The purpose of this MOU is to clearly identify the responsibilities of each party to successfully implement services under the Reemployment Service and Eligibility Assessment (RESER) Program by providing qualified Unemployment Insurance Claimants the appropriate reemployment services. Such services shall assist in retuming these participants to suitable employment. What options exist for the Board? Approval of the MOU with CDLE. Deny approval of the MOU with CDLE. Consequences: There will not be a MOU executed. Impacts: ESWC will not be in compliance with the requirements of the RESEA Program. Parties And Purpose This memorandum of Understanding ("MOU") is made between the Colorado Department of Labor and Employment on behalf of Unemployment Insurance ("CDLE-UI") located at 633 17th Street, Suite 200, Denver CO 80202 and on behalf of the Division of Employment and Training/Workforce Development Programs ("WDP") located at 633 17th Street, Suite 700, Denver CO 80202 (collectively `CDLE'), and the Employment Services of Weld County ("Service Provider") located at 315 N. 11th Ave Building B Greeley CO 80631 (all collectively the `Parties') and sets forth the Parties' understanding and responsibilities to successfully implement services under the Reemployment Service and Eligibility Assessment Program (`RESEA") for qualified UI Claimants (`RESEA Participants') in accordance with USDOL requirements, including but not limited to, providing the appropriate reemployment service to RESEA Participants, and providing the required data for Employment and Training Administration (`ETA') reports. Such service shall assist in returning RESEA Participants to suitable employment. 2. Term The parties and performance under this MOU (`Effective Date' and `Initial Term') shall commence on April 1, 2025, and shall terminate on March 31, 2026, unless terminated by one of the parties pursuant to the terms in Item 10 of this MOU. This MOU shall automatically renew for four (4) successive one year terms, contingent upon initial and continued funding of the Unemployment Insurance Reemployment Services and Eligibility Assessment Grant. Modification and Amendments Except as specifically provided in this MOU, modifications of this MOU shall not be effective unless agreed upon in writing by the Parties in an amendment to this MOU, properly executed and approved in accordance with applicable state and local laws, rules, and policies. 4. A thorough review of the claimants' continued eligibility for Unemployment Insurance, including a review of the most recent 2 weeks of Work Search Activities and the claimant's Able and Available specifics. (CDLE-UI and WFC) B. Support for the development of the RESEA Participant's reemployment plan. (CDLE-UI) C. Registration with the State of Colorado's Job bank, Connecting Colorado (CDLE-UI) D. A detailed discussion of labor market and career information, customized to meet the claimants individual reemployment goals (CDLE-UI and WFC) E. Referrals to partner agencies, workforce centers, and community organizations for reemployment services. (CDLE-UI and WFC) 5. UI Responsibility A. Engage in RESEA planning, administration, compliance assistance and oversight of the RESEA program. B. Prepare Statewide policy for the workforce center system. C. Train Service Provider/workforce center and UI staff on UI eligibility requirements. D. Coordinate technological system communications, written notifications, phone calls, policy and other collaborative activities to ensure all appropriate information is communicated by and between UI, Service Providers and WDR E. Provide and review UI data that is needed for the ETA required reports. F. Coordinate and oversee the required evaluation of the program under WP -2024-01 and subsequent guidance. G. Oversee all RESEA related fiscal spending. H. Coordinate technological and other communications to ensure that RESEA participants are identified through a profiling model. Conduct appropriate outreach to ensure that RESEA Participants are invited and booked to attend a mandatory RESEA meeting via electronic mail or regular mail. a. RESEA participants will be invited to the meeting after they receive their first payment of unemployment insurance benefits. J. Adjudicate all reported no shows. K. Adjudicate all reported potential eligibility issues. L. Provide one-on-one services to participants in an initial meeting, which includes all required RESEA services (see PGL WP -2024-01, Attachment 2 located at https://cdle.colorado.Rov/pgls). a. Provide career and labor market information. b. Development of Individualized Reemployment Plan (IRP). c. Assess UI Eligibility and refer to adjudication as appropriate, if a 1 potential issue is identified. d. Schedule participants to a required subsequent meeting with the local workforce center. e. Refer all participants to at least one reemployment service and/or training. f. Complete data entry in both MyUI+ and Connecting Colorado systems to optimize service delivery for a seamless handoff from UI to WFC service delivery. 