving the Pelican Shores Subdivision. State Engineer's Office Opinion Based upon the above and pursuant to section 30-28-136(1)(h)(I) and section 30-28- 136(1)(h)(II), C.R.S., it is our opinion that the proposed water supply is adequate and can be provided without causing injury to decreed water rights, provided the District is committed to supply both lots.
