Dear Molly Wright,
We have received your December 11, 2024 referral regarding a proposed resubdivision
application to combine two parcels into one on approximately .689+/- acres. The two
parcels are described as Lots 25 through 32 Block 5 of Roggen Town Subdivision, and a
portion of Harrison St. Right of Way, which were both recently acquired by the
Applicant. The two parcels are currently vacant, and the Applicant (Southeast Weld
Fire Protection District Station #2) wishes to combine them into a single parcel to
better align with an adjacent property owned by the Applicant to the South.
This referral does not appear to qualify as a "subdivision" as defined in section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and
March 11, 2011 memorandums to county planning directors, this office will only
perform a cursory review of the referral information and provide informal comments.
The comments do not address the adequacy of the water supply plan for this project
or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition, the comments provided herein cannot be used to

guarantee a viable water supply plan or infrastructure, the issuance of a well permit,
or physical availability of water.
The proposed water supply for the project is an existing well located on an adjacent
property owned by the Applicant to the South. No water demands were identified in
the application documents provided, therefore, the water demands for this project
are unknown.
A review of our records show no wells on the subject properties. Based on the
information provided in the application, it appears that the proposed future water
supply for the project is an existing commercial small capacity well (permit no.
332923-A) located on an adjacent parcel to the South known as Roggen Resubdivision
#1. Well permit no. 332923-A was issued on December 29, 2023 pursuant to CRS 37-
90-105(3)(d) for the replacement of an existing well, permit no. 332923 on the
condition that the original well be plugged and abandoned. A Well Abandonment
Report was not submitted for the original well, therefore the Applicant will need
to submit a Well Abandonment Report to show that the original well was properly
abandoned.
Additionally, well permit no. 332923-A was issued for use in one commercial business
described as a fire department, with an annual withdrawal amount not to exceed 0.33
acre-feet per year and a pumping rate not to exceed 15 gallons per minute. These
uses are consistent with the uses identified in the original well permit no. 332923.
Further, if well permit no. 332923-A is to be shared between two or more parcels
owned by the Applicant, the operation of the well is subject to the following
requirements:
• The total use of water cannot exceed the uses and amounts allowed by the well
permit.
• The properties served by the well may not be a part of a post -June 1, 1972
Subdivision.

• In order to verify that the total use of a well does not exceed the permitted uses of
the well, all water must be supplied to shared properties by pipeline.