6. WDP Responsibilities A. Coordinate PGL service delivery and assist in preparation of statewide policy for the workforce center system. B. Help ensure workforce center leadership maintains a direct line of communication with the State RESEA Program Administrator and/or RESEA Program Manager. C. Work collaboratively with the State RESEA Program Administrator and/or RESEA Program Manager to ensure that the RESEA program is correctly defined systematically, ensuring that the data relative to RESEA is able to be extrapolated based on a set period of participation. Report activities and participation in the activities outlined within RESEA participant's reemployment journey between UI, Service Providers, and WDP. b. Ensure that appropriate information is reported and shared on a timely basis. The majority of the coordinated communication will occur in MyUI+ and Connecting Colorado; however, there may be a time where other communication methods are accessed. c. Ensure that the interface of workforce data needed for the ETA required RESEA reports is correctly transported to MyUI+. 7 Service Provider Responsibilities A. Track and report all monthly RESEA expenditures by the 20th of the following month. B. Direct questions and concerns about the RESEA program directly to the State RESEA Program Administrator and/or RESEA Program Manager. C. Ensure timely and regular outreach to RESEA participants to remind them of the requirement to attend their subsequent RESEA meeting(s) and required completion of referred activities in accordance with PGL WP -2024-01 or its replacement. D. Provide one-on-one services, which include all required RESEA services (see PGL WP -2024-01, Attachment 2 located at https://cdle.colorado.gov/pgls). a. Provide detailed documentation of RESEA activities via document upload and case notes. F. Termination Intergovernmental Service Providers may terminate this MOU for convenience upon written notice to UI and WDP. Notice shall be sent via USPS mail or electronic mail, and termination shall be effective thirty-five (35) calendar days after notice date. This MOU shall automatically terminate between all Parties if funding is not obtained or provided in subsequent years for the Unemployment Insurance Reemployment and Eligibility Assessment Grant. 11. Dispute Resolution. Disputes concerning the performance of this Agreement which cannot be resolved by the designated MOU representatives shalt be referred in writing to a senior departmental management staff member designated by UI and a senior manager designated by WDP for resolution. Signature In Counterparts This MOU may be executed in multiple identical counterparts, all of which shall constitute one agreement. 14. PURPOSE: To establish a policy and provide procedural guidelines for the Reemployment Services and Eligibility Assessment (RESEA) program, which connects Unemployment Insurance (UI) Claimants with the Colorado Workforce Development System with the goal of facilitating an earlier return to work for those claimants. III. BACKGROUND: Since 2015, Colorado has been addressing individual reemployment needs of Unemployment Insurance (UI) claimants, and working to prevent and detect improper UI payments through the UI Reemployment and Eligibility Assessment (REA) program and its successor, Reemployment Services and Eligibility Assessment (RESEA). On February 9, 2018, the President signed the Bipartisan Budget Act of 2018, Public Law 115-123 (BBA), which included amendments to the Social Security Act (SSA) that created a permanent authorization for the RESEA program. To improve employment outcomes of UI recipients and to reduce the average duration of UI receipt through employment; 2. To strengthen program integrity and reduce improper UI payments through the detection and prevention of such payments to ineligible individuals; 3. To promote alignment with the broader vision of WIOA of increased program integration and service delivery for jobseekers, including UI claimants; and, 4. To establish reemployment services and eligibility assessments as an entry point for UI claimants into other workforce system partner programs. IV. DEFINITIONS AND ACRONYMS: A. General Definitions Able and Available (AEtA) - A UI or designated agent representative will review a claimant's ability to work, availability for work, and whether they are actively seeking work, i.e. the claimant is able and available to accept work if offered, or participate in specific job -search activities, such as attending a job interview or employer testing for specific employment. Deselection - Deselection occurs as part of the MyUI+ selection process for RESEA. Deselection excludes a participant from selection and profiling if the customer: a. is, at the time of selection, Job or Union attached; or b. is in UI approved training (See Regular Approved Training PGL). Note: Claimants who claim to be job attached must be verified in MyUI+ under the Basic Information section of their Home Page; many claimants believe they are job attached but only