HomeMy WebLinkAbout740283.tiff RESOLUTION WHEREAS, a public hearing was held on September 23, 1974, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Earl C. Rice, Route 2, Box 358, Fort Lupton, Colorado, seeking a conditional use permit for the erection of a single family dwelling on the following described property, to-wit: South half (Si) of Lot 6, Wiesner Subdivision First Filing, a subdivision of Weld County, Colorado, being the South half (Si) of Section 7, Township 2 North, Range 65 West of the 6th Principal Meridian Weld County, Colorado, being more particularly described as follows: Commencing at the Southwest Corner (SWCor) of said Section 7 and considering the West line of said Section 7 as bearing North 00°00'00" East, with all other bearings contained herein being relative thereto: Thence North 00°00'00" East along the West line of the South half of said Section 7, 50. 00 feet; Thence North 89°33'45" East, 50. 00 feet to the True Point of Beginning; Thence North 00°00'00" East, 313. 90 feet along the East right of way line of County Road No. 37; Thence North 89°29'45" East 1239. 34 feet; Thence South 00° 08'21" West 315. 35 feet; Thence South 89°33'45" West 1238. 56 feet along the North right of way line of County Road No. 22 to the True Point of Beginning, containing 8. 948 acres, more or less, and WHEREAS, the petitioner was present and represented by Mrs. Earl C. Rice, and WHEREAS, there was no opposition to the request of petitioner for the location of the said single family dwelling, and WHEREAS, the said requested location for the single family dwell- ing is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(d) of the Zoning Resolution of Weld County, said location for said single family dwelling may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Earl C. Rice, Route 2, Box 358, Fort Lupton, Colorado, for a conditional permit to locate a single family dwelling on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That said conditional use permit is subject to the County Engineer's review and recommendation of access of lot onto adjacent County Road No. 22 • PL0803 740283 3. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolu- tions of Weld County, Colorado. About the only time the burning pit will be used is in the case of an emergency, and then only for approximately an hour until problem is solved. About four to five wells will feed into this plant. Expected longevity is from 10 to 20 years, but closer to 10. The wells are located in about a two mile radius. RESOLUTION: Be it therefore resolved to recommend approval to the County Commision- ers subject to the following: Being fully aware of the need and necessity for the objections of the Planning staff and County Engineer; and in as much as the gentlemen have properly stated that they can get together and solve the problems and objections, time being of essence, and as soon as the information is received being put on the County Commissioners agenda. Motion by Mr. Nix, seconded by Mr. Heitman. A vote of "Aye" by Watson, Nix, Anderson, Heitman and Rothe. FURTHER VOTE: Add to the motion that the area will be returned to its original state after operation ceases. seconded and voted. APPLICANT: Westridge 5th & 6th DISCUSSION: Both have been withdrawn from today's scheduled hearing and rescheduled as nothing has been resolved with the ditch company yet. Meeting adjourned. Owned by Ralph Janitell , about 20 acres. Will strip and stockpile the overburden on this pit. As they go, will reclaim area . No set time tables. Mr. Weigand ' s letter states that he could see no problems. Needs geological information, EPA qualifications and Health Dept. recommendations. Pictures submitted with the letter were not there . No drainage problems. Access road there already. Weld County Planning staff recommends approval for the following reasons: (1 ) Agrees with the Weld County Comprehensive Plan in the ex- tracting of our natural resources and supplements H.B. 1529 regarding sand and gravel extraction; (2) Due to the fact that this is a State Highway Dept. site, the extraction and reclamation standards are included within the cover letter. Subject to: (1 ) Reclamation commencing immediately after extraction; (2) Extraction beginning within one years' time from date of approval by the Board of County Commissioners and limited to the use of the State Highway Dept. This permit is to terminate at the end of State Highway Dept. ' s use; (3) Approval of the revised legal description be submitted; (4) Extraction limited to plans submitted; (5) County Engineer's agreement concerning roads. Has 193 acre feet of water in the Smith & Emmons Ditch; also, 48% acre feet of water in the Plumb and Daily Ditch; allocated 100 acre feet to the Colorado Water 1055 APPLICANT: Earl Rice �bl CASE NUMBER: CUP #3 Tape 543 v_6, `�/ SUBJECT: Replat Wiesner Sub for Single-Family Dwelling / y LOCATION: S'z Lot 6 Wiesner Subdivision (Pt Sr-- Sec 7 T2 R65) APPEARANCE: Mrs. Rice & Jay Freese, Engineer DISCUSSION: Mr. Freese stated that they had taken the south half of Lot 6 and split out a dwelling site. Originally, Mrs. Rice owned this property prior to Mr. Wiesner' s subdividing the land. He, at that time, platted her property as the south half of an entire lot. Total of about 9 acres . Mrs. Rice stated that Lot B and Lot A had good drainage. Weld County Planning staff recommends denial for the following reasons : (1 ) Lot 6, as well as other lots in the subdivision , has already been split. Origi - nally there were 13 lots in the Wiesner Subdivision; there are now over 30 lots. This is contrary to the intent of subdividing land in the Weld County Subdivision Regulations. (2) There are over 3400 lots in subdi- visions throughout Weld County. There are also many small tracts (5, 10 and 40 acre in size) in the County. The Conditional Use Permit should not be used as a vehicle to subdivide or resubdivide these small parcels of land. (3) Section 3 .3.D of the Weld County Zoning Resolution states , . .that the Planning Commission shall consider need for the proposed use and its effect on future development of the area' . No special need or condition has been shown and the adverse effect on future development of the area and the County could be considerable. (4) The land split would require an additional and possibly dangerous access to the County Road. The reason for this being, there is a hill right at the edge of the lot. Needs to be gone over by the County Engineer regarding access. Mrs. Rice stated that she had come up to the office about a year ago and inquired as to the possibility of splitting up this lot and was told by a staff member that she could do so. In February of this year (1974) they put their home up for sale after checking again to make sure they could split this property. After they sold the home, they again came back to the Planning Office and this time was told , "no" , she couldn ' t do this. She talked to the Director and the Zoning Administrator and was told that if she would fill out the papers for a Conditional Use Permit, the Planning Commission would not recommend den'_:l . They would recommend it ok because it was for a single-family residence. Under the regulations, approval could not be recommended to the Planning Commission. However, it was felt that Mrs. Rice had a case that might possibly be reason for approval . But the staff could noc recommend approval . Mr. Freese had a meeting with Mr. Lorenson and Mrs. Lee about the 1st of May and was told that a further split would not conform to the regulations. After this, he was given confirmation to go ahead with the Conditional Use Permit. Mr. Freese felt there were already lot splits out there, and one more wouldn 't hurt anything probably. Don' t wish to abuse the Conditional Use Permit; that was the procedure suggested to them. Access would be over 600' from an intersection . Present staff felt Mrs. Rice was possibly a victim of circumstances. RESOI. iTION: In view of the past conditions and time elapsed, make special consideration for this and not to set a precedence in the future, recommend this to the Board of County Commissioners for approval .
