Buck, Chair Commissioner Scott K. James, Pro-Tern Commissioner Jason S. Maxey— Excused Commissioner Lynette Peppier— Excused Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services Representative, Matthew VanEyll Development Review Representative, Aaron Maurice The following business was transacted: I hereby certify that pursuant to a Notice dated September 17, 2025, and duly published September 19, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of Paragon Service Dogs, for Use by Special Review Permit, USR25-0015, for a Kennel (dog training and boarding facility for up to eight [8] dogs) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Carol Heider, applicant, Chair Buck instructed the applicant and reviewed for the public, with two (2) of the five (5) Commissioners being excused, the vote must be unanimous for the case to be approved today. Ms. Heider indicated she would like to move forward with the presentation. Matthew VanEyll, Department of Planning Services, presented a brief summary of the proposal, to be known as Paragon Service Dogs, he described the times the kennel will be open and operating. He relayed dog training will primarily take place indoors, there will be no dogs onsite over the weekends, with two (2) to four (4) visitors on-site, at a time. He stated the outdoor fencing is four (4) feet tall, and there are no outside kennels or runs, and no persons reside at the on-site residence. Mr. VanEyll described the sign posting, reviewed the criteria of a USR request, and stated nine (9) surrounding property Cc: PL(oC/MN/DA/►AWDA/KR) 2025-2869 I7_/1 l/25 PL2976 Hearing Certification (USR25-0015) — Paragon Service Dogs Page 2 owners (SPOs) were noticed, and one (1) response was received regarding noise. He relayed the site is located within the three (3) mile referral areas of the Towns of Mead and Firestone, and the City of Longmont, also the Town of Mead's Coordinated Planning Agreement boundary and the Town of Firestone's Coordinated Planning Agreement boundary; however, no objections were received and no interest in annexation was expressed. Mr. VanEyll suggested DS #16 be amended to include Section 14-9-40 of Weld County Code. He entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. In response to Commissioner James, Mr. VanEyll confirmed a Noise Narrative and a Noise Study are the same. Aaron Maurice, Department of Planning Services, Development Review, stated access will be from County Road 3, via a private gravel road, within a 30-foot-wide access easement created with Recorded Exemption, RE-4394. He stated CR 3 is a local gravel road, which requires 60 feet of right-of-way, the latest average daily traffic counts 203 vehicles per day, with 11 percent trucks, and the 85th percentile speed is 45 mph. He relayed traffic information indicates there will be approximately 14 passenger car or pickup truck daily round trips, with one (1) delivery truck daily roundtrip, and 80% of the site's traffic coming from the south on CR 3, and the balance of 20% from the north. He relayed a Road Maintenance Agreement is required and a Drainage Narrative was submitted meeting the exception for stormwater detention. Carol Heider, applicant, responded to Chair Buck, and indicated she had not had contact with any of the Commissioners regarding this case. Ms. Heider narrated a PowerPoint presentation (Exhibit D) and explained the difference between a kennel and training of service dogs. She provided a history of the organization, stating puppies are raised by community members or prison raisers from Torrington, Wyoming, and prior to actual service training, the dogs are trained early on for nuisance barking and she reiterated there are no dogs on the site over the weekends. No public testimony was offered concerning this matter. In response to Chair Buck, Ms. Heider indicated she had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner James requested Development Standard (DS) #16 be amended to reference Section 14-9-40 of the Weld County Code. The Board agreed to the aforementioned changes. No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. Commissioner James moved to approve the request of Paragon Service Dogs for Use by Special Review Permit, USR25-0015, for a Kennel (dog training and boarding facility for up to eight [8] dogs) outside of subdivisions and historic townsites in the A (Agricultural) 2025-2869 PL2976 Hearing Certification (USR25-0015) — Paragon Service Dogs Page 3 Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Ross and it carried unanimously. There being no further discussion, the hearing was completed at 10:51 a.m. (Clerk's Note: Teams recording start timestamp 30:44) The Board of County Commissioners of Weld County, Colorado, approved the above and foregoing Hearing Certification, on motion duly made and seconded, by the following vote on the 12th day of November, A.D., 2025: Perry L.