official job attachment by UI would be considered as the system reviews claimants for selection. Exclusion - Claimants may not be excluded from RESEA once they have been selected and profiled. In limited cases, a selected claimant may be determined to be an improper referral by UI. Example of improper referrals: • Claimants who have returned to work or will return to work before the RESEA deadline date. Claimants should be notified that UI will not hold them accountable for completing their initial PSM. Forced Booking - An initial PSM scheduled without the participation of the claimant. a. This process is completed 14 days after the date on the RESEA Notification Letter. Reemployment Services - Job -search assistance, job placement services, counseling, testing, career and labor market information, assessments, job search workshops, job clubs, job referrals, referrals to training services and other similar services. RESEA Deadline - RESEA profiled claimants are required to complete their initial PSM within thirty (30) days. RESEA Service - Per USDOL, a RESEA meeting is considered a participation service in Connecting Colorado, since participants are made aware of why the services are available, what the services are, and are able to participate in the identification of appropriate services to assist them in returning to employment. C. RESEA Service Code "AO" in Connecting Colorado AO - The RESEA Service is added to the claimant services page in CC. This code insertion is generated every Sunday after the weekly RESEA profiling run in MyUI+. It occurs through a file transfer from MyUI+ to CC (or its replacement product). CC should also update the UI status to "Claimant Ref'd by Worker Profile Sys." and place an indicator on the top right of the Applicant Information page where it has "UI Status" showing "Profiled:", followed by the date the claimant was profiled. The "Completer:" indicator originates defaulted to "N". Upon completion of the initial PSM, a file transfer occurs each Sunday showing which profiled claimants completed their initial PSM the previous week by changing the "N" to a "Y". POLICY/ACTION: This policy guidance letter is intended to provide a high-level overview of the RESEA program for One -Stop and UI representatives. Step -by -Step procedural guidance for the RESEA program is included as Attachments 1 and 2. One of the primary aims of the RESEA program is to connect UI claimants with reemployment and case management services through local One -Stop Centers. RESEA selection occurs early in a claim cycle in order to make this connection early, to result in a quick return to work for selected claimants. A. RESEA is a Required Program USDOL requires that One -Stop Centers must administer Worker Profiling and Reemployment Services (WPRS) throughout the state. RESEA is how Colorado meets the WPRS requirement; therefore, RESEA is a required program. Additionally, once claimants are selected into RESEA, their participation in the program is mandatory as a condition of continued UI eligibility. Therefore, to maintain eligibility for receipt of UI benefits, selected claimants must: 1. Schedule and attend their initial Personalized Service Meeting (PSM) with a UI RESEA Program Navigator; and, 2. Complete at least one referred activity before/on the date of their subsequent PSM; and, 3. Attend the subsequent PSM with One -Stop Center RESEA staff approximately four (4) weeks after their initial PSM. Note: Claimants who start a full time (32 or more hours per week) job, on or before the date of their subsequent PSM, may be excused from attendance in the subsequent PSM and completion of the referred activity. B. RESEA Selection Process 1. On a weekly basis, claimants who have received their first two (2) payments from UI and who are required to complete work search activities will be run through a scoring or "profiling" algorithm which is applied to the entire selected UI claimant pool for that week. Data collected from claimants are used to determine scores for each claimant. The variables used to determine a claimant's score include: a. Base -period earnings and wage replacement rates; b. Industry; c. Occupation; d. Weekly benefit amount; e. Claimant exhaustion rates by industry; f. Claimant exhaustion rates by month of claim filing; and, g. Number of base period employers. 2. This model may not produce results which discriminate in violation of any federal or state law or which otherwise favors some claimants over those similarly situated with respect to their need for reemployment services including age, race, ethnic group, sex, color, national origin, disability, religion, political affiliation and citizenship. 3. Claimants who claim to be job attached must be verified in MyUI+ under the Basic Information section of their Home Page; many claimants believe they are job attached but only official job attachment by UI would be considered as the system reviews claimants for selection. 