Approve Request to Temporarily Extend Hours of Operation for Amended Use by
Special Review Permit, AMUSR-1102, for Mineral Resource Development including
Open Pit Mining and Materials Processing (sand, gravel, and stone), including
concrete and asphalt recycling and a concrete and asphalt batch plant facility in
the A (Agricultural) Zone District — L.G. Everist, Inc.
Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, on May 18, 2011, the Board of County Commissioners of Weld County,
Colorado, approved the application of L.G. Everist, LLC, Attn: Lynn Shults,
P.O. Box 5829, Sioux Falls, South Dakota 87117, for Amended Use by Special Review
Permit, AMUSR-1102, for a Mineral Resource Development including Open Pit Mining
and Materials Processing (sand, gravel, and stone), including concrete and asphalt
recycling and a concrete and asphalt batch plant facility in the A (Agricultural) Zone
District, for property being more particularly described as follows:
Part of Section 32, Township 3 North, Range 67 West of the 6th P.M., Weld
County, Colorado
Whereas, Development Standard #23 was approved to read as follows:
"Section 23-4-290.B of the Weld County Code limits the hours of operation
for sand and gravel operations to the hours of daylight, except in the case
of public or private emergency, or to make necessary repairs to equipment.
Hours of operation may be extended with specific permission from the Weld
County Board of County Commissioners. This restriction shall not apply to
the operation of administrative and executive offices or repair and
maintenance facilities located on the property."
Whereas, the Board has been presented with an email from L.G. Everist, Inc., dated
September 2, 2025, requesting an extension of hours of operation at the bridge deck of
Weld County Road 38 over 1-25 for Colorado Department of Transportation's (CDOT),
1-25 North Express Lanes Project (NHPP0253-301, 25987), for a night concrete pour
scheduled to begin at 9:00 p.m., on September 15, 2025, or September 16, 2025, in the
event of inclement weather, for the Weld County Road 38 Over 1-25 Bridge Deck Pour,
and
Whereas, the Board of County Commissioners heard all the testimony and statements of
those present, studied the request of the applicant and the recommendation of the Weld
County Department of Planning Services, and having been fully informed, deems it
advisable to grant said request.

Now, therefore, be it resolved by the Board of County Commissioners of Weld County,
Colorado, that the hours of operation for Amended Use by Special Review Permit,
AMUSR-1102, be, and hereby are, temporarily extended to accommodate a night
concrete pour scheduled to begin at 9:00 p.m., on September 15, 2025, or September 16,
2025, in the event of inclement weather, for the Colorado Department of Transportation
(CDOT) 1-25 North Express Lanes Project (NHPP0253-301, 25987), Weld County
Road 38 Over 1-25 Bridge Deck Pour.
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Resolution, on motion duly made and seconded, by the following vote on
the 10th day of September, A.D., 2025:

AMUSR-1102 — Temporarily extend the hours of operation for
Subject: a batch plant
Date: September 10, 2025
On September 2, 2025, the Department of Planning Services received a request for Lynn Shultz with L.G.
Everist, Inc. to extend their hours of operation associated with AMUSR-1102 to accommodate concrete
pours on 1-25 North Express Lanes Project (NHPP 0253-301, 25987).
The mine associated with this project is AMUSR-1102, 12248 County Road 15, Longmont, CO, located
near County Road 15 and County Road 26.75 (with a backup batch plant located at 6550 S. Larimer County
Road 5 in Fort Collins). According to the request, the activity is expected to take place on September 15,
2025, beginning at 9:00 p.m., with a contingency date of September 16, 2025.
Section 23-4-290.B of the Weld County Code states that, "All sand and gravel operations shall be conducted
during the hours of daylight except in the case of public or private emergency, or to make necessary repairs
to equipment. This restriction shall not apply to operation of administrative and executive offices or repair
facilities located on the property. Upon request, the Board of County Commissioners may authorize
additional hours of operation for sand and gravel operations when the Board deems appropriate."
Recommendation:
Staff recommends that the applicant's request for extended hours be approved.

This letter is to inform you that RLW/SEMA, A Joint Venture, will be pouring the bridge deck of WCR38
over I-25 for CDOT's I-25 North Express Lanes Project (NHPP 0253-301, 25987) on September 15th
beginning at 9 PM with a contingency of September le. Amrize will be supplying the concrete for this
pour out of their batch plant #4909 located at 12248 County Road 15, Longmont, CO 80504, with a backup
batch plant #4906 located at 6550 S County Road 5, Fort Collins, CO 80528. This concrete pour will be
approximately 400 CY and last for approximately 8 hours.

We would like to request the allowance for our lessee, Amrize (formerly known as Holcim), to operate the concrete batch
plant for a NIGHT POUR for a public project. The batch plant is located on L.G. Everist, Inc.'s Firestone Gravel Resource
(USR-1102) site, at 12248 CR 15, Longmont, CO, 80504.
For ease of reference, for you and the Weld County Commissioners — here is language from our Firestone Gravel
Resource USR-1102 resolution about requesting extended hours:
23. Section 23-4-290.8 of the Weld County Code limits the hours of operation for sand and gravel operations to the hours
of daylight, except in the case of public or private emergency, or to make necessary repairs to equipment. Hours of
operation maybe extended with specific permission from the Weld County Board of County Commissioners. This
restriction shall not apply to the operation of administrative and executive offices or repair and maintenance facilities
located on the property.
See attached letter with more details on the location, date, and timing -length of the night pour. We are attaching a
letter from the contractor who is doing the public project NIGHT POUR work, and planning to get the concrete from
Amrize's concrete batch plant located at Firestone Gravel Resource. They hope to conduct the NIGHT POUR on
September 15th (or rain date of 9/16/25). Please see the letter for more details.