4. Traditionally, claimants with higher scores were given priority consideration for RESEA engagement, however, Colorado began a USDOL required RESEA program evaluation in August 2023 which will run through February 2025. During this Randomized Control Trial (RCT), all selected claimants are assigned a number which determines whether they are part of a control group or assigned the RESEA requirement. Note: Training and Employment Guidance Letter (TEGL) 10-09 provides guidance on provision of Veterans Priority of Service within 111 -Mandated programs. It establishes that veteran priority of service begins once the claimant attends the initial mandated meeting. One -Stops must follow the most current Veterans Priority of Service guidance, along with any update triage procedures, when referring customers to Disabled Veterans Outreach Program services. C. RESEA Selection and Notification Claimants who are selected through the MyUI+ selection process are required to participate in the RESEA program as a condition of continued UI benefits MOU Number: Weld County WFC-RESEA M0U_9681_BY25 13 Docusign Envelope ID: C3580A6A-8CCB-4AD3-9283-E2A2D893C2F5 eligibility. Claimants will be notified and reminded of their requirement to participate in the following ways: 1. RESEA Notification Letter - sent to claimants via MyUI+ account correspondence or U.S. mail on the date of their selection (See example as Attachment 3); 2. MyUI+ pop-up - MyUI+ will generate a pop-up advisement to claimants from time of selection to the point of their deadline directing them to enroll in the RESEA program which is available to them on their left navigation panel titled "Reemployment Services and Eligibility Assessment (RESEA)". On the pop-up, they can choose to select "Enroll" or "Enroll Later". If they select "Enroll", MyUI+ will take them to their left navigation where they will be guided through the steps of enrollment. If they select "Enroll Later", the pop-up will generate each time they log in to their MyUI+ account. a. Enrollment consists of i. Watching a short video about WFC services; ii. Watching a RESEA Orientation video (Available in Spanish); iii. Completing the required IRP; and, iv. Scheduling their required initial PSM 3. Email - The online scheduling tool will send subsequent automated emails to claimants who have been scheduled for the required PSM; 4. Forced Booking - If a claimant has not booked their initial PSM within fourteen (14) days after the date on their RESEA Notification Letter, the UI Reemployment Team will generate a forced appointment to ensure that all claimants are provided the required appointment; and, 5. Phone - UI generates an outbound IVR in weeks one and two post profiling. These automated messages advise the claimant of their requirement to participate and are sent to everyone, regardless of whether or not they have already engaged in the program. This strategy has shown to have a significant impact on completion rates. D. RESEA Procedures - UI RESEA Unit UI staff RESEA procedures, Attachment 1 of this PGL, provide step-by-step instructions for unit activities prior to and including completion of initial RESEA PSMs, conducted exclusively by our team of UI Reemployment Program Navigators. Duties generally include: 1. Participate in force -booking claimants; 3. Monitor and respond to messages on the Navigator message line; 4. Assist claimants with booking/rescheduling/canceling the initial PSM 5. Conducting the initial PSM, providing the following services: a. Individualized Reemployment Plan creation/review b. Work Search Activity Review c. UI Eligibility Assessment d. Connecting Colorado Registration Update e. Customized LMI and Career Information Review f. Referral to Additional Services 6. Completion and upload of claimant referral form; 7. Completion of the required SQ; 8. Reopening the claimant's workflow; 9. Scheduling the required subsequent PSM; 10. Entry of notes in MyUI+ and copying them to CC; 11. Ensuring the upload to CC of: RESEA Notification letter, claimant IRP, SQ, referral form; 12. Entry of services in CC or its replacement; 13. Correct and Timely data entry 14. Communication with One -Stop partner staff, as needed, to ensure appropriate referrals and achieve seamless service delivery to RESEA claimants. E. RESEA Procedures - One -Stop Staff One -Stop staff RESEA procedures, Attachment 2 of this PGL, provide step-by-step instructions for One -Stop staff activities prior to and including completion of subsequent RESEA PSMs. Responsibilities include: 1. Outreach to engage RESEA claimants after their initial PSM; 2. Entry of notes in CC documenting outreach and engagement with RESEA claimants prior to subsequent PSM; 3. Efforts within One -Stop units to build momentum to generate additional supports to assist RESEA participants, as internal policies permit; 4. Assistance to claimants in completing referred activities; 5. Rescheduling or canceling a subsequent PSM; 6. Evaluation of documentation and notes generated from the initial PSM as soon as possible after the subsequent PSM is booked on staff's calendar b. Work Search Activity Review c. UI Eligibility Assessment (Attachment 13) d. Evaluation of claimant's completion/non-completion of at least one (1) referred activity e. ES/non-ES work search f. Discussion of additional barriers claimant may be more ready to acknowledge g. Additional referrals to address barriers h. Completion of Subsequent Staff Questionnaire (SSQ) i. Upload of SSQ to CC j. Entry of robust notes in CC and MyUI+ k. Entry of appropriate services in CC F. RESEA Scheduling, Rescheduling, and Re -engagement MyUI+ profiles weekly on Sunday at 12:01 am. From the date of profiling, claimants have thirty (30) days in which to schedule and attend their initial PSM. This deadline will occur on a Tuesday which will help prevent the deadline from falling on a weekend, holiday or other day the State UI Division is closed. Claimants may schedule their initial PSM with UI RESEA Program Navigation staff for any available virtual (Google/Zoom/phone) appointment during that 30 -day period. The YouCanBookMe tool interface in MyUI+ will read and write to the Navigator calendars, and permit claimants to view and schedule available time slots based on the One -Stop service area to which they were assigned in MyUI+ when filing their UI claim. Occasionally, RESEA claimants may need to reschedule their appointments. Claimants can do so in MyUI+ provided they have not passed their deadline. If they have passed their deadline and are in "Reengagement" status or if they are in disqualified status for failure to attend and are within their 30 day deadline, staff must assist with scheduling/rescheduling. One -Stop centers may accommodate reschedule requests for claimants needing to book their initial PSM to the extent possible; however, primary responsibility for assisting a claimant who has exceeded the thirty (30) day deadline for the initial PSM rests with the UI Reemployment Unit. Please refer them to call the UI Reemployment Navigation Team at 303-318-7109 or 888-230-0446 to schedule/reschedule initial PSMs. MOU Number: Weld County WFC-RESEA M0U_9681_BY25 16 Docusign Envelope ID: C3580A6A-8CCB-4AD3-9283-E2A2D893C2F5 A claimant's subsequent PSM is booked during their initial PSM by the Navigator who conducted the initial PSM. Claimants are prohibited systematically from scheduling/rescheduling/canceling their subsequent PSM. One -Stop staff have primary responsibility for rescheduling/canceling a subsequent PSM. If a subsequent PSM must be rescheduled, the reason must be documented and the timing may not exceed six (6) weeks after their initial PSM. Any reschedule requests which constitute a potential Able and Available issue must be referred to UI Merit staff for adjudication. Colorado law requires an indefinite suspension of benefits for claimants who fail to schedule and attend an initial meeting within the thirty (30) day deadline, or who fail to attend any scheduled RESEA PSM, whether initial or subsequent. UI benefits for those claimants will be automatically suspended until such time as the claimant completes their required PSM. Intervening complete UI benefit weeks will not be paid; therefore, One -Stop staff are strongly encouraged to inform claimants of this policy during any interaction with a RESEA claimant who has failed to participate as required. It is imperative that One -Stop staff promptly enter a claimant as a no-show on the date of non-compliance and follow up immediately with claimants who fail to attend a RESEA appointment. Staff must document fully their attempts to reach the claimant to engage them in the scheduled meeting G. RESEA and Dislocated Worker Eligibility Claimants who are selected for RESEA are considered Dislocated Worker (DW) eligible for the purposes of the Workforce Innovation and Opportunity Act (WIOA), even if they fail to complete their RESEA initial PSM. One -Stop case files must include the individualized RESEA Notification Letter (Attachment 3), on official letterhead, with the date of issue when using the Letter as documentation of DW eligibility. The UI Reemployment Unit is responsible for uploading the RESEA Notification Letter to all profiled RESEA claimant's CC registrations. One -Stop staff are encouraged to enroll as many RESEA participants in WIOA DW programs as possible. The WIOA program store page must include the "PR" (profiled) category in the eligibility calculation section when the RESEA Notification Letter is used as documentation of eligibility for DW services under WIOA. The RESEA Notification Letter remains a viable eligibility document for up to three (3) years from its date only if all MOU Number: Weld County WFC-RESEA M0U_9681_BY25 17 Docusign Envelope ID: C3580A6A-8CCB-4AD3-9283-E2A2D893C2F5 subsequent employment can be considered "Stop -Gap" (See applicable WIOA Eligibility Requirements PGL for guidance). H. RESEA Data Entry Requirements MyUI+ is the primary means of collecting and collating RESEA program information, including participation and completion rates. MyUI+ communicates with Connecting Colorado on a weekly basis to report only RESEA selections and completions. It is therefore necessary for UI and One -Stop staff to also enter notes, services and uploads into CC as prescribed in the procedural attachments to this PGL. Because MyUI+ will automatically suspend claimant benefits upon report of a failure to participate in RESEA, it is critically important that RESEA data entry be both timely and accurate. I. RESEA Documentation Requirements The following documents and information must be included in the claimant's Connecting Colorado registration: 1. Initial RESEA Notification Letter - Found in MyUI+ claimant correspondence to be uploaded to CC by the UI Navigator. 2. Individualized Reemployment Plan - Created in MyUI+ by claimant prior to initial PSM or during PSM by Navigator. Uploaded to CC by Navigator after initial PSM. 3. Staff Questionnaire - Completed in initial PSM by Navigator. Uploaded to CC by Navigator after initial PSM. 4. Referral Form - Created by Navigator during initial PSM. Emailed to claimant and uploaded to CC and MyUI+ after initial PSM. Navigator will make this viewable to the claimant in their MyUI+ account. 5. Subsequent Staff Questionnaire - Created in MyUI+ by One -Stop staff during subsequent PSM. Uploaded to CC by One -Stop staff after subsequent PSM. Case Notes - Case management is an important factor in RESEA service delivery. 1. Comprehensive ES case notes in CC must be completed upon conclusion of a required PSM, whether initial or subsequent. The note must contain sufficient detail so other One -Stop staff can provide a continuity of service to the claimant. This note must also be pasted into the claimant's RESEA workflow in MyUI+. When reporting a possible UI eligibility issue, case notes must provide sufficient information to assist UI merit staff in the investigation of any potential eligibility issues generated before or during the RESEA PSM. 3. One -Stop staff must notate in CC only, actions taken to engage with a claimant throughout the duration between the initial PSM and subsequent PSM. The intention is to ensure that any staff, supervisor or monitor can determine what actions were taken to assist the RESEA claimant in completing referred activities to achieve their reemployment goal. J. RESEA Required Training 1. RESEA Program Administrator or designee must provide live virtual staff training for RESEA/MyUI+ navigation prior to allowing staff access to RESEA workflows in MyUI+. 2. RESEA Program Administrator or designee will provide required UI Eligibility/Able and Available training to all new staff. 3. RESEA Program Administrator or designee will provide required UI Eligibility/Able and Available training to ALL staff no less than twice per year. K. Financial Reporting Requirements One -Stop area financial staff designees must complete the "Grant Expenditure Report" Google Form specific to their local area each month no later than the reimbursement request deadline. The period covered by each month's report is detailed in the description of the form. The RESEA Administrator will share those forms upon request with appropriate One -Stop staff. L. Reimbursement Reimbursement requests must be based on actual direct costs incurred to provide services to RESEA participants. All RESEA activity by One -Stop Staff is cost -reimbursable to include: 1. Scheduling/rescheduling or reminding RESEA participants 2. All RESEA appointments conducted in a one-to-one setting either in -person or virtually. 4. Costs to provide additional referral career services to RESEA claimants 6. Follow up with claimants who fail to schedule or appear for RESEA activities 7. Business services designed to support reemployment of RESEA claimant(s) 8. RESEA staff professional development training can be included and charged to the RESEA grant if developed and provided by the state RESEA administrative team. Previous RESEA guidance capped reimbursement for RESEA activities. Beginning with PY20 funds, USDOL removed the reimbursement cap. However, all costs must be reasonable and allocable. M. RESEA Monitoring and UI Compliance Assistance Program Unemployment Insurance conducts its own RESEA Compliance Reviews. Attachment 13 details the intention, which consists of: 1. Monthly case file spot audits for claimant interaction with both Navigators and One -Stop staff 2. Semi -Annual or Annual file monitoring to include site visits to each Local Workforce Area 3. Distribution of Customer Satisfaction survey to each claimant post-PSMs (See Attachment 13) 4. Partnership with Local Workforce Areas and One -Stop staff to develop and track progress against a Performance Improvement Plan This Compliance Assistance Approach is intended to support several Statewide RESEA performance goals including: 1. Thus, you can receive all the disclosures and notices electronically or in paper format through the paper mail delivery system. We do not need any other information from you to withdraw consent.. The consequences of your withdrawing consent for online documents will be that transactions may take a longer time to process..
